which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to provide for a public awareness campaign with respect to human papillomavirus, and for other purposes.</official-title></form><legis-body id="H7FF6B50547CF4BAEBEAA3898ADFBFAC7" style="OLC"><section id="HFBB2B674C1524128B8BC962873D8DE61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Resources to Expand Vaccination, Education and New Treatments for HPV Cancers Act of 2021</short-title></quote> or the <quote><short-title>PREVENT HPV Cancers Act of 2021</short-title></quote>.</text></section><section id="HC88DD15B24B149A891E7A9173597A2F0" commented="no"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H3171C5F9A4AD45BE801E89751E264948" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The human papillomavirus (referred to in this Act as <quote>HPV</quote>) causes six different types of cancer (anal, cervical, oropharynx, penile, vaginal, and vulvar).</text></paragraph><paragraph id="HA8B34A14753644DA8231DE9FCB6A99D3" commented="no"><enum>(2)</enum><text>Almost 35,000 cases of cancer are caused by HPV each year impacting both women and men.</text></paragraph><paragraph id="H4482E76C6969434F937E4C4271D68DD0" commented="no"><enum>(3)</enum><text>About 90 percent of cervical and anal cancers are thought to be caused by HPV.</text></paragraph><paragraph id="H804A0731130C418D8D0A93EF4DC0A29D" commented="no"><enum>(4)</enum><text>Black and Hispanic women are more likely to get HPV-associated cervical cancer than women of other races and ethnicities.</text></paragraph><paragraph id="H98363ABF32B94BA682E82BD2157F14A2" commented="no"><enum>(5)</enum><text>Approximately 60 to 70 percent of oropharynx cancer is tied to HPV.</text></paragraph><paragraph id="H0CC011AA94B74B8780E22EF42442D84B" commented="no"><enum>(6)</enum><text>Most HPV infections that can lead to cancer can be prevented by vaccines. </text></paragraph><paragraph id="H0595FBA26F8E45C890C4D9E84044FF98" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">HPV vaccines can also help prevent recurrent respiratory papillomatosis, anal and genital warts.</text></paragraph><paragraph id="HCE3CEBA784CB45EC977D9797E74A389C" commented="no"><enum>(8)</enum><text>Vaccination for HPV is approved for men and women.</text></paragraph><paragraph id="H517B7906CC5048CCBF2CF84F94AB9E68" commented="no"><enum>(9)</enum><text>The vaccines are most effective if administered when an individual is between the ages of 9 and 12.</text></paragraph><paragraph id="HCA0248BDEE97480FBC6D654B6D8A7884" commented="no"><enum>(10)</enum><text>Only about half of adolescents have completed the HPV vaccine series.</text></paragraph><paragraph id="H949AAFE3A47846C48610ACB3BFDBB63A" commented="no"><enum>(11)</enum><text>Certain populations, like adolescents in rural areas and males are less likely to receive the HPV vaccine.</text></paragraph><paragraph id="H063D4B4EDEFA41A693DF97E9DC741C20" commented="no"><enum>(12)</enum><text>Health providers’ recommendation of the vaccine is critical to getting adolescents vaccinated</text></paragraph></section><section id="HE5F0185C936C497890B1F71837F271B6"><enum>3.</enum><header>HPV vaccine public awareness campaign</header><text display-inline="no-display-inline">Section 317 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b">42 U.S.C. 247b</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H2972419BCC5042B7969F6BBBA381EDB4" display-inline="no-display-inline"><subsection id="HB84E570A307344EDBD634BED716D2DB4"><enum>(o)</enum><header>HPV vaccine public awareness campaign</header><paragraph id="HFCF6BDA7DBE5410C9014DAAE2B7BF7A8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall carry out a national campaign to—</text><subparagraph id="H805AFE37875946388D51AAEBC3F43FA2"><enum>(A)</enum><text display-inline="yes-display-inline">increase awareness of the importance of HPV vaccination;</text></subparagraph><subparagraph id="HF633698A2C244DC88141AC864FDFEC98"><enum>(B)</enum><text>combat misinformation about HPV vaccination; and</text></subparagraph><subparagraph id="H87E3F988553B46DAAB3D56DCFF30164C"><enum>(C)</enum><text display-inline="yes-display-inline">increase HPV vaccination rates and completion of the vaccine series, especially among males.