Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reaffirm the critical role of congressional consultation and to require appropriate deliberation to assess the effects of the sale or export of major defense equipment to countries in the Middle East on the qualitative military edge of Israel, and for other purposes.</official-title></form><legis-body id="H1A81C1E5A82544DBBFDFE2754F7E8BDF" style="OLC"><section id="H00651A641B64495F813F9FDBED788991" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteeing Israel’s QME Act of 2020</short-title></quote>.</text></section><section id="HE94B545BD6F44083BEC3E1D38DD728CF"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HB1D2871F8ACF4E9FB6CC6561A44E5161"><enum>(1)</enum><text>The recent signing of the Abraham Accords and establishment of full diplomatic relations between United Arab Emirates and Bahrain with Israel represents a historic step towards perusing peace and security for all peoples in the Middle East region.</text></paragraph><paragraph id="HCDF743B08D764425BF9DB6B3195F6AA8"><enum>(2)</enum><text>Israel remains the most important and most reliable strategic ally of the United States in the Middle East.</text></paragraph><paragraph id="HCDD7C39763C44C5AA20424DF14A6872C"><enum>(3)</enum><text>The enactment of the United States-Israel Strategic Partnership Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/296">Public Law 113–296</external-xref>) established Israel as a major strategic partner of the United States.</text></paragraph><paragraph id="H9DC2FC8C98994B9D854CB5469A50DD07"><enum>(4)</enum><text>Certain countries and non-state actors in the Middle East region have been at war, both declared and undeclared, with Israel since its founding in 1948.</text></paragraph><paragraph id="H75C301ADE54F47699CB01ECCEE933239"><enum>(5)</enum><text>For more than 50 years, the United States has worked to ensure Israel’s qualitative military edge when considering the sale or export of defense articles and defense services to Israel or to others in the Middle East region.</text></paragraph><paragraph id="HABDC102CC4AE4DC7A8936C9BFC4D0D62"><enum>(6)</enum><text>Maintaining a substantial qualitative military edge is critical to preserving Israel’s safety and security, and has been a vital consideration in all previous sales of weapons to the region.</text></paragraph><paragraph id="H2676A160F45E4C9291F0E4D3652159D3"><enum>(7)</enum><text>Since 2008, the United States commitment to Israel’s qualitative military edge has been established and reaffirmed several times in law.</text></paragraph><paragraph id="H58DCAF3C3FBB458C8DC76E59D5476087"><enum>(8)</enum><text display-inline="yes-display-inline">In 2016, the United States and Israel signed a 10-year Memorandum of Understanding, in which the United States committed that <quote>the acquisition of additional U.S.-produced capabilities and technology provide the best means to ensure Israel preserves its Qualitative Military Edge (QME)</quote>.</text></paragraph></section><section id="H2B5B99C9AD4A4BC39918B083D3009085"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the President, consistent with long established United States law and in support of one of the most important United States allies, must ensure that any sale or export of defense articles or defense services to countries in the Middle East region does not in any way adversely affect Israel’s qualitative military edge.</text></section><section id="H6BE0CCE3DDB749D0A1527076F91B6F35"><enum>4.</enum><header>Additional assessment and consultation regarding Israel’s qualitative military edge</header><text display-inline="no-display-inline">Section 36(h) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776(h)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H04476BDC4776437082C168638317D189" style="OLC"><paragraph id="H0F73BCFC9B60432A9CB8157D31ADB3CF"><enum>(4)</enum><header>Consultation required</header><text>The President shall seek to consult with appropriate officials of the Government of Israel for information regarding Israel’s qualitative military edge before making a determination under paragraph (1).</text></paragraph><paragraph id="HE868713193094DFF91F889711FECBA62"><enum>(5)</enum><header>Initial determination with respect to letters of request</header><text display-inline="yes-display-inline">Not later than 60 days after the date of a letter of request for defense articles or defense services subject to this section, the President shall submit to Congress an unclassified determination with respect to the impact fulfilling such request would have on Israel’s qualitative military edge, and offer to provide supplemental classified briefing on such determination.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
