which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Education to cancel or repay up to $25,000 in Federal student loans for each borrower.</official-title></form><legis-body id="HCBC537ADFC1F4DC999387AC61A3DA4F9" style="OLC"><section id="H8C78B5A741A642B9B407F620DAD6368B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Loan Relief Act</short-title></quote>. </text></section><section id="H95F678C191E14682AE4C38E4CF0B2B1F"><enum>2.</enum><header>Writing down balances for Federal student loan borrowers</header><subsection id="H9602C987C23C4B97B1F1CD3452543175"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall cancel or repay an amount on the outstanding balance due (including the unpaid principal amount, any accrued interest, and any fees or charges) on the Federal student loans of a borrower that is equal to the lesser of—</text><paragraph id="HF2B15ED3F2604739A1B9F504759CB434"><enum>(1)</enum><text>$25,000; or</text></paragraph><paragraph id="H40B5FFCBFF6446CF8759D49A8833E2D6"><enum>(2)</enum><text>the total outstanding balance due on such loans of the borrower.</text></paragraph></subsection><subsection id="HBE064414C3A646F8AD5EC88495896D23"><enum>(b)</enum><header>Application</header><text>Unless otherwise requested by the borrower in writing, a cancellation or repayment under subsection (a) shall be applied—</text><paragraph id="H4F20F587C92A4A079500DA8C59A35157"><enum>(1)</enum><text>in the case of a borrower whose loans have different applicable rates of interest, first toward the outstanding balance due on the loan with the highest applicable rate of interest among such loans; and</text></paragraph><paragraph id="HB53A6955680047708B7743ADD94BAE95"><enum>(2)</enum><text>in the case of a borrower of loans that have the same applicable rates of interest, first toward the outstanding balance of principal due on the loan with the highest principal balance among such loans.</text></paragraph></subsection><subsection id="H8D3EDD98AA1345499E36F7394E6FFEF1"><enum>(c)</enum><header>Data To implement</header><text>Contractors of the Secretary, and holders of Federal student loans, shall report, to the satisfaction of the Secretary the information necessary to carry out this section.</text></subsection><subsection id="H057842B9BE424D68ABB0D1E8FC2175A6"><enum>(d)</enum><header>Taxation</header><text>For purposes of the Internal Revenue Code of 1986, in the case of any cancellation or repayment of indebtedness under this subsection with respect to any borrower:</text><paragraph id="H3FB16C2819CD4590AD809547BA7BA437"><enum>(1)</enum><header>Exclusion from gross income</header><text>No amount shall be included in the gross income of such borrower by reason of such cancellation or repayment.</text></paragraph><paragraph id="HC551C3B7B8994A269408BCEB0C1C6A5E"><enum>(2)</enum><header>Waiver of information reporting requirements</header><text>Amounts excluded from gross income under paragraph (1) shall not be required to be reported (and shall not be taken into account in determining whether any reporting requirement applies) under chapter 61 of such Code.</text></paragraph></subsection><subsection id="H015E8B141F5C40BF900AF7AFDCE27F9F"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HD82390A020644307ADCF17C71A1470B7"><enum>(1)</enum><header>Federal student loan</header><text>The term <term>Federal student loan</term> means a loan—</text><subparagraph id="H937407D2CF0D4C619E5E57B6F3E3FE0E"><enum>(A)</enum><text>made under part B, part D, or part E of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1071">20 U.S.C. 1071</external-xref> et seq., 1087a et seq., 1087aa et seq.), and held by the Department of Education; or</text></subparagraph><subparagraph id="H6ACFDE3CC4194CAE93FC9C62E6784D33"><enum>(B)</enum><text>made, insured, or guaranteed under part B of the such title (<external-xref legal-doc="usc" parsable-cite="usc/20/1071">20 U.S.C. 1071</external-xref> et seq.), or made under part E of such title (<external-xref legal-doc="usc" parsable-cite="usc/20/1087qaa">20 U.S.C. 1087qaa</external-xref> seq.), and not held by the Department of Education.</text></subparagraph></paragraph><paragraph id="H82DACF5A632D43698F85AEC7E414B4FE"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education. </text></paragraph></subsection></section></legis-body></bill>
