which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the imposition of sanctions pursuant to the Global Magnitsky Human Rights Accountability Act to combat corruption and human rights violations perpetrated by officials in the Mexican Government, and for other purposes.</official-title></form><legis-body id="HEB62AFA2CB864618A669C6C8E06A82DC" style="OLC"><section id="HC9E3294F8686438897A6AF89E107FD67" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Mexico Against Corruption Act</short-title></quote>.</text></section><section id="HCBD07A4BCF1B46FFAA0966335EB363E5"><enum>2.</enum><header>Global Magnitsky sanctions with respect to certain government officials that engage in corruption or human rights abuses in Mexico</header><subsection id="H6DE2D5CEDABA4F17B79E34BDB4BB96FA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, and as appropriate thereafter, the President shall impose the sanctions described in subsection (c) with respect to each foreign person described in subsection (b) if the President has credible evidence that the foreign person has knowingly engaged in any of the activities described in section 1263(a)(3) of the Global Magnitsky Human Rights Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note).</text></subsection><subsection id="HDFAF8E02AE6448E39376E0A1BF46531D"><enum>(b)</enum><header>Foreign persons described</header><text>A foreign person described in this subsection is a foreign person who is—</text><paragraph id="H1DF5AE83BA824C78AEEDDFECF2FBFDA2"><enum>(1)</enum><text>a current or former official of the Government of Mexico; or</text></paragraph><paragraph id="H53741561778B4A858DF5FD3E27FA34E8"><enum>(2)</enum><text>acting on behalf of, or in cooperation with, an official of such Government.</text></paragraph></subsection><subsection id="HA8E6C9DC9C074DAFA9AFEDFECE678E38"><enum>(c)</enum><header>Sanctions described</header><paragraph id="H0202A628B2074033876A99FC949A1BB7"><enum>(1)</enum><header>In general</header><text>The sanctions described in this subsection are the sanctions described in section 1263(b) of the Global Magnitsky Human Rights Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note).</text></paragraph><paragraph id="HF1A05807B63D4DAB82F53F09E4A0DFC8"><enum>(2)</enum><header>Exception for intelligence activities</header><text display-inline="yes-display-inline">The requirement to impose sanctions under this section shall not apply with respect to activities subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091</external-xref> et seq.), or any authorized intelligence activities of the United States.</text></paragraph></subsection><subsection id="HCD636B246E1846278264B3C60204F151"><enum>(d)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the imposition of the sanctions under this section with respect to a foreign person if the President determines and reports to the appropriate congressional committees that such waiver is—</text><paragraph id="H7A2837D28F534DB9A5320AC3F6A5DA1F"><enum>(1)</enum><text>in the national security interests of the United States; or</text></paragraph><paragraph id="HBFB6AD5CA77E467686CE9B1ADCB53777"><enum>(2)</enum><text>necessary to prevent undue economic harm to the people of Mexico.</text></paragraph></subsection><subsection id="HFD1526B20BD349C2B1F868F290CF678B"><enum>(e)</enum><header>Implementation</header><paragraph id="HC5A31DC71E1D41EC8138DA2DF337BD6D"><enum>(1)</enum><header>In general</header><text>The President may exercise all authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to carry out this section.</text></paragraph><paragraph id="H9A5E160611B94475842F8D188E598926"><enum>(2)</enum><header>Exception relating to the importation of goods</header><text display-inline="yes-display-inline">The authorities and requirements to impose sanctions authorized under this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</text></paragraph><paragraph id="HD8E2BBBB00B34C16A3B48A74B9123304"><enum>(3)</enum><header>Good defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment and excluding technical data.</text></paragraph></subsection><subsection id="H7D9C271639774896B6FEB7149850C259"><enum>(f)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subsection><subsection id="H94AA2DEADF324540AEA8C3238D0D73A7"><enum>(g)</enum><header>Report on implementation</header><text>Not later than 15 days after imposing sanctions under subsection (a), the President shall submit to the appropriate congressional committees a report regarding measures taken to implement this section.</text></subsection></section><section id="H4A15C489498342EF85FE217415210965"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H27487680B6154344816D78373D1916E4"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="HE558729C1E7048EDB4CE65D8660B5237"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on Armed Services, the Permanent Select Committee on Intelligence, the Committee on Financial Services, the Committee on the Judiciary, and the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph id="H6B45871CEC7849128C0B613884A7AD2B"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Armed Services, the Select Committee on Intelligence, the Committee on Banking, Housing, and Urban Affairs, the Committee on the Judiciary, and the Committee on Appropriations of the Senate.</text></subparagraph></paragraph><paragraph id="HE70E8B1F8B1646C58AAF90427E40DE70"><enum>(2)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person.</text></paragraph><paragraph id="H7D10A69BC8ED4BD3B49A4ACE75F68BB3"><enum>(3)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="H91A39AFE69624D998E4F6B99376F7DBF"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph><subparagraph id="H86FC46C0ED494415ABC64E9C68CA11B9"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph></section></legis-body></bill>
