<official-title display="yes">To authorize the Secretary of Veterans Affairs to provide COVID–19 vaccines to an expanded population of veterans during a covered emergency period, and for other purposes.</official-title>

<section id="HB5D98F7AA43F48EDA76235397772BF7B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vaccines for Veterans Act</short-title></quote>. </text></section> <section id="H4B72ADCF7D524FE1B8E2397AB29712BB"><enum>2.</enum><header>COVID–19 vaccines for expanded population of veterans during covered emergency period</header> <subsection id="H4EE7D1C939F248D1BC37F695DD3D3338"><enum>(a)</enum><header>COVID–19 vaccines</header> <paragraph id="HE3E2A31E215B459EAAFAA40064C2D2F0"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, during a covered emergency period, the Secretary of Veterans Affairs may furnish the COVID–19 vaccine to any veteran who was discharged from service in the Armed Forces under honorable conditions without regard to whether the veteran is enrolled in the annual patient enrollment system under section 1705 of title 38, United States Code, or otherwise eligible to receive health care services under chapter 17 of such title.</text></paragraph>
<paragraph id="HE2079B8ADFF14DF9AD1B2C22629B15E6"><enum>(2)</enum><header>State guidelines</header><text>In furnishing COVID–19 vaccines pursuant to paragraph (1), each director of a Department of Veterans Affairs health care facility may determine priorities among veterans eligible to receive COVID–19 vaccines in accordance with guidelines established by the State in which the facility is located.</text></paragraph></subsection> <subsection id="H0BCCADB4DE23454AA3DC43FE4287CBF4"><enum>(b)</enum><header>Coordination</header> <paragraph id="H8F2F70AF9DEF49719D72F10547CD351F"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary of Veterans Affairs shall coordinate with the entities described in paragraph (2), as appropriate, to determine—</text>
<subparagraph id="H4AE9B47A73EE4EACBFEE2D500D4ED853"><enum>(A)</enum><text>whether an individual seeking to receive a COVID–19 vaccine pursuant this section meets the requirements of subsection (a)(1); and</text></subparagraph> <subparagraph id="H143BEE2DA1F64036A7BBA82036488045"><enum>(B)</enum><text>the relevant prioritization for such individual, in accordance with subsection (a)(2).</text></subparagraph></paragraph>
<paragraph id="H4242F6A722FD4F10A3C95D43D598EB29"><enum>(2)</enum><header>Coordinating entities</header><text>The entities described in this paragraph are the following:</text> <subparagraph id="H8381E60E036B4F1EBD334B36792C98E5"><enum>(A)</enum><text>The Secretary of Defense.</text></subparagraph>
<subparagraph id="H7BEA2E5CC44D45A7A28DDF7E614F91C6"><enum>(B)</enum><text>The Secretary of Health and Human Services.</text></subparagraph> <subparagraph id="H2B9EF8EFFD6F462897FCE38CADEB1EC1"><enum>(C)</enum><text display-inline="yes-display-inline">The Director of the Centers for Disease Control and Prevention.</text></subparagraph>
<subparagraph id="H6B6B9C848DE449499AE6F0EA8626646C"><enum>(D)</enum><text>The Administrator of the Federal Emergency Management Agency.</text></subparagraph> <subparagraph id="H57D402B03A4745D7B413E7F9D640D60D"><enum>(E)</enum><text display-inline="yes-display-inline">The heads of State departments of health (or related agencies).</text></subparagraph>
<subparagraph id="HE847520255CE489F983829D65751760A"><enum>(F)</enum><text>Any other Federal agency determined relevant by the Secretary of Veterans Affairs.</text></subparagraph></paragraph></subsection> <subsection id="H66A2598CB6004F8BA8FEEB7B931B77C0"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HD1832DA7C9AA40668376ABB231278135"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered emergency period</term> means a period beginning on the date on which a President declares a national emergency under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the coronavirus disease 2019 (COVID–19) and ending on the date that is 30 days after the date on which such national emergency declaration terminates.</text></paragraph> <paragraph id="H6B86E44FF14342659564E0D5AD6DF86B"><enum>(2)</enum><text>The term <term>covered medical condition</term> means a medical condition determined by the Director of the Centers for Disease Control and Prevention to be high risk with respect to COVID–19.</text></paragraph>
<paragraph id="HBD5E019D178A4EF39735809B9A09C9B3"><enum>(3)</enum><text>The term <term>COVID–19 vaccine</term> means any vaccine approved or authorized by the Commissioner of Food and Drugs for COVID–19.</text></paragraph> <paragraph id="H1188071BFDEC42A58C1E95651EC9D67F"><enum>(4)</enum><text>The term <term>State</term> includes each of the several States, the District of Columbia, each territory or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph></subsection></section>
