Definitions.</toc-entry></toc></subsection></section><section id="H8A6E09BF4B224AA884E5A22A4196CA72"><enum>2.</enum><header>Safety management systems</header><subsection id="H177116D281C84E3BA7F0971F4D8529BC"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall initiate a rulemaking proceeding to require each person who holds both a type certificate and a production certificate issued under section 44704 of title 49, United States Code, to adopt, not later than the earlier of the date that is 180 days after the issuance of the regulation required under this subsection or the date that is 4 years after the date of enactment of this Act, a safety management system consistent with the standards and recommended practices contained in annex 19 to the Convention on International Civil Aviation (61 Stat. 1180) in effect on the earlier of the date of the issuance of such regulations or the date that is 4 years after the date of enactment of this Act.</text></subsection><subsection id="H224E1D0B510D4FAF9D5D8B765C762443"><enum>(b)</enum><header>Contents of regulations</header><text>The regulations issued under subsection (a) shall, at a minimum, include provisions for the Administrator’s approval of, and regular oversight of adherence to, a certificate holder’s safety management system adopted pursuant to such regulations.</text></subsection><subsection id="HB1A7806276E84BE68C386D98BA8AA7FA"><enum>(c)</enum><header>Deadline</header><text>Not later than 12 months after the end of the comment period for the proposed rule issued pursuant to subsection (a), the Administrator shall issue a final rule with respect to such proposed rule.</text></subsection><subsection id="H71A505C36E4D4D7F8442384FA2C8AA1E"><enum>(d)</enum><header>Safety reporting program</header><text>The regulations issued under subsection (a) shall require a safety management system to include a confidential employee reporting system through which employees can report hazards, issues, concerns, occurrences, and incidents. A reporting system under this subsection shall include provisions for non-punitive reporting of such items by employees in a manner consistent with other confidential employee reporting systems administered by the Administrator. Such regulations shall also require a certificate holder described in subsection (a) to submit a summary of reports received under this subsection to the Administrator at least twice per year.</text></subsection><subsection id="HF7205695439142E99DD2B7E4108D8DC4"><enum>(e)</enum><header>Code of ethics</header><text>The regulations issued under subsection (a) shall require a safety management system to include establishment of a code of ethics applicable to all employees of a certificate holder, including officers, which clarifies that safety is the organization’s highest priority.</text></subsection><subsection id="H9734B54A6D6E4A5A85B6C27B7158AFAB"><enum>(f)</enum><header>Protection of safety information</header><text>Section 44735(a) of title 49, United States Code, is amended—</text><paragraph id="H7703DBE32F6D47D798A4AD2306E4707B" commented="no"><enum>(1)</enum><text>by striking <quote>title 5 if the report</quote> and inserting the following:</text><quoted-block style="USC" id="HBAF08490713842209C56DA4E676F6459" display-inline="yes-display-inline"><text>title 5—</text><paragraph id="H2726A2B97E3D4CC4A3BBE85F9F7091A4" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">if the report</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H1F1B5C7C451D4FC59E85B00DAF7DBB6C"><enum>(2)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H7400E653519F45C1BE6AA837AD2A43A3"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H9067785CEBBD47FC98A1C35861A5A9CF" style="USC"><paragraph id="HC4458C8305354B2F9F36037C58A83500"><enum>(2)</enum><text>if the report, data, or other information is submitted to the Federal Aviation Administration pursuant to section 2(d) of the <short-title>Aircraft Certification Reform and Accountability Act</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HCA031E0053D248AC84087B9881CAABD9"><enum>3.</enum><header>Expert review of organization designation authorizations for transport airplanes</header><subsection id="H503849BD9E814CF3AB9DA9D196AB8254"><enum>(a)</enum><header>Expert review</header><paragraph id="H6FB02163AFE3416BAAC1772F0A04DA75"><enum>(1)</enum><header>Establishment</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall convene an expert panel (in this section referred to as the <quote>review panel</quote>) to review and make findings and recommendations on the matters listed in paragraph (2).</text></paragraph><paragraph id="H4EFA43CCA3804EF8B34D3186AF4808F4"><enum>(2)</enum><header>Contents of review</header><text>With respect to each holder of an organization designation authorization for the design and production of transport airplanes, the review panel shall review the following:</text><subparagraph id="H872A58F15A464C778CDCE701684B29FF"><enum>(A)</enum><text>The extent to which the holder has implemented a safety culture consistent with the principles of the International Civil Aviation Organization Safety Management Manual, Fourth Edition (International Civil Aviation Organization Doc. No. 9589) or any similar successor document.</text></subparagraph><subparagraph id="H5D50A4D477BA4D49B3BD67A0513EC228"><enum>(B)</enum><text>The effectiveness of measures instituted by the holder to instill, among employees and contractors of such holder that support organization designation authorization functions, a commitment to safety above all other priorities.</text></subparagraph><subparagraph id="H18D669A3C4684EC9B52EBFABDA7BF361"><enum>(C)</enum><text>The holder’s capability, based on the holder’s organizational structures, requirements applicable to officers and employees of such holder, and safety culture, of making reasonable and appropriate decisions regarding functions delegated to the holder pursuant to the organization designation authorization.</text></subparagraph><subparagraph id="H3729B2A925B04ECAAC722F132B1A05AA"><enum>(D)</enum><text>Any other matter determined by the Administrator for which inclusion in the review would be consistent with the public interest in aviation safety.</text></subparagraph></paragraph><paragraph id="HFB5887CC355B4B63BC02219D352B2952"><enum>(3)</enum><header>Composition of review panel</header><text>The review panel shall consist of—</text><subparagraph id="HBB32622FEAB0436186F1C16687B5BB35"><enum>(A)</enum><text>2 representatives of the National Aeronautics and Space Administration;</text></subparagraph><subparagraph id="H5F5AE1ABD840408D8211B87509CDACA0"><enum>(B)</enum><text>2 employees of the Administration’s Aircraft Certification Service with experience conducting oversight of persons not involved in the design or production of transport airplanes;</text></subparagraph><subparagraph id="H3B9E6ECDABDC4E58BF67ECCDD04ED333"><enum>(C)</enum><text>1 employee of the Administration’s Aircraft Certification Service with experience conducting oversight of persons involved in the design or production of transport airplanes; </text></subparagraph><subparagraph id="H8686FADDC469428C966A667DCAABF1A4"><enum>(D)</enum><text>2 employees of the Administration’s Flight Standards Service with experience in oversight of safety management systems;</text></subparagraph><subparagraph id="HA4FFEE2A111B4C1290B42145D9351A13"><enum>(E)</enum><text>1 appropriately qualified representative, designated by the applicable represented organization, of each of—</text><clause id="HB30ED09F7F1F4487AFBDAE791F45D4AC"><enum>(i)</enum><text>a labor union representing airline pilots involved in both passenger and all-cargo operations;</text></clause><clause id="H810B46B55C284C8DA2DBF379072B34FB" commented="no"><enum>(ii)</enum><text>a labor union, not selected under clause (i), representing airline pilots with expertise in the matters described in paragraph (2); </text></clause><clause id="HCC44BC181C174F96B80348C2B7DAEF72"><enum>(iii)</enum><text>a labor union representing employees engaged in the assembly of transport airplanes;</text></clause><clause id="H8D069BD420AA4133958334194C1A65D9"><enum>(iv)</enum><text>the certified bargaining representative under section 7111 of title 5, United States Code, for field engineers engaged in the audit or oversight of an organization designation authorization within the Aircraft Certification Service of the Administration; and</text></clause><clause id="HA1F86D11CB724FD7890109F7538669A9"><enum>(v)</enum><text>the certified bargaining representative for safety inspectors of the Administration;</text></clause></subparagraph><subparagraph id="H304BDAEA56364C78AA33290BAF8F4AF0"><enum>(F)</enum><text>2 independent experts who have not served as a political appointee in the Administration and—</text><clause id="H00730EA7ACC548B188A7420BDC732E17"><enum>(i)</enum><text>who hold either a baccalaureate or postgraduate degree in the field of aerospace engineering or a related discipline; and</text></clause><clause id="H476EEDB150874704A87ECDAD05E3D161"><enum>(ii)</enum><text>who have a minimum of 20 years of relevant applied experience;</text></clause></subparagraph><subparagraph id="H7D44F60550F448A4BBA266EB18DAA9DF"><enum>(G)</enum><text>4 air carrier employees whose job responsibilities include administration of a safety management system; and</text></subparagraph><subparagraph id="H2722CC6E856849579828B74E6D49FFB5"><enum>(H)</enum><text>4 individuals representing 4 different holders of organization designation authorizations, with preference given to individuals representing holders of organization designation authorizations for the design or production of aircraft other than transport airplanes or for the design or production of aircraft engines, propellers, or appliances.</text></subparagraph></paragraph><paragraph id="H42E47AF9BA204800836F125FE0ABE5A1"><enum>(4)</enum><header>Recommendations</header><text>The review panel shall make recommendations to the Administrator regarding suggested actions to address any deficiencies found after review of the matters listed in paragraph (2).</text></paragraph><paragraph id="H94DC321D79B24CB990ACD1A31E57F6A9"><enum>(5)</enum><header>Report</header><subparagraph id="HD6104B51CAFA46C89E666967CB664492"><enum>(A)</enum><header>Submission</header><text>Not later than 270 days after the date on which the review panel is established, the review panel shall transmit to the Administrator and the congressional committees of jurisdiction a report containing the findings and recommendations of the review panel regarding the matters listed in paragraph (2), except that such report shall include—</text><clause id="HD01D16D063F74563A6E92D10539327FB"><enum>(i)</enum><text>only such findings endorsed by 10 or more individual members of the review panel; and</text></clause><clause id="HAF8951C25AEA426A960C8C4773FF2C81"><enum>(ii)</enum><text>only such recommendations described in paragraph (4) endorsed by 18 or more of the individual members of the review panel.</text></clause></subparagraph><subparagraph id="H8DB2DCBCCF334DB1886B9E7EBE0E5651"><enum>(B)</enum><header>Dissenting views</header><text>In submitting the report required under this paragraph, the review panel shall append to such report the dissenting views of any individual member or group of members of the review panel regarding the findings or recommendations of the review panel.</text></subparagraph><subparagraph id="H2C35AFFF9C314AAE8B8B9FC1640960D3"><enum>(C)</enum><header>Publication</header><text>Not later than 5 days after receiving the report under subparagraph (A), the Administrator shall publish such report, including any dissenting views appended to the report, on the website of the Administration.</text></subparagraph><subparagraph id="H8952CBF4AF564A3EBC6325F9E9868D9B"><enum>(D)</enum><header>Termination</header><text>The review panel shall terminate upon submission of the report under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H63DA67FB4C2B45598B8E3D0909AE2475"><enum>(6)</enum><header>Administrative provisions</header><subparagraph id="HCB8735DFC84B464DBE679A7B67F0350D"><enum>(A)</enum><header>Access to information</header><text>The review panel shall have authority to perform the following actions if a majority of the total number of review panel members consider each action necessary and appropriate:</text><clause id="HB6CCE7C2FF5F4CB999F7A104D12EEE97"><enum>(i)</enum><text>Entering onto the premises of an organization designation authorization holder described in subsection (a) for access to and inspection of records or other purposes.</text></clause><clause id="HAC777C9203B6421A9192D53F4F8502FA"><enum>(ii)</enum><text>Notwithstanding any other provision of law, accessing and inspecting unredacted records in the possession of an employee or appointed political official of the Administration.</text></clause><clause id="HECD901F6EA8644A2B27AD4F994DB26C6"><enum>(iii)</enum><text>Interviewing employees of such organization designation authorization holder or the Administration as necessary for the panel to complete its work.</text></clause></subparagraph><subparagraph id="H2732E950B6504A1B974008689A5E7448"><enum>(B)</enum><header>Disclosure of financial interests</header><text>Each individual serving on the review panel shall disclose to the Administrator any financial interest held by such individual, or a spouse or dependent of such individual, in a business enterprise engaged in the design or production of transport airplanes, aircraft engines designed for transport airplanes, or major systems, components, or parts thereof. The Administrator shall publicly post such disclosure on the website of the Administration in a de-identified form.</text></subparagraph><subparagraph id="HE3D159FCEA1140F9AD45D6F442305C69"><enum>(C)</enum><header>Protection of proprietary information; trade secrets</header><clause id="HF39C4BBAC88E48C8BECCEF3F6AF8B93A"><enum>(i)</enum><header>Marking</header><text>The custodian of a record accessed under subparagraph (A) may mark such record as proprietary or containing a trade secret. A marking under this subparagraph shall not be dispositive with respect to whether such record contains any information subject to legal protections from public disclosure.</text></clause><clause id="HA9BF4564DEED43C4B5CB9C368A3B9630"><enum>(ii)</enum><header>Nondisclosure for non-Federal government participants</header><subclause id="H0E1DEF38DAE44370AE17087FD6AF69B4"><enum>(I)</enum><header>Non-Federal government participants</header><text>Prior to participating on the review panel, each individual serving on the review panel representing a non-Federal entity, including a labor union, shall execute an agreement with the Administrator in which the individual shall be prohibited from disclosing at any time, except as required by law, to any person, foreign or domestic, any non-public information made accessible to the panel under subparagraph (A).</text></subclause><subclause id="HDFEC0BD7E79B4B13A0D381999392379B"><enum>(II)</enum><header>Federal employee participants</header><text>Federal employees serving on the review panel as representatives of the Federal Government and who are required to protect proprietary information and trade secrets under section 1905 of title 18, United States Code, shall not be required to execute agreements under this subparagraph.