which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to carry out a pilot program on dog training therapy, and to amend title 38, United States Code, to authorize the Secretary of Veterans Affairs to provide service dogs to veterans with mental illnesses who do not have mobility impairments.</official-title></form><legis-body id="H0F4E11F71407416CAAAFB0AC5F38DF99" style="OLC"><section id="H3C96CC58FC3145F790F577AC9AE6A281" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Puppies Assisting Wounded Servicemembers for Veterans Therapy Act</short-title></quote> or the <quote><short-title>PAWS for Veterans Therapy Act</short-title></quote>.</text></section><section id="HDA22FE4F4B3D4CC39873544D0D06E64A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H5A419A98C59E40028EAF1448B2CFFFA8"><enum>(1)</enum><text display-inline="yes-display-inline">According to the analyses of veteran suicide published by the Department of Veterans Affairs in August 2016 and titled <quote>Suicide Among Veterans and Other Americans</quote>, and in June 2018, titled <quote>VA National Suicide Date Report</quote>—</text><subparagraph id="H94386205AE1040938FDD1DF791B5BEC0"><enum>(A)</enum><text>an average of 20 veterans died by suicide each day in 2014;</text></subparagraph><subparagraph id="H828859CF272C46349CEB22210A6285F1"><enum>(B)</enum><text>mental health disorders, including major depression and other mood disorders, have been associated with increased risk for suicide;</text></subparagraph><subparagraph id="H68A297A631FE44ECACA95BFE9A1B3300"><enum>(C)</enum><text>since 2001, the proportion of users of the Veterans Health Administration with mental health conditions or substance use disorders has increased from approximately 27 percent in 2001 to more than 40 percent in 2014; and</text></subparagraph><subparagraph id="HB345D49061EE4907BB635445D0AFC8BD"><enum>(D)</enum><text>overall, suicide rates are highest among patients with mental health and substance use disorder diagnoses who are in treatment and lower among those who received a mental health diagnosis but were not at risk enough to require enhanced care from a mental health provider.</text></subparagraph></paragraph><paragraph id="H293A9CA120B04C8FA1BDFA83592C817F"><enum>(2)</enum><text display-inline="yes-display-inline">The Department of Veterans Affairs must be more effective in its approach to reducing the burden of veteran suicide connected to mental health disorders, including post-traumatic stress disorder (in this section referred to as <quote>PTSD</quote>), and new, rigorous scientific research provides persuasive weight to the growing anecdotal evidence that service dogs ameliorate the symptoms associated with PTSD, and in particular, help prevent veteran suicide.</text></paragraph><paragraph id="HE6B35F1E68C944E19D252A165CF8E25F"><enum>(3)</enum><text display-inline="yes-display-inline">Several organizations have proven track records of training service dogs for veterans with severe PTSD and dramatically improving those veterans’ quality of life, ability to re-enter society, and, most importantly, their chances of survival.</text></paragraph></section><section id="H676683BFB3C14CF7BC63CED1718C34F7"><enum>3.</enum><header>Department of Veterans Affairs pilot program on dog training therapy</header><subsection id="H753FD61F59A54F08B7C6D81D90A43AED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Commencing not later than 120 days after the date of the enactment of the Act, the Secretary of Veterans Affairs shall carry out a pilot program under which the Secretary shall make grants to one or more appropriate non-government entities for the purpose of assessing the effectiveness of addressing post-deployment mental health and post-traumatic stress disorder (in this section referred to as <quote>PTSD</quote>) symptoms through a therapeutic medium of training service dogs for veterans with disabilities.</text></subsection><subsection id="H5AB781CC43C342A1A39EC2A994D84550"><enum>(b)</enum><header>Duration of pilot program</header><text>The pilot program required by subsection (a) shall be carried out during the five-year period beginning on the date of the commencement of the pilot program.