which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Lead-Based Paint Poisoning Prevention Act to provide for additional procedures for families with children under the age of 6, and for other purposes.</official-title></form><legis-body id="HFC244CB5F4C342F5A53BDD34135F8D0C" style="OLC"><section commented="no" display-inline="no-display-inline" id="H9B17B824E1614388BDCB331AE894F1B1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lead-Safe Housing for Kids Act of 2020</short-title></quote>.</text></section><section id="H07F4C48A155046C2A23728D5A94DF645"><enum>2.</enum><header>Congressional findings</header><text display-inline="no-display-inline">The Congress finds that—</text><paragraph id="HE79FF348F2D54CD88806880D414F9E38"><enum>(1)</enum><text display-inline="yes-display-inline">according to the Centers for Disease Control and Prevention (CDC), in 2014 approximately 995,600 or 4 percent of children under the age of 6 in the United States had elevated blood lead levels above the CDC reference value of 5 micrograms per deciliter (μg/dL);</text></paragraph><paragraph id="H80C99DAF9E7F4F11A3B835E69845C386"><enum>(2)</enum><text>there is no safe level of lead poisoning;</text></paragraph><paragraph id="HEAFE37F1CFAD4DBDA0F39DEA55E58486"><enum>(3)</enum><text>according to the CDC, the effects of lead poisoning are immediate and permanent—childhood exposure to lead, even at very low levels, can have lifelong consequences, including decreased IQ and cognitive function, developmental delays, and behavioral problems;</text></paragraph><paragraph id="H805227C239F8408E8D992BE95163C294"><enum>(4)</enum><text>higher exposures to lead at a young age can cause seizures, coma, and even death;</text></paragraph><paragraph id="HC61DEEC397834DB3AE2D8F1A409BF68A"><enum>(5)</enum><text display-inline="yes-display-inline">according to the National Housing Law Project, there are over 90,400 children in the United States living in housing assisted under the Housing Choice Voucher Program who have lead poisoning and there are an additional 340,000 children living in federally assisted housing who are at risk;</text></paragraph><paragraph id="HAD71292E930045EE89DD5408E9E67ABD"><enum>(6)</enum><text>under current program rules, children whose families participate in the Housing Choice Voucher Program must develop lead poisoning before a lead hazard risk assessment occurs;</text></paragraph><paragraph id="HCB71B60CBAD4447C8B8881CD4725F798"><enum>(7)</enum><text>Columbia University estimates the potential societal costs of lead poisoning in the Housing Choice Voucher Program to be almost $1.2 billion; and</text></paragraph><paragraph id="H917338077D9447929122A582A1B80E04"><enum>(8)</enum><text>while some localities have required property owners to conduct risk assessments and abate lead when a child under the age of 6 will reside in a dwelling unit, there has been evidence that such policies led to augmented instances of housing discrimination on the basis of familial status, making housing opportunities less available for families with children and increasing the risk of homelessness for such families.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H518183E53C734234A6B880DA0E81118A"><enum>3.</enum><header>Amendments to the Lead-Based Paint Poisoning Prevention Act</header><text display-inline="no-display-inline">Section 302(a) of the Lead-Based Paint Poisoning Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4822">42 U.S.C. 4822(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H1C9AD082B61E4BE0BEA30F712C1DE319"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC85127BE21AD49A885C37F83EC776C89"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="HCB93DE620DD448BA85ACD7A063BC5A9F" style="OLC"><paragraph id="H3C7DE3101AB74DA2877EA609CB00C6B5"><enum>(4)</enum><header>Additional procedures for families with children under the age of 6</header><subparagraph id="H026C04CFFF3F4852855B7573017303BE"><enum>(A)</enum><header>Risk assessment</header><clause id="H6F014067934945299EA1F891514D3A05"><enum>(i)</enum><header>Definition</header><text>In this subparagraph, the term <term>covered housing</term>—</text><subclause id="HD7D8BB55260946A78C702626A994C898" display-inline="no-display-inline"><enum>(I)</enum><text>means housing receiving Federal assistance described in paragraph (1) that—</text><item id="HEF6B624BA40D4309B1979ED3E47EE4B2"><enum>(aa)</enum><text>was constructed prior to 1978; and</text></item><item id="HE5A739E33D2C490191D2A8CCDD1B4302"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="H09D2B7D3E71B4C9DA0A19317FEF7BB88"><enum>(AA)</enum><text>is public housing; </text></subitem><subitem