</text></subclause></clause><clause id="HCED203524B7F4B5CA8A2FAEB253090C3"><enum>(iii)</enum><header>Protection of voluntarily submitted safety information</header><text>Information subject to protection from disclosure by the Administration in accordance with sections 40123 and 44735 of title 49, United States Code, is deemed voluntarily submitted to the Administration under such sections when shared with the review panel and retains its protection from disclosure (including protection under section 552(b)(3) of title 5, United States Code). The custodian of a record subject to such protection may mark such record as subject to statutory protections. A marking under this subparagraph shall not be dispositive with respect to whether such record contains any information subject to legal protections from public disclosure. Members of the review panel will protect voluntarily submitted safety information and other otherwise exempt information to the extent permitted under applicable law.</text></clause><clause id="H3758FB84DDE04D63A451973095C4742B"><enum>(iv)</enum><header>Protection of proprietary information and trade secrets</header><text>Members of the review panel will protect proprietary information, trade secrets, and other otherwise exempt information to the extent permitted under applicable law.</text></clause><clause id="H39F90A2820124766A4F1CB1A3E3F2795"><enum>(v)</enum><header>Resolving classification of information</header><text>If the review panel and an organization designation authorization holder subject to review under this section disagree as to the proper classification of information described in this subparagraph, then the deputy chief counsel of the Administration shall determine the proper classification of such information and whether such information will be redacted.</text></clause></subparagraph><subparagraph id="H9C685F809EE64880B42D5B7E6D5559A3" commented="no"><enum>(D)</enum><header>Applicable law</header><text display-inline="yes-display-inline">Public Law 92–463 shall not apply to the panel established under this subsection.</text></subparagraph><subparagraph id="HE4DAE317FF21425CBC25662F3CEC1C3E"><enum>(E)</enum><header>Financial interest defined</header><text>In this paragraph, the term <quote>financial interest</quote>—</text><clause id="H07F58343A5EC494FB2986CC7C34E35B4"><enum>(i)</enum><text>excludes securities held in an index fund; and</text></clause><clause id="H9FAB17F16FDB4C14BDDC48B94CFB43D2"><enum>(ii)</enum><text>includes—</text><subclause id="H522E8D4A67574769AA4287380DFE3422"><enum>(I)</enum><text>any current or contingent ownership, equity, or security interest;</text></subclause><subclause id="H8BA51ABFF72D4CD5BB7D6829AB0675B8"><enum>(II)</enum><text>an indebtedness or compensated employment relationship; or</text></subclause><subclause id="H0E641E06CAEE40B98D42AEC33157EE74"><enum>(III)</enum><text>any right to purchase or acquire any such interest, including a stock option or commodity future.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HB9EDDD9D66804E9BB01ECFC5A3D11B41"><enum>(b)</enum><header>FAA authority</header><paragraph id="H92B6A31CB0834DAA8D321B2D1175A932"><enum>(1)</enum><header>In general</header><text>After reviewing the findings of the review panel submitted under subsection (a)(5), the Administrator may limit, suspend, or terminate an organization designation authorization subject to review under this section.</text></paragraph><paragraph id="H805F868D8F8D4994B44DC3660EBAD427"><enum>(2)</enum><header>Reinstatement</header><text>The Administrator may condition reinstatement of a limited, suspended, or terminated organization designation authorization on the holder’s implementation of any corrective actions determined necessary by the Administrator.</text></paragraph><paragraph id="H45910BF580DA4E04865AA83846DB8EFC"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to limit the Administrator’s authority to take any action with respect to an organization designation authorization, including limitation, suspension, or termination of such authorization.</text></paragraph></subsection><subsection id="H8374FE39EEDA4059BFA054B10071BF87"><enum>(c)</enum><header>Organization designation authorization process improvements</header><text>Not later than 1 year after receipt of the recommendations submitted under subsection (a)(5), the Administrator shall—</text><paragraph id="H63D7312CDFE541638AECFFA3E90D0F7A"><enum>(1)</enum><text>report to the congressional committees of jurisdiction on—</text><subparagraph id="H2B9CEFB7E6D142488F5746025EC03592"><enum>(A)</enum><text>whether the Administrator has concluded that such holder is able to safely and reliably perform all delegated functions in accordance with all applicable provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, title 14, Code of Federal Regulations, and other orders or requirements of the Administrator, and, if not, the Administrator shall outline—</text><clause id="H7298B2B5BCE74154A2B4C45AC6D8E5A5"><enum>(i)</enum><text>the risk mitigations or other corrective actions, including the implementation timelines of such mitigations or actions, the Administrator has established for or required of such holder as prerequisites for a conclusion by the Administrator under subparagraph (A); or</text></clause><clause id="H090D4B6CFEBF4AE9A43DF012D85BEFE8"><enum>(ii)</enum><text>the status of any ongoing investigatory actions; and</text></clause></subparagraph><subparagraph id="HF6962D9CFA6F464BA72DF39825E77C7F"><enum>(B)</enum><text>the status of implementation of each of the recommendations of the review panel, if any, with which the Administrator concurs; and </text></subparagraph></paragraph><paragraph id="HCE77A99232FB41358C7AC565B25A5A68"><enum>(2)</enum><text>report to the congressional committees of jurisdiction on—</text><subparagraph id="H838174C72AEC4EEDA0355680802927C1"><enum>(A)</enum><text>the status of procedures under which the Administrator will conduct focused oversight of such holder’s processes for performing delegated functions with respect to the design of new and derivative transport airplanes and the production of such airplanes; and</text></subparagraph><subparagraph id="HEA710ADA9565477A8BEBC36072218DE3"><enum>(B)</enum><text>the Administrator’s efforts, to the maximum extent practicable and subject to appropriations, to increase the number of engineers, inspectors, and other qualified technical experts, as necessary to fulfill the requirements of this section, in—</text><clause id="H368F570A930F47F88FB270FB63BFDE90"><enum>(i)</enum><text>each office of the Administration responsible for dedicated oversight of such holder; and</text></clause><clause id="HE6B5259F9F67498EA8D656F748C55134"><enum>(ii)</enum><text>the System Oversight Division, or any successor division, of the Aircraft Certification Service.</text></clause></subparagraph></paragraph></subsection><subsection id="HE8F6CA8F0D604355A77FA1ED569C5359"><enum>(d)</enum><header>Non-Concurrence with recommendations</header><text>Not later than 6 months after receipt of the recommendations submitted under subsection (a)(5), with respect to each recommendation of the review panel with which the Administrator does not concur, if any, the Administrator shall publish on the website of the Administration and submit to the congressional committees of jurisdiction a detailed explanation as to why, including if the Administrator believes implementation of such recommendation would not improve aviation safety.</text></subsection></section><section id="H67A82CEDEA19457F9CF664F05A03CEA6"><enum>4.</enum><header>Certification oversight staff</header><subsection id="HAC2B33954B7148E2A3FC604D8AF7A4DD"><enum>(a)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator $27,000,000 for each of fiscal years 2021 through 2023 to recruit and retain engineers, safety inspectors, human factors specialists, and software and cybersecurity experts and other qualified technical experts who perform duties related to the certification of aircraft, aircraft engines, propellers, and appliances.</text></subsection><subsection id="H115D897032BA495E894F36361E02338E"><enum>(b)</enum><header>Recruitment and retention</header><paragraph id="HEED6EE201F194EFF84F64710CEB7ED4C"><enum>(1)</enum><header>Bargaining units</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Administrator shall begin collaboration with the exclusive bargaining representatives of engineers, safety inspectors, systems safety specialists, and other qualified technical experts certified under section 7111 of title 5, United States Code, to improve recruitment of employees for, and to implement retention incentives for employees holding, positions with respect to the certification of aircraft, aircraft engines, propellers, and appliances. If the Administrator and such representatives are unable to reach an agreement collaboratively, the Administrator and such representatives shall negotiate in accordance with section 40122(a) of title 49, United States Code, to improve recruitment and implement retention incentives for employees described in subsection (a) who are covered under a collective bargaining agreement.</text></paragraph><paragraph id="HB11422992D534EA0934CE20727BF0539"><enum>(2)</enum><header>Other employees</header><text>Notwithstanding any other provision of law, not later than 30 days after the date of enactment of this Act, the Administration shall improve recruitment of, and implement retention incentives for, any individual described in subsection (a) who is not covered under a collective bargaining agreement.</text></paragraph><paragraph id="HD7360DE372C9437383E7272833A84B92"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to vest in any exclusive bargaining representative any management right of the Administrator, as such right existed on the day before the date of enactment of this Act.</text></paragraph><paragraph id="H468FABD03A0F4821AE8BF434AE3C33DC"><enum>(4)</enum><header>Availability of appropriations</header><text>Any action taken by the Administrator under this section shall be subject to the availability of appropriations authorized under subsection (a).</text></paragraph></subsection></section><section id="H50C1A9588CAD4E088B021E81474F64E5"><enum>5.</enum><header>Disclosure of safety-critical information</header><subsection id="H59AF82D3A7B542E682C31DB72ED1BB18"><enum>(a)</enum><header>Prohibition</header><text>Section 44704 of title 49, United States Code, is amended by striking subsection (e) and inserting the following:</text><quoted-block id="H0D9F07866C2B44C8B5707C623161D9D9" style="OLC"><subsection id="H26BE5AD9314B416BAFC0E2A49B9504C3"><enum>(e)</enum><header>Disclosure of safety-Critical information</header><paragraph id="H8A7785C521DB49FEAD986F1A6761A13F"><enum>(1)</enum><header>In general</header><text>Notwithstanding a delegation described in section 44702(d), the Administrator shall require an applicant for, or holder of, a type certificate for a transport-category aircraft covered under part 25 of title 14, Code of Federal Regulations, to submit safety-critical information with respect to such aircraft to the Administrator in such form, manner, or time as the Administrator may require. Such safety-critical information shall include—</text><subparagraph id="H8506EB2E27C2435CB62F3305ED1E0C48"><enum>(A)</enum><text>any design and operational details, intended functions, and failure modes of any system that, without being commanded by the flight crew, commands the operation of any safety-critical function or feature required for control of an aircraft during flight or that otherwise changes the flight path or airspeed of an aircraft;</text></subparagraph><subparagraph id="HFA4678FA8EF14565B7FF203966856726"><enum>(B)</enum><text>the design and operational details, intended functions, failure modes, and mode annunciations of autopilot and autothrottle systems, if applicable;</text></subparagraph><subparagraph id="H7889551DC13E48528A50354CBD7B320C"><enum>(C)</enum><text>any failure or operating condition that the applicant or holder anticipates or has concluded would result in an outcome with a severity level of hazardous or catastrophic, as defined in the appropriate Administration airworthiness requirements and guidance applicable to transport-category aircraft defining risk severity;</text></subparagraph><subparagraph id="H39720BAC1E0546F18BAA75DA8BE3ECBF"><enum>(D)</enum><text>any adverse handling quality that fails to meet the requirements of applicable regulations without the addition of a software system to augment the flight controls of the aircraft to produce compliant handling qualities; and</text></subparagraph><subparagraph id="HA1CA720C55CE4614B10FEDE361B5BE88"><enum>(E)</enum><text display-inline="yes-display-inline">a system safety assessment with respect to a system described in subparagraph (A) or (B) or with respect to any component or other system for which failure or erroneous operation of such component or system could result in an outcome with a severity level of hazardous or catastrophic, as defined in the appropriate Administration airworthiness requirements and guidance applicable to transport-category aircraft defining risk severity. </text></subparagraph></paragraph><paragraph id="H39BE2B4A87EF40468F25EFBE71063E30"><enum>(2)</enum><header>Ongoing communications</header><subparagraph id="HFA686CBCFBAE4F4FA8A7735436821C9F"><enum>(A)</enum><header>Newly discovered information</header><text>The Administrator shall require that an applicant for, or holder of, a type certificate disclose to the Administrator, in such form, manner, or time as the Administrator may require, any newly discovered information or design or analysis change that would materially alter any submission to the Administrator under paragraph (1). </text></subparagraph><subparagraph id="H5C47F41B811940DAA5E5A44959DB6C43"><enum>(B)</enum><header>Aircraft system development changes</header><text>The Administrator shall establish multiple milestones throughout the certification process at which a proposed aircraft system will be assessed to determine whether any change to such system during the certification process is such that such system should be considered novel or unusual by the Administrator.</text></subparagraph></paragraph><paragraph id="HC0331E534D364D4FA818FD926969A704"><enum>(3)</enum><header>Flight manuals</header><text>The Administrator shall ensure that an aircraft flight manual and a flight crew operating manual (as appropriate or applicable) for an aircraft contains a description of the operation of a system described in paragraph (1)(A) and flight crew procedures for responding to a failure or aberrant operation of such system.</text></paragraph><paragraph id="HA05DE3D50B2A4470833E6A179FB160F1"><enum>(4)</enum><header>Civil penalty</header><subparagraph id="H1EC61EE48B53418DB7073536D9C76148" commented="no"><enum>(A)</enum><header>Amount</header><text>Notwithstanding section 46301, an applicant for, or holder of, a type certificate that knowingly violates paragraph (1), (2), or (3) of this subsection shall be liable to the Administrator for a civil penalty of not more than $1,000,000 for each violation.</text></subparagraph><subparagraph id="HD15E8637276E446E8D728A292509D8F5"><enum>(B)</enum><header>Penalty considerations</header><text>In determining the amount of a civil penalty under subparagraph (A), the Administrator shall consider—</text><clause id="H34C1F68D1DB84974AE1D18184BF3E0E7"><enum>(i)</enum><text>the nature, circumstances, extent, and gravity of the violation, including the length of time that such safety-critical information was known but not disclosed; and</text></clause><clause id="HC5CB9B0CDFD94E7AA19982B5EC813563"><enum>(ii)</enum><text>with respect to the violator, the degree of culpability, any history of prior violations, and the size of the business concern.</text></clause></subparagraph></paragraph><paragraph id="H7F294E8FB571475B93032543CF8A3250"><enum>(5)</enum><header>Revocation and civil penalty for individuals</header><subparagraph id="H44E42D3217C04753988C6C51FC04F04B"><enum>(A)</enum><header>In general</header><text>The Administrator shall revoke any airline transport pilot certificate issued under section 44703 held by any individual who, while acting on behalf of an applicant for, or holder of, a type certificate, knowingly makes a false statement with respect to any of the matters described in subparagraphs (A) through (D) of paragraph (1).