</text></subparagraph></paragraph><paragraph id="H24FEDB9E0B944305B123B87666AD66D5"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out the national campaign required by paragraph (1), the Secretary shall consult with the National Academy of Medicine, including health care providers and public health associations, nonprofit organizations (including those that represent communities most impacted by HPV-associated cancers and communities with low vaccination rates), State and local public health departments, elementary and secondary education organizations (including student and parent organizations), and institutions of higher education, to solicit advice on evidence-based information for policy development and program development, implementation, and evaluation.</text></paragraph><paragraph id="HAC8E778D073548A9AF9A8FA99FCC6A2A"><enum>(3)</enum><header>Requirements</header><text>The national campaign required by paragraph (1) shall—</text><subparagraph id="HD0D0DDAF72F643FFB38C03026804883B"><enum>(A)</enum><text>include the use of evidence-based media and public engagement;</text></subparagraph><subparagraph id="HE40B5311FCC344E099A5A2F0FECBBDED"><enum>(B)</enum><text display-inline="yes-display-inline">be carried out through competitive grants or cooperative agreements awarded to one or more private, nonprofit entities with a history developing and implementing similar campaigns;</text></subparagraph><subparagraph id="HA31BBF56DDA047A98821EECD11E8B5C7"><enum>(C)</enum><text display-inline="yes-display-inline">include the development of culturally and linguistically competent resources that shall be tailored for—</text><clause id="H1993B6A00DAA42D0BD4CB4DF250C40BB"><enum>(i)</enum><text>communities with high rates of—</text><subclause id="H546BB0BC00A14003946C9EE6A03D7D22"><enum>(I)</enum><text>unvaccinated individuals, including males;</text></subclause><subclause id="HD7278DE9516A42FEA85E20A99780ED76"><enum>(II)</enum><text>individuals with unique health care needs (such as lesbian, gay, bisexual, transgender, and queer individuals); </text></subclause><subclause id="H155B114421DB4380B996DE67CDEA1A30"><enum>(III)</enum><text>individuals with high rates of cervical cancer and other HPV-associated cancers (such as Black and Hispanic women); and</text></subclause><subclause id="H4D06DEAE43A64A5CA90546FB1C0D80A4"><enum>(IV)</enum><text display-inline="yes-display-inline">populations impacted by the increase in oropharynx cancers;</text></subclause></clause><clause id="H2FE60EE2078F4A998AF383A731604670"><enum>(ii)</enum><text>rural communities; and</text></clause><clause id="HFA2A870250B84B92A823946F64E9E19D"><enum>(iii)</enum><text>such other communities as the Secretary determines appropriate;</text></clause></subparagraph><subparagraph id="HD781B63B7F7C486C9A20D0B368AF4915"><enum>(D)</enum><text display-inline="yes-display-inline">include the dissemination of HPV vaccination information and communication resources to health care providers and health care facilities (including primary care providers, community health centers, dentists, obstetricians, and gynecologists), and such providers and such facilities for pediatric care, State and local public health departments, elementary and secondary schools, and colleges and universities;</text></subparagraph><subparagraph id="HBE9EBEB1C87E49F7ADB6FAB20D4CE877"><enum>(E)</enum><text display-inline="yes-display-inline">be complementary to, and coordinated with, any other Federal efforts with respect to HPV vaccination;</text></subparagraph><subparagraph id="H0A6B0B58434C4AADA0CEC9F7D60BA039"><enum>(F)</enum><text display-inline="yes-display-inline">include message testing to identify culturally competent and effective messages for behavioral change; and</text></subparagraph><subparagraph id="H74BE880C8879429A92430BC963C9DA35"><enum>(G)</enum><text display-inline="yes-display-inline">include the award of grants or cooperative agreements to State, local, and Tribal public health departments—</text><clause id="H32EF74B620434D11B2E309F578539E10"><enum>(i)</enum><text>to engage with communities specified in subparagraph (C), local education agencies, health care providers, community organizations, or other groups the Secretary determines are appropriate to develop and deliver effective strategies to increase HPV vaccination rates; and</text></clause><clause id="H7DDE50BDE70445F8B7023864D6BD746A"><enum>(ii)</enum><text display-inline="yes-display-inline">to disseminate culturally and linguistically competent resources on the National Breast and Cervical Cancer Early Detection Program and where an individual can access the screenings locally.