R. 8868</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20201203">December 3, 2020</action-date><action-desc><sponsor name-id="T000483">Mr. Trone</sponsor> (for himself, <cosponsor name-id="C001080">Ms. Judy Chu of California</cosponsor>, and <cosponsor name-id="L000593">Mr. Levin of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title V of the Public Health Service Act to provide for increased oversight of recovery housing, and for other purposes.</official-title></form><legis-body id="HD1414F1D3E7A48329969610F39874240" style="OLC"><section id="HE6BA381282EB440BBC1D17976544FEF4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Excellence in Recovery Housing Act</short-title></quote>.</text></section><section id="HAFE6316227DA47CBA232D6D043072E49" commented="no"><enum>2.</enum><header>Clarifying the role of SAMHSA in promoting the availability of high-quality recovery housing</header><text display-inline="no-display-inline">Section 501(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa</external-xref>) is amended—</text><paragraph id="H8D4E8BE1055242FCB3440C5B3966F5E6" commented="no"><enum>(1)</enum><text>in paragraph (24)(E), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H5F09EEAD9AFF4CA092B8E7269FFA2865" commented="no"><enum>(2)</enum><text>in paragraph (25), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HDE46B40E51CB467487A3CEDBF5526876" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4DD4ED6FA6A940D68829B325E287E223" display-inline="no-display-inline"><paragraph id="H0298D40D7DDE4928AC491C9ABB5A26ED" commented="no"><enum>(26)</enum><text display-inline="yes-display-inline">collaborate with national accrediting entities and reputable providers and analysts of recovery housing services and all relevant Federal agencies, including the Centers for Medicare &amp; Medicaid Services, the Health Resources and Services Administration, other offices and agencies within the Department of Health and Human Services, the Office of National Drug Control Policy, the Department of Justice, the Department of Housing and Urban Development, and the Department of Agriculture, to promote the availability of high-quality recovery housing for individuals with a substance use disorder. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HB8970D368AA847FDBB012C2FC66E80F5" commented="no"><enum>3.</enum><header>Developing guidelines for States to promote the availability of high-quality recovery housing</header><subsection id="HD07CB77B24DC41998BE075D328CFF4BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use, shall develop, and publish on the internet website of the Substance Abuse and Mental Health Services Administration, consensus-based guidelines and nationally recognized standards for States to promote the availability of high-quality recovery housing for individuals with a substance use disorder. Such guidelines shall—</text><paragraph id="H37AB583F08E445F180105BA7C438C8C9"><enum>(1)</enum><text>be developed in consultation with national accrediting entities and reputable providers and analysts of recovery housing services and be consistent with the best practices developed under section 550 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa</external-xref>); and</text></paragraph><paragraph id="H297DBE859A534C4C98EAC870266091D0"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, build on existing best practices and suggested guidelines developed previously by the Substance Abuse and Mental Health Services Administration.</text></paragraph></subsection><subsection id="H5AF2764EBC864B81B4502C99AB7F962F"><enum>(b)</enum><header>Public comment period</header><text>Before finalizing guidelines under subsection (a), the Secretary of Health and Human Services shall provide for a public comment period.</text></subsection><subsection id="HF82F566D3E9045509DA86A1CA62C6FFF"><enum>(c)</enum><header>Exclusion of guideline on treatment services</header><text>In developing the guidelines under subsection (a), the Secretary may not include any guideline or standard with respect to substance use disorder treatment services.