</text></subparagraph><subparagraph id="HF4D5BD3D5D674D06A5A4F1952EBC4666"><enum>(B)</enum><header>Authority to impose civil penalty</header><text>The Administrator may impose a civil penalty under section 46301 for each violation described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HF6250BF8D0B547A09C5CF421E50DE8D4"><enum>(6)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to affect or otherwise inhibit the authority of the Administrator to deny an application by an applicant for a type certificate or to revoke a type certificate of a holder of such certificate.</text></paragraph><paragraph id="H2AD4A8807E7449868ABC5C357127F393"><enum>(7)</enum><header>Definition of type certificate</header><text>In this subsection, the term <quote>type certificate</quote>—</text><subparagraph id="HD9FBCF75B1C44887805273EA37C6D341"><enum>(A)</enum><text>means a type certificate issued under subsection (a) or an amendment to such certificate; and </text></subparagraph><subparagraph id="HC2EF47F4C50143B988F4BC4B49D48FD3"><enum>(B)</enum><text>does not include a supplemental type certificate issued under subsection (b).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC78088335F9F4DB0ADB6E642D595769B"><enum>(b)</enum><header>Civil penalty authority</header><text>Section 44704 of title 49, United States Code, is further amended by adding at the end the following:</text><quoted-block id="HE0CB9DB2128A47D795F385C5E023605D" style="OLC"><subsection id="HA6EFCC9160EB46CABF62B1A2DD83CCD8"><enum>(f)</enum><header>Hearing requirement</header><text>The Administrator may find that a person has violated subsection (a)(6) or paragraph (1), (2), or (3) of subsection (e) and impose a civil penalty under the applicable subsection only after notice and an opportunity for a hearing. The Administrator shall provide a person—</text><paragraph id="H223A9F2C9AF042E3B4E67ACB92541A62"><enum>(1)</enum><text>written notice of the violation and the amount of penalty; and</text></paragraph><paragraph id="HC39714366E894B32A212D351E357D293"><enum>(2)</enum><text>the opportunity for a hearing under subpart G of part 13 of title 14, Code of Federal Regulations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H335EEC039EB343378D500216CA566FF2"><enum>6.</enum><header>Periodic reviews of organization designation authorizations</header><text display-inline="no-display-inline">Section 44736 of title 49, United States Code, is amended—</text><paragraph id="HA181C1DAA561405481701DF4F2258D67"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="H1B105C2FA66044DAA369D10D8031DAF3"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block id="HBEF50EC444894ACF9B59D347D5B1CB96" style="OLC"><subsection id="H2F877B4A9B38447FA6CFB16E5923F079"><enum>(c)</enum><header>Periodic reviews</header><paragraph id="H92C86FE6C43D488D8B756A335306760C"><enum>(1)</enum><header>In general</header><text>Not less than once every 7 years, the Administrator shall conduct a comprehensive review of the capability of each ODA holder for the design of an aircraft, aircraft engine, propeller, or appliance pursuant to a delegation by the Administrator under section 44702(d) to meet the requirements of subpart D of part 183 of title 14, Code of Federal Regulations, based on the holder’s organizational structures, requirements applicable to officers and employees, and safety culture.</text></paragraph><paragraph id="HF600175DB2CF49FBB2F892293E5DCA74"><enum>(2)</enum><header>Contents of review</header><text>A comprehensive review under this subsection shall include an assessment of the effectiveness of, and organization-wide adherence to, an ODA holder’s procedures manual and voluntary safety reporting system.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HB34F248AFE1B4CDFBB2F9024D77961C8"><enum>7.</enum><header>Limitations on delegation</header><text display-inline="no-display-inline">Section 44702(d) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H30A0BD352E184EA193F640C2C6A427C1" style="OLC"><paragraph id="H74C9586E4196409B9216DE42545F5918"><enum>(4)</enum><text>Notwithstanding any other provision of law, the Administrator may not delegate a matter under this subsection—</text><subparagraph id="HDBBCDDBA7E27468985ECF34579EA0D4E"><enum>(A)</enum><text>with respect to the certification of the design of a novel or unusual design feature that results in a major change to a type design, except when the Administrator determines—</text><clause id="H612F80F47A434AA99D1C8452FC09CFF4"><enum>(i)</enum><text>a matter is a routine task; or</text></clause><clause id="H2A3C9036FAB84A439AE5195BBD4A4E70"><enum>(ii)</enum><text>during the course of the certification process, that a matter no longer relates to a novel or unusual design feature; or</text></clause></subparagraph><subparagraph id="H3315A9E308C94F63B8E585BD971F1D15"><enum>(B)</enum><text>on the sole basis that the Federal Aviation Administration lacks a sufficient number of personnel qualified or with the requisite expertise to perform the function.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF72A6B6812AD403CA2274E9CFA3FA2AD"><enum>8.</enum><header>Oversight of organization designation authorization unit members</header><subsection id="HD879D21174CE44B0BDB5D808D45F12D3"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, as amended by this Act, is amended by adding at the end the following:</text><quoted-block id="H2EBE6C5A688442C2A72F1AA25C54DC7E" style="USC"><section id="HF3F5774F8D714490AD0B08ABFF2279D2"><enum>44741.</enum><header>Approval of organization designation authorization unit members</header><subsection id="H11FA6695D87648E3A2053F76632A360E"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 1 year after the date of enactment of the <short-title>Aircraft Certification Reform and Accountability Act</short-title>, each individual who is selected on or after such date to become a member of an ODA unit by an ODA holder engaged in the design of an aircraft, aircraft engine, propeller, or appliance and performs an authorized function pursuant to a delegation by the Administrator of the Federal Aviation Administration under section 44702(d)—</text><paragraph id="H2A7D0327721C47EABD7409ECBB654BB3"><enum>(1)</enum><text>shall be an employee, a contractor, or the employee of a supplier of the ODA holder; and</text></paragraph><paragraph id="HBA49F6A39AF64936BF96950969CB701B"><enum>(2)</enum><text>may not become a member of such unit unless approved by the Administrator pursuant to this section.</text></paragraph></subsection><subsection id="H44DBF409522B4AA0921BEC7B8A7840E9"><enum>(b)</enum><header>Process and timeline</header><paragraph id="H4DE74582CDD8431981923C2EE874153E"><enum>(1)</enum><header>In general</header><text>The Administrator shall maintain an efficient process for the review and approval of an individual to become a member of an ODA unit under this section.</text></paragraph><paragraph id="HF5D78DC9A28C48469194040514AC36F9"><enum>(2)</enum><header>Process</header><text>An ODA holder described in subsection (a) may submit to the Administrator an application for an individual to be approved to become a member of an ODA unit under this section. The application shall be submitted in such form and manner as the Administrator determines appropriate. The Administrator shall require an ODA holder to submit with such an application information sufficient to demonstrate an individual’s qualifications under subsection (c).</text></paragraph><paragraph id="H44D874010D374719AC92BDF04739329E"><enum>(3)</enum><header>Timeline</header><text>The Administrator shall approve or reject an individual that is selected by an ODA holder to become an ODA unit member under this section not later than 30 days after the receipt of an application by an ODA holder.</text></paragraph><paragraph id="H4A878433DF404467B3991C967AD9BA52"><enum>(4)</enum><header>Documentation of approval</header><text>Upon approval of an individual to become a member of an ODA unit under this section, the Administrator shall provide such individual a letter confirming that such individual has been approved by the Administrator under this section to be an ODA unit member. </text></paragraph><paragraph id="H1E7E1E2F29824E8A9A3CFEE13AF8D79F"><enum>(5)</enum><header>Reapplication</header><text>An ODA holder may submit an application under this subsection for an individual to become a member of an ODA unit under this section regardless of whether an application for such individual was previously rejected by the Administrator. </text></paragraph></subsection><subsection id="H3722BA66ED9A49A2AC550366857B764A"><enum>(c)</enum><header>Qualifications</header><paragraph id="H46808DA5F121493E9F6D905FB115E99E"><enum>(1)</enum><header>In general</header><text>The Administrator shall issue minimum qualifications for an individual to become a member of an ODA unit under this section. In issuing such qualifications, the Administrator shall consider existing qualifications for Administration employees with similar duties and whether such individual—</text><subparagraph id="H9DFBCE83211046FD8DC033B7EC6DFDF8"><enum>(A)</enum><text>is technically proficient and qualified to perform the authorized functions sought;</text></subparagraph><subparagraph id="H571FD7B0BF7542A78397C55BF35D74D0"><enum>(B)</enum><text>has no recent record of serious enforcement action, as determined by the Administrator, taken by the Administrator with respect to any certificate, approval, or authorization held by such individual;</text></subparagraph><subparagraph id="HC6CEA94EDF2A4F1D9B5D59335A3C638C"><enum>(C)</enum><text>is of good moral character (as such qualification is applied to an applicant for an airline transport pilot certificate issued under section 44703); </text></subparagraph><subparagraph id="HDDD00BD1BCC348D58191D5CB94BF2857"><enum>(D)</enum><text>possesses the knowledge of applicable design or production requirements in this chapter and in title 14, Code of Federal Regulations, necessary for performance of the authorized functions sought;</text></subparagraph><subparagraph id="HC6910C5B82404CD4A0F87C0FF2D0330D"><enum>(E)</enum><text>possesses a high degree of knowledge of applicable design or production principles, system safety principles, or safety risk management processes appropriate for the authorized functions sought; and</text></subparagraph><subparagraph id="HB4F48F1BF9E542BA998EEBE5214F3F09"><enum>(F)</enum><text>meets such testing, examination, training, or other qualification standards as the Administrator determines are necessary to ensure the individual is competent and capable of performing the authorized functions sought.</text></subparagraph></paragraph><paragraph id="HB95E8E25A2054D37A349C6FC1EF04835"><enum>(2)</enum><header>Previously rejected application</header><text>In reviewing an application for an individual to become a member of an ODA unit under this section, if an application for such individual was previously rejected, the Administrator shall ensure that the reasons for the prior rejection have been resolved or mitigated to the Administrator’s satisfaction before making a determination on the individual’s reapplication. </text></paragraph></subsection><subsection id="H96DE6705201A4A449FE196290ADDE7E4"><enum>(d)</enum><header>Rescission of approval</header><text>The Administrator may rescind an approval of an individual as a member of an ODA unit granted pursuant to this section at any time and for any reason the Administrator considers appropriate. The Administrator shall develop procedures to provide for notice and opportunity to appeal rescission decisions made by the Administrator. Such decisions by the Administrator are not subject to judicial review.</text></subsection><subsection id="H495BE126E40E4B0C9651F72794551513"><enum>(e)</enum><header>Records and briefings</header><paragraph id="HE34EE66822E445DBAF044F1B4F42D995"><enum>(1)</enum><header>In general</header><text>Beginning on the date described in subsection (a), an ODA holder shall maintain, for a period to be determined by the Administrator and with proper protections to ensure the security of sensitive and personal information—</text><subparagraph id="H8C2CE733B70F48D4AA3AA8D51272B2B2"><enum>(A)</enum><text>any data, applications, records, or manuals required by the ODA holder’s approved procedures manual, as determined by the Administrator;</text></subparagraph><subparagraph id="HE541ADC9653847E88F5A9E7AC854B7D1"><enum>(B)</enum><text>the names, responsibilities, qualifications, and example signature of each member of the ODA unit who performs an authorized function pursuant to a delegation by the Administrator under section 44702(d);</text></subparagraph><subparagraph id="H44073A00C9B94257B23EDA3FD8748664"><enum>(C)</enum><text>training records for ODA unit members and ODA administrators; and</text></subparagraph><subparagraph id="HF7C7E69406EC49A68625BD016699BE0B"><enum>(D)</enum><text>any other data, applications, records, or manuals determined appropriate by the Administrator.</text></subparagraph></paragraph><paragraph id="HABDACBA6FF944A6DB28EC4081B273ED2"><enum>(2)</enum><header>Congressional briefing</header><text>Not later than 90 days after the date of enactment of the <short-title>Aircraft Certification Reform and Accountability Act</short-title>, and every 90 days thereafter through September 30, 2023, the Administrator shall provide to the Committee on Transportation and Infrastructure of the House of Representatives and Committee on Commerce, Science, and Transportation of the Senate a briefing on the implementation and effects of this section, including—</text><subparagraph id="H46134A0A30154CAA973500D45ED8DB2D"><enum>(A)</enum><text>the Administration’s performance in completing reviews of individuals and approving or denying such individuals within the timeline required under subsection (b)(3);</text></subparagraph><subparagraph id="H6DDC355A60514E82AB71F4205249F19F"><enum>(B)</enum><text>for any individual rejected by the Administrator under subsection (b) during the preceding 90-day period, the reasoning or basis for such rejection; and</text></subparagraph><subparagraph id="H1731664C3264423988460EC3CD9707BA"><enum>(C)</enum><text>any resource, staffing, or other challenges within the Administration associated with implementation of this section.</text></subparagraph></paragraph></subsection><subsection id="HE5443AD4613A4BAB8B06EE7D61D328BA"><enum>(f)</enum><header>Special review of qualifications</header><paragraph id="H76830F6E54714F9C978633B8D10A06FB"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the issuance of minimum qualifications under subsection (c), the Administrator shall initiate a review of the qualifications of each individual who on the date on which such minimum qualifications are issued is a member of an ODA unit of a holder of a type certificate for a transport airplane to ensure such individual meets the minimum qualifications issued by the Administrator under subsection (c).</text></paragraph><paragraph id="HD927F781639742E2ADBCF9C5E8A645F6"><enum>(2)</enum><header>Unqualified individual</header><text>For any individual who is determined by the Administrator not to meet such minimum qualifications pursuant to the review conducted under paragraph (1), the Administrator—</text><subparagraph id="H16C2BAEF935B48399B3F2DFFD9A30FC8"><enum>(A)</enum><text>shall determine whether the lack of qualification may be remedied and, if so, provide such individual with an action plan or schedule for such individual to meet such qualifications; or</text></subparagraph><subparagraph id="H1F6DEADB441D4765B2AD210026410FBC"><enum>(B)</enum><text>may, if the Administrator determines the lack of qualification may not be remedied, take appropriate action, including prohibiting such individual from performing an authorized function.