id="H7DBE66075CCB4D419CC6468141EDE48D" indent="up1"><enum>(BB)</enum><text>receives project-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>);</text></subitem><subitem id="HD9F0B3E1EADC4E328F4E1A7D114E0BA3" indent="up1"><enum>(CC)</enum><text>receives assistance under the Housing Opportunities for Persons With AIDS under subtitle D of title VIII of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12901">42 U.S.C. 12901</external-xref> et seq.); or</text></subitem><subitem id="HAE71EF68B06947F5B737C1C92615A241" indent="up1"><enum>(DD)</enum><text>receives assistance under the Supportive Housing for Persons With Disabilities under section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>); and</text></subitem></item></subclause><subclause id="H356B94263C6A4953B9D5BADBA7BEEEFA"><enum>(II)</enum><text>does not include—</text><item id="HD26C49C587104DC1858F36AB40D6AF48"><enum>(aa)</enum><text>single-family housing covered by an application for mortgage insurance under the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1701">12 U.S.C. 1701</external-xref> et seq.); or</text></item><item commented="no" display-inline="no-display-inline" id="H6D76F2D3362E4EE58ADC5304BE0D41C8"><enum>(bb)</enum><text>multi-family housing that—</text><subitem commented="no" display-inline="no-display-inline" id="HF492E2C69E444A50BB9B216C599DF568"><enum>(AA)</enum><text>is covered by an application for mortgage insurance under the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1701">12 U.S.C. 1701</external-xref> et seq.); and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="HD3CC7EBADC104AAB8E3751A7BCF6FB56"><enum>(BB)</enum><text>does not receive any other Federal housing assistance.</text></subitem></item></subclause></clause><clause id="HF3C8C543A4624C4FA8549FC664699B33"><enum>(ii)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of the <short-title>Lead-Safe Housing for Kids Act of 2020</short-title>, the Secretary shall promulgate regulations that—</text><subclause id="HBD4835C40A9044A49E3DB9DE7D411DED"><enum>(I)</enum><text>require the owner of covered housing in which a family with a child of less than 6 years of age will reside or is expected to reside to conduct an initial risk assessment for lead-based paint hazards—</text><item id="H596D633D8AC64D77898CF258020308FD"><enum>(aa)</enum><text>in the case of covered housing receiving public housing assistance under the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437</external-xref> et seq.) or project-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>), not later than 15 days after the date on which a physical condition inspection occurs; and</text></item><item id="H6CF347A82F8D444A8A05FBFB8BD0A929"><enum>(bb)</enum><text>in the case of covered housing not described in item (aa), not later than a date established by the Secretary;</text></item></subclause><subclause id="H22A677518F9D4F8C830C94ACF9CB1609"><enum>(II)</enum><text>provide that a visual assessment alone is not sufficient for purposes of complying with subclause (I);</text></subclause><subclause id="HC16808F726F24F72B22BCA7C23F67290"><enum>(III)</enum><text>require that, if lead-based paint hazards are identified by an initial risk assessment conducted under subclause (I), the public housing agency for or owner of the covered housing shall—</text><item id="HEFF4129D5D974C8785E4D7D596B5AB7F"><enum>(aa)</enum><text display-inline="yes-display-inline">not later than 30 days after the date on which the initial risk assessment is conducted, control the lead-based paint hazards, including achieving clearance in accordance with regulations promulgated under section 402 or 404 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682</external-xref>, 2684), as applicable, except that to the extent that the requirements under this item result in additional costs, this item shall be effective and apply only to the extent that amounts to cover such additional costs are provided in advance in appropriation Acts; and</text></item><item id="HD29195D6BD174F5F8D4B4AB46286B572"><enum>(bb)</enum><text>provide notice to all residents in the covered housing affected by the initial risk assessment, and provide notice in the common areas of the covered housing, that lead-based paint hazards were identified and will be controlled within the 30-day period described in item (aa); and</text></item></subclause><subclause id="H3C22E26FE66947ECB61FBD204378A425"><enum>(IV)</enum><text>provide that there shall be no extension of the 30-day period described in subclause (III)(aa).