R. 8552</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20201009">October 9, 2020</action-date><action-desc><sponsor name-id="C001090">Mr. Cartwright</sponsor> (for himself, <cosponsor name-id="S001204">Mr. San Nicolas</cosponsor>, and <cosponsor name-id="B001278">Ms. Bonamici</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to require institutions of higher education to establish record-management plans in order to be accredited or continue to be accredited, and for other purposes.</official-title></form><legis-body id="HD629B9C707314FC2B82E0DBF7EC2C060" style="OLC"><section id="H437AA3F0E874452F86B4F85472C444AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Records Protection Act</short-title></quote>. </text></section><section id="HCC557FFCE23743FEB9DD1972EA4FEE72"><enum>2.</enum><header>Record-management plans required</header><subsection id="HD12A5D14DB37416BA617A70748ED262E"><enum>(a)</enum><header>Accrediting requirements</header><text display-inline="yes-display-inline">Section 496(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b(c)</external-xref>) is amended—</text><paragraph id="HFB11C37B980C4F35B0BA15C7679A703F"><enum>(1)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H44A695521439452B857051D4B8312FFA"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H81F7CB05005B434B8C1619884DB10F18"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="HC23D188055524634A578C1B53D386970" style="OLC"><paragraph id="H5590C87C3B2A426D8D14EDC82B43AFF7"><enum>(10)</enum><text display-inline="yes-display-inline">beginning on the date that is 5 years after the date of the enactment of this paragraph, requires an institution to submit for approval to the accrediting agency a records management plan upon the institution’s notifying the accrediting agency that the institution intends to cease operations. Such plan shall include—</text><subparagraph id="HB8801A1AB51A4E30A9CFC50DCE7EF736"><enum>(A)</enum><text display-inline="yes-display-inline">a plan for the custody, continued access, and disposition of student records, including student transcripts, billing, and financial aid records; </text></subparagraph><subparagraph id="H6675D183B5A44108A511784748D6BC82" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a plan to provide to the Secretary, State authorizing agency, and such accrediting agency or association a list that includes the name and contact information of each student enrolled in such institution—</text><clause id="H15C84192B25C45589A61C3A50C098941"><enum>(i)</enum><text>on the date such institution closed;</text></clause><clause id="H73FF6E23837A49D198FF730BC15C9518"><enum>(ii)</enum><text>on the date that is 120 days before the date described in clause (i); and</text></clause><clause id="HF0A79C3E97BA4AFE8A6B978BD673C7B3"><enum>(iii)</enum><text>on the date that is 180 days before the date described in clause (i); </text></clause></subparagraph><subparagraph id="H19E6B2171D7B4C5F9E98C0246BF5E966"><enum>(C)</enum><text>an assurance from the institution that such institution—</text><clause id="HDC2B3F1919034615A6E2C0519FC18208"><enum>(i)</enum><text>will release all financial holds placed on student records; </text></clause><clause id="H6477065117EE4D42B0313970F4CE6343"><enum>(ii)</enum><text>for the 1-year period beginning on the date of the closure of such institution, will not require any student or former student who requests the student records of such student to purchase such records or otherwise charge such student a fee with respect to such records; and</text></clause><clause id="H101758BF8A4C45B98F1C963336871E3C"><enum>(iii)</enum><text>after the 1-year period described in clause (ii), will either continue to not require the purchase of the records described in such subclause or charge a nominal fee with respect to such records, as determined by the Secretary; and</text></clause></subparagraph><subparagraph id="H8900143FADF540B78D46D393A39C9297"><enum>(D)</enum><text>an estimate of the costs necessary to carry out the record-management plan and a plan for how such institution will provide funding for such costs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6CD5BAB4C25648DCA9169456E2DD0B8A"><enum>(b)</enum><header>Program participation agreement</header><paragraph id="H29D78AFCA8E04CADA9F9EDF1BF8AA629" commented="no"><enum>(1)</enum><header>Amendment</header><text>Section 487(f)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(f)(1)</external-xref>) is amended by striking the period at the end and inserting <quote>and to prepare and submit to the Secretary a record-management plan that includes the information required under subparagraphs (A) through (D) of section 496(c)(10).</quote></text></paragraph><paragraph id="H3E98DB6E967946A6ABEA9A976E8BD86C"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date that is 6 months after the date of the enactment of this Act. </text></paragraph></subsection></section></legis-body></bill>