</text></subparagraph></paragraph><paragraph id="H4A62AF1F65654C37A3B1D246D8EF7128"><enum>(3)</enum><header>Deadline</header><subparagraph id="H4006C5BB43C74379801E5D55DD95016B"><enum>(A)</enum><text>The Administrator shall complete the review required under paragraph (1) not later than 18 months after the date on which such review was initiated.</text></subparagraph><subparagraph id="H1045D09B1E5B43F888C572AC27091BB8"><enum>(B)</enum><text>If the Administrator fails to complete the review in compliance with subparagraph (A), the Secretary of Transportation shall assume the responsibility for completing the review.</text></subparagraph><subparagraph id="HC8891C636C624852B0B1A6DCB04E4075"><enum>(C)</enum><text>The Secretary’s completion of the review under subparagraph (B)—</text><clause id="H9678CAEA83624C62B923F2AAF8F56FCA"><enum>(i)</enum><text>may not be delegated to the Administration; and</text></clause><clause id="H7BB4B29B13C94C28BBF3C9E14B76C763"><enum>(ii)</enum><text>shall be completed within 120 days of the date the Secretary’s assumption of responsibility following the Administrator’s failure to complete the review in compliance with subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="HCE601E1E5C4C45E9A5E624EA507991E4"><enum>(4)</enum><header>Savings clause</header><text display-inline="yes-display-inline">An individual approved to become a member of an ODA unit of a holder of a type certificate for a transport airplane under subsection (a) shall not be subject to the review under this subsection.</text></paragraph></subsection><subsection id="H7CFDEB7E417140AD952FA5B0E396A401"><enum>(g)</enum><header>Prohibition</header><text>The Administrator may not authorize an organization or ODA holder to approve an individual selected by an ODA holder to become an ODA unit member under this section.</text></subsection><subsection id="HAB7194C7D89A4AA9A4EC61FDA7BB080D" commented="no"><enum>(h)</enum><header>Definitions</header><paragraph id="H6B4BBBFEAC6249CDA629A4C834D15361"><enum>(1)</enum><header>General applicability</header><text>The definitions contained in section 44736 shall apply to this section.</text></paragraph><paragraph id="H95700D315CB74A7BA87DFEFBC1A438E5"><enum>(2)</enum><header>Transport airplane</header><text display-inline="yes-display-inline">The term <quote>transport airplane</quote> means a transport-category airplane designed for operation by an air carrier or foreign air carrier type-certificated with a passenger seating capacity of 30 or more or an all-cargo or combi derivative of such an airplane.</text></paragraph></subsection><subsection id="HACDF18222BD1499ABE2ED82489C568A5"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $3,000,000 for each of fiscal years 2021 through 2023.</text></subsection></section><section id="H2AC2AAF5C3B342678B8A97C00E2AA709"><enum>44742.</enum><header>Interference with the duties of organization designation authorization unit members</header><subsection id="H9FAA694742BE4948AA4A5BF14FC48F05"><enum>(a)</enum><header>In general</header><text>The Administrator of the Federal Aviation Administration shall continuously seek to eliminate or minimize interference by an ODA holder that affects the performance of authorized functions by members of an ODA unit.</text></subsection><subsection id="HC3A6C4E282B748E7A6F5DE860C795516"><enum>(b)</enum><header>Prohibition</header><paragraph id="H9077B66F72CD41B5B65E9F526AEBC883"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for any individual who is employed by an ODA holder to commit an act of interference with an ODA unit member’s performance of authorized functions.</text></paragraph><paragraph id="HC7C4A9C4DA794D22985A3EAB313DE43C"><enum>(2)</enum><header>Civil penalty</header><subparagraph id="H40D07D0C3EA64AA59585140DD05BA153"><enum>(A)</enum><header>Individuals</header><text>An individual shall be subject to a civil penalty under section 46301(a)(1) for each violation under paragraph (1).</text></subparagraph><subparagraph id="H9DD128BFB0724BACBFB922B708567631"><enum>(B)</enum><header>Savings clause</header><text>Nothing in this paragraph shall be construed as limiting or constricting any other authority of the Administrator to pursue an enforcement action against an individual or organization for violation of applicable Federal laws or regulations of the Administration.</text></subparagraph></paragraph></subsection><subsection id="HF2AB83A36C3849EBA28834295D77432C"><enum>(c)</enum><header>Reporting</header><paragraph id="HD623CEBD92994E018531656FD1AA0214"><enum>(1)</enum><header>Reports to ODA holder</header><text>A member of an ODA unit shall promptly report any instances of interference experienced or witnessed by such member to the office of the ODA holder that is designated to receive such reports.</text></paragraph><paragraph id="H27D97914B9AA4BE9BF94C3B9BEABC53C"><enum>(2)</enum><header>Reports to the FAA</header><subparagraph id="HE73902D4DDD046A7AEB5E377D4A17B12"><enum>(A)</enum><header>In general</header><text>The ODA holder office described in paragraph (1) shall submit to the office of the Administration designated by the Administrator to accept and review such reports any credible instances of interference reported under paragraph (1).</text></subparagraph><subparagraph id="H0B8ABDB7EBE0464C82463B4C82627AC3"><enum>(B)</enum><header>Contents</header><text>A report to the Administration under this paragraph shall be submitted in a manner, at a time, and in a form prescribed by the Administrator. Such report shall include the results of any investigation conducted by the ODA holder in response to a report of interference, a description of any action taken by the ODA holder as a result of the report of interference, and any other information or potentially mitigating factors the ODA holder or the Administrator deems appropriate.</text></subparagraph><subparagraph id="H70DAE6A4FF4C4E5E91B92CE28489F3E0"><enum>(C)</enum><header>Use of report</header><text>The Administrator may use the information submitted in a report under this paragraph, including the actions taken by an ODA holder in response to a report under paragraph (1), in determining whether to issue a civil penalty pursuant to subsection (b) or whether such civil penalty should be subject to a setoff or compromised.</text></subparagraph></paragraph><paragraph id="HE96F1EB2A82942E8AE018B77FA142395"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to preclude a member of an ODA unit from reporting an instance of interference reported under paragraph (1) directly to the Administration. Each ODA holder shall provide notice to each member of such holder’s ODA unit stating that such individual may report an instance of interference reported under paragraph (1) directly to the Administration.</text></paragraph></subsection><subsection id="H0D7921A59D21467D94C561F7339509DB"><enum>(d)</enum><header>Definitions</header><paragraph id="H26033237F35F4BF88C55878F6109CF13"><enum>(1)</enum><header>General applicability</header><text>The definitions contained in section 44736 shall apply to this section.</text></paragraph><paragraph id="H7EAF8E3040DD435A89D7AD902B4B5AF8" commented="no"><enum>(2)</enum><header>Interference</header><text>In this section, the term <quote>interference</quote> means—</text><subparagraph id="H5CFE7BBBEEC6483D9819AF5B26D9E8FA" commented="no"><enum>(A)</enum><text>blatant or egregious statements or behavior, such as harassment, beratement, or threats, that a reasonable person would conclude was intended to improperly influence or prejudice an ODA unit member’s performance of his or her duties; or</text></subparagraph><subparagraph id="H5E3944988B6646E7B1B58D3C532A1770" commented="no"><enum>(B)</enum><text>the presence of non-ODA unit duties or activities that conflict with the performance of authorized functions by ODA unit members.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF8E62447DA794759B93130562BEF883D"><enum>(b)</enum><header>Lateral communications</header><paragraph id="HE4384B92EEBC41D08FE2691B395ACB6E"><enum>(1)</enum><header>Contact with administration</header><text>The Administrator shall ensure that employees of the Administration with responsibility for aircraft certification functions may directly contact non-managerial employees of an aircraft manufacturer for consultation regarding the certification of aircraft design, production, and other matters.</text></paragraph><paragraph id="H38EE4AAE6A004371BCC868D972FAB2BD"><enum>(2)</enum><header>Prohibition</header><text>It shall be a violation of section 44736(a)(2)(C) of title 49, United States Code, for a manufacturer to prohibit employees from contacting any employee of the Administration or otherwise impose any condition, restriction, or penalty (including by requiring prior notice to or the approval of any supervisor or manager) with respect to such contact, except that such manufacturer may institute reasonable, company-wide policies requiring documentation of communications regarding aircraft design or production between the manufacturer’s employees and Administration employees.</text></paragraph></subsection><subsection id="H37AD82832DDB46078D9C86546310C855"><enum>(c)</enum><header>ODA program enhancements</header><text>Section 44736 of title 49, United States Code, is further amended—</text><paragraph id="HEB68A8282B3B4BDC8520453139E9EC0F"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H160000C22AF54766A73E49DD94AED585"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H6CBC0DA94F924FD6B58B5E8BD460FFC8"><enum>(i)</enum><text>in subparagraph (A) by striking the semicolon and inserting <quote>; and</quote>;</text></clause><clause id="H9895BE9155CC489FB48B95D81A24855E"><enum>(ii)</enum><text>by striking subparagraph (B);</text></clause><clause id="HA1A00112D797443FB342C6A6B1E09AC0"><enum>(iii)</enum><text>in subparagraph (C) by striking <quote>; and</quote> and inserting a period;</text></clause><clause id="H28351D2E7DE54DE981F18FC8AF833D13"><enum>(iv)</enum><text>by striking subparagraph (D); and</text></clause><clause id="H23138495A9A14BC69F3ECE315EB14FB3"><enum>(v)</enum><text>by redesignating subparagraph (C) as subparagraph (B); and</text></clause></subparagraph><subparagraph id="H0D2368F683BD4FC3B48E94C04BE90A4A"><enum>(B)</enum><text>in paragraph (3) by striking <quote>shall—</quote> and all that follows through the end and inserting <quote>shall conduct regular oversight activities by inspecting the ODA holder’s delegated functions and taking action based on validated inspection findings.</quote>; and</text></subparagraph></paragraph><paragraph id="HA0BEB4E6A47B423CB348DC1E3A4175B0"><enum>(2)</enum><text>in subsection (b)(3)—</text><subparagraph id="H637BEC6B2DFE4E48AF235F27A282A43F"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H5EE348C456B44037998D496A17449DED"><enum>(i)</enum><text>by striking clause (i) and redesignating clauses (ii), (iii), and (iv) as clauses (i), (ii), and (iii), respectively;</text></clause><clause id="H80A64E4D04D14A50AC9A8EAB90497CD1"><enum>(ii)</enum><text>in clause (i) as redesignated by inserting <quote>, as appropriate,</quote> after <quote>require</quote>;</text></clause><clause id="HEF8D970C4FE04AD1B5A8558DB70EA310"><enum>(iii)</enum><text>in clause (ii) as redesignated by inserting <quote>, as appropriate,</quote> after <quote>require</quote>; and</text></clause><clause id="HF80E0F8DABD64880B15332A6807B972C"><enum>(iv)</enum><text>in clause (iii) as redesignated by inserting <quote>when appropriate,</quote> before <quote>make a reassessment</quote>;</text></clause></subparagraph><subparagraph id="H52A5DDF314D74ED4BDAB98630543B6F0"><enum>(B)</enum><text>by striking subparagraph (B);</text></subparagraph><subparagraph id="HD18EF7AAC92C43D2A7B2EBF6391246E1"><enum>(C)</enum><text>in subparagraph (D) by striking the semicolon and inserting <quote>; and</quote>;</text></subparagraph><subparagraph id="H9AF8A56BF8CF4F1896732B8881C7831D"><enum>(D)</enum><text>in subparagraph (E) by striking <quote>; and</quote> and inserting a period;</text></subparagraph><subparagraph id="HACAC37FD7C05498AB8BBD83FF9297725"><enum>(E)</enum><text>in subparagraph (F) by inserting <quote>, when appropriate,</quote> before <quote>approve</quote>; and</text></subparagraph><subparagraph id="HBD4EE0B12DF64C36869876112952F757"><enum>(F)</enum><text>by redesignating subparagraphs (C), (D), (E), and (F) as subparagraphs (B), (C), (D), and (E), respectively.</text></subparagraph></paragraph></subsection><subsection id="HBEBB4222657B4489981DE4C0D97845AE" display-inline="no-display-inline" commented="no"><enum>(d)</enum><header>Technical corrections</header><paragraph id="H106B4E57E930405A827975447C692E46" commented="no"><enum>(1)</enum><header>Section 44737</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, is further amended by redesignating the second section 44737 (as added by section 581 of the FAA Reauthorization Act of 2018) as section 44740.</text></paragraph><paragraph id="HD545A8FE3E164B98B8D7069E4CB6C4DC" commented="no"><enum>(2)</enum><header>Analysis</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, is amended—</text><subparagraph id="H4B07879AF5B04A048F06492C8AED7312" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">by striking the item relating to the second section 44737 (as added by section 581 of the FAA Reauthorization Act of 2018); </text></subparagraph><subparagraph id="H1CCA0909B7DF4AE28FD416E584F0B4F6" commented="no"><enum>(C)</enum><text>in subsection (b)(1) by striking <quote>(1)</quote> the second time it appears; and </text></subparagraph><subparagraph id="H0776BA6360BC4807A663CA6D7991D404" commented="no"><enum>(D)</enum><text>in subsection (c)(2) by adding a period at the end.</text></subparagraph></paragraph></subsection></section><section id="HE0A54580118248A9A8F9B3433ACD44E6"><enum>9.</enum><header>Integrated project teams</header><subsection id="HBB491F5146884990960A7B6AE6A9E42A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Upon receipt of an application for a type certificate for a new transport airplane, the Administrator shall convene an interdisciplinary integrated project team responsible for coordinating review of such application.</text></subsection><subsection id="H6569C9751D61481B940F184880FC1A3C"><enum>(b)</enum><header>Membership</header><text>In convening an interdisciplinary integrated project team under subsection (a), the Administrator shall appoint employees of the Administration with specialized expertise and experience in the fields of engineering, systems design, human factors, and pilot training, including, at a minimum—</text><paragraph id="H886F68F0B1A745BCBAEC44693620CD0E"><enum>(1)</enum><text>not less than 1 designee of the Associate Administrator for Aviation Safety whose duty station is in the Administration’s headquarters;</text></paragraph><paragraph id="H619FF34797FE42DB95E645FCE80FB5BA"><enum>(2)</enum><text>representatives of the Aircraft Certification Service of the Administration;</text></paragraph><paragraph id="H40ECF4DF842C4A6286FE4E20EB69A490"><enum>(3)</enum><text>representatives of the Flight Standards Service of the Administration;</text></paragraph><paragraph id="H17EA9727876641089E217FC3EED75F96"><enum>(4)</enum><text>experts in the fields of human factors, aerodynamics, flight controls, software, and systems design; and</text></paragraph><paragraph id="H29F89ECBB55A4130931DE7168F4B9F3A"><enum>(5)</enum><text>any other subject matter expert whom the Administrator determines appropriate.</text></paragraph></subsection></section><section id="H85B56092BB1C4710833613BDC4B707B7"><enum>10.