States citizenship for certain internationally adopted individuals, and for other purposes.</official-title></form><legis-body id="H47ABFFD997F44389ABD2FC523AFB20B4" style="OLC"><section id="HE595E58BC5CD4713BC476D8A5BF48473" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Adoptee Citizenship Act of 2021</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HCC2EA54E0163449FAD478F6283CA3EF0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">United States citizenship for certain internationally adopted individuals</header><text display-inline="no-display-inline">Section 320(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1431">8 U.S.C. 1431(b)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HF339F4605AF94C038B80663682112FDA" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H71A57A29DBE94AB4818C4A5C9D8ED903"><enum>(b)</enum><header>Adopted children of citizen parent</header><paragraph commented="no" display-inline="no-display-inline" id="H8E8A4D99599F4541A9E23B783C9375B6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) shall apply to a child adopted by a United States citizen parent if the child satisfies the requirements applicable to adopted children under subparagraph (E), (F), or (G) of section 101(b)(1), regardless of the date on which the adoption was finalized.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDE577A697AE34E08972EE75022A3BA83"><enum>(2)</enum><header>Limited application to certain adopted individuals residing in the united states</header><text display-inline="yes-display-inline">Notwithstanding section 318, an individual born outside of the United States who was adopted by a United States citizen parent shall automatically become a citizen of the United States when all of the following conditions have been fulfilled:</text><subparagraph commented="no" display-inline="no-display-inline" id="HAB56401F48E147C6B51F2215757B0614"><enum>(A)</enum><text display-inline="yes-display-inline">The individual was adopted by a United States citizen before the individual reached 18 years of age.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF5D65BC6C8A3449D952ECF49C59189F9"><enum>(B)</enum><text display-inline="yes-display-inline">The individual was physically present in the United States in the legal custody of the citizen parent pursuant to a lawful admission before the individual reached 18 years of age.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H015657E234E94066A50A9FE825F40F93"><enum>(C)</enum><text display-inline="yes-display-inline">The individual never acquired United States citizenship before the date of the enactment of the <short-title>Adoptee Citizenship Act of 2021</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBC44249448034B52A8B096DA83C18C0C"><enum>(D)</enum><text display-inline="yes-display-inline">The individual was residing in the United States on the date of the enactment of the <short-title>Adoptee Citizenship Act of 2021</short-title> pursuant to a lawful admission.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H48D45A3027CC45F89A6923032E7FDEDE"><enum>(3)</enum><header>Limited application to certain adopted individuals residing outside of the united states</header><subparagraph commented="no" display-inline="no-display-inline" id="H1B26B43ECD15459FA884D2DA4E7774C8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An individual who meets all of the criteria described in paragraph (2) except for subparagraph (D) shall automatically become a citizen of the United States on the date on which the individual is physically present in the United States pursuant to a lawful admission.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H38059B66354843CF98D53303565AD278"><enum>(B)</enum><header>Inapplicability of grounds of inadmissibility</header><text display-inline="yes-display-inline">The grounds of inadmissibility set forth in section 212(a) shall not apply to an individual described in subparagraph (A) who is seeking admission to the United States.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD64142BD1A534E7C834940AB5BF4BCE2"><enum>(C)</enum><header>Criminal background check</header><text display-inline="yes-display-inline">Notwithstanding subparagraphs (A) and (B), an individual described in subparagraph (A) may not be issued a visa unless—</text><clause commented="no" display-inline="no-display-inline" id="H9DE407DB44BB4C96BB44D134B3DB1215"><enum>(i)</enum><text display-inline="yes-display-inline">the individual was subjected to a criminal background check; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HF9B72ED8094945E9B93A912FBA83E98A"><enum>(ii)</enum><text display-inline="yes-display-inline">if the background check conducted pursuant to clause (i) reveals that the individual has committed a crime that was not properly resolved, the Secretary of Homeland Security and the Secretary of State coordinated with relevant law enforcement agencies to ensure that appropriate action is taken to resolve such criminal activity.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