</text></subclause></clause><clause id="H9177E48AA7984D389F6B82B74B6291DC"><enum>(iii)</enum><header>Exceptions</header><text>The regulations promulgated under clause (ii) shall provide an exception to the requirement under subclause (I) of such clause for covered housing—</text><subclause id="H2F320869EE6D4CD4A66B774F8717BBFC"><enum>(I)</enum><text>if the public housing agency for or owner of the covered housing submits to the Secretary documentation—</text><item id="H9A271FF9BDE94A3BB633FD2657D9B398"><enum>(aa)</enum><text>that the public housing agency or owner conducted a risk assessment of the covered housing for lead-based paint hazards during the 12-month period preceding the date on which the family is expected to reside in the covered housing; and</text></item><item id="H77E001C18C2C45D080BFC49DDA259F26"><enum>(bb)</enum><text>of any clearance examinations of lead-based paint hazard control work resulting from the risk assessment described in item (aa);</text></item></subclause><subclause id="H2F5C2AE905C144F6875C10FE25AE3C54"><enum>(II)</enum><text>from which all lead-based paint has been identified and removed and clearance has been achieved in accordance with regulations promulgated under section 402 or 404 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682</external-xref>, 2684), as applicable;</text></subclause><subclause id="H11CCA086FDD841329A7B150A159BEE45"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="H6AE51F44925D4E1981A693A7312E1492"><enum>(aa)</enum><text>if the dwelling unit is unoccupied;</text></item><item id="HA20B4B764C88446E83F419257CF2D193" indent="up1"><enum>(bb)</enum><text>if the public housing agency for or owner of the covered housing, without any further delay in occupancy or increase in rent, provides the family with another dwelling unit in the covered housing that has no lead-based paint hazards; and</text></item><item id="H89E8A99C88864C99A2865F891E8612F7" indent="up1"><enum>(cc)</enum><text>the common areas servicing the new dwelling unit have no lead-based paint hazards; and</text></item></subclause><subclause id="HFB335E1842D9445DA15B9D03344444F6" display-inline="no-display-inline"><enum>(IV)</enum><text>if the covered housing is in compliance with the schedule for risk assessment under the program under which assistance is provided for the housing and such schedule provides that the period of time between the most recent assessment and the next assessment will not exceed 24 months.</text></subclause></clause></subparagraph><subparagraph id="H9280C55931204FD7BF7D4859EBE95D7A"><enum>(B)</enum><header>Relocation</header><text>Not later than 180 days after the date of enactment of the <short-title>Lead-Safe Housing for Kids Act of 2020</short-title>, the Secretary shall promulgate regulations to provide that a family with a child of less than 6 years of age that occupies a dwelling unit in covered housing in which lead-based paint hazards were identified, but not controlled in accordance with regulations required under clause (ii), may relocate on an emergency basis and without placement on any waiting list, penalty (including rent payments to be made for that dwelling unit), or lapse in assistance to another dwelling unit in covered housing that has no lead-based paint hazards.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HA02BE74F9B6D4D0CBB13C480290E4504" commented="no"><enum>4.</enum><header>Demonstration program for tenant-based housing</header><subsection id="H3200FE8F08B54AA498BD6024EB26F5E1" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this Act, the Secretary of Housing and Urban Development shall establish and implement a demonstration program under which—</text><paragraph id="HA783E4F8BCE542A2A1D8382F383F2F4B"><enum>(1)</enum><text>an owner of a dwelling for which tenant-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) is provided and in which a child of less than 6 years of age will reside or is expected to reside shall conduct, and cover the costs of, an initial risk assessment for lead-based paint hazards in such housing;</text></paragraph><paragraph id="H3A81492BFB344AD39720BBEBEEB68E20"><enum>(2)</enum><text>the Secretary shall cover the costs of abatement of any lead-based paint hazards identified pursuant to risk assessments paid for as provided under paragraph (1); and</text></paragraph><paragraph id="HDC699CA0A8E44AECA7E323A1EF21C7B9"><enum>(3)</enum><text>the owner of any dwelling unit for which abatement activities are conducted pursuant to paragraph (2) is required, for a period to be determined by the Secretary based on the cost or percentage of the cost of such abatement activities covered by the Secretary, to rent the dwelling unit only to a household assisted with tenant-based rental assistance under such section 8.