which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HVR00">Veterans' Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to expand eligibility to certain military retirees for concurrent receipt of veterans’ disability compensation and retired pay or combat-related special compensation, and for other purposes.</official-title></form><legis-body id="HDE78F055C4EA4793929AAD45CD5D33FB" style="OLC"><section id="H138682D78B194FABB1497F7CFA0C5884" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Major Richard Star Act</short-title></quote>.</text></section><section id="H46F1B601D3E54C819B8194F2DAFB614A" section-type="subsequent-section"><enum>2.</enum><header>Expansions of eligibility to certain military retirees for concurrent receipt of veterans’ disability compensation and retired pay or combat-related special compensation</header><subsection id="HA4B7CF0917054E5786C04CF3E4595A92"><enum>(a)</enum><header>Inclusion of chapter 61 disability retirees with fewer than 20 years of service who are eligible for combat-Related special compensation</header><text display-inline="yes-display-inline">Section 1413a(b)(3) of title 10, United States Code, is amended—</text><paragraph id="H69307325104B42399F2CA6B1A34B6338"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>In</quote> and inserting <quote>Subject to subparagraph (B), in</quote>; and</text></paragraph><paragraph id="H455CDEA13ABF4299911AC583154428FB"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>In the case of</quote> and all that follows and inserting <quote>The retired pay of an eligible combat-related disabled uniformed services retiree, who is retired under chapter 61 of this title with fewer than 20 years of creditable service, is not subject to reduction under sections 5304 and 5305 of title 38.</quote>.</text></paragraph></subsection><subsection id="HC59EC44521A9443BAD0266B4ED6D20E8"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="HD695E71394E949FAA1605B9C38E422D6" commented="no"><enum>(1)</enum><header>Section heading</header><text display-inline="yes-display-inline">The heading of section 1414 of such title is amended to read as follows:</text><quoted-block id="H2957F20048B74084BD990B82F58C944D" style="USC"><section id="H645484558F844C3D896E9F51CE83AEAD" commented="no"><enum>1414.</enum><header>Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent receipt</header></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H6D0C7177EF774FB49AD92E10B76865D1" commented="no"><enum>(2)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The item relating to such section 1414 in the table of sections at the beginning of chapter 71 of such title is amended to read as follows:</text><quoted-block id="H0D0F7A008C7846898C5871C77B6488B4" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">1414. Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent receipt.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HB21ED080409C431BB2ED49A0B07813C1"><enum>(3)</enum><header>Conforming amendments reflecting end of concurrent receipt phase-in period</header><text display-inline="yes-display-inline">Such section 1414 is further amended—</text><subparagraph id="H32613D15C531426AA4ED635BE7E63D09"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text><clause id="H8EBD97DD6F1C49B9927E4F3ADB64E032"><enum>(i)</enum><text>by striking the second sentence; and</text></clause><clause id="HC1F4048182F24D658D49215052BD848D"><enum>(ii)</enum><text>by striking subparagraphs (A) and (B);</text></clause></subparagraph><subparagraph id="H52573FFEDA934F46A5DD9C965C83A0D9"><enum>(B)</enum><text>by striking subsection (c) and redesignating subsections (d) and (e) as subsections (c) and (d), respectively; and</text></subparagraph><subparagraph id="HF41E32147B0246FF992F006A226D4634"><enum>(C)</enum><text>in subsection (d), as redesignated, by striking paragraphs (3) and (4).</text></subparagraph></paragraph></subsection><subsection id="H320271C4793A489AB372ED1B88B7F4F2"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first month beginning after the date of the enactment of this Act and shall apply to payments for months beginning on or after that date.</text></subsection></section></legis-body></bill>
