Labor provisions.</toc-entry></toc></subsection></section><section commented="no" id="H09A18D46DCC04DEAAA857C1AB3EB0283"><enum>2.</enum><header>Water Affordability, Transparency, Equity, and Reliability Trust Fund</header><subsection id="HB6684176A59C4910BFE99C43B50F80B4"><enum>(a)</enum><header>Establishment</header><paragraph id="HD6625055646546E5B5A98B3AB948DF4B"><enum>(1)</enum><header>In general</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block id="H9FEA123035424F3A95DB9CE05CA79EDD" style="OLC"><section commented="no" id="HD6E89E6981D04729BD9288F9FAB43AB7"><enum>9512.</enum><header>Water Affordability, Transparency, Equity, and Reliability Trust Fund</header><subsection commented="no" id="HFE7C820F81C14081A12840EB5275AE96"><enum>(a)</enum><header>Creation of trust fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund to be known as the <quote>Water Affordability, Transparency, Equity, and Reliability Trust Fund</quote> (referred to in this section as the <quote>Trust Fund</quote>), consisting of such amounts as may be appropriated or credited to such Trust Fund as provided in this section or section 9602(b).</text></subsection><subsection commented="no" id="HDF2FCFCCE8044FF4BD8367A21EA174EA"><enum>(b)</enum><header>Transfers to fund</header><paragraph id="HE825205268A94ADCB8AF5D6AAA66C7AA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are hereby appropriated to the Trust Fund such amounts as the Secretary from time to time estimates are equal to the increase in Federal revenues attributable to the amendment made by section 2(b) of the <short-title>Water Affordability, Transparency, Equity, and Reliability Act of 2021</short-title>.</text></paragraph><paragraph id="H3386FB27C1CC4B41B110D7E0306D30B3"><enum>(2)</enum><header>Limitation</header><text>The sum of the amounts appropriated under paragraph (1) during any fiscal year shall not exceed $34,850,000,000.</text></paragraph></subsection><subsection commented="no" id="H56B6CBC6D49B428AB44CFF783F128586"><enum>(c)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Amounts in the Trust Fund are available, without further appropriation and without fiscal year limitation, for the purposes described in section 2(c) of the <short-title>Water Affordability, Transparency, Equity, and Reliability Act of 2021</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H5CF96A1764EC438FAAD377138748D4AE"><enum>(2)</enum><header>Clerical amendment</header><text>The table of parts for subchapter A of chapter 98 of such Code is amended by inserting after the item relating to section 9511 the following new item:</text><quoted-block display-inline="no-display-inline" id="HFF11BC59EA9D4CBCA6B2FB05916089B4" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 9512. Water Affordability, Transparency, Equity, and Reliability Trust Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4A627E41DAED4785BCCD8236245AE88D"><enum>(b)</enum><header>Imposition of tax</header><paragraph id="HF635593CDC2C4668B312F0F9E454E1D1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/11">Section 11(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>21</quote> and inserting <quote>24.5</quote>.</text></paragraph><paragraph id="H00B926B69D204A2DBE3EA7AFCDB0F485" commented="no"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall apply to taxable years beginning after December 31, 2020.</text></paragraph></subsection><subsection id="H1BE3095E218B4A5988C9DBD621797812"><enum>(c)</enum><header>Allocation of funds</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency and the Secretary of Agriculture shall allocate, for a fiscal year, the funds available, at the beginning of such fiscal year, in the Water Affordability, Transparency, Equity, and Reliability Trust Fund, established by <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512</external-xref> of the Internal Revenue Code of 1986, as follows:</text><paragraph id="H802A113219FB4A679E3CE5B93A2013CE"><enum>(1)</enum><header>Clean water programs</header><text>Of such amount, the Administrator shall make available—</text><subparagraph id="HBEAD9628AC5C4B75A8E748B6409016DB"><enum>(A)</enum><text display-inline="yes-display-inline">0.5 percent for making grants under section 104(b)(8) of the Federal Water Pollution Control Act;</text></subparagraph><subparagraph id="H8BCC65C081044102A4B3439EDD2C8631"><enum>(B)</enum><text>1.5 percent for making grants under section 106 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1256">33 U.S.C. 1256</external-xref>);</text></subparagraph><subparagraph id="H705D7E0B77744C52A873F444CAD2DAD0"><enum>(C)</enum><text display-inline="yes-display-inline">2.5 percent for making grants under section 222 of such Act;</text></subparagraph><subparagraph id="H0D94C337C9894AD89E5CE73E76C6ECBD"><enum>(D)</enum><text display-inline="yes-display-inline">2.5 percent for making grants under section 319 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1329">33 U.S.C. 1329</external-xref>); and</text></subparagraph><subparagraph id="H0CAD566DB65943A2826DFE60DD203ACA"><enum>(E)</enum><text display-inline="yes-display-inline">45 percent for making capitalization grants under section 601 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref>).