</text></subsection><subsection id="H7C008369FDA6449D9740D0C8195B24DA"><enum>(d)</enum><header>Substance use disorder treatment services</header><text display-inline="yes-display-inline">In this section, the term <term>substance use disorder treatment services</term> means items or services furnished for the treatment of a substance use disorder, including—</text><paragraph id="H7041039524F442578E911717792BA1D8"><enum>(1)</enum><text display-inline="yes-display-inline">medications approved by the Food and Drug Administration for use in such treatment, excluding each such medication used to prevent or treat a drug overdose;</text></paragraph><paragraph id="HB17B5DC1DF214AB4B291BFB02A56A9CE" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the administering of such medications;</text></paragraph><paragraph id="H8A6E4B942C724632A57449F3A58735D6"><enum>(3)</enum><text>recommendations for such treatment;</text></paragraph><paragraph id="HB834D2D3958B445D9A1D46261033ABDD"><enum>(4)</enum><text>clinical assessments and referrals;</text></paragraph><paragraph id="H8E251180AE8646CD8D4ACF0C20DE1E45"><enum>(5)</enum><text>counseling with a physician, psychologist, or mental health professional (including individual and group therapy); and</text></paragraph><paragraph id="H60241624FAFF42738A47077EE7560A35"><enum>(6)</enum><text>toxicology testing.</text></paragraph></subsection></section><section id="HED63A9A5B68540B68E867F3771CC25F8"><enum>4.</enum><header>Coordination of Federal activities to promote the availability of high-quality recovery housing</header><text display-inline="no-display-inline">Section 550 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5</external-xref>) is amended—</text><paragraph id="H1B98A09A68B74169B251440DD5680484"><enum>(1)</enum><text>by redesignating subsections (e), (f), and (g) as subsections (h), (i), and (j), respectively; and</text></paragraph><paragraph id="H95293BEBACFB4D4CB93D8EA680AA061E"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" id="HCBCE6B15E1CD4F4CAD2425D22730C1D0" display-inline="no-display-inline"><subsection id="H185962F552E3449AA31C3B99A4F7C3B1"><enum>(e)</enum><header>Coordination of Federal activities To promote the availability of high-Quality recovery housing for individuals with a substance use disorder</header><paragraph id="HEE78A56A0BA14539A7797F5EF1104468"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary, and the Secretary of the Department of Housing and Urban Development, shall convene and serve as the co-chairs of an interagency working group composed of representatives of each of the Federal agencies described in paragraph (2) (referred to in this section as the <quote>working group</quote>) for the following purposes:</text><subparagraph id="H1EF75108BDF84B99A6B1322F18AF48A5"><enum>(A)</enum><text display-inline="yes-display-inline">To increase collaboration, cooperation, and consultation among such Federal agencies, with respect to promoting the availability of high-quality recovery housing.</text></subparagraph><subparagraph id="H200A27E5F8FB4FE898A0249A235D1341"><enum>(B)</enum><text display-inline="yes-display-inline">To align the efforts of such agencies and avoid duplication of such efforts by such agencies.</text></subparagraph><subparagraph id="HEBE453071E3A4450AF3DF2EC6A862DD9"><enum>(C)</enum><text display-inline="yes-display-inline">To develop objectives, priorities, and a long-term plan for supporting State, Tribal, and local efforts with respect to the operation of high-quality recovery housing that is consistent with the best practices developed under this section.</text></subparagraph><subparagraph id="H65930A1D40374F17A62C8C8D464DADC6"><enum>(D)</enum><text display-inline="yes-display-inline">To coordinate inspection and enforcement among Federal and State agencies.</text></subparagraph><subparagraph id="H787F1FD7BC924EE2A7E69DAA5F247C21"><enum>(E)</enum><text>To coordinate data collection on the quality of recovery housing.</text></subparagraph></paragraph><paragraph id="H0464640161354651890D7064736724DC"><enum>(2)</enum><header>Federal agencies described</header><text display-inline="yes-display-inline">The Federal agencies described in this paragraph are the following:</text><subparagraph id="H90D385B99BC942F39820908A3F660DF5"><enum>(A)</enum><text>The Department of Health and Human Services.</text></subparagraph><subparagraph id="H7A2D983780984C459C963C35AD107539"><enum>(B)</enum><text>The Centers for Medicare &amp; Medicaid Services.