R. 1349</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210225">February 25, 2021</action-date><action-desc><sponsor name-id="K000009">Ms. Kaptur</sponsor> (for herself, <cosponsor name-id="G000563">Mr. Gibbs</cosponsor>, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, <cosponsor name-id="B001301">Mr. Bergman</cosponsor>, <cosponsor name-id="B001281">Mrs. Beatty</cosponsor>, <cosponsor name-id="G000588">Mr. Gonzalez of Ohio</cosponsor>, <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>, <cosponsor name-id="K000386">Mr. Katko</cosponsor>, <cosponsor name-id="M001206">Mr. Morelle</cosponsor>, <cosponsor name-id="H001081">Mrs. Hayes</cosponsor>, <cosponsor name-id="S001187">Mr. Stivers</cosponsor>, <cosponsor name-id="A000376">Mr. Allred</cosponsor>, and <cosponsor name-id="R000577">Mr. Ryan</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide for the conversion of certain accelerated and advance payments to grants under parts A and B of the Medicare program.</official-title></form><legis-body id="H63FF35C259BF4EFAA415AE7721BB844A" style="OLC"><section id="HEBB33C1E7E4C4620A7C538948A4BE8AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>The COVID-19 Hospital and Health Provider Loan Conversion Act of 2021</short-title></quote>.</text></section><section id="HB0253F62DDF941A29F6DD27ED8CFF21C"><enum>2.</enum><header>Providing for the conversion of certain accelerated and advance payments to grants under parts A and B of the Medicare program</header><subsection id="H1E0864B28CCD412BB3FE3F8152687707"><enum>(a)</enum><header>Conversion of payments</header><paragraph id="H0AEE7C9BDF204CA59A40CE6EA691B8A6"><enum>(1)</enum><header>Part A</header><text display-inline="yes-display-inline">Section 1815(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395g">42 U.S.C. 1395g(f)</external-xref>) is amended—</text><subparagraph id="H3DB1C300FCFA4EAB916D973C2D57E801"><enum>(A)</enum><text>in paragraph (2), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H39657003329E423CB75B5C9E2800F3C3" display-inline="no-display-inline"><subparagraph id="H3BE85A367B6742038E5D6FF2A1735638" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">In the case of an accelerated payment made to a hospital under such program on or after the date of the enactment of the CARES Act and so made during the emergency period described in section 1135(g)(1)(B), the Secretary shall waive the requirement that such payment be repaid (or recouped) if the hospital meets the requirements described in paragraph (5), except that such waiver shall not apply with respect to any amounts from such payment that were not used for health care related expenses or lost revenues that are attributable to coronavirus as of December 31, 2021, based on the attestation of the hospital. The hospital shall repay any such amounts to the Secretary not later than July 1, 2023. The interest rate for any such amount not so repaid as of such date shall be 2 percent if the hospital demonstrates hardship. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HD4B7D955B41841848E0AE5E34641FFD6"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>and paragraph (2)(D)</quote> after <quote>paragraph (2)(C)</quote>; and</text></subparagraph><subparagraph id="HDCB59F47FE264070B381BBCFD51CDDDC"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H32DAE3DD8195426C9C94397E9157A7E4" display-inline="no-display-inline"><paragraph id="H0F36468B05094EDABF15F3960A347CF9" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">For purposes of paragraph (2)(D), the requirements described in this paragraph are the following:</text><subparagraph id="HD09B4854B10E4C35A3D260FCF66C10AC"><enum>(A)</enum><text display-inline="yes-display-inline">The hospital did not use any portion of a payment described in such paragraph for compensation or benefits, including salary, bonuses, awards of stock, or other financial benefits, for an officer or employee described in section 4004(a)(2) of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></subparagraph><subparagraph id="H3CF6CDF085D34D9C82093C50EF65B8C4"><enum>(B)</enum><text display-inline="yes-display-inline">The hospital used at least 60 percent of such payment for employee compensation (other than an officer or employee described in subparagraph (A)) during the period beginning on January 1, 2020, and ending on December 31, 2021.</text></subparagraph><subparagraph id="HE5DC538F949F4FBEA1755BFA424054CC"><enum>(C)</enum><text>The hospital did not balance bill or surprise bill any COVID–19 patient.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA76576ADEDD248A49B147B259B4ADED1"><enum>(2)</enum><header>Part B</header><subparagraph id="HF4168CFF09ED47E98035CDA5818CAA65"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the program described in section 421.214 of title 42, Code of Federal Regulations (or a successor regulation), in the case of a payment made under such program to an entity on or after the date of the enactment of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) and so made during the emergency period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>), the Secretary of Health and Human Services shall waive the requirement that such payment be repaid (or recouped) if the entity meets the requirements described in subparagraph (B), except that such waiver shall not apply with respect to any amounts from such payment that were not used for health care related expenses or lost revenues that are attributable to coronavirus as of December 31, 2021, based on the attestation of the entity. The entity shall repay any such amounts to the Secretary not later than July 1, 2023. The interest rate for any such amount not so repaid as of such date shall be 2 percent if the entity demonstrates hardship. </text></subparagraph><subparagraph id="H8BB524E2D686494D83C9D751A7A1C328"><enum>(B)</enum><header>Requirements</header><text>For purposes of subparagraph (A), the requirements described in this subparagraph are the following:</text><clause id="H7A9BCFD06A3B4520927F55607144F8C4"><enum>(i)</enum><text display-inline="yes-display-inline">The entity did not use any portion of a payment described in such subparagraph for compensation or benefits, including salary, bonuses, awards of stock, or other financial benefits, for an officer or employee described in section 4004(a)(2) of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></clause><clause id="H4C7BBCF8A1CF47D88A09626AC295D21E"><enum>(ii)</enum><text display-inline="yes-display-inline">The entity used at least 60 percent of such payment for employee compensation (other than an officer or employee described in clause (i)) during the period beginning on January 1, 2020, and ending on June 30, 2021.