</text></paragraph></subsection><subsection id="H64FB1034AC3241D391679B4168521548"><enum>(b)</enum><header>Procedures and requirements</header><text>Under the demonstration program, the Secretary shall establish procedures and requirements with respect to housing covered by the demonstration program that are similar to the procedures and requirements applicable under paragraph (1) of section 302(a) of the Lead-Based Paint Poisoning Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4822">42 U.S.C. 4822(a)(1)</external-xref>) to housing covered by such paragraph, except as otherwise modified by this section.</text></subsection><subsection id="H4954AE5685D940D09677F52D40C2CB04"><enum>(c)</enum><header>Geographical diversity</header><text display-inline="yes-display-inline">The Secretary shall carry out the demonstration program under this section in a variety of locations having high rates of lead poisoning, including urban areas and rural areas, in a manner that ensures geographically diversity of housing assisted under the program.</text></subsection><subsection id="H9AC88535172542A78AF9374DC6A576B5"><enum>(d)</enum><header>Coordination</header><text display-inline="yes-display-inline">Public housing agencies providing rental assistance for dwelling units participating in the demonstration program under this section shall coordinate with local public health agencies to determine if such dwelling units had a previous history of lead poisoning and if that lead poisoning was reported to the public housing agency.</text></subsection><subsection id="H28A9D8CDBBD643E3AFEF4717BE1FC684" commented="no"><enum>(e)</enum><header>Monitoring; reporting</header><paragraph id="H92B6A967B0B94BD1A7DB8ECE56AE0849"><enum>(1)</enum><header>Monitoring</header><text display-inline="yes-display-inline">The Secretary shall monitor the extent of landlord compliance and participation under the demonstration program under this section and shall assess the relationships between the period of affordability required under subsection (a)(2), the amount or portion of the cost of abatement activities covered by the Secretary pursuant to such subsection, and the level of participation in the demonstration program by landlords.</text></paragraph><paragraph id="HB68ECD1E6EF14648A29C60F451711871"><enum>(2)</enum><header>Annual reports</header><text>The Secretary shall submit a report annually to the Congress on landlord compliance and participation in the demonstration program. Each such report shall identify any changes in the rate of landlord compliance and participation from year to year and from immediately before the implementation of the demonstration program to the time of such report, and shall include an analysis of whether and the extent to which the availability of dwelling units to be assisted with tenant-based rental assistance under section 8 of the United States Housing Act of 1937 is restricted or limited based on race, color, religion, sex, disability, familial status, or national origin in any manner that does not comply with the Fair Housing Act.</text></paragraph><paragraph id="HC5E08FC757D74F9F8B00C7BCC1E72277"><enum>(3)</enum><header>Involvement of Office of Fair Housing and Equal Opportunity</header><text display-inline="yes-display-inline">In conducting monitoring pursuant to paragraph (1) and preparing reports pursuant to paragraph (2), the Secretary shall involve and consult with the Office of Fair Housing and Equal Opportunity.</text></paragraph><paragraph id="H311AED52EE254D268941F0703AA29C36"><enum>(4)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than the expiration of the 6-month period beginning upon the termination of the demonstration program under subsection (h), the Secretary shall submit a final report on the program to the Congress that shall include the following information:</text><subparagraph id="HF7804C1C03B54CC3A281017661B23465"><enum>(A)</enum><header>Annual report information</header><text>All information required to be submitted pursuant to paragraph (2) in each annual report under such paragraph.</text></subparagraph><subparagraph id="HB71BA212D81A4E10AB5D0062AF47F25E"><enum>(B)</enum><header>Effectiveness in preventing lead poisoning</header><text>Identification of—</text><clause id="H5BC1690A5D1B4E598F34E41CBBC50B09"><enum>(i)</enum><text>the overall number of dwelling units where a risk assessment identified a lead hazard before a child under age six occupied the unit; and</text></clause><clause id="HA7AF223E7273417386CF4E84ADFA9EA8"><enum>(ii)</enum><text>if feasible, for each dwelling with such an identified lead hazard—</text><subclause id="H917BA401E8E34E73A859D497C79D4AFE"><enum>(I)</enum><text>whether the unit had visual signs of a lead hazard or had previously passed a visual inspection; and</text></subclause><subclause id="HB07E63E8DED8428DB0ABB7B09A334F5A"><enum>(II)</enum><text>any documented cases of lead poisoning in children previously residing in the dwelling unit.