</enum><header>Oversight integrity briefing</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall brief the congressional committees of jurisdiction on specific measures the Administrator has taken to reinforce that each employee of the Administration responsible for overseeing an organization designation authorization with respect to the certification of aircraft perform such responsibility in accordance with safety management principles and in the public interest of aviation safety.</text></section><section id="H1482BB6A3E3D4B188BFE0CF8DFF37308"><enum>11.</enum><header>Appeals of certification decisions</header><subsection id="H7B211B86AE634B449B3172C1F5F1EC11"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 44704, of title 49, United States Code, is further amended by adding at the end the following:</text><quoted-block id="HEF5BE92F877A4E05B5CD5343555F163A" style="USC"><subsection id="H3FF66CF757DB4412B55C28DBD8D4709F"><enum>(g)</enum><header>Certification dispute resolution</header><paragraph id="HB88ECCDC46CB4C7BBBFCAB40C6BA22FA"><enum>(1)</enum><header>Dispute resolution process and appeals</header><subparagraph id="H748D6D99F94E46268E3814633929CFE7"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this subsection, the Administrator shall issue an order establishing—</text><clause id="H567F5EFD1144446AB45A49101EA2DBE2"><enum>(i)</enum><text>an effective, timely, and milestone-based issue resolution process for type certification activities under subsection (a); and</text></clause><clause id="H87D0DBE068244D52A0D6BDF8B8E998B4"><enum>(ii)</enum><text>a process by which a decision, finding of compliance or noncompliance, or other act of the Administration, with respect to compliance with design requirements, may be appealed by a covered person directly involved with the certification activities in dispute on the basis that such decision, finding, or act is erroneous or inconsistent with this chapter, regulations, or guidance materials promulgated by the Administrator, or other requirements. </text></clause></subparagraph><subparagraph id="H32BE021365704C17BBD6B615CAE2945D"><enum>(B)</enum><header>Escalation</header><text>The order issued under subparagraph (A) shall provide for—</text><clause id="HB528A3854D8E422798FA436FFF044033"><enum>(i)</enum><text>resolution of technical issues at pre-established stages of the certification process, as agreed to by the Administrator and the type certificate applicant;</text></clause><clause id="H1AFA82AAC94047C1AB2795E4D27C2CDA"><enum>(ii)</enum><text>automatic elevation to appropriate management personnel of the Administration and the type certificate applicant of any major certification process milestone that is not completed or resolved within a specific period of time agreed to by the Administrator and the type certificate applicant; </text></clause><clause id="H007E64D73CEC4B5BAD0A1695DB1DEF3D"><enum>(iii)</enum><text>resolution of a major certification process milestone elevated pursuant to clause (ii) with a specific period of time agreed to by the Administrator and the type certificate applicant;</text></clause><clause id="H9FC2C2419C734538AFB91AB726D3F1D0"><enum>(iv)</enum><text>initial review by appropriate Administration employees of any appeal described in subparagraph (A)(ii); and</text></clause><clause id="H75D48FF3015A44F996DA5A67B43B4D7A"><enum>(v)</enum><text>subsequent review of any further appeal by appropriate management personnel of the Administration and the Associate Administrator for Aviation Safety.</text></clause></subparagraph><subparagraph id="H66C46B08457F448AB643E6D9C3AE671B"><enum>(C)</enum><header>Disposition</header><clause id="H1A79C40CC8524E80BE33BC32EFBF1488"><enum>(i)</enum><header>Written decision</header><text>The Associate Administrator for Aviation Safety shall issue a written decision on each appeal submitted under subparagraph (A)(ii), stating the grounds for the decision of the Associate Administrator.</text></clause><clause id="H7C88B7A9679A4D8E88CA101A153AA013"><enum>(ii)</enum><header>Report to congress</header><text>Not later than December 31 of each calendar year through calendar year 2025, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report summarizing each appeal resolved under this subsection.</text></clause></subparagraph><subparagraph id="HB90E72D456184652BA2B9338CBBC3925"><enum>(D)</enum><header>Final review</header><clause id="H3A18ABC93C7549CD9304BF5F23107C9E"><enum>(i)</enum><header>In general</header><text>A written decision of the Associate Administrator under subparagraph (C) may be appealed to the Administrator for a final review and determination.</text></clause><clause id="HACF85B9D6B334FF18A0968B72576FD2E"><enum>(ii)</enum><header>Decline to review</header><text>The Administrator may decline to review an appeal initiated pursuant to clause (i).</text></clause><clause id="H89C576527792496F84748113ECC8EC2D"><enum>(iii)</enum><header>Judicial review</header><text>Notwithstanding any other provision of law, neither a final determination of the Administrator under clause (i) nor a decision to decline to review an appeal under clause (ii) shall be subject to judicial review.</text></clause></subparagraph></paragraph><paragraph id="H708CC5A46F4D43D29B7654D6575EDCFE"><enum>(2)</enum><header>Prohibited contacts</header><subparagraph id="H230733285AC648D5B2B28A6874DB87B2"><enum>(A)</enum><header>Prohibition generally</header><text>During the course of an appeal under this subsection, no covered official may engage in an ex parte communication with an individual representing or acting on behalf of an applicant for, or holder of, a certificate under this section in relation to such appeal unless such communication is disclosed pursuant to subparagraph (B).</text></subparagraph><subparagraph id="HCD7A46B035BB4D8F9802A2E0E62B375E"><enum>(B)</enum><header>Disclosure</header><text>If, during the course of an appeal under this subsection, a covered official engages in, receives, or is otherwise made aware of an ex parte communication, the covered official shall disclose such communication in the public record at the time of the issuance of the written decision in accordance with subsection (g)(1)(C), including the time and date of the communication, subject of communication, and all persons engaged in such communication.</text></subparagraph></paragraph><paragraph id="H8B17AD59260947CAA17126B5AFBCB6F7"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HC4219144DF0D4CD28A27CB64F72FC1CC"><enum>(A)</enum><header>Covered person</header><text>The term <quote>covered person</quote> means either—</text><clause id="H5E91DFDA4BC94492BE0EA643D36532ED"><enum>(i)</enum><text>an employee of the Administration whose responsibilities relate to the certification of aircraft, engines, propellers, or appliances; or</text></clause><clause id="HD3C0CD2631EB4D6E813A6F68C8C890CB"><enum>(ii)</enum><text>an applicant for, or holder of, a type certificate or amended type certificate issued under this section.</text></clause></subparagraph><subparagraph id="H60F434AA176944F9AFB267B45AAD6ED0"><enum>(B)</enum><header>Covered official</header><text>The term <quote>covered official</quote> means the following officials:</text><clause id="HCA2392B0C1F44D8097D9480F88FA6DF5"><enum>(i)</enum><text>The Executive Director or any Deputy Director of the Aircraft Certification Service.</text></clause><clause id="HFDC7BED2F56A43B893F045FF6EAA5074"><enum>(ii)</enum><text>The Deputy Executive Director for Regulatory Operations of the Aircraft Certification Service.</text></clause><clause id="HC05C4AA820784444AE70E5A07395D75D"><enum>(iii)</enum><text>The Director or Deputy Director of the Compliance and Airworthiness Division of the Aircraft Certification Service.</text></clause><clause id="H44605ECEDBFD450990D22DF5E42BEBC2"><enum>(iv)</enum><text>The Director or Deputy Director of the System Oversight Division of the Aircraft Certification Service.</text></clause><clause id="H5EB98C7C134A4CD286A2C9D41A722400"><enum>(v)</enum><text>The Director or Deputy Director of the Policy and Innovation Division of the Aircraft Certification Service.</text></clause><clause id="H3C4C01BD805149F3935D6CAEF1D6682F"><enum>(vi)</enum><text>The Executive Director or any Deputy Executive Director of the Flight Standards Service.</text></clause><clause id="HDE430913EB5641E49150E8E64C3A27FF"><enum>(vii)</enum><text>The Associate Administrator or Deputy Associate Administrator for Aviation Safety.</text></clause><clause id="HEA7AC3C01F52436FB83552C4D3FA3F1F"><enum>(viii)</enum><text>The Deputy Administrator of the Federal Aviation Administration.</text></clause><clause id="HDAA254F3EBEC4903809BAEA7E12EE954"><enum>(ix)</enum><text>The Administrator of the Federal Aviation Administration.</text></clause><clause id="H0C6BB93CF7044517B1965BB35F05D2BF"><enum>(x)</enum><text>Any similarly situated or successor FAA management position, as determined by the Administrator.</text></clause></subparagraph><subparagraph id="H20C4CBE0D69D440E9E123CD896310E19"><enum>(C)</enum><header>Major certification process milestone</header><text>The term <quote>major certification process milestone</quote> means a milestone related to the type certification basis, type certification plan, type inspection authorization, issue paper, or other major type certification activity agreed to by the Administrator and the type certificate applicant.</text></subparagraph></paragraph><paragraph id="H6243E5E8ADB44629BEAC6EF4A53BB1A5"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection shall apply to the communication of a good-faith complaint by any individual alleging—</text><subparagraph id="H671402C56EC84D1F813688C2744777A0"><enum>(A)</enum><text>gross misconduct;</text></subparagraph><subparagraph id="HDA70717AC9184280AA1F1F7F4DE5D84A"><enum>(B)</enum><text>a violation of title 18; or</text></subparagraph><subparagraph id="H0C611D543AF6426DBEA93BAF32FF5D8A"><enum>(C)</enum><text>a violation of any of the provisions of part 2635 or 6001 of title 5, Code of Federal Regulations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H80DA129602614607A74D87AD884E4CE3"><enum>(b)</enum><header>Conforming amendment</header><text>Section 44704(a) is amended by striking paragraph (6). </text></subsection></section><section id="H800AA81D86D8420B897B72912C254817"><enum>12.</enum><header>Employment restrictions</header><subsection id="HEC337ABEDFCB47EE8A3ED5106201C20D"><enum>(a)</enum><header>Disqualification based on prior employment</header><text>An employee of the Administration with supervisory responsibility may not direct, conduct, or otherwise participate in oversight of a holder of a certificate issued under section 44704 that previously employed such employee in the preceding 1-year period.</text></subsection><subsection id="HBBA3F90F97314155829E95159A17A768"><enum>(b)</enum><header>Post-Employment restrictions</header><text>Section 44711(d) of title 49, United States Code, is amended to read as follows:</text><quoted-block id="HC26B731F5ECA44B2955278634FC646F5" style="USC"><subsection id="H28FD2EDA35CC4382AB374A13CC1906BF"><enum>(d)</enum><header>Post-Employment restrictions for inspectors and engineers</header><paragraph id="H7F683A7FD33C41E79C84C61CE79E5DC6"><enum>(1)</enum><header>Prohibition</header><text>A person holding a certificate issued under part 21 or 119 of title 14, Code of Federal Regulations, may not knowingly employ, or make a contractual arrangement that permits, an individual to act as an agent or representative of such person in any matter before the Administration if the individual, in the preceding 2-year period—</text><subparagraph id="HEE4CAFAC3A8C447ABDB067896B00B72A"><enum>(A)</enum><text>served as, or was responsible for oversight of—</text><clause id="HE46E197CA0B844789C4FA826B774E1D0"><enum>(i)</enum><text>a flight standards inspector of the Administration; or</text></clause><clause id="H4E43C6A49A214F0081EA8E5D3A832071"><enum>(ii)</enum><text>an employee of the Administration with responsibility for certification functions with respect to a holder of a certificate issued under section 44704(a); and</text></clause></subparagraph><subparagraph id="HAEE15E05EADF4A5397A09939005E8B0D"><enum>(B)</enum><text>had responsibility to inspect, or oversee inspection of, the operations of such person.</text></subparagraph></paragraph><paragraph id="H25B55A571A4F4A1F8436680E31D321D4"><enum>(2)</enum><header>Written and oral communications</header><text>For purposes of paragraph (1), an individual shall be considered to be acting as an agent or representative of a certificate holder in a matter before the Administration if the individual makes any written or oral communication on behalf of the certificate holder to the Administration (or any of its officers or employees) in connection with a particular matter, whether or not involving a specific party and without regard to whether the individual has participated in, or had responsibility for, the particular matter while serving as an individual covered under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0BC9B93962F84DD1B549850883D35BDF"><enum>13.</enum><header>Professional development and skills enhancement</header><subsection id="H38D10B4F096749D98E30A2FAD8C81F05"><enum>(a)</enum><header>In general</header><text>The Administrator shall—</text><paragraph id="H5F40446357D2436B8BDE841CFA293164"><enum>(1)</enum><text>develop a program for regular recurrent training of engineers, inspectors, and other subject-matter experts employed in the Aircraft Certification Service of the Administration in accordance with the training strategy developed pursuant to section 231 of the FAA Reauthorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/254">Public Law 115–254</external-xref>; 132 Stat. 3256); and</text></paragraph><paragraph id="H98C8F7ECB9E04149A22099ADD3D9CC49"><enum>(2)</enum><text>to the maximum extent practicable, implement measures, including assignments in multiple divisions of the Aircraft Certification Service, to ensure that such engineers and other subject-matter experts in the Aircraft Certification Service have access to diverse professional opportunities that expand their knowledge and skills.</text></paragraph></subsection><subsection id="H5CB0290217FA4873AC0044A76576C3F5"><enum>(b)</enum><header>Implementation</header><text>The Administrator shall, to the maximum extent practicable, ensure that actions taken pursuant to subsection (a)—</text><paragraph id="H72722780CDD74C21A4EB47E8C13BB21F"><enum>(1)</enum><text>permit engineers, inspectors, and other subject matter experts to continue developing knowledge of, and expertise in, new and emerging technologies in systems design, flight controls, principles of aviation safety, system oversight, and certification project management;</text></paragraph><paragraph id="H02A3DF29A50D4082BFC1FFC3B9F91B0F"><enum>(2)</enum><text>minimize the likelihood of an individual developing an inappropriate bias toward a designer or manufacturer of aircraft, aircraft engines, propellers, or appliances;</text></paragraph><paragraph id="H91D59DA9BCE6493EAF586F9029CBF37B"><enum>(3)</enum><text>are consistent with any applicable collective bargaining agreements; and</text></paragraph><paragraph id="HA2898882A9D54FC8ADF372C2BA7E923B"><enum>(4)</enum><text>account for gaps in knowledge and skills between Administration employees and private-sector employees, as identified by the exclusive bargaining representatives certified under section 7111 of title 5, United States Code, for each group of Administration employees covered under this section.</text></paragraph></subsection></section><section id="HF522F662BE674DF39A03BCFC0E80078B"><enum>14.