R. 1443</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210712">July 12, 2021</action-date><action-desc> Received; read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Equal Credit Opportunity Act to require the collection of small business loan data related to LGBTQ-owned businesses.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H3197E03F72C141E4BFA889D726D50134"><section id="H99CEAEC8ECFD4309A1B12240DC6AAFB8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>LGBTQ Business Equal Credit Enforcement and Investment Act</short-title></quote>.</text></section><section id="H32B7AA195A8E4ABDA5C57A080423D4E3"><enum>2.</enum><header>Small business loan data collection</header><text display-inline="no-display-inline">Section 704B of the Equal Credit Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1691c-2">15 U.S.C. 1691c–2</external-xref>) is amended—</text><paragraph id="HE5D729CB81204EF782D8CCB301105EF5"><enum>(1)</enum><text>by inserting <quote>LGBTQ-owned,</quote> after <quote>minority-owned,</quote> each place such term appears;</text></paragraph><paragraph id="H80B8225D815E4675A6E93779A502C441"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(2)(G), by inserting <quote>, sexual orientation, gender identity</quote> after <quote>sex</quote>; and</text></paragraph><paragraph id="H0B3CF56227E04896868D168DB6CFE2AC"><enum>(3)</enum><text>in subsection (h), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H10E0EEF613F2445EB705F6444FFD49DD" style="OLC"><paragraph id="H1E3471C1AFC14919AE6FA7C6523CE9A2"><enum>(7)</enum><header>LGBTQ-owned business</header><text display-inline="yes-display-inline">The term <term>LGBTQ-owned business</term> means a business—</text><subparagraph id="H7030E28AD81D43858533798EAB4B3CB6"><enum>(A)</enum><text>more than 50 percent of the ownership or control of which is held by 1 or more individuals self-identifying as lesbian, gay, bisexual, transgender, or queer; and</text></subparagraph><subparagraph id="H76CBEE82AC544CEBBE2A4F4EFBE05101"><enum>(B)</enum><text display-inline="yes-display-inline">more than 50 percent of the net profit or loss of which accrues to 1 or more individuals self-identifying as lesbian, gay, bisexual, transgender, or queer.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H95F978BE958D46A8B971CDBAB31CEE00" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage. </text></section></legis-body><attestation><attestation-group><attestation-date date="20210624" chamber="House">Passed the House of Representatives June 24, 2021.</attestation-date><attestor display="yes">Cheryl L.