</text></subclause></clause></subparagraph><subparagraph id="HAEBAF6328E1840BAA486CC02A514305A"><enum>(C)</enum><header>Actual cost</header><text>Identification of—</text><clause id="HDF842772E26C4EBC9CDA16DE691BAC02"><enum>(i)</enum><text>the actual cost of conducting pre-occupancy risk assessments of dwelling units, including the varying cost based on the age, building type, and location of the unit;</text></clause><clause id="H5C1A1D4706344891AA58ABDE8D1F0458"><enum>(ii)</enum><text>the actual cost of lead-based paint hazard control activities conducted after a risk assessment that indicated the presence of a lead-based paint hazard in the participating units; and</text></clause><clause id="H23EF01FABFE142CAB15AD49AC196B0CA"><enum>(iii)</enum><text>the actual cost of the clearance examination conducted after completion of lead-based paint hazard control activities.</text></clause></subparagraph><subparagraph id="H46F4B8E7D5264D35AAC52DD72B91D50F"><enum>(D)</enum><header>Participating tenants</header><text>Identification of—</text><clause id="H0619100B629549238603A449582C240A"><enum>(i)</enum><text display-inline="yes-display-inline">the number, age, race, and ethnicity of children who would have lived in dwelling units where a lead hazard was discovered after a pre-occupancy risk assessment; and</text></clause><clause id="H997A4DCDBCB0461D8E8C8A91AE44B72D"><enum>(ii)</enum><text display-inline="yes-display-inline">the number, age, race, and ethnicity of children residing in dwelling units in buildings in which a participating dwelling unit having a lead-based paint hazard is located.</text></clause></subparagraph><subparagraph id="HC605A95ED47C4D7A98034430D3259431"><enum>(E)</enum><header>Participating Units</header><text>Identification of—</text><clause id="H2DF4F5044BCB423397119F063DA7BDF7"><enum>(i)</enum><text>the age of participating dwelling units;</text></clause><clause id="HBAF50B3E9A634F6E9EE74AC5F8277792"><enum>(ii)</enum><text>the block in which participating units are located and, if not available, the census tract in which participating units are located;</text></clause><clause id="HE97687BEFAA540E9852344C3F65BFF6B"><enum>(iii)</enum><text>the type of building in which participating units are located; and</text></clause><clause id="HC94E6BDC76E0490C917A09B083881CD6"><enum>(iv)</enum><text>the number of participating units in which a lead-based paint hazard was discovered.</text></clause></subparagraph><subparagraph id="H094867E51D414A37A3331FAAA8C45933"><enum>(F)</enum><header>Risk assessments</header><text>Identification of—</text><clause id="HFC133314CFA842AE854AAD4F3E10C579"><enum>(i)</enum><text display-inline="yes-display-inline">the number of inspectors available in each locality to conduct risk assessments under the program;</text></clause><clause id="H7C296189CBB04D34860834B9CFCF59DE"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of time elapsed from making of a request for a risk assessment until completion of the assessment; and</text></clause><clause id="HCFE30DA5A49044DCB6B4CF79AFD64699"><enum>(iii)</enum><text>the agency employing each inspector.</text></clause></subparagraph></paragraph></subsection><subsection id="HA35660BE11634E5DA2DD79A28BED9448"><enum>(f)</enum><header>Public availability of information</header><text>The Secretary shall make information collected pursuant to the demonstration program under this section publicly available on the website of the Department in a manner that does not provide any personally identifiable information regarding individuals or households participating in the program.</text></subsection><subsection id="HA1D1A1DD1AFC4BB89C07ACF35041E81A" commented="no"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section, the terms <term>risk assessment</term>, <quote>inspection</quote>, <quote>interim controls</quote>, and <quote>lead-based paint hazard</quote> have the same meaning given such terms in section 1004 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/4851b">42 U.S.C. 4851b</external-xref>).</text></subsection><subsection id="HFF5920C1380A4F15888C8F081281DFC4" commented="no"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $50,000,000 for fiscal years 2021 through 2025 to carry out this section.</text></subsection><subsection id="H27F9361B6E3A425F905A7CEE0401680F" commented="no"><enum>(i)</enum><header>Termination</header><text>The demonstration program established under this section shall terminate 5 years after the date of the enactment of this Act.