R. 1002</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210419">April 19, 2021</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Controlled Substances Act to authorize the debarment of certain registrants, and for other purposes.</official-title></form><legis-body id="H89F1D720E0934443A6A16DEDE4FEBE78" style="OLC"><pagebreak></pagebreak><section id="H627D64D41D6740BEB6D4A6350D0D7FCE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debarment Enforcement of Bad Actor Registrants Act of 2021</short-title></quote> or the <quote><short-title>DEBAR Act of 2021</short-title></quote>.</text></section><section id="H5E155EB3B82C4080A1B4E322FF7EFACB"><enum>2.</enum><header>Debarment of certain registrants</header><text display-inline="no-display-inline">Section 304 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/824">21 U.S.C. 824</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF79FD438297F43D786A9CDB27DC22AAA" style="traditional"><subsection id="H53861F36A09E453E9D25E5B7B02FF72A"><enum>(h)</enum><text display-inline="yes-display-inline">The Attorney General may issue an order to prohibit, conditionally or unconditionally, and permanently or for such period as the Attorney General may determine, any person from being registered under this title to manufacture, distribute, or dispense a controlled substance or a list I chemical, if the Attorney General finds that—</text><paragraph id="H59F88C5BB6DE41D980F9779F207A6EB6"><enum>(1)</enum><text display-inline="yes-display-inline">such person meets or has met any of the conditions for suspension or revocation of registration under subsection (a); and</text></paragraph><paragraph id="H68268B3C80D446A1A6694E9E2C719B38"><enum>(2)</enum><text display-inline="yes-display-inline">such person has a history of prior suspensions or revocations of registration.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3D2BF17360F74CF3943841F5E5392CDC"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body><attestation><attestation-group><attestation-date date="20210415" chamber="House">Passed the House of Representatives April 15, 2021.</attestation-date><attestor display="yes">Cheryl L.