</text></subparagraph><subparagraph id="HB67371727AD24514B9FA0816E97AB50E"><enum>(C)</enum><text>The Substance Abuse and Mental Health Services Administration.</text></subparagraph><subparagraph id="H6016DAD0C65D448D8FB9F883071FF800"><enum>(D)</enum><text>The Health Resources Services Administration.</text></subparagraph><subparagraph id="H7DFECD6961654C5DACC4C7F8B819B6DB"><enum>(E)</enum><text>The Indian Health Service.</text></subparagraph><subparagraph id="HE048231C32AE4B349A3D15DC7459B100"><enum>(F)</enum><text display-inline="yes-display-inline">The Department of Housing and Urban Development.</text></subparagraph><subparagraph id="HA412DAF3DB96480186FCDBEB5491E376"><enum>(G)</enum><text display-inline="yes-display-inline">The Department of Agriculture.</text></subparagraph><subparagraph id="HF3EFE77E808748F6A74CB6641B201B81"><enum>(H)</enum><text>The Department of Justice.</text></subparagraph><subparagraph id="HF4F81A3E2EA349C1A5163C3BB132F856"><enum>(I)</enum><text>The Office of National Drug Control Policy.</text></subparagraph><subparagraph id="H322FE4B50F9347E48791E53002DD6496"><enum>(J)</enum><text display-inline="yes-display-inline">The Bureau of Indian Affairs. </text></subparagraph><subparagraph id="HE6FB713A26F74E5092724E684FD34FA0"><enum>(K)</enum><text display-inline="yes-display-inline">Any other such agency or subagency as the chair determines necessary and appropriate.</text></subparagraph></paragraph><paragraph id="HBA3089FA171E4457B4774FE7B328BAA7"><enum>(3)</enum><header>Meetings</header><text>The working group shall meet on a quarterly basis.</text></paragraph><paragraph id="H68245AC0233E41CB853360B6F9970E05"><enum>(4)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Beginning not later than one year after the date of the enactment of this section and annually thereafter, the working group shall submit to the Committee on Energy and Commerce, the Committee on Ways and Means, the Committee on Agriculture, and the Committee on Financial Services of the House of Representatives and the Committee on Health, Education, Labor, and Pensions, the Committee on Agriculture, Nutrition, and Forestry, and the Committee on Finance of the Senate a report describing the work of the working group and any recommendations of the working group to improve Federal, State, and local policy with respect to recovery housing operations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H71FF116817724FCF9DCE61C8A690C2E3"><enum>5.</enum><header>NAS study</header><text display-inline="no-display-inline">Section 550 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5</external-xref>), as amended by section 4, is further amended by inserting after subsection (e) (as inserted by such section 4) the following: </text><quoted-block style="OLC" id="HC5C7A738431F4DF59822D2DCB2E76032" display-inline="no-display-inline"><subsection id="HDB7B3FB9B2A04D40A0FEAFDCBD86692F"><enum>(f)</enum><header>NAS study and report</header><paragraph id="HDD45232FF8EB49A28A489BEC21415209"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary, shall enter into an arrangement with the National Academy of Sciences under which the National Academy agrees to conduct a study on—</text><subparagraph id="H09FEA93061FF4B96835344630E1AD8E5"><enum>(A)</enum><text display-inline="yes-display-inline">the availability in the United States of high-quality recovery housing and whether that availability meets the demand for such housing in the United States; and</text></subparagraph><subparagraph id="HA1A65AB528314DBAA9401448193F74FE"><enum>(B)</enum><text>State, Tribal, and local regulation and oversight of recovery housing.