</text></clause></subparagraph></paragraph><paragraph id="H922CEE3BE0214898841C83311A26D1A2"><enum>(4)</enum><header>Options for dissemination of information</header><text display-inline="yes-display-inline">The national campaign required by paragraph (1) may—</text><subparagraph id="H55F204E9234A46E48528ACEBB2B28DE9"><enum>(A)</enum><text>include the use of—</text><clause id="H7A7C312786E8462885603CB2ABB05B44"><enum>(i)</enum><text>social media, television, radio, print, the internet, and other media;</text></clause><clause id="HEF6CFE4F632E49B9ABA9436BFF564D2B"><enum>(ii)</enum><text display-inline="yes-display-inline">in-person or virtual public communications; and</text></clause><clause id="H41C9AB6802FE48E98C7E56D6697624BA" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">recognized, trusted figures;</text></clause></subparagraph><subparagraph id="H43C77E76734042EAB77BAC2A39535257"><enum>(B)</enum><text display-inline="yes-display-inline">be targeted to specific groups and communities specified in paragraph (3)(C); and</text></subparagraph><subparagraph id="H0DB290A1A5C94420832009CDF7B9B643"><enum>(C)</enum><text display-inline="yes-display-inline">include the dissemination of information highlighting each of the following:</text><clause id="HE8D76DA47CAA4CC5B066A9809A5A9B63"><enum>(i)</enum><text display-inline="yes-display-inline">Recommended age range to get the HPV vaccine.</text></clause><clause id="H5C46FBDCFCDB46D384B53845EE2EE89B"><enum>(ii)</enum><text display-inline="yes-display-inline">The benefits of getting vaccinated against HPV, including the potential to not acquire HPV-associated cancers.</text></clause><clause id="HBF6B3C8CC46F40028523FA55AD9C210F"><enum>(iii)</enum><text display-inline="yes-display-inline">HPV vaccine safety and the systems in place to monitor such safety.</text></clause></subparagraph></paragraph><paragraph id="H98C4E87B498E47F7A33D1327DC86534E"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $5,000,000 for each of fiscal years 2021 through 2025.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEE8C81DC631942C4B2D107211F9C3483"><enum>4.</enum><header>State immunization information system enhancement</header><text display-inline="no-display-inline">Section 317(k) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b">42 U.S.C. 247b(k)</external-xref>) is amended—</text><paragraph id="H77549666C41845438BBDFCAB9A5E4768"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H0B76F65723994F148C9A1EC3D2D24CF1"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HD81EA00DA366427DA762CE06B0E8EB11"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H1D3A0B650877472BBF4D91EAA8F93131"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H3F60DA43C6904D658B3AA1D631473340" display-inline="no-display-inline"><subparagraph id="HB1A635FEBBB242869BF0E0E6A5FA4CC6"><enum>(E)</enum><text display-inline="yes-display-inline">State immunization information systems.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD2FAECA410674BFCA21058CA6DBE7401"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="H7B2474D4E67441E390AF913663439488"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H20D15791794946488140585EF8BFB4DB"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H569A8DC9A139413989D32BEE9B53D67B"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H083CE5A1E096482C989A15F61D55E00C" display-inline="no-display-inline"><subparagraph id="H60BCEF708E8E4341BC8C63C251654A63"><enum>(E)</enum><text display-inline="yes-display-inline">State immunization information systems.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H01F3B9E977A74CB28937833BFC1EB91B"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="traditional" id="HFFED757E6B0F4238A8C9DFBFA388C2AA" display-inline="no-display-inline"><paragraph id="HF17F53F8A9D64C5B9D6B10F664A6455A"><enum>(5)</enum><text>In addition to any funds made available under subsection (j) to carry out this subsection, there are authorized to be appropriated to carry out this subsection $50,000,000 for each of fiscal years 2021 through 2025.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HCA293986E84D4709B3A7C7B2C026978C"><enum>5.