</text></subparagraph></paragraph><paragraph id="H65CAB819DD5649869420C33B18CA97A2"><enum>(2)</enum><header>Safe drinking water funding</header><text>Of such amount, the Administrator shall make available—</text><subparagraph id="H271FAE2FFE744B2390FC281E39287587"><enum>(A)</enum><text display-inline="yes-display-inline">0.5 percent for providing technical assistance under section 1442(e) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-1">42 U.S.C. 300j–1(e)</external-xref>);</text></subparagraph><subparagraph id="H5E27081BB7F447059FE28A8CD239D3B5"><enum>(B)</enum><text display-inline="yes-display-inline">43.5 percent for making capitalization grants under section 1452 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); and</text></subparagraph><subparagraph id="HE98E5010F9474472B9FAAEDF3057E3BD"><enum>(C)</enum><text display-inline="yes-display-inline">3 percent for making grants under section 1465 of such Act.</text></subparagraph></paragraph><paragraph id="H4E11012BFD664A5FA61847D077B5579F"><enum>(3)</enum><header>Household water well systems</header><text>Of such amount, the Secretary shall make available 1 percent for making grants under section 306E of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926e">7 U.S.C. 1926e</external-xref>).</text></paragraph></subsection></section><section id="H8D0ABB949E6F4B7CB76BF8D24A143245"><enum>3.</enum><header>Report on affordability, discrimination and civil rights violations, public participation in regionalization, and data collection</header><subsection id="HF7F859379D324F66957F4AD2C52695AE"><enum>(a)</enum><header>Study</header><paragraph id="H75ADB87606CD48309176F0CF889D466D"><enum>(1)</enum><header>In general</header><text>The Administrator of the Environmental Protection Agency shall conduct a study on water and sewer services, in accordance with this subsection.</text></paragraph><paragraph id="H3AAC3E4C238B467EA581BBE5CADB58C4"><enum>(2)</enum><header>Affordability</header><text>In conducting the study under paragraph (1), the Administrator shall study water affordability nationwide, including—</text><subparagraph id="H5D92F0C16B11415190FD8A7A68BA2164"><enum>(A)</enum><text display-inline="yes-display-inline">rates for water and sewer services, increases in such rates during the ten-year period preceding such study, and water service disconnections due to unpaid water service charges; and</text></subparagraph><subparagraph id="HF52C3DB3E84748EE97727FF81F313616"><enum>(B)</enum><text display-inline="yes-display-inline">the effectiveness of funding under section 1452 of the Safe Drinking Water Act and under section 601 of the Federal Water Pollution Control Act for promoting affordable, equitable, transparent, and reliable water and sewer service.</text></subparagraph></paragraph><paragraph id="H36AB627E93C342D28671655AECBF7D3E"><enum>(3)</enum><header>Discrimination and civil rights</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator, in collaboration with the Civil Rights Division of the United States Department of Justice, shall study—</text><subparagraph id="H718111338B404F8096FA4C928A3ACCEF"><enum>(A)</enum><text>discriminatory practices of water and sewer service providers; and</text></subparagraph><subparagraph id="H6AF3D4DF63A64CB2A38B25652F8F62A7"><enum>(B)</enum><text display-inline="yes-display-inline">violations by such service providers that receive Federal assistance of civil rights under title VI of the Civil Rights Act of 1964 with regard to equal access to water and sewer services.</text></subparagraph></paragraph><paragraph id="H38F6A0708D3B47C2A499117484972728"><enum>(4)</enum><header>Public participation in regionalization</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator shall evaluate efforts to regionalize public water systems, as defined in section 1401 of the Safe Water Drinking Act, and sewer services with respect to public participation in—</text><subparagraph id="H6829ABD3F97C475AABA81C3B9274DC14"><enum>(A)</enum><text>the decision to undergo such regionalization; and</text></subparagraph><subparagraph commented="no" id="H528C18153CB04FF6A350E3790241CB59"><enum>(B)</enum><text>decision making by the board of directors (or other governing body) of the entity that provides, or oversees or coordinates the provision of, water by the public water systems subject to such regionalization.