</text></subsection></section><section id="H88FED7AD9F9A4884BD7072F96DA255B2"><enum>5.</enum><header>Risk assessments</header><text display-inline="no-display-inline">Paragraph (25) of section 1004 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/4851b">42 U.S.C. 4851b(25)</external-xref>) is amended—</text><paragraph id="HAFF8279A3EF04D1996D0D0801E305F7B"><enum>(1)</enum><text>by redesignating subparagraph (E) as subparagraph (G); and</text></paragraph><paragraph id="HE7CBF06FAA8A45CFB3D0468AC14B4420"><enum>(2)</enum><text>by striking subparagraphs (C) and (D) and inserting the following new subparagraphs:</text><quoted-block style="OLC" id="H0CD80FA3B1584CC3BAB6F834DD1A5063" display-inline="no-display-inline"><subparagraph id="HA17B1423C0F044BE9EB6BC8D6BA8222C"><enum>(C)</enum><text display-inline="yes-display-inline">dust sampling;</text></subparagraph><subparagraph id="H9A7FC622176E445CA9B0364B8D09D2E5"><enum>(D)</enum><text>soil sampling;</text></subparagraph><subparagraph id="H1F6E38A1D27146D18F21CCD1F2A778B0"><enum>(E)</enum><text>paint testing;</text></subparagraph><subparagraph id="HCCD199E107AE4677863F58B78DD835E9"><enum>(F)</enum><text>water testing; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H16898B3FE7B04C6DB75F0F6C9C19843F"><enum>6.</enum><header>Notice to assisted families regarding fair housing rights and lead-based paint</header><text display-inline="no-display-inline">Subtitle F of title V of the Quality Housing and Work Responsibility Act of 1998 is amended—</text><paragraph id="H93C4B3CCD39E4E18BABBE76E23956078"><enum>(1)</enum><text display-inline="yes-display-inline">in section 578(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/13663">42 U.S.C. 13663(c)</external-xref>), by striking <quote>section 579(a)(2)</quote> and inserting <quote>section 580(a)(2)</quote>; </text></paragraph><paragraph id="H119C9E4C92F7415DB84707F428C4E18F"><enum>(2)</enum><text>by redesignating section 579 (<external-xref legal-doc="usc" parsable-cite="usc/42/13664">42 U.S.C. 13664</external-xref>) as section 580; and</text></paragraph><paragraph id="HF892D57876B94CA08325461C18C824A5"><enum>(3)</enum><text>by inserting after section 578 (<external-xref legal-doc="usc" parsable-cite="usc/42/13663">42 U.S.C. 13663</external-xref>) the following new section:</text><quoted-block style="OLC" id="H0D3EF587F58D4C3998EF1688DD63E961" display-inline="no-display-inline"><section id="H3EF4AD78A7BB4262BAD4EC01A0BD1C5F"><enum>579.</enum><header>Notice to assisted families regarding fair housing rights and lead-based paint</header><subsection id="H0ABD699117704234B6F67C6B6ED5BB01"><enum>(a)</enum><header>Required provision</header><text display-inline="yes-display-inline">The Secretary shall require each public housing agency and owner of housing described in subsection (d) to provide written notice under subsection (b) to each—</text><paragraph id="HF2B36AA2E8D4406CB7E18C9CCEB09C95"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF88E7C3A188C47298E5593883CE5A993"><enum>(A)</enum><text>applicant who is selected from the waiting list for admission to such federally assisted housing or to such a federally assisted housing program; and</text></subparagraph><subparagraph id="HC98236E6DD454FFA9A2894435FD38CE9" indent="up1"><enum>(B)</enum><text>assisted family who moves to a different such federally assisted housing dwelling unit; and</text></subparagraph></paragraph><paragraph id="HBC0B5F57F9AC42EBACCEDDCF56EE0D62"><enum>(2)</enum><text>whose household at the time of such selection or move, includes a child of less than 6 years of age who will reside or is expected to reside in such housing.</text></paragraph></subsection><subsection id="HB5A57E3443C542DF912DBEF84CD29BD0"><enum>(b)</enum><header>Contents; timing</header><text display-inline="yes-display-inline">Written notice under this subsection shall be notice, in the form developed under subsection (c) that is provided at the time of the selection or move, as applicable, described in subsection (a)(1), that includes information sufficient to describe to the applicant or assisted family—</text><paragraph id="HF09224BFDDC74FD6A5F5A258C7CE330B"><enum>(1)</enum><text display-inline="yes-display-inline">the adverse health effects lead poisoning can have on individuals and particularly on children;</text></paragraph><paragraph id="HE869AFF7426C4308A44D307515500208"><enum>(2)</enum><text>their rights under the Fair Housing Act and other applicable State or local laws regarding fair housing, including how to report housing discrimination violations under such Act and laws;</text></paragraph><paragraph id="HD7FCA7810767428EAD7C20AC2D4A5802"><enum>(3)</enum><text>the