</text></subsection><subsection id="HE303FDD4277F4DEF913B2E1F8425842B"><enum>(c)</enum><header>Conditions on receipt of grants</header><text>As a condition of receiving a grant under this section, a non-government entity shall—</text><paragraph commented="no" id="H51EA75DCC9AC4CD08C7C02554467798C"><enum>(1)</enum><text>submit to the Secretary certification that the entity is an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 that—</text><subparagraph commented="no" id="H8B44ECC4B64E40A3B6599C75B18EF605"><enum>(A)</enum><text>provides service dogs to veterans with PTSD; and</text></subparagraph><subparagraph commented="no" id="H42EB89E490B84D6BAC098E559A5A1BF8"><enum>(B)</enum><text>is accredited by, or adheres to standards comparable to those of, an accrediting organization with demonstrated experience, national scope, and recognized leadership and expertise in the training of service dogs and education in the use of service dogs;</text></subparagraph></paragraph><paragraph id="H0356790839DB420EBFB9386A67686E10"><enum>(2)</enum><text>agree to cover all costs in excess of the grant amount;</text></paragraph><paragraph id="HF42A3F5F4204416DB3F023CCC7AD26BE"><enum>(3)</enum><text display-inline="yes-display-inline">agree to reaccept or replace the service dog the organization provided to the veteran, if necessary, as determined by the organization and the veteran;</text></paragraph><paragraph id="HC9224A7544224088BF3569E5ECA98A73"><enum>(4)</enum><text>provide a wellness certification from a licensed veterinarian for any dog participating in the program;</text></paragraph><paragraph id="H8F34F21235F940EB8017453EE68A86FC"><enum>(5)</enum><text>employ at least one person with clinical experience related to mental health;</text></paragraph><paragraph id="H7304D25C40CF4D8B99D549A5803549CF"><enum>(6)</enum><text display-inline="yes-display-inline">ensure that veterans participating in the pilot program receive training from certified service dog training instructors for a period of time determined appropriate by the organization and the Secretary, including service skills to address or alleviate symptoms unique to veterans' needs;</text></paragraph><paragraph id="H510A616C0D3F43518E9CDDF2C71FAFB9"><enum>(7)</enum><text>agree to provide both lectures on service dog training methodologies and practical hands-on training and grooming of service dogs;</text></paragraph><paragraph id="HB29D65A7648F4527B9207CB20A8103BA"><enum>(8)</enum><text>agree that in hiring service dog training instructors to carry out training under the pilot program, the non-government entity will give a preference to veterans who have successfully graduated from PTSD or other residential treatment program and who have received adequate certification in service dog training;</text></paragraph><paragraph id="H9F6418D8ED694CE28437DD512F09FF03"><enum>(9)</enum><text>agree not to use shock collars or prong collars as training tools and to use positive reinforcement training;</text></paragraph><paragraph id="H782F216689E94883B02E075B88BE1B27"><enum>(10)</enum><text>agree that upon the conclusion of training provided using the grant funds—</text><subparagraph id="HD2EB1B975A8E45D68D6A099A9191F76D"><enum>(A)</enum><text>the veteran who received the training will keep the dog unless the veteran and the veteran’s health provider decide it is not in the best interest of the veteran;</text></subparagraph><subparagraph id="HC7352ED7F61A430A96B69D62E9E9EE12"><enum>(B)</enum><text>if the veteran does not opt to own the dog, the entity will be responsible for caring for and appropriately placing the dog;</text></subparagraph><subparagraph id="HD9F9E0FC3B574277901D3A25EB03B629"><enum>(C)</enum><text>the Department of Veterans Affairs will have no additional responsibility to provide for any benefits under this section; and</text></subparagraph><subparagraph id="H3EACA8F0A52E457EADC7E54969E9FBCF"><enum>(D)</enum><text>the Department of Veterans Affairs will have no liability with respect to the dog;</text></subparagraph></paragraph><paragraph id="H7500A94BD8B64577B8E111780B1F0BB7"><enum>(11)</enum><text>provide follow-up support service for the life of the dog, including a contact plan between the veteran and the entity to allow the veteran to reach out for and receive adequate help with the service dog and the organization to communicate with the veteran to ensure the service dog is being properly cared for; and</text></paragraph><paragraph id="HF114010590AB490481D46C81A6386A4D"><enum>(12)</enum><text>submit to the Secretary an application containing such information, certification, and assurances as the Secretary may require.</text></paragraph></subsection><subsection id="H5D463110391A43D58468A0E5F0FC80C8"><enum>(d)</enum><header>Veteran eligibility</header><paragraph id="HA13E4146D0824566AE8F149119A72FD8"><enum>(1)</enum><header>In general</header><text>For the purposes of this section, an eligible veteran is a veteran who—</text><subparagraph id="H1BBFBF20241F40948CE0E3CB191CF5B1"><enum>(A)</enum><text>is enrolled in the patient enrollment system in the Department of Veterans Affairs under section 1705 of title 38, United States Code;</text></subparagraph><subparagraph id="H0654A6C018EB4B8AB773D00333AC52DB"><enum>(B)</enum><text>has been recommended for the pilot program under this section by a qualified health care provider or clinical team based on the medical judgment that the veteran may potentially benefit from participating; and</text></subparagraph><subparagraph id="H973B5DD3B7E74E788F806848DB68CEF6"><enum>(C)</enum><text>agrees to successfully complete training provided by an eligible organization that receives a grant under this section.