R. 1466</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210301">March 1, 2021</action-date><action-desc><sponsor name-id="M001156">Mr. McHenry</sponsor> (for himself and <cosponsor name-id="P000096">Mr. Pascrell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HHM00">Homeland Security</committee-name>, <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, <committee-name committee-id="HVR00">Veterans' Affairs</committee-name>, <committee-name committee-id="HED00">Education and Labor</committee-name>, <committee-name committee-id="HWM00">Ways and Means</committee-name>, <committee-name committee-id="HII00">Natural Resources</committee-name>, and <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the purchase by the Federal Government of certain medical supplies and protection equipment from the United States, and for other purposes.</official-title></form><legis-body id="H46917C3CF9214CE7AE6FF5EAC4229DD2"><section id="H5981998283AA4AB2BE7892B4A0F218E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the “<short-title>American PPE Supply Chain Integrity Act</short-title>”.</text></section><section id="H214D4D1704D547E4B168F61DE6F5EA29"><enum>2.</enum><header>Requirement to purchase certain medical supplies and personal protective equipment from the United States</header><subsection id="H3BE012128C254967B793804249C3ABE3"><enum>(a)</enum><header>Covered Secretaries</header><paragraph id="H94BEB04394504118BC2BF9D81F00F8B9"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), any covered item purchased by a covered Secretary shall be from the United States. For purposes of this subsection, <quote>from the United States</quote> means that 100 percent of a product is grown, reprocessed, reused, or produced in the United States.</text></paragraph><paragraph id="HFBE464A42C464C8598FAE38AEC6AFAA6"><enum>(2)</enum><header>Exceptions</header><text>Notwithstanding paragraph (1), the applicable covered Secretary may waive the requirements of such paragraph if such covered Secretary determines that satisfactory quality and sufficient quantity of any such covered item from the United States cannot be procured as and when needed at United States market prices. This subsection shall not apply to covered items that are or that include materials determined to be non-available in accordance with section 25.104 of title 48 of the Federal Acquisition Regulation.</text></paragraph></subsection><subsection id="HFBF9159E80B44C58AD845FE7C9CCBBF9"><enum>(b)</enum><header>Exception for small purchases</header><text>Subsection (a) shall not apply to purchases for amounts not greater than $150,000. A proposed purchase or contract for an amount greater than $150,000 may not be divided into several purchases or contracts for lesser amounts in order to qualify for this exception.</text></subsection><subsection id="HD475BD6C47C84AB18DBBABB19FAC7E22"><enum>(c)</enum><header>Applicability</header><text>The requirements of this section shall apply with respect to a purchase of a covered item made pursuant to subsection (a) on or after the date of the enactment of this Act.</text></subsection><subsection id="H999FA24B2B02408C89B381B6E982F536"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H95E76FBCC9C84AB39F4EA3DC0C50E92C"><enum>(1)</enum><header>Covered item</header><text>The term <quote>covered item</quote> means an article or item of—</text><subparagraph id="H963C5DB3D7B742EA81FAD532000E8934"><enum>(A)</enum><text>personal protective equipment (including surgical masks, respirator masks and powered air purifying respirators and required filters, face shields and protective eyewear, surgical and isolation gowns, and head and foot coverings) or clothing, and the materials and components thereof, other than sensors, electronics, or other items added to and not normally associated with such personal protective equipment or clothing;</text></subparagraph><subparagraph id="H9FF5BDEA22AB453FB104D95F7A140CE0"><enum>(B)</enum><text>sanitizing and disinfecting wipes, privacy curtains, beds and bedding, testing swabs, gauze and bandages, tents, tarpaulins, covers, or bags; or</text></subparagraph><subparagraph id="H82D8554F6A2549D49BC689776A498033"><enum>(C)</enum><text>cotton and other natural fiber products, woven silk or woven silk blends, spun silk yarn for cartridge cloth, synthetic fabric or coated synthetic fabric (including all textile fibers and yarns that are for use in such fabrics), canvas products, or wool (whether in the form of fiber or yarn or contained in fabrics, materials, or manufactured articles).</text></subparagraph></paragraph><paragraph id="HC0803728D66D4B02BF110D6D04A58424"><enum>(2)</enum><header>Covered Secretary</header><text>The term <quote>covered Secretary</quote> means the Secretary of Health and Human Services, the Secretary of the Department of Homeland Security, and the Secretary of the Department of Veterans Affairs.