</text></subparagraph></paragraph><paragraph id="H763F99F0ABF64F70A1E27AF11C9C0471"><enum>(5)</enum><header>Data collection</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator shall collect information, assess the availability of information, and evaluate the methodologies used to collect information, related to—</text><subparagraph id="H048938CE415A424A96D94D5F0BF108D6"><enum>(A)</enum><text>people living without water or sewer services;</text></subparagraph><subparagraph id="HF9D4CFA8F47345A2BC9CA2F0E0125CB2"><enum>(B)</enum><text display-inline="yes-display-inline">water service disconnections due to unpaid water service charges, including disconnections experienced by households containing children, elderly persons, disabled persons, chronically ill persons, or other vulnerable populations; and</text></subparagraph><subparagraph id="HE5C1693CA01E47E5BCEA6D5C9FD7C106"><enum>(C)</enum><text display-inline="yes-display-inline">disparate effects, on the basis of race, gender, or socioeconomic status, of water service disconnections and the lack of public water service.</text></subparagraph></paragraph></subsection><subsection id="H6ED9B3006CEA4A5B856AB55ECC530EC1"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Administrator of the Environmental Protection Agency shall submit to Congress a report that contains—</text><paragraph id="HE54B6449130B478386A0C68D42DA0279"><enum>(1)</enum><text>the results of the study conducted under subsection (a)(1); and</text></paragraph><paragraph id="H457B5862E58D46C894DB45DAAAD94F2E"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations for utility companies, Federal agencies, and States relating to such results.</text></paragraph></subsection></section><section commented="no" id="H1583C61366474E50B674B3A07C86EC56"><enum>4.</enum><header>Technical assistance to rural and small municipalities and tribal governments</header><text display-inline="no-display-inline">Section 104(u) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(u)</external-xref>) is amended by striking <quote>not to exceed $25,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$175,000,000 for each of fiscal years 2021 through 2026</quote>.</text></section><section id="H36C350558C384C64AA813B05A5D2DF11"><enum>5.</enum><header>Residential onsite sewage disposal system improvement</header><text display-inline="no-display-inline">Title II of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8844DDDE5CF4451AAD16FDD72FB60BAF" style="OLC"><section id="HBA3C145837244EDA97827A64C96B23CC"><enum>222.</enum><header>Residential onsite sewage disposal systems</header><text display-inline="no-display-inline">Not later than the date that is 1 year after the date of the enactment of this section, the Administrator shall establish a grant program to make grants to users of a septic tank and drainage field for costs associated with repairing, replacing, or upgrading such tank and such field.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA3E28BF6255D476C934952047B79D0AB"><enum>6.</enum><header>Household water well systems</header><text display-inline="no-display-inline">Section 306E(d) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926e">7 U.S.C. 1926e(d)</external-xref>) is amended by striking <quote>$20,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$348,500,000 for each fiscal year</quote>.</text></section><section id="H8E253A77B3884AFFA1B5EE1296C9FBC5"><enum>7.</enum><header>State water pollution control revolving funds</header><subsection id="H33C3A834752547548A16499A7E6BC195"><enum>(a)</enum><header>Specific requirements</header><text display-inline="yes-display-inline">Section 602(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>) is amended—</text><paragraph id="H3E09BE113B6F4612B2D597BF5B421E63"><enum>(1)</enum><text>in paragraph (2), by striking <quote>will be made to the State with funds to be made available</quote> and inserting <quote>were made to the State with funds made available for fiscal year 2019</quote>;</text></paragraph><paragraph id="H92911D54545F44729EBF05AE68D46466"><enum>(2)</enum><text>in paragraph (13), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H57953E405B7F4B00AA45FEA94864DFC7"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="H55B2EF387FDD4C68BA967E8269D606D3"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7E023FD1FD5C43A7B5C68DDD122DF00D" style="OLC"><paragraph id="H7D494E8B11D74FE1B18849D2C8DEF4C4"><enum>(15)</enum><text display-inline="yes-display-inline">the State will not provide financial assistance using amounts