which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to limit interactive computer service immunity.</official-title></form><legis-body id="H9324D467726841C6BC95BD235664A7E4" style="OLC"><section id="H9421A6CC3C304DFBB326E6788D5EE45F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Break Up Big Tech Act of 2020</short-title></quote>. </text></section><section id="HB06313BC95154BA0BAEB639C5044ACA7"><enum>2.</enum><header>Limitation on interactive computer service immunity</header><text display-inline="no-display-inline">Section 230(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H1B8C7E75DB7840908A3B420F1A89C085"><paragraph id="H756CD831B68C4AA4AC0458E900773583"><enum>(3)</enum><header>Limitation</header><text display-inline="yes-display-inline">After the date of the enactment of this paragraph, paragraphs (1) and (2) shall not apply to a provider of an interactive computer service with respect to a service if the provider after such date—</text><subparagraph id="H04B58DB074EB4501856A058D29B44846"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H7479276C572C4F9082AB97457E6A1CDA"><enum>(i)</enum><text display-inline="yes-display-inline">sells advertising in which an advertisement is displayed to a user of such service based on—</text><subclause id="H92D45FAC6E4F4E05A289CCEC88EDB786" indent="up1"><enum>(I)</enum><text>personal traits of the user;</text></subclause><subclause id="H85C59910BD6E421C91ED6A41A231030B" indent="up1"><enum>(II)</enum><text>previous location information with respect to the user;</text></subclause><subclause id="HC30C3964E6B64D2FBE8DDFE9EFF2B750" indent="up1"><enum>(III)</enum><text>personal information from a profile about the user that is created for the purpose of selling advertisements; </text></subclause><subclause id="H7D5450C7C2754A25931995A7F43D80C1" indent="up1"><enum>(IV)</enum><text>the previous online or offline behavior of the user;</text></subclause><subclause id="HB7E19278B884412B8726F5A74C3F5BF8" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">the content of the website, online service, online application, or mobile application to which the user is connected; </text></subclause><subclause id="HC884CBB979624E15A9E28665CFED1E0E" indent="up1"><enum>(VI)</enum><text>the location of the user, as of the time at which the advertising is directed to the user; or</text></subclause><subclause id="H866267B41A6C4D1BB031A78E01AE4773" indent="up1"><enum>(VII)</enum><text>the search terms that the user applied to arrive at the website, service, or application to which the user is connected; and </text></subclause></clause><clause id="HE8540622A6634A76941C92001BB53D43" indent="up1"><enum>(ii)</enum><text>displays an advertisement in a manner described under clause (i) to a user who did not opt-in to having an advertisement displayed to such user in such a manner;</text></clause></subparagraph><subparagraph id="H81B970EEDE7640FCB24EBCCAACAC40B2"><enum>(B)</enum><text>through such service, places items, or facilitates the placement of items, into the stream of commerce; </text></subparagraph><subparagraph id="HF4F5ECD899864A04995BAB86372C41BA"><enum>(C)</enum><text display-inline="yes-display-inline">through such service, collects data for commercial purposes other than receiving from users of such service direct payment for the use of such service; or</text></subparagraph><subparagraph id="H7760DC6C3A3F459A99F055B70FEEC555"><enum>(D)</enum><text>uses a design or product that addicts, or whose purpose is to addict, users to such service.</text></subparagraph></paragraph><paragraph id="H0D7C826AB778438E9DA36A7810B51518"><enum>(4)</enum><header>Exception</header><subparagraph id="HCB30F99E9D3F4B398222B03EE7749E4F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), an owner or operator of a social media service that displays user-generated content in an order other than chronological order, delays the display of such content relative to other content, or otherwise hinders the display of such content relative to other content, if for a reason other than to restrict access to or availability of material described in paragraph (2)(A) or to carry out the direction of the user that generated or requested such content or generated or requested restricted access to such content, shall be treated as a publisher or speaker of such content.</text></subparagraph><subparagraph id="HD3413C42AB17471C83D6473BA28B3A99"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph—</text><clause id="HF6270AD882F1409D8D33AAA670EE0D62"><enum>(i)</enum><header>Social media service</header><text>The term <quote>social media service</quote> means any interactive computer service provided over the Internet that connects users for the purpose of such users engaging in dialogue, sharing information, collaborating, or otherwise interacting.</text></clause><clause id="HFE18E2CDCD9549B1A482291242014254"><enum>(ii)</enum><header>User-generated content</header><text>The term <quote>user-generated content</quote> means content that is supplied on a social media service by an information content provider who is a user of such service.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