</text></paragraph></subsection></section><section id="HDB470F6ABA2441F9ACDF2606F646A782"><enum>3.</enum><header>Procurement of personal protective equipment</header><subsection id="HEB5CAAC6130046D3AC80B7D383ECCCD7"><enum>(a)</enum><header>Limitation</header><text>Not later than 90 days after the date of the enactment of this Act, the President or the President’s designee(s) shall promulgate regulations—</text><paragraph id="H24FAE47A8190414ABB674D783DAD2D19"><enum>(1)</enum><text>to prohibit the use by any department or agency of the Federal Government of reverse auctions or lowest price technically acceptable contracting methods for the procurement of personal protective equipment if the level of quality or failure of the item could result in exposure to infection, illness, or death; and</text></paragraph><paragraph id="HC72B0F22816343D59092BDFC303E2D18"><enum>(2)</enum><text>to establish a preference for the use of best value contracting methods for the procurement of such equipment.</text></paragraph></subsection></section><section id="H51C3E994D9B948ED8024A21093AC36BA"><enum>4.</enum><header>Modification to small purchase threshold exception to sourcing requirements for certain articles</header><text display-inline="no-display-inline">Subsection (f) of section 604 the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/6/453b">6 U.S.C. 453b</external-xref>) is amended to read as follows:</text><quoted-block id="H1D9ADBA9775640D68AC43D3DF29BD86C" style="OLC"><subsection id="H88135B165AE349CC8154279767535E65"><enum>(f)</enum><header>Exception for small purchases</header><paragraph id="H53635218CC2B4332B2E678C4FF6EF93A"><enum>(1)</enum><text>Subsection (a) does not apply to purchases for amounts not greater than $150,000. A proposed purchase or contract for an amount greater than $150,000 may not be divided into several purchases or contracts for lesser amounts in order to qualify for this exception.</text></paragraph><paragraph id="H36F218A119A145E291FF6A80B37E41BD"><enum>(2)</enum><text>On October 1 of each year evenly divisible by 5, the Secretary of Homeland Security may adjust the dollar threshold in this subsection based on changes in the Consumer Price Index. The Secretary shall publish notice of any such adjustment in the Federal Register, and the new price threshold shall take effect on the date of publication.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H718194F8080C450C81AF359619195A39"><enum>5.</enum><header>Application of the Berry Amendment to certain Defense Logistics Agency purchases</header><subsection id="H06458E70F81B4328A4CFCABF11154EF4"><enum>(a)</enum><header>In general</header><text>Section 2533a of title 10, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block id="HEE55A3EAFF5F41A7A7B22059DF8C5A32" style="OLC"><subsection id="HCBECE41F73744A549D16649814545870"><enum>(l)</enum><header>Application to certain defense logistics agency purchases</header><text>Subsection (a) applies to purchases made by the Director of the Defense Logistics Agency on behalf of the General Services Administration or any other Federal agency.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFD3131E694ED4516A9B70862922B193A"><enum>(b)</enum><header>Applicability</header><text>The requirements of this section and the amendments made by this section shall apply with respect to a purchase made under section 2533a of title 10, United States Code, on or after the date of the enactment of this Act.</text></subsection></section><section id="H67C3174E0F47427BA109C6E522934524"><enum>6.</enum><header>Application of the Berry Amendment to certain medical supplies and personal protective equipment</header><subsection id="H442CF6A9EE7443448A54635BE641D8F1"><enum>(a)</enum><header>In general</header><text>Section 2533a(b) of title 10, United States Code, is amended by adding at the end the following new paragraphs:</text><quoted-block id="H2CB092A22AE84F898633CF8DD109E739" style="OLC"><paragraph id="H28879A248738489A8C2309E698957B52"><enum>(5)</enum><text>Surgical dressing materials.</text></paragraph><paragraph id="H107DA499511A47F5B6A6C53FE8D95521"><enum>(6)</enum><text>Hospital and surgical clothing and related special purpose items.</text></paragraph><paragraph id="HA78385324E81465EABEDE05A80C07E70"><enum>(7)</enum><text>Replenishable field medical sets, kits, and outfits.</text></paragraph><paragraph id="HAA1B4E1718C245E98478D85E8AF2A547"><enum>(8)</enum><text>All textile medical supplies and equipment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD2773F451C8B413A9AFDACC2CDA0263D"><enum>(b)</enum><header>Applicability</header><text>The requirements of this section and the amendments made by this section shall apply with respect to a purchase made under section 2533a of title 10, United States Code, on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
