R. 1589</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210303">March 3, 2021</action-date><action-desc><sponsor name-id="R000103">Mr. Rosendale</sponsor> (for himself and <cosponsor name-id="D000032">Mr. Donalds</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to modify the exemption for re-hires for loan forgiveness under the paycheck protection program, and for other purposes.</official-title></form><legis-body id="HA82042F61F55401CAB652E260F1A1BEF" style="OLC"><section id="H8464CA9E7D8A4E3997F693828C4862C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paycheck Protection Program Loan Forgiveness Flexibility Act of 2021</short-title></quote>.</text></section><section id="H732AC0031B324BF08657A46651B08593" section-type="subsequent-section"><enum>2.</enum><header>Exemption for re-hires for loan forgiveness under the paycheck protection program</header><subsection id="HA01F879C4D8E427398D6E15B0CB54278"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7A(d)(5) of the Small Business Act (as redesignated, transferred, and amended by section 304(b) of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>)) is amended—</text><paragraph id="H887A0461F9414B309D673161A18DDD53"><enum>(1)</enum><text>in subparagraph (B)(i)(II), by striking <quote>not later than</quote> and all that follows through <quote>covered loan)</quote> and inserting <quote>not later than 90 days after the termination date of all State or local COVID–19 emergencies applicable to the location of the eligible entity, if such date occurs after disbursement of the covered loan</quote>;</text></paragraph><paragraph id="H5A40E881663F4236893F8E0945AFA8B2"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii)(II), by striking <quote>not later than</quote> and all that follows through <quote>covered loan)</quote> and inserting <quote>not later than 90 days after the termination date of all State or local COVID–19 emergencies applicable to the location of the eligible entity, if such date occurs after disbursement of the covered loan</quote>; and</text></paragraph><paragraph id="H6AC2B6355123409FBAAE5D41C8164118"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H373C56F0937C4EB88B94B84220938ABD" display-inline="no-display-inline"><subparagraph id="H37AC2D42B4A34D1097F8CB93368F60EE"><enum>(C)</enum><header>State or local COVID–19 emergency</header><text display-inline="yes-display-inline">The term <term>State or local COVID–19 emergency</term> means a public health emergency declared by a State or local government because of the COVID–19 pandemic.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H70EED4CEAE4F4DED8F59319A710500D3" commented="no"><enum>(b)</enum><header>Applicability</header><paragraph id="HD9D668607EBE4BE1BD6ACD8D89F51761" commented="no"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by subsection (a) shall apply to any covered loan made pursuant to section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) before, on, or after the date of enactment of this Act, including forgiveness of such a loan.</text></paragraph><paragraph id="HCFB2BCC4136A497CAD4C1B661019B274" commented="no"><enum>(2)</enum><header>Exclusion of loans already forgiven</header><text>The amendments made by subsection (a) shall not apply to a loan made pursuant to section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) for which the borrower received forgiveness before the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