from the fund for any project that will provide substantial direct benefits to new communities, lots, or subdivisions, other than a project to construct an advanced decentralized wastewater system; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="HD7B54A50D9274C4DAA525919D0265AE4"><enum>(b)</enum><header>Projects and activities eligible for assistance</header><text display-inline="yes-display-inline">Section 603(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>) is amended—</text><paragraph id="H20339109457646BCAA48B86766A6D6EC"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (11)(B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H503DB225B42747CC9F7C105974C52C91"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (12)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HD195815CCB034AE8B8ABD0C35568419E"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H957849B4517346FE84C2D0C13E73E639" style="OLC"><paragraph commented="no" id="H89B430813C194B5EB25CD31BB25F7E0F"><enum>(13)</enum><text display-inline="yes-display-inline">to any municipality or intermunicipal, interstate, or State agency for—</text><subparagraph commented="no" id="H2F842DB3E5824AC6850ADF56290EE42E"><enum>(A)</enum><text>purchasing from a willing or unwilling seller a privately owned treatment works; and</text></subparagraph><subparagraph commented="no" id="H6215174E41994760A44FB2AA6EAFF7C8"><enum>(B)</enum><text display-inline="yes-display-inline">expenses related to canceling a contract for the operation or management of a publicly owned treatment works.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1D289AF710324E61B4F4DD776D72EFEC"><enum>(c)</enum><header>Increasing the amount of additional subsidization by the State</header><text display-inline="yes-display-inline">Section 603(i)(3)(B) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(i)(3)(B)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H94724D320C8B43938F4AA1819A3F4906" style="OLC"><subparagraph id="H987ECF2D6BA04117AAE327569FF5A3F0"><enum>(B)</enum><header>Additional limitation</header><text display-inline="yes-display-inline">A State may use not less than 50 percent of the total amount received by the State in capitalization grants under this title for a fiscal year for providing additional subsidization under this subsection.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HA84627732FC742C48A85D350B502AC84"><enum>8.</enum><header>Use of State revolving loan funds under the Safe Drinking Water Act</header><text display-inline="no-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text><paragraph commented="no" id="HD21BB27292C04F10B574DBFC31CB8991"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" id="H0AB7C0FB8E8544708AE022662A33C77B"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="HD8B84C9657D5482B9100CE0F45B2BD9A"><enum>(i)</enum><text>in subparagraph (A), by inserting <quote>publicly owned, operated, and managed</quote> before <quote>community water systems</quote>; and</text></clause><clause commented="no" id="HE64DD9CD1BC14783835A9C2E29A05E90"><enum>(ii)</enum><text>in subparagraph (E), by striking <quote>The funds under this section shall not be used for the acquisition of real property or interests therein, unless the acquisition is integral to a project authorized by this paragraph and the purchase is from a willing seller.</quote> and inserting <quote>The funds may also be used for purchasing from a willing or unwilling seller a privately owned community water system, or for the expenses related to canceling a contract for the operation or management of a community water system.</quote>; and</text></clause></subparagraph><subparagraph id="H9F380AD3D42A40B2AFE5F9151177E3B2"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HB9F362C59D284DD18BE1F3A91C32FABF" style="OLC"><paragraph commented="no" id="HB47A9E1573FC4F559C8E1EB6236EDD4A"><enum>(6)</enum><header>Exception to public ownership, operation, and management requirement</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2)(A), public water systems that regularly serve fewer than 10,000 persons, and which are not owned, operated, or managed by any person who owns, operates, or manages any other public water system, may receive assistance under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="HB2061ACEA862437D8BABFD71D47D7BD9"><enum>(2)</enum><text>by amending subsection (d)(2) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HACF6358BE68E424E81771517D299688C" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H83E239857C3F441E9DF9E4F7A1792020"><enum>(2)</enum><header>Total amount of subsidies</header><text>To the extent that there are sufficient applications for loans to communities described in paragraph (1), of the amount of the capitalization grant received by a State in a fiscal year, the total amount of loan subsidies made by the State in the fiscal year pursuant to paragraph (1) may not be less than 50 percent.