</enum><header>Expanding Research and Education with Respect to HPV-Associated Cancers</header><text display-inline="no-display-inline">Part B of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284">42 U.S.C. 284</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H721880EFBEAC4B8080070835DFF4E7AF" style="OLC"><section id="H6957BE5F663A442AA1919A115A4426D5"><enum>409K.</enum><header>HPV-associated cancers</header><subsection id="H66F00B5936FA478BB7B6459854A4CE49"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the National Cancer Institute, shall expand, intensify, and coordinate programs to conduct and support research with respect to HPV-associated cancers.</text></subsection><subsection id="HB8F4EB936FBF40A18F023FC67A1419E8"><enum>(b)</enum><header>Coordination with other institutes</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the National Cancer Institute, shall coordinate activities carried out by the Director pursuant to subsection (a) with similar activities carried out by other national research institutes and agencies of the National Institutes of Health to the extent that those Institutes and agencies have responsibilities that are related to HPV-associated cancers.</text></subsection><subsection id="HD0A5781D8DD84579BF61F2F8AFAF385A"><enum>(c)</enum><header>Authorization of appropriations</header><text>For purposes of carrying out this section, there is authorized to be appropriated $10,000,000 for each of fiscal years 2021 through 2025.</text></subsection><subsection id="HF13E7D2EEA484FBE8E7D582BCD48263F"><enum>(d)</enum><header>HPV-Associated cancer</header><text display-inline="yes-display-inline">In this section, the term <quote>HPV-associated cancer</quote> means cancer associated with the human papillomavirus. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H9FFCD077E0A44B51AF2BB7B7F364D75D"><enum>6.</enum><header>Breast and Cervical Cancer Early Detection Program</header><subsection id="H410F2F84569A4075BED684BC066059B4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1510(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300n-5">42 U.S.C. 300n–5(a)</external-xref>) is amended by striking <quote>and $275,000,000 for fiscal year 2012</quote> and inserting <quote>$275,000,000 for fiscal year 2012, and $300,000,000 for each fiscal years 2021 through 2025</quote>.</text></subsection><subsection id="H5ED8D3C479534B0A8EB43B277BCD95F0"><enum>(b)</enum><header>Coordinating committee</header><text display-inline="yes-display-inline">Section 1501(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300k">42 U.S.C. 300k(d)</external-xref>) is amended—</text><paragraph id="HC273D08560F341DB93B83B7A17B4C763"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC"><enum-in-header>2020</enum-in-header></header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC"><enum-in-header>2030</enum-in-header></header-in-text></quote>; and</text></paragraph><paragraph id="HD6758115578742BCA233CF197BB95A7E"><enum>(2)</enum><text>by striking <quote>2020</quote> and inserting <quote>2025</quote>.</text></paragraph></subsection></section><section id="H6BC78BD79BF94668A02D6E8031664952"><enum>7.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 2025, the Secretary of Health and Human Services shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor and Pensions of the Senate a report—</text><paragraph id="HB5DD0E8605604F55A4DD0166387F5B7B" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">that contains a qualitative assessment of the campaign under subsection (o) of section 317 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b">42 U.S.C. 247b</external-xref>) and the activities conducted under such campaign; and </text></paragraph><paragraph id="H73287B05009041A68A1146B51B792A34"><enum>(2)</enum><text display-inline="yes-display-inline">on, with respect to the impact on cancer associated with human papillomavirus—</text><subparagraph id="H39A109071ED444FA8C58F22FDDF8579D"><enum>(A)</enum><text>the activities conducted under subsection (o) of section 317 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b">42 U.S.C. 247b</external-xref>), as added by section 3;</text></subparagraph><subparagraph id="HACC9511732ED479EBC670AEAE06E711D"><enum>(B)</enum><text>research conducted under subsection (k) of such section, pursuant to the amendments made by section 4; and</text></subparagraph><subparagraph id="HEA21BA2B7DAD4238843C519A5A942CD7"><enum>(C)</enum><text>section 409K of the Public Health Service Act, as added by section 5. </text></subparagraph></paragraph></section></legis-body></bill>