</enum><header>Voluntary safety reporting program</header><subsection id="H90DE4D5E4B7645F4B48FDCAA03072167"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall begin collaboration with the exclusive bargaining representatives of engineers, safety inspectors, systems safety specialists, and other subject matter experts certified under section 7111 of title 5, United States Code, to implement a confidential voluntary safety reporting program, in a manner that is consistent with other voluntary reporting programs administered by the Administrator. The program shall include provisions addressing, at a minimum—</text><paragraph id="H047E044C83D947418D1376CF19DF6AD8"><enum>(1)</enum><text>participation in all facets of the program by the exclusive bargaining representatives for employees identified in the matter preceding this paragraph;</text></paragraph><paragraph id="H2FF924E62D544373972D3C8E0D4255BE"><enum>(2)</enum><text>protections for frontline employees from adverse employment actions related to their participation in the program;</text></paragraph><paragraph id="H3F7EF4296A374B0DB39183296BBD268F"><enum>(3)</enum><text>identification of exclusionary criteria; and</text></paragraph><paragraph id="H9961307535324DB7AAC10040C16E705D"><enum>(4)</enum><text>creation of a corrective action process in order to address safety issues that are identified through the program.</text></paragraph></subsection><subsection id="H853A230E9131432EA075F150D0E5BA27"><enum>(b)</enum><header>Negotiations</header><text>If the Administrator and the representatives described in subsection (a) are unable to reach an agreement collaboratively, the Administrator and such representatives shall negotiate in accordance with section 40122(a) of title 49, United States Code, to reach agreement on the terms and conditions of such a program.</text></subsection></section><section id="H12E90FB315F94A3FBA34B3836A16FBC1"><enum>15.</enum><header>Compensation limitation</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, an employee of the Administration may not receive an adjustment to the employee’s compensation solely on the basis of the employee’s performance in meeting or exceeding a deadline related to the completion of certification functions.</text></section><section id="HBD2CDA436EA4428491CDE8918F65B0E4"><enum>16.</enum><header>System safety assessments and other requirements</header><subsection id="H29510B536D4A4E318D3677842A238273"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall issue such regulations as are necessary to amend title 14, Code of Federal Regulations, and any associated advisory circular, guidance, or policy of the Administration, in accordance with this section.</text></subsection><subsection id="HB953D29B1D76441BA4FB51631F1C2CF3"><enum>(b)</enum><header>System safety assessments and other requirements</header><text>In developing regulations under subsection (a), the Administrator shall—</text><paragraph id="H540313F23FC84AD7B5D409E8CC5047FA"><enum>(1)</enum><text>require an applicant for an amended type certificate for a transport airplane to—</text><subparagraph id="HF812A3793C254424B04A09B9E885F1A8"><enum>(A)</enum><text>perform a system safety assessment with respect to each proposed design change that the Administrator determines is significant, with such assessment considering the airplane-level effects of individual errors, malfunctions, or failures and realistic pilot response times to such errors, malfunctions, or failures related to such change;</text></subparagraph><subparagraph id="HA1C981586562407FB8814E4A07B1C4D9"><enum>(B)</enum><text>update such assessment to account for each subsequent proposed design change that the Administrator determines is significant; and</text></subparagraph><subparagraph id="HB6927BD04E9344FFB085B1CBB08B7033"><enum>(C)</enum><text>provide appropriate employees of the Administration with the data and assumptions underlying each assessment and amended assessment; and</text></subparagraph></paragraph><paragraph id="HF8F39D11BD204EA8801A76B01CD9B815"><enum>(2)</enum><text>work with other civil aviation authorities representing states of design to ensure such regulations remain harmonized internationally.</text></paragraph></subsection><subsection id="HC3270E2433C846C39C47C52AFE82A948"><enum>(c)</enum><header>FAA review</header><text>Appropriate employees of the Aircraft Certification Service and the Flight Standards Service of the Administration shall review each system safety assessment required under subsection (b)(1)(A), updated assessment required under subsection (b)(1)(B), and supporting data and assumptions required under subsection (b)(1)(C), to ensure that each such assessment sufficiently considers the matters listed under subsection (b)(1).</text></subsection></section><section id="HFD200F4B096C4332B9531B622277F8F7"><enum>17.</enum><header>Flight crew alerting</header><subsection id="H473CEAD3E57F41C6B54EDD5074E45819"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall fully implement National Transportation Safety Board recommendations A–19–11 and A–19–12 (as contained in the safety recommendation report adopted on September 9, 2019).</text></subsection><subsection id="H5BFF5DD1C06C4B43B58A0B8D405D59C2"><enum>(b)</enum><header>Prohibition</header><text>Beginning on the date that is 2 years after the date of enactment of this Act, the Administrator may not issue a type certificate for a transport-category aircraft unless—</text><paragraph id="H9A38915725B4401DA230DC6BC97989E4"><enum>(1)</enum><text>in the case of a transport airplane, such airplane incorporates a flight crew alerting system that, at a minimum, displays and differentiates among warnings, cautions, and advisories, and includes functions to assist the flight crew in prioritizing corrective actions and responding to systems failures; or</text></paragraph><paragraph id="HDE3F6D804A094A18AA2687D66468DA33"><enum>(2)</enum><text>in the case of a transport-category aircraft other than a transport airplane, the type certificate applicant provides a means acceptable to the Administrator to assist the flight crew in prioritizing corrective actions and responding to systems failures (including by cockpit or flight manual procedures). </text></paragraph></subsection></section><section id="HA4E72A22B1DD4A14A30EE5F514F60C82"><enum>18.</enum><header>Amended type certificates</header><subsection id="HC91A2F8F3EB2458693B1010CFC43866A"><enum>(a)</enum><header>Review and reevaluation of amended type certificates</header><paragraph id="HD52FD6AB08FA4538AEAF9F4E570E43F9"><enum>(1)</enum><header>International leadership</header><text>The Administrator shall exercise leadership in the creation of international policies and standards relating to the issuance of amended type certificates within the group of international civil aviation authorities known as the Certificate Management Team.</text></paragraph><paragraph id="HEBBBE23ED5684E359B4DF85C51EB2037"><enum>(2)</enum><header>Reevaluation of amended type certificates</header><text>In carrying out this subsection, the Administrator shall—</text><subparagraph id="HE84C7F55CB4B407487A06530C65C2A47"><enum>(A)</enum><text>encourage Certificate Management Team members to examine and address any relevant covered recommendations (as defined in section 22) relating to the issuance of amended type certificates;</text></subparagraph><subparagraph id="H2AF8BCA9B1DE4D5CBC306617953FEA3C"><enum>(B)</enum><text>reevaluate existing assumptions and practices inherent in the amended type certificate process and assess whether such assumptions and practices are valid; and</text></subparagraph><subparagraph id="H8A90EE5C9575467F9A5B765CBCEC5F53"><enum>(C)</enum><text>ensure, to the greatest extent practicable, that Federal regulations relating to the issuance of amended type certificates are harmonized with the regulations of other international states of design.</text></subparagraph></paragraph></subsection><subsection id="H464B2275CEA74A25B7A0B48929D1DE49"><enum>(b)</enum><header>Amended type certificate report and rulemaking</header><paragraph id="HB7ADBFF1FDAF4BB0AD4014CC48D8024E"><enum>(1)</enum><header>Report on certificate management team efforts</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall submit a report to the congressional committees of jurisdiction on the efforts by the Certificate Management Team to modify and harmonize policies and regulations relating to the issuance of amended type certificates.</text></paragraph><paragraph id="HCA682CEA43AA43328F266AA90DF1BD14"><enum>(2)</enum><header>Initiation of action</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall revise and improve the process of issuing amended type certificates in accordance with this section. Such action may include the revision of guidance, the initiating of a rulemaking, or such other action as the Administrator determines necessary to implement this section. </text></paragraph><paragraph id="H13539BE8D3E04D2999603A2EA00F39D9"><enum>(3)</enum><header>Contents</header><text>In taking an action required under paragraph (2), the Administrator shall—</text><subparagraph id="H0060CACA9E8340929032A170F7148BB3"><enum>(A)</enum><text>consider—</text><clause id="HC6B9A0E21BF24497A1C655479F2853A4"><enum>(i)</enum><text>the findings and work of the Certificate Management Team and other similar international harmonization efforts;</text></clause><clause id="H5CA0A8D8B34844DF8A4D9F25686C4C5C"><enum>(ii)</enum><text>any relevant covered recommendations (as defined in section 22); and</text></clause><clause id="H9528F0A1C8A9494EB79350CF1F4EDCDC"><enum>(iii)</enum><text>whether a fixed time beyond which a type certificate may not be amended would improve aviation safety; and</text></clause></subparagraph><subparagraph id="H669A317EA1644A229262BAF787A59890" commented="no"><enum>(B)</enum><text>establish the extent to which the following design characteristics should preclude the issuance of an amended type certificate:</text><clause id="HCFA55DF44FE34309A309E8159DED9BF4" commented="no"><enum>(i)</enum><text>A new or revised flight control system.</text></clause><clause id="HF646A0C4CA6D4D2F9B2BA6CF01C43400" commented="no"><enum>(ii)</enum><text>Any substantial changes to aerodynamic stability resulting from a physical change that may require a new or modified software system or control law in order to produce positive and acceptable stability and handling qualities.</text></clause><clause id="H1AD7BD5B0D174A2889F85D785B05BF57" commented="no"><enum>(iii)</enum><text>A flight control system or augmented software to maintain aerodynamic stability in any portion of the flight envelope that was not required for a previously certified derivative.</text></clause><clause id="H67C0BE37D6DD4C23AE7F823B8FEBD725" commented="no"><enum>(iv)</enum><text>A change in structural components (other than a stretch or shrink of the fuselage) that results in a change in structural load paths or the magnitude of structural loads attributed to flight maneuvers or cabin pressurization.</text></clause><clause id="H8C2490706A50400F94967319DE7FD1A6" commented="no"><enum>(v)</enum><text>A novel or unusual system, component, or other feature whose failure would present a hazardous or catastrophic risk.</text></clause></subparagraph></paragraph><paragraph id="HE4F0A33CC0964EA3B6BCDA48673D7C07"><enum>(4)</enum><header>Deadline</header><text>The Administrator shall finalize the actions initiated under paragraph (2) not later than 3 years after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H027FD26920D54E7BAE5BF1ADD7159B91"><enum>(c)</enum><header>International leadership</header><text>The Administrator shall exercise leadership within the International Civil Aviation Organization and among other civil aviation regulators representing states of aircraft design to advocate for the adoption of requirements equivalent to those described in this section.</text></subsection></section><section id="H486A52461D4644E9BC8D6D91CE90053C"><enum>19.</enum><header>Whistleblower protections</header><text display-inline="no-display-inline">Section 42121 of title 49, United States Code, is amended—</text><paragraph id="H7740FCD33B2E49E894369AFC65CD01BB"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block id="H145365A915634A1E849D79CB9DA942A7" style="USC"><subsection id="HB0B55E62889A4F1E8C7FE55C3A411B55"><enum>(a)</enum><header>Prohibited discrimination</header><text>A holder of a certificate under section 44704 or 44705 of this title, or contractor or subcontractor of such holder, may not discharge an employee or otherwise discriminate against an employee with respect to compensation, terms, conditions, or privileges of employment because the employee (or any person acting pursuant to a request of the employee)—</text><paragraph id="H7645AF303FE34560ADB8307AE4C8446B"><enum>(1)</enum><text>provided, caused to be provided, or is about to provide (with any knowledge of the employer) or cause to be provided to the employer or Federal Government information relating to any violation or alleged violation of any order, regulation, or standard of the Federal Aviation Administration or any other provision of Federal law relating to aviation safety under this subtitle or any other law of the United States;</text></paragraph><paragraph id="H4B94265EA0934900998E0E40075317A4"><enum>(2)</enum><text>has filed, caused to be filed, or is about to file (with any knowledge of the employer) or cause to be filed a proceeding relating to any violation or alleged violation of any order, regulation, or standard of the Federal Aviation Administration or any other provision of Federal law relating to aviation safety under this subtitle or any other law of the United States;</text></paragraph><paragraph id="HAB156DA730AA43B4B41D9E705BE384A9"><enum>(3)</enum><text>testified or is about to testify in such a proceeding; or</text></paragraph><paragraph id="H5F8C5498E4AF4E6594C943ECC4EDAE5C"><enum>(4)</enum><text>assisted or participated or is about to assist or participate in such a proceeding.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H5426A6E12562430EBF13BE6F518BF26E"><enum>(2)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block id="HF83FCC7E4F1D416C8500A7C3C8B016E5" style="USC"><subsection id="HCC187AE7FC58426FA2AD6A61DB09CD88"><enum>(d)</enum><header>Nonapplicability To deliberate violations</header><text>Subsection (a) shall not apply with respect to an employee of a holder of a certificate issued under section 44704 or 44705, or a contractor or subcontractor thereof, who, acting without direction from such certificate-holder, contractor, or subcontractor (or such person’s agent), deliberately causes a violation of any requirement relating to aviation safety under this subtitle or any other law of the United States.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H802EE83D546A4800A3CC0B833FC9CD97"><enum>(3)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block id="H90A8FA1E90014BF0A2095A72CC0D8905" style="USC"><subsection id="H24CAFE11E16D40588B0718EC0D295687"><enum>(e)</enum><header>Contractor defined</header><text>In this section, the term <quote>contractor</quote> means—</text><paragraph id="HDB303C35725544338F50D910764B7B5C"><enum>(1)</enum><text>a person that performs safety-sensitive functions by contract for an air carrier or commercial operator; or</text></paragraph><paragraph id="H5E7F260D3B544925B63B548B90A1A377"><enum>(2)</enum><text>a person that performs safety-sensitive functions related to the design or production of an aircraft, aircraft engine, propeller, appliance, or component thereof by contract for a holder of a certificate issued under section 44704.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4F65B18556284BFFA60E1B7BC70196F8"><enum>20.</enum><header>Pilot training</header><subsection id="H5C2C9F257C5547AA901D0694DFF2B348"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, as amended by section 8, is further amended by adding at the end the following:</text><quoted-block style="USC" id="H6C6E5B1F2A4E488FAAD9273A56EBE191" display-inline="no-display-inline"><section id="HF7B5B63F7DEA4EE4B705CA4AB7B24175"><enum>44743.