</text></subparagraph></paragraph><paragraph id="H7094A3C8CC2B472CAFC8DFD9191D9AD6"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">The arrangement under paragraph (1) shall provide for the National Academy of Sciences to submit, not later than 1 year after the date of the enactment of this subsection, a report that contains—</text><subparagraph id="H52E472DBD05147C3B669B58237695F32"><enum>(A)</enum><text>the results of the study under such paragraph; </text></subparagraph><subparagraph id="H80622BF71CA044478344AC5B61B8542E"><enum>(B)</enum><text display-inline="yes-display-inline">the National Academy’s recommendations for Federal, State, and local policies to promote the availability of high-quality recovery housing in the United States;</text></subparagraph><subparagraph id="H2EA73E538AE54DC5ADE812761AE1055F"><enum>(C)</enum><text display-inline="yes-display-inline">recommendations for Federal, State, and local policies to improve data collection on the quality of recovery housing;</text></subparagraph><subparagraph id="HDC0426F97D0A4FEA8B5B0E7B4805AB93"><enum>(D)</enum><text>recommendations for recovery housing quality metrics;</text></subparagraph><subparagraph id="H7A8E0729A17D4B09BF6D037B2DC0242F"><enum>(E)</enum><text>recommendations to eliminate restrictions by recovery residences that exclude individuals who take prescribed medications for opioid use disorder; and</text></subparagraph><subparagraph id="HC157C4B8EF6C407AB060DD182FAA7911"><enum>(F)</enum><text display-inline="yes-display-inline">a summary of allegations, assertions, or formal legal actions on the State and local levels by governments and non-governmental organizations with respect to the opening and operation of recovery residences.</text></subparagraph></paragraph><paragraph id="H250EDEB3B6474F768AFD9CBCD0DF996B"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the study under this subsection, the National Academy of Sciences shall consult with national accrediting entities and reputable providers and analysts of recovery housing services. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HDB996680C20E42BCBC5A7DF78E83B372"><enum>6.</enum><header>Grants for States to promote the availability of high quality recovery housing</header><text display-inline="no-display-inline">Section 550 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5</external-xref>), as amended by sections 4 and 5, is further amended by inserting after subsection (f) (as inserted by such section 5) the following:</text><quoted-block style="OLC" id="H89246E64D34843AA8DBBC34FE708D00F" display-inline="no-display-inline"><subsection id="HCAF6DA0879FA4887B735F2EFBAEEC302"><enum>(g)</enum><header>Grants for implementing national recovery housing best practices</header><paragraph id="H8C09CA29FAB64D3585C988E5EE2C655B"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to States (and political subdivisions thereof), Tribes, and territories—</text><subparagraph id="H8D33ED2FFB964FB18EF6997BFDA5D26A"><enum>(A)</enum><text display-inline="yes-display-inline">for the provision of technical assistance by national accrediting entities and reputable providers and analysts of recovery housing services to implement the guidelines, nationally recognized standards, and recommendations developed under section 3 of the <short-title>Excellence in Recovery Housing Act</short-title> and this section; and</text></subparagraph><subparagraph id="HF389680937B744A9A45B65210B0C9A93"><enum>(B)</enum><text display-inline="yes-display-inline">to promote the availability of high-quality recovery housing for individuals with a substance use disorder and practices to maintain housing quality long term.</text></subparagraph></paragraph><paragraph id="HFED127662161488FAF0585A96CA945A0"><enum>(2)</enum><header>State enforcement plans</header><text display-inline="yes-display-inline">Beginning not later than 90 days after the date of the enactment of this paragraph and every 2 years thereafter, as a condition on the receipt of a grant under paragraph (1), each State (or political subdivisions thereof), Tribe, or territory receiving such a grant shall submit to the Secretary, and make publicly available on a publicly accessible Internet website of the State (or political subdivisions thereof), Tribe, or territory, the plan of the State (or political subdivisions thereof), Tribe, or territory, with respect to the promotion of high-quality recovery housing for individuals with a substance use disorder located within the jurisdiction of such State (or political subdivisions thereof), Tribe, or territory, and how such plan is consistent with the best practices developed under this section and guidelines developed under section 3 of the <short-title>Excellence in Recovery Housing Act</short-title>.