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HF190850AE6E844ECBD5E4DDB98C4A0BD" commented="no"><enum>(3)</enum><text>in subsection (e), by striking <quote>to be made to the State</quote> and inserting <quote>that was made to the State in fiscal year 2021</quote>;</text></paragraph><paragraph id="H9C01EDB6A882460CAD04628313670FF1"><enum>(4)</enum><text>in subsection (g)(3)—</text><subparagraph id="H17083A42C89F49A1A31AEF2176731B17"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H0D2D0368A6834148B2A40CA841BD717D"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HF9D93FAE08F2448C9645AC1802FDF76D"><enum>(C)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block id="HCC9A5610702E4C03919BEF9C98490B1D" style="OLC"><subparagraph id="H34D4858695D94EDFB0FA3004DACA44EB"><enum>(D)</enum><text display-inline="yes-display-inline">guidance to ensure affordable, equitable, transparent and reliable water service provision, to provide protections for households facing service disconnection due to unpaid water service charges, and to promote universal equal access to water services.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H4163CED19BD6438F9B8C8B1C7B13E7F5"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (k)(1), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HAEAA3166545C4390B1923F6C1DA5C098" style="OLC"><subparagraph commented="no" id="H0B99A2456A9B47B986F26973221AF62A"><enum>(E)</enum><text>Provide assistance in the form of a grant to owners of private property on which a lead service line (as defined in section 1459B) is or may be located, for the purpose of replacing the lead service line with a service line that is lead-free (as defined in section 1417(d)).</text></subparagraph><subparagraph commented="no" id="H86E45BF238B74CB691F020F92E0E8F32"><enum>(F)</enum><text>Provide assistance to a publicly owned, operated, and managed community water system for the purpose of updating treatment plants or switching water sources due to contamination from per- and polyfluoroalkyl substances (PFAS) (as defined by the State in which the community water system is located).</text></subparagraph><subparagraph commented="no" id="HD86B1B0F85894575AD13CF1BDE02F6E3"><enum>(G)</enum><text>Provide assistance in the form of a grant to owners of a household water well that has been contaminated by per- and polyfluoroalkyl substances (PFAS) (as defined by the State in which the household well is located), for the purpose of purchasing and installing a household filtration system.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H9C71CED4CFA743A1B9B82622F798DF05"><enum>9.</enum><header>Drinking water grant programs</header><subsection commented="no" display-inline="no-display-inline" id="HD261AED655254C6194A0543485F1FC33"><enum>(a)</enum><header>School drinking water improvement</header><text display-inline="yes-display-inline">Section 1465 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-25">42 U.S.C. 300j–25</external-xref>) is amended—</text><paragraph commented="no" id="H93857ABED7454CD9A75E0CA870D0412E"><enum>(1)</enum><text display-inline="yes-display-inline">in the section header, by striking <quote><header-in-text level="section" style="OLC">fountain</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">infrastructure</header-in-text></quote>;</text></paragraph><paragraph commented="no" id="H9E4865CD49744675B6BA2B6380C4354C"><enum>(2)</enum><text>in subsection (a), by striking <quote>fountains manufactured prior to 1988</quote> and inserting <quote>infrastructure</quote>;</text></paragraph><paragraph commented="no" id="H0F47E8EE6030499F8061C5B06FFF2DF6"><enum>(3)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H8377F73BB0E2425DBAEC0E0B9902E759" style="OLC"><subsection commented="no" id="HD266E9B9D0BE4BE8A0070F95295E24B6"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds awarded under the grant program may be used to pay costs associated with—</text><paragraph commented="no" id="HAC68B6C3928A47BF9E778FE52E4899EB"><enum>(1)</enum><text>installing, repairing, or replacing the infrastructure necessary to ensure that drinking water fountains, drinking water coolers, and bottle filling stations at schools are lead free; and</text></paragraph><paragraph commented="no" id="H0A80C715EBEE4265AB1CC92D1C4DDA1E"><enum>(2)</enum><text display-inline="yes-display-inline">monitoring and reporting of lead levels in the drinking water of schools, as determined appropriate by the Administrator.