R. 1510</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210519">May 19, 2021</action-date><action-desc> Received; read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to submit to Congress a report on the use of cameras in medical facilities of the Department of Veterans Affairs.</official-title></form><legis-body id="HF1F7BC0335A5494697635D403C7DD120" style="OLC"><section id="H4294DF8899014911968615EBE8FC46E0" section-type="section-one"><enum>1.</enum><header>Report on use of cameras in medical facilities of the Department of Veterans Affairs</header><subsection id="HE060901264E34D57B6145B1AE9E168FD"><enum>(a)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs, in collaboration with the Office of Operations, Security, and Preparedness of the Department of Veterans Affairs, the Veterans Health Administration, and the Office of Construction and Facilities Management of the Department, shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives a report analyzing the policies, use, and maintenance of cameras deployed by the Department for patient safety and law enforcement at medical facilities of the Department.</text></subsection><subsection id="HFA83713C8B474388ABB6D2377897728A"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include the following:</text><paragraph id="H3CDD04D78A6B464AB68946B4124F33DA"><enum>(1)</enum><text>A comprehensive review of the policies and procedures of the Department regarding the use and maintenance of cameras with respect to the following:</text><subparagraph id="HBC0A6BC18BA24BB0A0C5DD5235D364FD"><enum>(A)</enum><text>Patient safety, including—</text><clause id="H978C2C9F80C141F09318001B8035E78E"><enum>(i)</enum><text>an analysis of how cameras are used to monitor staff and patients;</text></clause><clause id="H757B608B3782418F8DF9D3A735CC5D84"><enum>(ii)</enum><text>an analysis of the specific units within medical facilities in which the use of cameras is prioritized to protect patient safety;</text></clause><clause id="H789575136E0842FDA83A83E76142671C"><enum>(iii)</enum><text>an analysis of the procedures regarding the positioning of cameras;</text></clause><clause id="H8C4DC5C044D14F6FA2A402053F9047E1"><enum>(iv)</enum><text>an analysis of the extent to which cameras monitor locations where drugs are stored to ensure that drugs are accounted for, and an assessment of whether this is a widely used practice; and</text></clause><clause id="HF120BADC106C4021B49B4C309FCE686E" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">an analysis of the actions taken to preserve and protect patient privacy.</text></clause></subparagraph><subparagraph id="HDC5CBA23A616439093B511879321FC24"><enum>(B)</enum><text>Law enforcement of medical facilities of the Department, including—</text><clause id="H39000A7CC7F74086B4BE67BAE012C379"><enum>(i)</enum><text>how exterior cameras are used;</text></clause><clause id="HE9FA01DC80AE4161B44367C29F096D69"><enum>(ii)</enum><text>how interior cameras are used; and</text></clause><clause id="HD178C3F8F2F94C1090A1A5B222611214"><enum>(iii)</enum><text>an analysis of locations, interior and exterior, in which camera use is prioritized.</text></clause></subparagraph></paragraph><paragraph id="H90CFA9FC3CC6461AAD665A1DE3C525EA"><enum>(2)</enum><text>Recommendations of the Secretary to improve patient safety and law enforcement, including—</text><subparagraph id="HC6DF99FC79E74547A96F1F254E30CCF1"><enum>(A)</enum><text>the placement and maintenance of cameras;</text></subparagraph><subparagraph id="HC1B4B8FEF4A54211ABF7D6F52B722419"><enum>(B)</enum><text>the storage of data from such cameras;</text></subparagraph><subparagraph id="H4D460A05643A46CA92E83048DCF4B5F0"><enum>(C)</enum><text>the authority of supervisors at medical facilities of the Department to review recordings from cameras;</text></subparagraph><subparagraph id="H629E31E9E8DF497989624F0EE89EF7A8"><enum>(D)</enum><text>the number of staff required to monitor live footage from cameras at each medical facility of the Department;</text></subparagraph><subparagraph id="H66139260DC2E472C8F10EB1E16667B6B"><enum>(E)</enum><text>the funding necessary to address shortfalls with respect to cameras and the specific uses for such funding;</text></subparagraph><subparagraph id="H03B0CF985BFF4F60B70C1522F20E0137"><enum>(F)</enum><text display-inline="yes-display-inline">any additional actions required to preserve and protect patient privacy; and</text></subparagraph><subparagraph id="H94E1E03DFB0A4105BCF2F29FD4683CA0"><enum>(G)</enum><text>such other matters the Secretary determines appropriate.</text></subparagraph></paragraph></subsection><subsection id="H0012611BDCE54A23AEDDAA8B1A9AF2FE"><enum>(c)</enum><header>Camera defined</header><text display-inline="yes-display-inline">In this section, the term <term>camera</term> means any video camera used in a medical facility of the Department of Veterans Affairs for purposes of patient safety or law enforcement, but does not include cameras used solely by the Inspector General of the Department of Veterans Affairs to assist in criminal investigations conducted by the Inspector General.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210518" chamber="House">Passed the House of Representatives May 18, 2021.</attestation-date><attestor display="yes">Cheryl L.