</text></paragraph><paragraph id="HF11C1DEE60B84592AD60025627CED850"><enum>(3)</enum><header>Review of accrediting entities</header><text>The Secretary shall periodically review the accrediting entities providing technical assistance pursuant to paragraph (1)(A). </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H2204E445CB7B424AA9C265F96F69BAC9"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 550 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5</external-xref>), as amended by sections 4, 5, and 6 is further amended by amending subsection (j) (as redesignated by such section 4) to read as follows: </text><quoted-block style="OLC" id="HE3791A4DEA6D432A8FCBF4BFE61D5C3D" display-inline="no-display-inline"><subsection id="HC23344E30C794C07A0B93966BD44DA05"><enum>(j)</enum><header>Authorization of appropriations</header><paragraph id="HA91588981E1C4FA6B569D6F3734DD924"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out this section, there is authorized to be appropriated—</text><subparagraph id="H528B5C02508543A0B006BE072BDCDA46"><enum>(A)</enum><text>$2,000,000 for fiscal year 2021; and</text></subparagraph><subparagraph id="HF8459C8FE8C942C6A14966066D81CD4E"><enum>(B)</enum><text>$11,000,000 for each of fiscal years 2022 through 2026.</text></subparagraph></paragraph><paragraph id="H63528BE5507E4E8FBCC324CDAADDDD6B"><enum>(2)</enum><header>Reservations of funds</header><text>The Secretary shall reserve—</text><subparagraph id="HE62F4B74039B4AFF8F791557A1713D73"><enum>(A)</enum><text>not less than $1,000,000 to carry out subsection (e) for each of fiscal years 2021 through 2026;</text></subparagraph><subparagraph id="H77D4CDB7AE8449B2BB8E427A952EF41C"><enum>(B)</enum><text>not less than $1,000,000 to carry out subsection (f) for fiscal year 2021; and</text></subparagraph><subparagraph id="HDD61CC015F394752BE535D15DD555270"><enum>(C)</enum><text>not less than $10,000,000 to carry out subsection (g) for each of fiscal years 2022 through 2026.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H92EFA29C354C4FB092EEDF267D2C87E5"><enum>8.</enum><header>Reputable providers and analysts of recovery housing services definition</header><text display-inline="no-display-inline">Section 550(i) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5(i)</external-xref>), as redesignated by section 4, is amended by adding at the end the following: </text><quoted-block style="OLC" id="H04E01413D5A24876AA1B031F75123D09" display-inline="no-display-inline"><paragraph id="H28B8FF4787224F74BB1341F60AB41ECF"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>reputable providers and analysts of recovery housing services</term> means recovery housing service providers and analysts that—</text><subparagraph id="H64E39C35829C49EE9D4336B1BB882739"><enum>(A)</enum><text>use evidence-based approaches;</text></subparagraph><subparagraph id="H82ADA960C1CC4317B0156422321CFF8E"><enum>(B)</enum><text>act in accordance with guidelines issued by the Assistant Secretary for Mental Health and Substance Use;</text></subparagraph><subparagraph id="HCA2DEE537A8A4E95B75288F25F9DA7A6"><enum>(C)</enum><text display-inline="yes-display-inline">have not been found guilty of health care fraud by the Department of Justice; and</text></subparagraph><subparagraph id="H7EE82C0F24094CA38E6339989C910A1D"><enum>(D)</enum><text>have not been found to have violated Federal, State, or local codes of conduct with respect to recovery housing for individuals with a substance use disorder.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBF1D9AAF97C44816929E8618E2F34478"><enum>9.</enum><header>Technical correction</header><text display-inline="no-display-inline">Title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa</external-xref> et seq.) is amended—</text><paragraph id="H9EFA27C83E73441890BC923B1FD73328"><enum>(1)</enum><text>by redesignating section 550 (relating to Sobriety Treatment and Recovery Teams) (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-10">42 U.S.C. 290ee–10</external-xref>), as added by section 8214 of <external-xref legal-doc="public-law" parsable-cite="pl/115/271">Public Law 115–271</external-xref>, as section 550A; and</text></paragraph><paragraph id="HD58916309CC34434B8B924BE5BF363C2"><enum>(2)</enum><text>moving such section so it appears after section 550 (relating to National Recovery Housing Best Practices).</text></paragraph></section></legis-body></bill>
