R. 8708</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20201030">October 30, 2020</action-date><action-desc><sponsor name-id="E000299">Ms. Escobar</sponsor> (for herself, <cosponsor name-id="W000810">Mr. Woodall</cosponsor>, and <cosponsor name-id="S001200">Mr. Soto</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to promote family unity, and for other purposes.</official-title></form><legis-body id="HB3E699364F004D88BD25B200A70E930E" style="OLC"><section id="H70DE12543DA8474792138ED3D5DDCA31" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Families United Act</short-title></quote>.</text></section><section id="H40428FCC3A1F45C0A35E7AD30D2EEEFE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H2AAABC5DDBF345D792C2CBC2C6214971"><enum>(1)</enum><text>The rights and interests of U.S. citizens should be protected by our Nation’s immigration laws.</text></paragraph><paragraph id="H1DED6715A1B743A89F177D0422272665"><enum>(2)</enum><text>It is the intent of Congress to provide the Attorney General and Secretary of Homeland Security with the limited ability to exercise their discretion in favor of the spouses, children, and parents of American citizens in immigration proceedings, on a case-by-case basis, to ensure fairness and prevent hardships associated with family separation.</text></paragraph></section><section id="H05E71C4A025E430DA8B114088BF032CF"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to provide the Attorney General or the Secretary of Homeland Security with the ability to exercise the discretionary authority provided in this Act, except on a case-by-case basis.</text></section><section id="H76096399C4704704A2DB3C076EA43549"><enum>4</enum><header>Definition of conviction</header><paragraph id="HF6E0E7BC85EE403C98A4DCAB99027CB6"><enum>(1)</enum><header>In general</header><text>Section 101(a)(48) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(48)</external-xref>) is amended by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block id="HBC3E50ACB22347FCB783D9B16B7AD5E0" style="OLC"><subparagraph id="H3A6CBF0A81474E4C8957CEF7CB2D5095"><enum>(A)</enum><text>The term <quote>conviction</quote> means, with respect to an alien, a final, formal judgment of guilt entered by a court. A State or Federal court adjudication or judgment of guilt that has been withheld, deferred, expunged, annulled, invalidated, or vacated; an order of probation without entry of judgment; or any similar disposition under State or Federal law shall not be considered a conviction for purposes of the immigration laws.</text></subparagraph><subparagraph id="H9D9CCC2079AB4CC4AAFD100FF7BD6A19"><enum>(B)</enum><text>A pardon entered by a State or Federal authority shall render the underlying conviction null and void for purposes of the immigration laws.</text></subparagraph><subparagraph id="H8CDFCD53791E4D8DBB754873DB5E8871"><enum>(C)</enum><text>Any reference to a term of imprisonment or sentence with respect to an offense is deemed to include only the actual period of incarceration or confinement ordered by a court of law. The suspension of the imposition or execution of a term of imprisonment or sentence in whole or in part shall not be included as a part of the sentence for purposes of the immigration laws.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H83F88CF05D004E5B9FFEB396C02DB413"><enum>(2)</enum><header>Effective date and application</header><text>The amendments made by paragraph (1) shall take effect on the date of the enactment of this Act and shall apply to convictions and sentences entered before, on, or after the date of the enactment of this Act.</text></paragraph></section><section id="HF6620B3FF4D6442EBFE9A8C2A79A462B"><enum>5.</enum><header>Discretionary authority with respect to removal, deportation, ineligibility or inadmissibility of citizen family members</header><subsection id="H296A3D28219340188DA12EB44D508BC5"><enum>(a)</enum><header>Applications for relief from removal</header><text>Section 240(c)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(c)(4)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HFB018D22E9454CA89B0AC86AF090A3C2" style="OLC"><subparagraph id="HE31F8A6FC10846BB9B6755620254F4E6"><enum>(D)</enum><header>Judicial discretion</header><clause id="H8845AEE6798A459F840C1AE1253EF12B"><enum>(i)</enum><header>In general</header><text>In the case of an alien subject to removal, deportation, or exclusion proceedings, the Attorney General may, for reasons described in clause (ii)—</text><subclause id="H247AD5FA787E45EABFE69A435F0868F4"><enum>(I)</enum><text>decline to order such alien removed, deported, or excluded from the United States;</text></subclause><subclause id="H8A7675E2237246CE9D167114FF543F67"><enum>(II)</enum><text>terminate such removal, deportation, or exclusion proceedings; and</text></subclause><subclause id="HCC7B588B55EF485CA241B365C83597D3"><enum>(III)</enum><text>grant such alien permission to reapply for admission to the United States or any other application for relief from removal.</text></subclause></clause><clause id="HE9BDB9C5F86843358B896764EFFDEAE8"><enum>(ii)</enum><header>Limitation on discretion</header><text>The Attorney General may exercise the discretion described in clause (i)—</text><subclause id="H77453040DA5349989E2C1D3554FDE91E"><enum>(I)</enum><text>for humanitarian purposes; or</text></subclause><subclause id="HBF2BDE455D5248B995DBE53EE0416E72"><enum>(II)</enum><text>to preserve family unity in the United States if the alien is—</text><item id="H83DC7E6988E7497485FB9D0B928502F0"><enum>(aa)</enum><text>the spouse of a United States citizen; or</text></item><item id="HF951D425633344A98335487EB201F202"><enum>(bb)</enum><text>the parent of a United States citizen child and such child’s other parent is a United States citizen or was a United States citizen at the time of such other parent’s death.