<official-title display="yes">To amend the Internal Revenue Code of 1986 to allow a refundable credit against tax for the purchase of communications signal boosters in areas with inadequate broadband internet access service, and for other purposes.</official-title>

<section id="H32F60AFDDF61437F9F946FD09075C95F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadening Online Opportunities through Simple Technologies Act</short-title></quote> or the <quote><short-title>BOOST Act</short-title></quote>.</text></section> <section id="H37E4023C0D69421B8A020FD6B3473E24"><enum>2.</enum><header>Broadband Internet communications signal booster credit</header> <subsection id="HAE3CC8C3CE074129AD00889F546CE193"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 37 the following new section:</text>

<section id="HD4AE131F9C2B421D872BC952BAC902A1"><enum>36C.</enum><header>Broadband internet communications signal booster credit</header>
<subsection id="H30448FFD086C415299E8BB390105B6FF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an individual who elects the application of this section, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to 75 percent of so much of the qualified signal booster expenditures of the taxpayer for the taxable year as does not exceed $400.</text></subsection> <subsection id="H7EE27153CEBF4C769F552B187D6F02C3"><enum>(b)</enum><header>Qualified signal booster expenditures</header><text>For purposes of this section—</text>
<paragraph id="H33B5C1CED74341F4A0A24B4ED3727EF7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>qualified signal booster expenditures</quote> means amounts paid or incurred by the taxpayer for the purchase of any communications signal booster for use by the taxpayer in a principal residence (within the meaning of section 121) of the taxpayer which is located in an unserved area.</text></paragraph> <paragraph id="H72C0D33A9508453D9022F853E77A747E"><enum>(2)</enum><header>Communications signal booster</header><text display-inline="yes-display-inline">The term <quote>communications signal booster</quote> means a device the first use of which is with the taxpayer and that receives a wireless signal, or a commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>)) signal—</text>
<subparagraph id="HBE17F4891DFD4FE0B7FFE1BE7C6B264B"><enum>(A)</enum><text>in order to increase the strength or range of such signal, and</text></subparagraph> <subparagraph id="H4E6160EDBF8C48E2BEBF26BF0351EF31"><enum>(B)</enum><text display-inline="yes-display-inline">in connection with retransmitting a broadband internet access service signal. </text></subparagraph></paragraph>
<paragraph id="H157B6DE5951E49199454EDBDDBA65437"><enum>(3)</enum><header>Unserved area</header><text display-inline="yes-display-inline">The term <quote>unserved area</quote> means an area eligible for funding under phase 1 or phase 2 of the Rural Digital Opportunity Fund established by the Federal Communications Commission in the Report and Order in the matter of Rural Digital Opportunity Fund and Connect America Fund that was adopted by the Commission on January 30, 2020 (FCC 20–5).</text></paragraph> <paragraph id="HFE173D9BE7A043DD9EBFB162C2D2E6F5"><enum>(4)</enum><header>Broadband internet access service</header><text display-inline="yes-display-inline">The term <quote>broadband internet access service</quote> has the meaning given such term in section 8.1(b) of title 47, Code of Federal Regulations (or any successor regulation).</text></paragraph></subsection>
<subsection id="HA07755F9A1694157975FA1F0A36CFB90"><enum>(c)</enum><header>Credit allowed for only 1 taxable year</header><text display-inline="yes-display-inline">An election by the taxpayer to have this section apply may not be made for any taxable year if such an election is in effect for the taxpayer for any preceding taxable year.</text></subsection> <subsection id="HB281DFCD5BA2466B9417F105235661A1"><enum>(d)</enum><header>Regulations and guidance</header><text>The Secretary shall, in consultation with the Federal Communications Commission, prescribe such regulations, and provide such other guidance, as may be necessary to carry out the purposes of this section.</text></subsection>
<subsection id="H330A9694C01E4AEE9ADEE59CBEAD9F23"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">This section shall not apply to any amounts paid or incurred in any taxable year beginning after December 31, 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7B053590FA224443B11777CBB55D17E6"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart C of part IV of subchapter A of chapter 1 of such Code is amended by inserting before the item relating to section 26 the following new item:</text>

<toc-entry level="section">Sec. 36C. Broadband internet communications signal booster credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H87CA7A1469454F9FB58181EF21281891"><enum>(c)</enum><header>Conforming amendment</header><text>Section 1324(b) of title 31, United States Code, is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text></subsection> <subsection id="H4CA2A06607A142D78DF946083EBEC303"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2020.</text></subsection></section>
<section id="HC7808F3499D347FA96672709931F51C8"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that the Federal Communications Commission should establish maps of areas eligible for funding under phase 2 of the Rural Digital Opportunity Fund as expeditiously as possible.</text></section> </legis-body> </bill>
