R. 1337</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210225">February 25, 2021</action-date><action-desc><sponsor name-id="C001068">Mr. Cohen</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for grants for States that require sensitivity training for law enforcement officers of that State and to incentivize States to enact laws requiring the independent investigation and prosecution of the use of deadly force by law enforcement officers, and for other purposes.</official-title></form><legis-body id="HF364754C6B5C40B1B219839EB80CE7E8" style="OLC"><section id="HAD6845C002B34C3F92CE4DD69E7E946A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Police Training and Independent Review Act of 2021</short-title></quote>.</text></section><section id="H1B9636BD67E2456EA959E1C20654DFFD"><enum>2.</enum><header>Grants for training and sensitivity and the use of independent prosecutors</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0F9C3556181F4F5385DEFB597F5B41BE" style="OLC"><part id="H6E9FDC86A4E24F99BB8690FBA1AF1DF4"><enum>NN</enum><header>Grants for training and independent prosecution</header><section id="H15B830E977814E4E86A8CA7E6DB75610"><enum>3041.</enum><header>In general</header><text display-inline="no-display-inline">The Attorney General may make a grant to a State each fiscal year for purposes of carrying out the requirements of section 3042(a) and 3043. The term of such grant shall be 1 year.</text></section><section id="H263DDFAFC54E46F4929463D347BEA424"><enum>3042.</enum><header>Training on diversity and sensitivity for law enforcement</header><subsection id="H63389A0CB6E34FE68B9AA0795AAA466C"><enum>(a)</enum><header>Training requirement</header><text>The requirements of this subsection are as follows:</text><paragraph id="HAFA831A607CD4ADD9D9C0F99F0ABDE8D"><enum>(1)</enum><text>A State shall require that all individuals enrolled in an academy of a law enforcement agency of the State and all law enforcement officers of the State fulfill a training session on sensitivity each fiscal year, including training on ethnic and racial bias, cultural diversity, and police interaction with the disabled, mentally ill, and new immigrants. In the case of individuals attending an academy, such training session shall be for 8 hours, and in the case of all other law enforcement officers, the training session shall be for 4 hours.</text></paragraph><paragraph id="H936B3990DB384B30835D117E3B3B495B"><enum>(2)</enum><text>A State shall certify to the Attorney General of the United States that such training sessions have been completed.</text></paragraph></subsection><subsection id="HA271357714F342A8A0C816D7AE318A6B"><enum>(b)</enum><header>Compliance and ineligibility</header><paragraph id="H23DA45C58D394B458A71303DA4A5B207"><enum>(1)</enum><header>Compliance date</header><text>The period specified under this paragraph is the period beginning 120 days after the date of enactment of this part, to comply with subsection (a), except that—</text><subparagraph id="H1531BC6F16084CD18BC5A6FA564803E3"><enum>(A)</enum><text>the Attorney General may grant an additional 120 days to a State that is making good faith efforts to comply with such subsection; and</text></subparagraph><subparagraph id="H24266B06A09C40068E37DB738BB806F6"><enum>(B)</enum><text>the Attorney General shall waive the requirements of subsection (a) if compliance with such subsection by a State would be unconstitutional under the constitution of such State.</text></subparagraph></paragraph><paragraph id="H998EBF131A48472FB23ACCF521E37D90"><enum>(2)</enum><header>Ineligibility</header><text>A State that is not in compliance with the requirements of subsection (a) during a fiscal year is not eligible for a grant under this part.</text></paragraph></subsection></section><section id="H628F1C27B7494F36BD4B1E545B031C85"><enum>3043.</enum><header>Independent Review of law enforcement use of deadly force</header><text display-inline="no-display-inline">In the case of a State that fails by the end of a fiscal year to enact or have in effect an independent prosecution of law enforcement law, that State is not eligible for a grant under this part.</text></section><section id="H8D74CFF2A15347059F0C2E1F582669E3"><enum>3044.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph id="H65564D74791D4F3597A71B0B3355843B"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>deadly force</term> means that force which a reasonable person would consider likely to cause death or serious bodily harm.</text></paragraph><paragraph id="HD9453E4B0C054DB5962588813B39894F"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>independent prosecution of law enforcement law</term> means a statute requiring the appointment of an independent prosecutor to conduct any criminal investigation and prosecution in which—</text><subparagraph id="HE6FFA5C47CFB4C738D97414DA25E0F1E"><enum>(A)</enum><text display-inline="yes-display-inline">one or more of the possible defendants is a law enforcement officer;</text></subparagraph><subparagraph id="H118B2E517BD44514A165497BF1A47FDF"><enum>(B)</enum><text display-inline="yes-display-inline">one or more of the alleged offenses involves the law enforcement officer’s use of deadly force in the course of carrying out that officer’s duty; and</text></subparagraph><subparagraph id="HD19C978091F04BC1896B1587F95D5ED8"><enum>(C)</enum><text display-inline="yes-display-inline">the law enforcement officer’s use of deadly force resulted in a death or injury.</text></subparagraph></paragraph><paragraph id="H9EC81C2CF6374E7EBEF76E88363E0154"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>independent prosecutor</term> means, with respect to a criminal investigation or prosecution, a prosecutor who—</text><subparagraph id="HBEBEAF6F48034AAD9B85FE5735916756"><enum>(A)</enum><text>does not live or work in the same county as the county in which the alleged crime was committed; and</text></subparagraph><subparagraph id="H15B5F65FFD8C48FF87D629EC84E3E425"><enum>(B)</enum><text>would not be involved in the prosecution in the ordinary course of that prosecutor’s duties.</text></subparagraph></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
