R. 1153</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210218">February 18, 2021</action-date><action-desc><sponsor name-id="M001185">Mr. Sean Patrick Maloney of New York</sponsor> (for himself and <cosponsor name-id="J000298">Ms. Jayapal</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To eliminate certain benefits for former Presidents convicted of a felony, and for other purposes.</official-title></form><legis-body id="H71C95396B6064A70B6BE3B9D5C52757A" style="OLC"><section id="HBDE43C7DDFE74432BFBE6FE82BA779DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring and Enforcing Accountability of Presidents Act</short-title></quote> or the <quote><short-title>REAP Act</short-title></quote> . </text></section><section id="H371BDD1BBE484A7FA423FA4DBF85FD53"><enum>2.</enum><header>Forfeiture of benefits for former Presidents convicted of a felony</header><text display-inline="no-display-inline">The Act entitled <quote>An Act to provide retirement, clerical assistants, and free mailing privileges to former Presidents of the United States, and for other purposes</quote>, approved August 25, 1958 (commonly known as the <quote>Former Presidents Act of 1958</quote>; <external-xref legal-doc="usc" parsable-cite="usc/3/102">3 U.S.C. 102</external-xref> note), is amended—</text><paragraph id="H153FFC685E084D4B8EC1F2177D102A57"><enum>(1)</enum><text>in subsection (a), by striking <quote>Each former President</quote> and inserting <quote>Subject to subsection (h), each former President</quote>;</text></paragraph><paragraph id="HC6539FEFAD8B4D9C914B5106358FA308"><enum>(2)</enum><text>in subsection (f), by striking paragraph (2) and inserting:</text><quoted-block style="traditional" id="H96BCD22FA1E34FA9AB3C2410FFA2EA1A" display-inline="no-display-inline"><paragraph id="H40CA36360BA14C4FB0F3D3C9EA60446E"><enum>(2)</enum><text>who has not been impeached by the House of Representatives and convicted by the Senate pursuant to the impeachment.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8955004D62E840D2B19C98AB7330BA88"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="traditional" id="HACB2463927194489B1CA9F3FCFC08560" display-inline="no-display-inline"><subsection id="H3234400DBD184691B682AF554398B1EA"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HC9C073EA5A5649CB9DF86CC0520DD893"><enum>(1)</enum><text display-inline="yes-display-inline">If a former President is finally convicted of a felony for which every act or omission that is needed to satisfy the elements of the felony is committed during or after the period such former President holds the office of President of the United States of America, or was finally convicted of such a felony while holding such office—</text><subparagraph id="HFA38A88622EE4ACC87ED00719D51FA05" indent="up1"><enum>(A)</enum><text>no monetary allowance under subsection (a) may be provided to such former President;</text></subparagraph><subparagraph id="HFB353D2EC53341B48621ECE797D750F1" indent="up1"><enum>(B)</enum><text>no funds may be obligated or expended under subsection (g) with respect to such former President except to the extent necessary to maintain the security of such former President, as determined by the Director of the Secret Service; and</text></subparagraph><subparagraph id="H8A4464B524C94A599CF63E4A18240793" indent="up1"><enum>(C)</enum><text>such former President shall repay any amounts received under subsection (a) during the period beginning on the date on which such former President is initially convicted of the felony and ending on the date such former President is finally convicted of the felony.</text></subparagraph></paragraph><paragraph id="HFFABD268195F468EB109CEA96875191B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>finally convicted</term> means a conviction—</text><subparagraph id="H2E149359E43F4BDD813D9D36600822F4"><enum>(A)</enum><text>which has not been appealed and is no longer appealable because the time for taking an appeal has expired; or</text></subparagraph><subparagraph id="HBBF4B98DFF9E4F989717D4E4EB71BF22"><enum>(B)</enum><text>which has been appealed and the appeals process for which is completed.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
