which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Abuse Prevention and Treatment Act to ensure protections for lesbian, gay, bisexual, and transgender youth and their families.</official-title></form><legis-body id="HE1CEA946CBD84E5A8FDFAF1AC135C0D1" style="OLC"><section id="H012E1285062445A2AC2A864947C2381A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting LGBTQ Youth Act</short-title></quote>.</text></section><section id="H061B4B8845DB4FEB9C0E01994829F26F"><enum>2.</enum><header>Amendments to CAPTA</header><text display-inline="no-display-inline">The Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101</external-xref> et seq.) is amended—</text><paragraph id="HA1C34CE124E84E47BA79812288A0CB41"><enum>(1)</enum><text>in section 104 (<external-xref legal-doc="usc" parsable-cite="usc/42/5105">42 U.S.C. 5105</external-xref>)—</text><subparagraph id="HC7442AF9E70641FCB0905A50A6480C87"><enum>(A)</enum><text>in subsection (a)—</text><clause id="H143FFE97E7294AE3B04BB2A16136D76B"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="H619F84709EF24DE7A40C2BFB4CB4C100"><enum>(I)</enum><text>by redesignating subparagraphs (N) and (O) as subparagraphs (O) and (P), respectively;</text></subclause><subclause id="H23C5E14F4D63481FBC1431607141E33D"><enum>(II)</enum><text>by inserting after subparagraph (M) the following:</text><quoted-block display-inline="no-display-inline" id="HBEB363C3450A480FA468E3EC33E0D0B6" style="OLC"><subparagraph id="H691D5508834C456B85950969BACEDE37"><enum>(N)</enum><text>child abuse and neglect issues facing lesbian, gay, bisexual, and transgender youth and families, including providing recommendations for improving the collection of data at the Federal, State, and local levels to better identify young people who may be at risk of, or experiencing, child abuse or neglect because of their sexual orientation or gender identity;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subclause><subclause id="HD5B37E77126542259317C6D5BCFA70E2"><enum>(III)</enum><text>in subparagraph (O), as so redesignated, by striking <quote>subparagraph (O)</quote> and inserting <quote>subparagraph (P)</quote>; and</text></subclause><subclause id="HECB4110EFCEB46FBBD5F43802305FBFA"><enum>(IV)</enum><text>in clause (ix) of subparagraph (P), as so redesignated, by inserting <quote>(including sexual orientation and gender identity)</quote> after <quote>sex</quote>; and</text></subclause></clause><clause id="H32E7D8881F1841AB82EBCB7C2E039A08"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>paragraph (1)(O)</quote> and inserting <quote>paragraph (1)(P)</quote>; and</text></clause></subparagraph><subparagraph id="H13E42870F99245199B9FE35DEA7146A5"><enum>(B)</enum><text>in subsection (b), by inserting <quote>or lesbian, gay, bisexual, and transgender youth</quote> after <quote>children with disabilities</quote>;</text></subparagraph></paragraph><paragraph id="HEB50950F5B9D4EE8A959EA0E2F08ED2A"><enum>(2)</enum><text>in section 105(a)(1)(E) (<external-xref legal-doc="usc" parsable-cite="usc/42/5106">42 U.S.C. 5106(a)(1)(E)</external-xref>), by inserting <quote>and lesbian, gay, bisexual, and transgender youth</quote> after <quote>children with disabilities</quote>;</text></paragraph><paragraph id="H66ED9DE3A6FF407585EF6780A0F741C9"><enum>(3)</enum><text>in section 106(d)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/5106a">42 U.S.C. 5106a(d)(1)</external-xref>), by inserting <quote>, disaggregated by demographic characteristics such as age, sex (including sexual orientation and gender identity), race, family structure, household relationship, school enrollment and education attainment, disability, grandparents as caregivers, labor force status, work status in previous year, and income in previous year</quote> before the period;</text></paragraph><paragraph id="HA5EB9227A58C4CC3A4D5C4F8DA7CB30E"><enum>(4)</enum><text>in section 107 (<external-xref legal-doc="usc" parsable-cite="usc/42/5106c">42 U.S.C. 5106c</external-xref>)—</text><subparagraph id="H2C7B5335EBE74B45B1FC8B610964E914"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HE2F530C1E1CB449F8AD147009FC0A19E"><enum>(i)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text></clause><clause