which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit Federal employees from making allegations or appeals with respect to an adverse action to more than one entity, and for other purposes.</official-title></form><legis-body id="HFDE8A99598CE4094973CFA04E341DBB2" style="OLC"><section id="HA1F3850DCA6743EC83F9AB8B6200537B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help End Redundant Claims Unnecessarily Leaving Employers Suffering Act</short-title></quote> or the <quote><short-title>HERCULES Act</short-title></quote>.</text></section><section id="HB4B68CDEA4DA44D19059916F74251EEE"><enum>2.</enum><header>Limit Federal employees adverse action appeal avenues</header><subsection id="HED38484C128F4CA7A4163EA4E1B67E50"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an employee who alleges or appeals, as the case may be, a covered matter to a reviewing entity that has authority to consider such allegation or appeal may not subsequently or simultaneously allege or appeal such covered matter to any other reviewing entity.</text></subsection><subsection id="H2AE9303EF1924785B6B42817E4F1DA6E"><enum>(b)</enum><header>Rules of construction</header><text display-inline="yes-display-inline">Subsection (a) shall not be construed as—</text><paragraph id="H5388895114204192980F72C6107E2EB0"><enum>(1)</enum><text display-inline="yes-display-inline">restricting to whom an employee may appeal for review of a decision of a reviewing entity with respect to a covered matter; and</text></paragraph><paragraph id="H44E860C42D214D558C925F2FB4012F5B"><enum>(2)</enum><text>affecting or otherwise modifying the rights of employees—</text><subparagraph id="HC37FA878253A4C9D9A516CDAEB653E70"><enum>(A)</enum><text>under any collective bargaining agreements; or</text></subparagraph><subparagraph id="H5550C2A6E7784341851AD80875D4A8CE"><enum>(B)</enum><text>to seek judicial review of any matter.</text></subparagraph></paragraph></subsection><subsection id="H88F388B4D73D43DD9BA36DC24436E4B0"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE8547975751249A19B84625B6CA04726"><enum>(1)</enum><header>Covered matter</header><text>The term <term>covered matter</term> means—</text><subparagraph id="H62A08D61A0574ED690F9DF5B930EFE2A"><enum>(A)</enum><text>any action or final decision that an employee can appeal to the Merit Systems Protection Board;</text></subparagraph><subparagraph id="HBD23C810C470452892D91EE7D01A2482"><enum>(B)</enum><text>any action or final decision that involves a complaint of discrimination of the type prohibited by any law administered by the Equal Employment Opportunity Commission and for which the employee can seek review by such Commission;</text></subparagraph><subparagraph id="HC0B71713CAE842808E9CEEE2F3DB4EBE"><enum>(C)</enum><text>any matter with respect to which the procedures under section 7121(a) of title 5, United States Code, apply;</text></subparagraph><subparagraph id="H021C2BB81B0D486C891EF1235D5129C5"><enum>(D)</enum><text>prohibited personnel practices under section 2302 of such title; or</text></subparagraph><subparagraph id="HE83727ABE1854339BE5E46F87518358B"><enum>(E)</enum><text>unfair labor practices under section 7116 of such title.</text></subparagraph></paragraph><paragraph id="H6911263E8C4D46F68FAFF9D9A795E78E"><enum>(2)</enum><header>Employee</header><text>The term <term>employee</term> has the meaning given such term in section 2105 of title 5, United States Code.</text></paragraph><paragraph id="HC0CAD0DE6835422F90FD8B13BE3A250D"><enum>(3)</enum><header>Reviewing entity</header><text>The term <term>reviewing entity</term> means—</text><subparagraph id="HE9F672B0A9864312A2991735D4287F96"><enum>(A)</enum><text>the Merit System Protection Board;</text></subparagraph><subparagraph id="HF7D053006C5E45D48613129B03316F94"><enum>(B)</enum><text>the Equal Employment Opportunity Commission;</text></subparagraph><subparagraph id="HAF68B0CC3D794A06B17E46B142067AB6"><enum>(C)</enum><text>the Office of Special Counsel; or</text></subparagraph><subparagraph id="H01FDA643C86845999A23BE4B41383295"><enum>(D)</enum><text>the Federal Labor Relations Authority.</text></subparagraph></paragraph></subsection><subsection id="H42DB05B886F6412889D9287A5CBC12D9"><enum>(d)</enum><header>Applicability</header><text>Subsection (a) shall apply only with respect to—</text><paragraph id="HABDF2CE12E0B4B05AD5C62255D8B86BF"><enum>(1)</enum><text>covered matters for which the initial allegation or appeal to a reviewing entity occurs after the date of the enactment of this Act; and</text></paragraph><paragraph id="H3A018E13B68940DB839F3664ECB1C098"><enum>(2)</enum><text>contracts entered into after the date of the enactment this Act.</text></paragraph></subsection></section></legis-body></bill>