extent of the owner’s responsibility to ensure that their housing is controlled for lead-based paint;</text></paragraph><paragraph id="H9B745CB5260F4A819D0201729A086D9F"><enum>(4)</enum><text display-inline="yes-display-inline">that the responsibility described pursuant to paragraph (2) should not limit the ability of the applicant or assisted family to secure federally assisted housing based on Fair Housing rights under such paragraph; and</text></paragraph><paragraph id="HDBB0D45B71544317B958F86F1F46DFBD"><enum>(5)</enum><text display-inline="yes-display-inline">that all children enrolled in Medicaid, including children enrolled for medical assistance under a State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) (or a waiver of such a plan) and children enrolled for child health assistance under a State child health plan under title XXI of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa</external-xref> et seq.) (or a waiver of such a plan), are required to receive blood lead screening tests at ages 12 months and 24 months and that, in addition, any child between 24 and 72 months with no record of a previous blood lead screening test must receive such a screening test.</text></paragraph></subsection><subsection id="H4D39FBDE73F846E1923CD77AD0F032CF"><enum>(c)</enum><header>Standard form</header><text display-inline="yes-display-inline">The Secretary shall develop a standard form of the notice required under this section that complies with all of the requirements of this section and shall make such standard form available to public housing agencies and owners of federally assisted housing to facilitate compliance with the requirements this section.</text></subsection><subsection id="HBE30488E23B446EA8692CDF04AF3E293"><enum>(d)</enum><header>Covered housing programs</header><text display-inline="yes-display-inline">Housing described in this subsection is housing that is—</text><paragraph id="H42BF3BD771FF4F518FBD8E947385AD05"><enum>(1)</enum><text>specified in subparagraph (A), (B), (C), or (F) of section 580(a)(1); or</text></paragraph><paragraph id="HA8C9EEA8BBB249B09F01C2BCB2FFF1CB"><enum>(2)</enum><text display-inline="yes-display-inline">assisted under the Housing Opportunities for Persons With AIDS under subtitle D of title VIII of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12901">42 U.S.C. 12901</external-xref> et seq.)</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="H032D644AF0AF41D4B97DC692970DE22F" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out the amendments made by section 2 such sums as may be necessary for each of fiscal years 2020 through 2024 for—</text><paragraph id="H0FCF56AA228145E895EA6AF44CC68A25"><enum>(1)</enum><text display-inline="yes-display-inline">covering administrative costs of public housing agencies and other owners of covered housing in complying with such amendments, including cost of providing notice under section 302(a)(4)(A)(ii)(III)(bb) of the Lead-Based Paint Poisoning Prevention Act (as added by the amendment made by section 2(2) of this Act) and section 579 of the Quality Housing and Work Responsibility Act of 1998 (as added by section 5(3) of this Act);</text></paragraph><paragraph id="H3933C5F9E84C4455B67C98AFBD131F3C"><enum>(2)</enum><text display-inline="yes-display-inline">costs of the Department of Housing and Urban Development for training individuals to conduct risk assessments to be conducted under section 302(a) of the Lead-Based Paint Poisoning Prevention Act and under the demonstration program under section 4 of this Act; </text></paragraph><paragraph id="HEB85502BFB784973BC378D42FF306910"><enum>(3)</enum><text display-inline="yes-display-inline">the Office of Fair Housing and Equal Opportunity of the Department of Housing and Urban Development—</text><subparagraph id="HBA76F012E359485DB82EA9D8C7B7DE31"><enum>(A)</enum><text>for carrying out a national education campaign regarding lead-based paint on Fair Housing Act protections and for tenant outreach and landlord engagement; and</text></subparagraph><subparagraph id="H9153AEAC92BA46718E06852606A3E60C"><enum>(B)</enum><text display-inline="yes-display-inline">for enforcement activities, including activities under the Fair Housing Initiatives Program under section 561 of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a</external-xref>); and</text></subparagraph></paragraph><paragraph id="HFCCD80040A8E43C99FA770B732CA8BA8"><enum>(4)</enum><text display-inline="yes-display-inline">the Secretary of Housing and Urban Development to conduct a study of universal lead abatement that is phased in over time.</text></paragraph></section></legis-body></bill>