id="H3B38E66DB491473B8970C7BB49EDE76E"><enum>(ii)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block display-inline="no-display-inline" id="HF44CC42BFF9F474280CF17EE71BB3E9C" style="OLC"><paragraph id="H2440E8BAD2DF4AED83AE82151B114210"><enum>(3)</enum><text>the assessment and investigation of cases involving lesbian, gay, bisexual, and transgender youth who are suspected victims of child abuse or neglect;</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA5D7E53B4E874CEF93520BF179E25C1A"><enum>(B)</enum><text>in subsection (b)(5), by striking <quote>paragraphs (1) through (3)</quote> and inserting <quote>paragraphs (1) through (4)</quote>; and</text></subparagraph><subparagraph id="H7A1688C3AAAE4BC2BDF623AFA7797041"><enum>(C)</enum><text>in subsection (c)(1)—</text><clause id="H3D62815D7F374CDC82836B3777221CE5"><enum>(i)</enum><text>by redesignating subparagraphs (G) through (J) as subparagraphs (H) through (K), respectively; and</text></clause><clause id="HCCE7024C2C9848759F0D5A42AED8B400"><enum>(ii)</enum><text>by inserting after subparagraph (F) the following:</text><quoted-block display-inline="no-display-inline" id="HE8C71E85F51A4F57B12891A84B3609CD" style="OLC"><subparagraph id="HFF9EC1F74DC1497A9E27BFE2A2C16A65"><enum>(G)</enum><text>individuals experienced in working with lesbian, gay, bisexual, and transgender youth and families;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H20553EE2A05441FB9150B0E5AD732DB5"><enum>(5)</enum><text>in section 201(b)(1)(G) (<external-xref legal-doc="usc" parsable-cite="usc/42/5116">42 U.S.C. 5116(b)(1)(G)</external-xref>), by inserting <quote>(including lesbian, gay, bisexual, and transgender youth and families)</quote> before the semicolon;</text></paragraph><paragraph id="HD6D7E178C06D48BB89A94604EDEC1767"><enum>(6)</enum><text>in section 202 (<external-xref legal-doc="usc" parsable-cite="usc/42/5116a">42 U.S.C. 5116a</external-xref>)—</text><subparagraph id="H1333633B7C9E4346BEF4354E227CD785"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="HE5A988DF7C1848C0BA5F176D5396C691"><enum>(i)</enum><text>in subparagraph (A), by inserting <quote>and families with other vulnerable youth, including lesbian, gay, bisexual, and transgender youth</quote> before the semicolon; and</text></clause><clause id="H6F82575866174B9FBFC5058122F2ED30"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>and public sector and private nonprofit sector service providers, and parents with disabilities</quote> and inserting <quote>public sector and private nonprofit sector service providers, parents with disabilities, and parents of other vulnerable youth, including lesbian, gay, bisexual, and transgender youth</quote>; and</text></clause></subparagraph><subparagraph id="HCF946C153C624631813F8ACD35B036BA"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="H124ECE0BC959435C8B1BD0BF07A9F3C2"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="HB9D441DFCA6041A3AE65C25F79573885"><enum>(ii)</enum><text>in subparagraph (D), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="HB8225864CA9C4C7DAF1CC968C0BF8451"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4596EA35081241D19EC4F4D65332E31A" style="OLC"><subparagraph id="HEC79ED1B6284410FAF5EEA8CE63FC8A8"><enum>(E)</enum><text>will integrate its efforts with individuals and organizations experienced in working in partnership with families with vulnerable youth, including lesbian, gay, bisexual, and transgender youth, and with the child abuse and neglect prevention activities of the State, and demonstrate a financial commitment to those activities.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H07F934D3E1394E748E9778B93AB522CD"><enum>(7)</enum><text>in section 206(4) (<external-xref legal-doc="usc" parsable-cite="usc/42/5116f">42 U.S.C. 5116f(4)</external-xref>), by striking <quote>and parents with disabilities</quote> and inserting <quote>parents with disabilities, and families with other vulnerable youth, including lesbian, gay, bisexual, and transgender youth</quote>.</text></paragraph></section></legis-body></bill>