</enum><header>Pilot training requirements</header><subsection id="H1B61C9A4BE7F419BB1C6070D362D755D"><enum>(a)</enum><header>In general</header><paragraph id="HF7064C5F3D734E50BBE85C50F104F976"><enum>(1)</enum><header>Administrator’s determination</header><text display-inline="yes-display-inline">In establishing any pilot training requirements with respect to a new transport airplane, the Administrator of the Federal Aviation Administration shall independently review any proposal by the manufacturer of such airplane with respect to the scope, format, or minimum level of training required for operation of such airplane.</text></paragraph><paragraph id="H61EC661E6A724BAABF44F4A125C39645"><enum>(2)</enum><header>Assurances and marketing representations</header><text>Before the Administrator has established applicable training requirements, an applicant for a new or amended type certificate for an airplane described in paragraph (1) may not, with respect to the scope, format, or magnitude of pilot training for such airplane—</text><subparagraph id="HACBA6B096F34437CB43AB9A68BBF41A6"><enum>(A)</enum><text>make any assurance, whether verbal or in writing, to a potential purchaser of such airplane unless a clear and conspicuous disclaimer (as defined by the Administrator) is included regarding the status of training required for operation of such airplane; or</text></subparagraph><subparagraph id="HCFF2E65E66514245888B1D1FA40966D7"><enum>(B)</enum><text>provide financial incentives (including rebates) to a potential purchaser of such airplane regarding the scope, format, or magnitude of pilot training for such airplane.</text></subparagraph></paragraph></subsection><subsection id="H277BA9F595EA4801915C105B0A43158F" display-inline="no-display-inline"><enum>(b)</enum><header>Pilot response time</header><text display-inline="yes-display-inline">Beginning on the day after the date on which regulations are issued under section 20(b)(5) of the <short-title>Aircraft Certification Reform and Accountability Act</short-title>, the Administrator may not issue a new or amended type certificate for an airplane described in subsection (a) unless the applicant for such certificate has demonstrated to the Administrator that the applicant has accounted for realistic assumptions regarding the time for pilot responses to non-normal conditions in designing the systems and instrumentation of such airplane. Such assumptions shall—</text><paragraph id="H4C3441DE60374E318920D262B7477DA2"><enum>(1)</enum><text>be based on test data, analysis, or other technical validation methods; and</text></paragraph><paragraph id="HB3A14F38C1BC4374926298DE0744CB4E"><enum>(2)</enum><text>account for generally accepted scientific consensus among experts in human factors regarding realistic pilot response time.</text></paragraph></subsection><subsection id="HA1D1E670CC9D4342BE7473B3302AE719"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>transport airplane</quote> means a transport-category airplane designed for operation by an air carrier or foreign air carrier type-certificated with a passenger seating capacity of 30 or more or an all-cargo or combi derivative of such an airplane. </text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="HCB3C5087323A4BCCB9B4EF884DBF4A55"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, is further amended by adding at the end the following: </text><quoted-block style="USC" id="H71D720943F494FA4A3A18F5B0CD026E5" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">44743. Pilot training requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF8DDE86985FB41A08C8E729D737ACA08"><enum>(c)</enum><header>Expert safety review</header><paragraph id="H3F63A1018A0B4C11A4E91798A3C226CB"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall initiate an expert safety review of assumptions relied upon by the Administration and manufacturers of transport-category aircraft in the design and certification of such aircraft.</text></paragraph><paragraph id="H6CA22E6CE85446D292C6CDC1173F6E9F"><enum>(2)</enum><header>Contents</header><text>The expert safety review required under paragraph (1) shall include—</text><subparagraph id="H6F60EB1896FE45D99C2F59B8AA73554E"><enum>(A)</enum><text>a review of Administration regulations, guidance, and directives related to pilot response assumptions relied upon by the FAA and manufacturers of transport-category aircraft in the design and certification of such aircraft;</text></subparagraph><subparagraph id="H0EF7BC043B5946A5B75244BB45E4BFDD"><enum>(B)</enum><text>a focused review of the assumptions relied on regarding the time for pilot responses to non-normal conditions in designing such aircraft’s systems and instrumentation;</text></subparagraph><subparagraph id="H161643251DE94DA087F6AFA59DD573C4"><enum>(C)</enum><text>a review of revisions made to the airman certification standards for certificates over the last four years, including any possible effects on pilot competency in basic manual flying skills;</text></subparagraph><subparagraph id="HBCD69394A93E42D98645A249A226D63D"><enum>(D)</enum><text>consideration of the global nature of the aviation marketplace, varying levels of pilot competency, and differences in pilot training programs worldwide; and</text></subparagraph><subparagraph id="H29A0A2CD68F44B9191408CBF45AE1AB0"><enum>(E)</enum><text>a process for aviation stakeholders, including pilots, airlines, inspectors, engineers, test pilots, human factors experts, and other aviation safety experts, to provide and discuss any observations, feedback, and best practices.</text></subparagraph></paragraph><paragraph id="HF42F73AC6F0C4A85B03CA03DA904FA36"><enum>(3)</enum><header>Report and recommendations</header><text>Not later than 30 days after the conclusion of the expert safety review pursuant to paragraph (1), the Administrator shall submit to the congressional committees of jurisdiction a report on the results of the review, any recommendations for actions or best practices to ensure the FAA and the manufacturers of transport-category aircraft have accounted for pilot response assumptions to be relied upon in the design and certification of transport-category aircraft.</text></paragraph><paragraph id="HBD180A1E2FFE42D0B149520DB6A319C0"><enum>(4)</enum><header>Termination</header><text>The expert safety review shall end upon submission of the report required pursuant to paragraph (3).</text></paragraph><paragraph id="H23CC238AC3F041478C60CB2A33FB6C1C"><enum>(5)</enum><header>Regulations</header><text>The Administrator shall issue such regulations as are necessary to implement the recommendations of the expert safety review that the Administrator determines are necessary to improve aviation safety.</text></paragraph></subsection><subsection id="H1C673F9D9C4E411D8900E5BB224B2685"><enum>(d)</enum><header>Call to action on airman certification standards</header><paragraph id="HFF3D935740FF4C76A6D3F5AD6EF8BD91"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall initiate a call to action safety review of pilot certification standards in order to bring stakeholders together to share lessons learned, best practices, and implement actions to address any safety issues identified.</text></paragraph><paragraph id="HDF59B931F6404428AB086AAD0A3D65B5"><enum>(2)</enum><header>Contents</header><text>The call to action safety review required under paragraph (1) shall include—</text><subparagraph id="H11D4DA5C49A1426EA851640543F380CC"><enum>(A)</enum><text>a review of Administration regulations, guidance, and directives related to the pilot certification standards, including the oversight of those processes;</text></subparagraph><subparagraph id="H17F005C136C743FD8CE9CE522FA6AEB5"><enum>(B)</enum><text>a review of revisions made to the pilot certification standards for certificates over the last four years, including any possible effects on pilot competency in manual flying skills and effectively managing automation to improve safety; and</text></subparagraph><subparagraph id="HDF9D1AA9D6A542DB973A11BB1EDDE66C"><enum>(C)</enum><text>a process for aviation stakeholders, including aviation students, instructors, designated pilot examiners, pilots, airlines, labor, and aviation safety experts, to provide and discuss any observations, feedback, and best practices.</text></subparagraph></paragraph><paragraph id="HBD55453F10F74A548ADE7C29ACE70242"><enum>(3)</enum><header>Report and recommendations</header><text>Not later than 90 days after the conclusion of the call to action safety review pursuant to paragraph (1), the Administrator shall submit to the congressional committees of jurisdiction a report on the results of the review, any recommendations for actions or best practices to ensure pilot competency in basic manual flying skills and in effective management of automation, and actions the Administrator will take in response to the recommendations.</text></paragraph></subsection><subsection id="H1C07120697284400954FBA33450515E7"><enum>(e)</enum><header>International pilot training</header><paragraph id="H14A7C82E82F64A52AEDF3789B3341183"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation, the Administrator, and other appropriate officials of the Government shall exercise leadership in setting global standards to improve air carrier pilot training and qualifications for—</text><subparagraph id="H8DAEFC77F7FD48939E1F4CC337AE02B6"><enum>(A)</enum><text>monitoring and managing the behavior and performance of automated systems;</text></subparagraph><subparagraph id="HF32E88C551AC43C2979D809A63E5C5BB"><enum>(B)</enum><text>controlling the flightpath of aircraft without autoflight systems engaged;</text></subparagraph><subparagraph id="HAC71F77AD2654A6CB7090FFC4180D985"><enum>(C)</enum><text>effectively utilizing and managing autoflight systems, when appropriate;</text></subparagraph><subparagraph id="H6750F257DC19439F8FD3C415DE4A4891"><enum>(D)</enum><text>effectively identifying situations in which the use of autoflight systems is appropriate and when such use is not appropriate; and</text></subparagraph><subparagraph id="H6CCCE839B01B4551AF8795D305AE943D"><enum>(E)</enum><text>recognizing and responding appropriately to non-normal conditions.</text></subparagraph></paragraph><paragraph id="H6C849B04125B45C1A9505AFFA212CFA5"><enum>(2)</enum><header>International leadership</header><text>The Secretary, the Administrator, and other appropriate officials of the Government shall exercise leadership under subsection (a) by working with—</text><subparagraph id="H58E2F610A02447A394E0FEC0CDEB632C"><enum>(A)</enum><text>foreign counterparts of the Administrator in the International Civil Aviation Organization and its subsidiary organizations;</text></subparagraph><subparagraph id="HA2E890B23BC34917A474BD6947F597EE"><enum>(B)</enum><text>other international organizations and fora; and</text></subparagraph><subparagraph id="HDE57F56520C2412AA24E2C761F0F5074"><enum>(C)</enum><text>the private sector.</text></subparagraph></paragraph><paragraph id="HA6AED25E8A4D4E87B38961316CF5A5E7"><enum>(3)</enum><header>Considerations</header><text>In exercising leadership under paragraph (1), the Secretary, the Administrator, and other appropriate officials of the Government shall consider—</text><subparagraph id="H1896094B93864752B37C8D51978DC15B"><enum>(A)</enum><text>the latest information relating to human factors;</text></subparagraph><subparagraph id="H2F0BEF557F7A47B6BC19949E96F653BB"><enum>(B)</enum><text>aircraft manufacturing trends, including those relating to increased automation in the cockpit;</text></subparagraph><subparagraph id="HFD9FCB4CF2EA429EB154E73487A1DCF1"><enum>(C)</enum><text>the extent to which cockpit automation improves aviation safety and introduces novel risks;</text></subparagraph><subparagraph id="H6A2AD1C8ADBF4914953D62C300497097"><enum>(D)</enum><text>the availability of opportunities for pilots to practice manual flying skills;</text></subparagraph><subparagraph id="H5D718310E82D435CB9B0924C3A457177"><enum>(E)</enum><text>the need for consistency in maintaining and enhancing manual flying skills worldwide;</text></subparagraph><subparagraph id="HE62D43C48803427EB6F299715AEE68FE"><enum>(F)</enum><text>recommended practices of other countries that enhance manual flying skills and automation management; and</text></subparagraph><subparagraph id="H8625EE8E800E474196D5CAD323C18EDB"><enum>(G)</enum><text>whether a need exists for initial and recurrent training standards for improve pilots’ proficiency in manual flight and in effective management of autoflight systems.</text></subparagraph></paragraph><paragraph id="H5CC6C038E87B4BBE921AAFBE8F10D0D7"><enum>(4)</enum><header>Congressional briefing</header><text>The Secretary, the Administrator, and other appropriate officials of the Government shall provide to the congressional committees of jurisdiction regular briefings on the status of efforts undertaken pursuant to this section.</text></paragraph></subsection></section><section id="H37B8958D15C34D68BE5349F1E266930C"><enum>21.</enum><header>Nonconformity with approved type design</header><text display-inline="no-display-inline">Section 44704(a) of title 49, United States Code, is further amended by adding at the end the following:</text><quoted-block id="H2E3C2242309C47A5A47FA906BE5E00A7" style="USC"><paragraph id="H612A9168368D42F8B71B2C8541FA3E88"><enum>(6)</enum><header>Nonconformity with approved type design</header><subparagraph id="HE37C1055A7E8415FB27198994CC2877A"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (D), a holder of a production certificate for an aircraft may not present a nonconforming aircraft to the Administrator for issuance of an airworthiness certificate.</text></subparagraph><subparagraph id="HD34484D346F44C1E98B61078A7B010FB"><enum>(B)</enum><header>Civil penalty</header><text>Notwithstanding section 46301, a production certificate holder who knowingly violates subparagraph (A) shall be liable to the Administrator for a civil penalty of not more than $1,000,000 for each nonconforming aircraft.</text></subparagraph><subparagraph id="H9B7205D055554338BE9217968226C026"><enum>(C)</enum><header>Penalty considerations</header><text>In determining the amount of a civil penalty under subparagraph (B), the Administrator shall consider—</text><clause id="HA0216B6759584023A661D29186FB72A1"><enum>(i)</enum><text>the nature, circumstances, extent, and gravity of the violation, including the length of time the nonconformity was known but not disclosed; and</text></clause><clause id="H43E758A41A33417699A199EA9A45BE0A"><enum>(ii)</enum><text>with respect to the violator, the degree of culpability, any history of prior violations, and the size of the business concern. </text></clause></subparagraph><subparagraph id="H84C746F60FC44B0EBC7C8DF1D5831A2E"><enum>(D)</enum><header>Remedial action</header><text>The Administrator may permit a production certificate holder to present a nonconforming aircraft to the Administrator for an airworthiness certificate if—</text><clause id="H1ADB2B51E8F64197808820445D85F49E"><enum>(i)</enum><text>the Administrator determines the nonconformity, when compared to the configuration approved as part of the type design, does not diminish by any degree the aircraft’s safe operation without any change in flight crew operating procedures;</text></clause><clause id="HF83B43632BAA4ABF82CB4A04CBAFBA1D"><enum>(ii)</enum><text>the Administrator determines the nonconformity was not the product of an intentional decision by the production certificate holder to alter the aircraft’s configuration from the approved type design;</text></clause><clause id="HD972C334E0A243498D183A935360E0E2"><enum>(iii)</enum><text>the production certificate holder has fully complied with subparagraph (E);</text></clause><clause id="HA22CC17768CA4B3BB12B1F55B7BC5576"><enum>(iv)</enum><text>the production certificate holder agrees to correct the nonconformity on all nonconforming aircraft within a timeframe that is—</text><subclause id="HB434D27765AC4587B4403AA5B08E1267"><enum>(I)</enum><text>prescribed by the Administrator; and</text></subclause><subclause id="H2E93615AFEF147589D9737DE04348A34"><enum>(II)</enum><text>commensurate with the severity of the nonconformity;</text></subclause></clause><clause id="HC5FAB2EC88554386910DF4C18C09B957"><enum>(v)</enum><text>the production certificate holder informs a person who is to take delivery of the nonconforming aircraft of the nonconformance prior to its delivery; and</text></clause><clause id="HA090F3B4761F48BBACCE407661DC4FA2"><enum>(vi)</enum><text>the production certificate holder agrees not to impose any penalty, financial or otherwise, on a person that chooses to delay the delivery of a nonconforming aircraft until the production certificate holder, to the Administrator’s satisfaction, conforms the aircraft to the approved type design of such aircraft. </text></clause></subparagraph><subparagraph id="HE3B5C62296D6477A88A8E0ED2F8702AB"><enum>(E)</enum><header>Notification and proposed remedial action</header><text>A production certificate holder shall, within 5 days of determining that such production certificate holder delivered a nonconforming aircraft, notify the Administrator, the purchaser of the airplane, and (if the purchaser is a lessor) the intended operator of the airplane, if known. A notification under this clause shall describe—</text><clause id="HA314FD8757B3464BB250240E4B72F56B"><enum>(i)</enum><text>the nonconformity in detail; and</text></clause><clause id="H74638A1E7B924BFC85164B23ACEA1097"><enum>(ii)</enum><text>the production certificate holder’s initial proposal for actions necessary to eliminate the nonconformity.