</text></item></subclause></clause><clause id="H1422C108373846D8A9675A52A04C2C17"><enum>(iii)</enum><header>Exclusions</header><text>This subparagraph shall not apply to an alien whom the Attorney General determines—</text><subclause id="id16129FAC16BB489A96F3FF2F55F8E388"><enum>(I)</enum><text>is inadmissible or deportable under—</text><item id="id1C182C4E42BB4E64B432903C8FF306BB"><enum>(aa)</enum><text>subparagraph (B), (C), (D)(ii), (E), (H), or (I) of section 212(a)(2);</text></item><item id="id4914478CA9D443E1BE4AB38C1AE33AB0"><enum>(bb)</enum><text>section 212(a)(3);</text></item><item id="id20B08B7C618D4CC3AD55E688CEC8376D"><enum>(cc)</enum><text>subparagraph (A), (C), or (D) of section 212(a)(10); or</text></item><item id="idB2D0311592EA4671957A889C49438512"><enum>(dd)</enum><text>paragraph (2)(A)(ii), (2)(A)(v), (2)(F), (4), or (6) of section 237(a); or</text></item></subclause><subclause id="id8E0E6F112F414F8CA595EAF3EA746CED"><enum>(II)</enum><text>has—</text><item id="id9A59FF4DB98449F1824CDBABAEF3FAF9"><enum>(aa)</enum><text>been convicted of conduct described in paragraph (8), (11), or (12) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>); or</text></item><item id="id3D680B162CF4449AB558DB626ADAAA24"><enum>(bb)</enum><text>a felony conviction described in section 101(a)(43) that would have been classified as an aggravated felony at the time of conviction.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4A76C86DBD4A46DFB8AE869C1CF161E0"><enum>(b)</enum><header>Secretary’s discretion</header><text>Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended—</text><paragraph id="H986505A377A64006BFC9EEC5B27784EB"><enum>(1)</enum><text>by redesignating the second subsection (t) as subsection (u); and</text></paragraph><paragraph id="HFE7845225D334E37BCFACB86B80F4C6C"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H26E566C1D2BD44E2BEDD581EF04FA973" style="OLC"><subsection id="H26713B85564845F8A5087310D0CE1E58"><enum>(v)</enum><header>Secretary’s discretion</header><paragraph id="HABDE8DC104A6492ABEF4A427545133D6"><enum>(1)</enum><header>In general</header><text>In the case of an alien who is inadmissible under subsection (a), deportable under section 237, or ineligible for any immigration benefit or relief under the immigration laws, the Secretary of Homeland Security may, for reasons described in paragraph (2)—</text><subparagraph id="H301E9C23C7E94988A0E2F49678247A8D"><enum>(A)</enum><text>and subject to paragraph (3), waive one or more grounds of inadmissibility or deportability;</text></subparagraph><subparagraph id="HD965BEE12E694C709C6ED29269B6ABE5"><enum>(B)</enum><text>decline to issue a notice to appear requiring such an alien to appear in a removal proceeding;</text></subparagraph><subparagraph id="H28146AA4803D483A9A1F18EACA2A6A37"><enum>(C)</enum><text>decline to reinstate an order of removal under section 241(a)(5); and</text></subparagraph><subparagraph id="H8E7D6C14E4584DCEA5F04443810DE3B1"><enum>(D)</enum><text>grant such an alien permission to reapply for admission to the United States or any other application for immigration benefits.</text></subparagraph></paragraph><paragraph id="HB68464C62BE248078045DEB1878CE974"><enum>(2)</enum><header>Limitation on discretion</header><text>The Secretary of Homeland Security may exercise the discretion described in clause (i)—</text><subparagraph id="H945A4DC5EF034406A7E98D97B6C323ED"><enum>(A)</enum><text>for humanitarian purposes; or</text></subparagraph><subparagraph id="HB5BEE67A8B724DBB8D9D5E344F75CBFD"><enum>(B)</enum><text>to preserve family unity in the United States if the alien is—</text><clause id="HA246F2DB07434064A2825971587F47CD"><enum>(i)</enum><text>the spouse of a United States citizen; or</text></clause><clause id="H0FFDCBDA5D3F41C89E72177A4C10F70A"><enum>(ii)</enum><text>the parent of a United States citizen child and such child’s other parent is a United States citizen or was a United States citizen at the time of such other parent’s death.</text></clause></subparagraph></paragraph><paragraph id="H33C0EE6A764C4164A499DDD51DA74FD8"><enum>(3)</enum><text>This subsection shall not apply to an alien whom the Secretary determines—</text><subparagraph id="HD83EBFBB131649D391E06F6DD56D905B"><enum>(A)</enum><text>is inadmissible or deportable under—</text><clause id="H39C0B73CBB4F404EB5E306AEC01B8377"><enum>(i)</enum><text>subparagraph (B), (C), (D)(ii), (E), (H), or (I) of subsection (a)(2);</text></clause><clause id="H186F7AF2442F401B91A5C0B2C7BC8F30"><enum>(ii)</enum><text>subsection (a)(3);</text></clause><clause id="H530649F406A245579A19CD219D1AC651"><enum>(iii)</enum><text>subparagraph (A), (C), or (D) of subsection (a)(10); or</text></clause><clause id="HB813166B6BF84DB486687A7A9D26D9FD"><enum>(iv)</enum><text>paragraph (2)(A)(ii), (2)(A)(v), (2)(F), or (6) of section 237(a); or</text></clause></subparagraph><subparagraph id="H146EC4031C434CD2A0998103C920412A"><enum>(B)</enum><text>has—</text><clause id="HD134DC430BD344D0A173633E9886B69D"><enum>(i)</enum><text>been convicted of conduct described in paragraph (8), (11), or (12) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>); or</text></clause><clause id="HF89E911ED0A14DF78B0D6144D5AF67E1"><enum>(ii)</enum><text>a felony conviction described in section 101(a)(43) that would have been classified as an aggravated felony at the time of conviction;</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
