which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to prohibit a person from knowingly providing substantial assistance relating to a contribution or donation by a foreign national, and for other purposes.</official-title></form><legis-body id="HC9FD58A3A17445BB8A951364B4059F60" style="OLC"><section id="HEA56554A87864122A6990BFC4E5F70E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Supporting Foreign Interference in Our Democracy Act</short-title></quote>.</text></section><section id="H2D0B769555D9484088D72EAE9FF3650B"><enum>2.</enum><header>Prohibition on provision of substantial assistance relating to contribution or donation by foreign nationals</header><subsection id="HE271907A461A4AA1A98D759B0966915C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121</external-xref>) is amended—</text><paragraph id="HD8651B7DE16F4C9DB4EA580E33173312"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H36335AF1A2EB4C77AF24C69EE206C92E"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of paragraph (1)(C);</text></subparagraph><subparagraph id="HCF34EDDF815A4EB2879C54AE947CFBC2"><enum>(B)</enum><text>by striking the period at the end of paragraph (2) and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H39775CC9BCF54E838DD9DF2F80F672D9"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3155D6F26B2145C3B0F24DBCD8B55FE2" style="OLC"><paragraph id="H3BC0E81026EC4EC5A700F26824D2846A"><enum>(3)</enum><text display-inline="yes-display-inline">a person to knowingly provide substantial assistance to another person in carrying out an activity described in paragraph (1) or (2).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7EE8F41C4D9D4F33ADE86E5E0A0BD71E"><enum>(2)</enum><text>by adding at the end the following new subsections:</text><quoted-block display-inline="no-display-inline" id="H679FE4EA38E14C6B8EF6DE4B25E0F495" style="OLC"><subsection id="H4562332A47774510B4BA394697633FEF"><enum>(c)</enum><header>Knowingly described</header><paragraph id="H3707A20B4B7F43379A11C06A079D5505"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subsection (a)(3), the term <term>knowingly</term> means actual knowledge, awareness of pertinent facts that would lead a reasonable person to conclude there is a substantial probability, or awareness of pertinent facts that would lead a reasonable person to conduct a reasonable inquiry to establish—</text><subparagraph display-inline="no-display-inline" id="HD8BDE06105F740579B889AE2E660AD27"><enum>(A)</enum><text>with respect to an activity described in subsection (a)(1), that the contribution, donation, expenditure, independent expenditure, or disbursement is from a foreign national; and</text></subparagraph><subparagraph id="HD85C6A6130044B13BE76FEBC67B64DD0"><enum>(B)</enum><text>with respect to an activity described in subsection (a)(2), that the contribution or donation solicited, accepted, or received is from a foreign national.</text></subparagraph></paragraph><paragraph id="HE08CAAF36D92447C9800DC905F0A1188"><enum>(2)</enum><header>Pertinent facts</header><text>For purposes of paragraph (1), pertinent facts include, but are not limited to, that the person making the contribution, donation, expenditure, independent expenditure, or disbursement, or that the person from whom the contribution or donation is solicited, accepted, or received—</text><subparagraph id="H86F98CE764C14E8D92E4A1D6336AA2E2"><enum>(A)</enum><text display-inline="yes-display-inline">uses a foreign passport or passport number for identification purposes;</text></subparagraph><subparagraph id="HBF94A407E7E9465BADB88B59C8022D5F"><enum>(B)</enum><text display-inline="yes-display-inline">provides a foreign address;</text></subparagraph><subparagraph id="H2458682B89204D1D83A8E9D93260D24C"><enum>(C)</enum><text display-inline="yes-display-inline">uses a check or other written instrument drawn on a foreign bank, or by a wire transfer from a foreign bank, in carrying out the activity; or</text></subparagraph><subparagraph id="H127ED2E46ACF4EE48414C93327D79E2E"><enum>(D)</enum><text display-inline="yes-display-inline">resides abroad.</text></subparagraph></paragraph></subsection><subsection id="HCD0121C9C3B3469EB8D1C891D79FDDBD"><enum>(d)</enum><header>Substantial assistance defined</header><text>As used in this section, the term <term>substantial assistance</term> means, with respect to an activity prohibited by paragraph (1) or (2) of subsection (a), involvement with an intent to facilitate successful completion of the activity.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