</text></subparagraph></paragraph><paragraph id="H6DFFCC6596DA4D1593CB6854B80CFD8D"><enum>(2)</enum><header>Relationship to participation in other program</header><text>Veterans may participate in the pilot program in conjunction with the compensated work therapy program of the Department of Veterans Affairs.</text></paragraph><paragraph id="H34DE999A69B04A9D9BE973C47A972188"><enum>(3)</enum><header>Continuing eligibility requirement</header><text>To remain eligible to participate in the program, a veteran shall see the health care provider or clinical team of the Department of Veterans Affairs treating the veteran for PTSD at least once every six months to determine, based on a clinical evaluation of efficacy, whether the veteran continues to benefit from the program.</text></paragraph></subsection><subsection id="HF8ED122E48F64307849AE6D994EC6156"><enum>(e)</enum><header>Collection of data</header><text>In carrying out this section, the Secretary shall—</text><paragraph id="H50DCD9D4AF7B40F08FF35228CA73C5E6"><enum>(1)</enum><text>develop metrics and other appropriate means to measure, with respect to veterans participation in the program, the improvement in psychosocial function and therapeutic compliance of such veterans and changes with respect to the dependence on prescription narcotics and psychotropic medication of such veterans;</text></paragraph><paragraph id="HCC7B120CCE5246FE925F03DAB5FDD65D"><enum>(2)</enum><text>establish processes to document and track the progress of such veterans under the program in terms of the benefits and improvements noted as a result of the program; and</text></paragraph><paragraph id="H370886DFD2CB40058F6F1EFC3F3EA4ED"><enum>(3)</enum><text>in addition, the Secretary shall continue to collect these data over the course of five years for each veteran who has continued with the dog he or she has personally trained.</text></paragraph></subsection><subsection id="HCC60DEED48F4438B812D01C252E42479"><enum>(f)</enum><header>GAO briefing and study</header><paragraph id="HFA46B27316074196B4150229E80F9FDB"><enum>(1)</enum><header>Briefing</header><text>Not later than one year after the date of the commencement of the pilot program under subsection (a), the Comptroller General of the United States shall provide to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a briefing on the methodology established for the program.</text></paragraph><paragraph id="H91ADCEB135AB4B03ADBCDEE140C8080D"><enum>(2)</enum><header>Report</header><text>Not later than 270 days after the date on which the program terminates, the Comptroller General shall submit to the committees specified in paragraph (1) a report on the program. Such report shall include an evaluation of the approach and methodology used for the program with respect to—</text><subparagraph id="HAE03BC37203343CC9B8AF95DB55E8023"><enum>(A)</enum><text>helping veterans with severe PTSD return to civilian life;</text></subparagraph><subparagraph id="H7692A3CF07844A4A934BF38C832419A3"><enum>(B)</enum><text>relevant metrics, including reduction in metrics such as reduction in scores under the PTSD check list (PCL–5), improvement in psychosocial function, and therapeutic compliance; and</text></subparagraph><subparagraph id="H8C82913F7DF6448CB7E53B0CEC3818CB"><enum>(C)</enum><text>reducing the dependence of participants on prescription narcotics and psychotropic medication.</text></subparagraph></paragraph></subsection><subsection id="H8A3E1A2B0CC24DE6A32C6D7E1DD5262C"><enum>(g)</enum><header>Definition</header><text>For the purposes of this section, the term <term>service dog training instructor</term> means an instructor who provides the direct training of veterans with PTSD and other post-deployment issues in the art and science of service dog training and handling.</text></subsection></section><section id="H673DD09FC96E4954A52C895AEA6BF5E1"><enum>4.</enum><header>Authority of Secretary of Veterans Affairs to provide service dogs to veterans with mental illnesses who do not have mobility impairments</header><text display-inline="no-display-inline">Section 1714 of title 38, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H4D48B951B4DB4050AC7D183D2CB9B5E8" style="USC"><subsection id="H73AC5B12BD4D4E2199273BDDA6DBD071"><enum>(e)</enum><text display-inline="yes-display-inline">The Secretary may provide a service dog to a veteran under subsection (c)(3) regardless of whether the veteran has a mobility impairment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