</text></clause><clause id="HC6AA54D1C42B4F0A8541C9361A159CC9"><enum>(iii)</enum><text display-inline="yes-display-inline">The entity did not balance bill or surprise bill any COVID–19 patient. </text></clause></subparagraph></paragraph></subsection><subsection id="H66C5684A9ED3420898B64DDAECA24428" commented="no"><enum>(b)</enum><header>Ensuring the solvency of Medicare trust funds</header><paragraph id="H4D972916DBA94875806284249E635335" commented="no"><enum>(1)</enum><header>Federal Hospital Insurance Trust Fund</header><text display-inline="yes-display-inline">Section 1817 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H1AEDF534FD9E4AB8B4B738C106B18C0F" display-inline="no-display-inline"><subsection id="H03AB5156964D47C69CB735E5EB3FEF35" commented="no"><enum>(l)</enum><header>Accelerated payment program transfers</header><paragraph id="H98509222508A40469F13E13B1E4AF699" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There shall be transferred from the General Fund of the Treasury to the Trust Fund, periodically (as determined by the Managing Trustee), amounts such that the aggregate amount so transferred under this paragraph equals the total amount of specified payments (as defined in paragraph (2)) made under this part.</text></paragraph><paragraph id="HDF758970D5F640DA8B130F424FE13F60" commented="no"><enum>(2)</enum><header>Specified payment</header><text>In this subsection, the term <quote>specified payment</quote> means a payment that is made—</text><subparagraph id="HCEB8139A0DBB4E81B3536B2614E584C9" commented="no"><enum>(A)</enum><text>under section 1815(e)(3); and</text></subparagraph><subparagraph id="H69E35CE544FC47299DAA8934C41EA415" commented="no"><enum>(B)</enum><text>during the emergency period described in section 1135(g)(1)(B). </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HD8482D7D37C84ECFAD938631EE7DC06B" commented="no"><enum>(2)</enum><header>Federal Supplementary Medical Insurance Trust Fund</header><text>Section 1844(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w">42 U.S.C. 1395w(f)</external-xref>) is amended—</text><subparagraph id="H1A5251791E8F4DEDA22C47E5A0B93590"><enum>(A)</enum><text>by striking <quote>(1) There shall be transferred</quote> and inserting <quote>There shall be transferred</quote>;</text></subparagraph><subparagraph id="H386FD3CB900343818D4D72A47F5E1881"><enum>(B)</enum><text>by striking <quote>during the period beginning on the first day of the emergency period described in section 1135(g)(1)(B) and ending on the date of the enactment of this paragraph</quote> and inserting <quote>during the emergency period described in section 1135(g)(1)(B)</quote>; and</text></subparagraph><subparagraph id="H61866DFA615548E4AD099813F54C2F3D"><enum>(C)</enum><text>by striking paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="H4DEE5728FEA347AC80794E60097EFF48"><enum>(c)</enum><header>Insurer requirements</header><text>Subpart II of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-11">42 U.S.C. 300gg–11</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H5067FBD36731461F98D50AEE7456D695" display-inline="no-display-inline"><section id="H3C13C91B89A647D2A476CC1AF7BB3A28"><enum>2730.</enum><header>Coverage and payment requirements for items and services furnished to COVID–19 patients out-of-network</header><text display-inline="no-display-inline">In the case of an item or service furnished by a health care provider to a COVID–19 patient who is an enrollee in a group health plan or group or individual health insurance coverage offered by a health insurance issuer, if such provider does not have in effect a contractual relationship for furnishing such item or service under such plan or coverage, the plan or issuer (as applicable)—</text><paragraph id="H657D0D90AF934E49A7ACB640237BC1C4"><enum>(1)</enum><text>shall pay to such provider the amount which would have been payable to such provider had such provider had in effect such a relationship for furnishing such item or service; and</text></paragraph><paragraph id="H62A1A0AB39FA4A2985DAE15BB536F0B6"><enum>(2)</enum><text>shall ensure that any applicable cost-sharing requirement is the same requirement that would have applied had such item or service been furnished by a provider that had in effect such a relationship.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8D6AD03F61E14489A7BEDF9FF87F3597"><enum>(d)</enum><header>Publication</header><text>The Secretary of Health and Human Services shall publish on a public website the following:</text><paragraph id="H2958DF9F410643269F4924D7A8BD3659"><enum>(1)</enum><text display-inline="yes-display-inline">A specification of each hospital to which a waiver described in section 1815(f)(2)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395g">42 U.S.C. 1395g(f)(2)(D)</external-xref>) applies and each entity to which a waiver described in subsection (a)(2)(A) applies.</text></paragraph><paragraph id="HFA76B34FBDED43DEBEC80D60BF47C040"><enum>(2)</enum><text>The amount to which such waivers apply with respect to each such hospital and entity.</text></paragraph></subsection></section></legis-body></bill>