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC4F1C443FC904DC48B4889F33EB35761"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="H926379B04F5845988BF58FEF982E2E86"><enum>(A)</enum><text>by striking <quote>$5,000,000</quote> and inserting <quote>$1,050,000,000</quote>; and</text></subparagraph><subparagraph id="H968B0783A62443459A2DC789F623E338" commented="no"><enum>(B)</enum><text>by striking <quote>2021</quote> and inserting <quote>2024</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HB3B76E8D931B4940808D44309F7D68A6"><enum>(b)</enum><header>Tribal drinking water</header><text display-inline="yes-display-inline">Section 1452(i)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(i)(1)</external-xref>) is amended, in the first sentence—</text><paragraph commented="no" id="HAF5026B8462848BCBC15FC7C9CD18160"><enum>(1)</enum><text>by striking <quote>1 1/2</quote> and inserting <quote>Three</quote>; and</text></paragraph><paragraph commented="no" id="H0571888746DC406885A2D26F47B708F7"><enum>(2)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></paragraph></subsection></section><section id="H07BC7F72EF01468F90A0E2086772FD00"><enum>10.</enum><header>Requirement for the use of American materials in drinking water</header><text display-inline="no-display-inline">Section 1452(a)(4) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(a)(4)</external-xref>) is amended by striking <quote>During fiscal years 2019 through 2023, funds</quote> and inserting <quote>Funds</quote>.</text></section><section id="HBFCF8A8BE67C4B4A8BDB4294A3F63051"><enum>11.</enum><header>Labor provisions</header><subsection id="HD56DE703C96B4315B673048255FD5745"><enum>(a)</enum><header>Prevailing rate of wage</header><text display-inline="yes-display-inline">Nothing in this Act shall affect the applicability of the requirements relating to labor standards of sections 513 and 602(b)(6) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1372">33 U.S.C. 1372</external-xref>, 1382(b)(6)) and section 1450(e) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-9">42 U.S.C. 300j–9(e)</external-xref>) to projects carried out under those Acts.</text></subsection><subsection id="H2B467B6B1284412BAC9A17398F4009B4"><enum>(b)</enum><header>Project labor agreements</header><paragraph commented="no" id="H5DC6DEC29B2B4A4691695D0A6C01E385"><enum>(1)</enum><header>Clean water revolving funds</header><text display-inline="yes-display-inline">Section 602(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>), as amended by section 7, is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4C2A0E8259144816BD9458DC49B2E134" style="OLC"><paragraph commented="no" id="HA0DB7AC6D9B141DB8B9CFC76DEA5769A"><enum>(16)</enum><text display-inline="yes-display-inline">the State will—</text><subparagraph commented="no" id="HE931643D9DC6416981E898D71B370D68"><enum>(A)</enum><text display-inline="yes-display-inline">permit recipients of assistance under this title to enter into agreements authorized under section 8(f) of the National Labor Relations Act (commonly known as <quote>project labor agreements</quote>) with respect to projects for building or construction carried out with such assistance; and</text></subparagraph><subparagraph commented="no" id="HAC18E8ABF6DC4CD898A62CF3839B253D"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that, to the maximum extent practicable, recipients of assistance under this title carry out such projects through the use of such agreements.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFE465432ACCE44AEA5949600FC56A149"><enum>(2)</enum><header>Drinking water revolving funds</header><text display-inline="yes-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text><subparagraph id="HC95AD7FFB9684500B2615A9A3874F039"><enum>(A)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE4CBF6D86EB34FC881B3CFA4FDE28B46" style="OLC"><paragraph id="HD4B84CAB4F044DAFA86F0E820B5DA8DE"><enum>(7)</enum><header>Project labor agreements</header><text display-inline="yes-display-inline">Each agreement under this subsection shall require that the State permit recipients of assistance under this section to enter into agreements authorized under section 8(f) of the National Labor Relations Act (commonly known as <quote>project labor agreements</quote>) with respect to projects for building or construction carried out with such assistance.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H8518591FD81E4AEEB67B5D145AFACDBF"><enum>(B)</enum><text>in subsection (b)(3)(A)—</text><clause id="H49520BC7DDFD4DE38B68ABCAE151974A"><enum>(i)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="HC47E105F5512418789528E7A1F2F3E40"><enum>(ii)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>;