</text></clause></subparagraph><subparagraph id="H99684F48DAB444B6B1522A009D14846E"><enum>(F)</enum><header>Nonconforming aircraft defined</header><text>In this paragraph, the term <quote>nonconforming aircraft</quote> means an aircraft that does not conform to the approved type design for such aircraft type.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA2817B9ED2284F9EA2354E7980A0AB18"><enum>22.</enum><header>Implementation of recommendations</header><subsection id="HA051A23CFD1F47F5B0629A8D75979272"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall submit a report to the congressional committees of jurisdiction on the status of the Administration’s implementation of covered recommendations.</text></subsection><subsection id="H3C9CDADD404545D1A27A88DCF0621BEE"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall contain, at a minimum—</text><paragraph id="H8476D7041CDF4877BF5568ED8363315D"><enum>(1)</enum><text>a list and description of all covered recommendations;</text></paragraph><paragraph id="HE01AABA4F8054508AC0786B176C6EB39"><enum>(2)</enum><text>a determination of whether the Administrator concurs, concurs in part, or does not concur with each covered recommendation;</text></paragraph><paragraph id="HDD8B0059CD054D108EE47A01DD502159"><enum>(3)</enum><text>an implementation plan and schedule for all covered recommendations the Administrator concurs or concurs in part with; and</text></paragraph><paragraph id="H1A5AD1308D87478DAED7E6C2A1D3B58C"><enum>(4)</enum><text>for each covered recommendation with which the Administrator does not concur (in whole or in part), a detailed explanation as to why.</text></paragraph></subsection><subsection id="H6BC71CCCCE9440AB82ED746CE1207F23"><enum>(c)</enum><header>Covered recommendations defined</header><text>In this section, the term <quote>covered recommendations</quote> means recommendations made by the following entities in any review initiated in response to the accident of Lion Air flight 610 on October 29, 2018, or Ethiopian Airlines flight 302 on March 10, 2019, that recommend Administration action:</text><paragraph id="H3BE83767838D4846AB5DC9426D1271F6"><enum>(1)</enum><text>The National Transportation Safety Board.</text></paragraph><paragraph id="HFDB4CBB26F7740B9A9E0FDD0B8E6CF42"><enum>(2)</enum><text>The Joint Authorities Technical Review.</text></paragraph><paragraph id="H0F2CCF1AB77641FBA84078770EF55614"><enum>(3)</enum><text>The inspector general of the Department of Transportation.</text></paragraph><paragraph id="HA399842C84E9409EAEE3CD7229A29875"><enum>(4)</enum><text>The Safety Oversight and Certification Advisory Committee, or any special committee thereof.</text></paragraph><paragraph id="HE78B681D3FC9467CAC20FE7ECAF3024C"><enum>(5)</enum><text>Any other entity the Administrator may designate.</text></paragraph></subsection></section><section id="HCB36542743C14CBAADCC7876FDEEF084"><enum>23.</enum><header>Oversight of FAA compliance program</header><subsection id="H595FC67C831B424395E2AF4DCC048124"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall establish an Executive Council within the Administration to oversee the use and effectiveness across program offices of the Administration’s Compliance Program, described in Order 8000.373A dated October 31, 2018.</text></subsection><subsection id="HCD6A10BE89A344B59D2DA058B57497F2"><enum>(b)</enum><header>Compliance program oversight</header><text>The Executive Council established under this section shall—</text><paragraph id="H6CDB9EA292A04E639D1EDCF6023AD01E"><enum>(1)</enum><text>monitor, collect, and analyze data on the use of the Compliance Program across program offices of the Administration, including data on enforcement actions and compliance actions pursued against regulated entities by such program offices;</text></paragraph><paragraph id="H9C031EEC5ABB4FFF9A93DC2AC6185632"><enum>(2)</enum><text>conduct an evaluation of the Compliance Program, not less frequently than annually each calendar year through 2023, to assess the functioning and effectiveness of such program in meeting the stated goals and purpose of the program;</text></paragraph><paragraph id="H67EE9C88D0044B139D19A28D0EF63B2E"><enum>(3)</enum><text>provide reports to the Administrator containing the results of any evaluation conducted under paragraph (2), including identifying in such report any nonconformities or deficiencies in the implementation of the program and compliance of regulated entities with safety standards of the Administration;</text></paragraph><paragraph id="HACC3CB160D584EB8AEBF2AC67C7844D8"><enum>(4)</enum><text>make recommendations to the Administrator on regulations, guidance, performance standards or metrics, or other controls that should be issued by the Administrator to improve the effectiveness of the Compliance Program in meeting the stated goals and purpose of the program and to ensure the highest levels of aviation safety; and</text></paragraph><paragraph id="HEE92167B496648259DADAC590DB3CCA5"><enum>(5)</enum><text>carry out any other oversight duties with respect to implementation of the Compliance Program and assigned by the Administrator.</text></paragraph></subsection><subsection id="H4D38C01C959A4D00A02486804CF6D3AF"><enum>(c)</enum><header>Executive council</header><paragraph id="HFE88412AE6D748E580293EA9D6DC3408"><enum>(1)</enum><header>Executive council membership</header><text>The Compliance Program Executive Council shall be comprised of representatives from each program office with regulatory responsibility as provided in Order 8000.373A.</text></paragraph><paragraph id="H7CCAF702F47041D3B0B1A0250A84DAB1"><enum>(2)</enum><header>Chairperson</header><text>The Executive Council shall be chaired by a person, who shall be appointed by the Administrator and shall report directly to the Administrator.</text></paragraph><paragraph id="HC8A58B44A3EF4E7783A047983FDD3B1A"><enum>(3)</enum><header>Independence</header><text>The Secretary of Transportation, the Administrator, or any officer or employee of the Administration may not prevent or prohibit the chair of the Executive Council from performing the activities described in this section or from reporting to Congress on such activities.</text></paragraph><paragraph id="HFCF22139D78A46D9B3F9DE1B3C491C2E"><enum>(4)</enum><header>Duration</header><text>The Executive Council shall terminate on October 1, 2023.</text></paragraph></subsection><subsection id="H7FD39EC000B146F18C268010B6889FD3"><enum>(d)</enum><header>Annual briefing</header><text>Each calendar year through 2023, the chair of the Executive Council shall provide a briefing to the congressional committees of jurisdiction on the effectiveness of the Administration’s Compliance Program in meeting the stated goals and purpose of the program and the activities of the office described in subsection (b), including any reports and recommendations made by the office during the preceding calendar year.</text></subsection></section><section id="H981E811D29DA4C05B55C03FFA24B3AAA"><enum>24.</enum><header>Settlement agreement</header><subsection id="H16C76EE84D0C4DC286E2F159676859D7"><enum>(a)</enum><header>Sense of congress</header><text>It is the sense of Congress that the Administrator should fully exercise all rights and pursue all remedies available to the Administrator under any settlement agreement between the Administration and the holder of a type certificate and production certificate for transport airplanes executed on December 18, 2015, including a demand for full payment of any applicable civil penalties deferred under such agreement, if the Administrator concludes that such holder has not fully performed all obligations incurred under such agreement.</text></subsection><subsection id="H6BF0DBB96F9B44ABA02486D983711843"><enum>(b)</enum><header>Congressional briefing</header><text>Not later than February 1, 2021, and every 6 months thereafter until a certificate holder described in subsection (a) has fully performed all obligations incurred by such certificate holder under such settlement agreement, the Administrator shall brief the congressional committees of jurisdiction on action taken consistent with subsection (a).</text></subsection></section><section id="HB2C51FF5C08A4665AFB609A1B5B80DE3" display-inline="no-display-inline" section-type="subsequent-section"><enum>25.</enum><header>Human factors</header><subsection id="H497AC912E77F4B4ABCA7759BB3D97D4D"><enum>(a)</enum><header>Aircraft certification process</header><paragraph id="H7A4A34A803554F2286184F388C562FA7"><enum>(1)</enum><header>Evaluation</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator (acting through the Associate Administrator for Aviation Safety of the Administration) shall—</text><subparagraph id="H74B61F7BAC3943DB8D73474E7700D741"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an evaluation of the development of tools and methods to support the integration of human factors assessment and system safety assessments of human interaction with flight deck and flight control systems for transport airplanes into the aircraft certification process under section 44704 of title 49, United States Code; and</text></subparagraph><subparagraph id="H6B4B0BE6944140FCBF7DC843177B480C"><enum>(B)</enum><text display-inline="yes-display-inline">develop a framework to better integrate human factors throughout such aircraft certification process with the objective of improving safety by designing systems and training pilots in a manner that accounts for contemporary knowledge to reduce the possibility of an accident resulting in whole or in part from the pilot’s interaction with the aircraft.</text></subparagraph></paragraph><paragraph id="H36260214E71F4EB59BDE53DEEFDD8D9B" commented="no"><enum>(2)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 60 days after the completion of the evaluation required under paragraph (1), the Administrator shall submit to Congress a report detailing the findings of such report and a plan for implementation based on such findings of such report.</text></paragraph><paragraph id="H3387E954DFA346BCB000B8A948E60B06"><enum>(3)</enum><header>Implementation</header><text display-inline="yes-display-inline">Upon submission of the report required under paragraph (2), the Administrator shall implement the findings of such evaluation.</text></paragraph></subsection><subsection id="HA19A02A5B7504368B793988D8D1A18E2"><enum>(b)</enum><header>Human factors education program</header><paragraph id="H0DDC95D342DD473089728A7B70005DE6"><enum>(1)</enum><header>In general</header><text>The Administrator shall develop a human factors education program that addresses the effects of modern flight deck systems, including automated systems, on human performance for transport airplanes and the approaches for better integration of human factors in aircraft design and certification.</text></paragraph><paragraph id="H8514B6878862497C82B0D92CC1BC0057" commented="no"><enum>(2)</enum><header>Target audience</header><text>The human factors education program shall be integrated into the training protocol in existence as of the date of the enactment of this Act such that such program is routinely administered to the following:</text><subparagraph id="HC88061219B0E40D48EA3F3102532B3F2" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Appropriate employees within the Flight Standards Service.<italic></italic></text></subparagraph><subparagraph id="H716A2DE9191B44A3AF9DC6B83DA1DCA1" commented="no"><enum>(B)</enum><text>Appropriate employees within the Aircraft Certification Service.<italic></italic></text></subparagraph><subparagraph id="HA06094ECCF8849BA935A2F4A5A227C4F" commented="no"><enum>(C)</enum><text>Other employees or authorized representatives determined to be necessary by the Administrator.</text></subparagraph></paragraph></subsection><subsection id="H2CC061A95BAC41EBBF8A103ED561EF44"><enum>(c)</enum><header>Transport airplane manufacturer information sharing</header><text display-inline="yes-display-inline">The Administrator shall—</text><paragraph id="H2CB1CA99F33A4B5F80C8B6E7B8FA33C7" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">require each transport airplane manufacturer to provide the Administrator with the information or findings necessary for flight crew to be trained on flight deck systems;</text></paragraph><paragraph id="H41286D7233FE4A4AADE551137BE22261"><enum>(2)</enum><text display-inline="yes-display-inline">ensure the information or findings under paragraph (1) adequately includes consideration of human factors; and</text></paragraph><paragraph id="H69F168D6B2CD427CB42A6FF0A0A5A07C"><enum>(3)</enum><text display-inline="yes-display-inline">ensure that each transport airplane manufacturer identifies any technical basis, justification or rationale for the information and findings under paragraph (1).</text></paragraph></subsection></section><section id="H5A1C4995B3CA41248E9E68D704865D1A"><enum>26.</enum><header>Technical corrections</header><text display-inline="no-display-inline">Section 46301 of title 49, United States Code, is amended—</text><paragraph id="H9FBC11D62AD74327903A25F7ED5B6867"><enum>(1)</enum><text>in subsection (a)(1)(A) by striking <quote>(except sections 44717 and 44719–44723)</quote> and inserting <quote>(except sections 44704(a)(6), 44704(e)(4), 44717, and 44719–44723)</quote>;</text></paragraph><paragraph id="H4C43169AF1394C4485CBBD0F6AB9A5E9"><enum>(2)</enum><text>in subsection (a)(5)(A) by striking <quote>(except sections 44717–44723)</quote> and inserting <quote>(except sections 44704(a)(6), 44704(e)(4), and 44717–44723)</quote>;</text></paragraph><paragraph id="HE8C2A9BECE134F89BAC1AD279B2E1984" commented="no"><enum>(3)</enum><text>in subsection (d)(2) by striking <quote>(except sections 44717 and 44719–44723)</quote> and inserting <quote>(except sections 44704(a)(6), 44704(e)(4), 44717, and 44719–44723)</quote>; and </text></paragraph><paragraph id="HD9CE22BC8C854209A4D739327E27B341"><enum>(4)</enum><text>in subsection (f)(1)(A)(i) by striking <quote>(except sections 44717 and 44719–44723)</quote> and inserting <quote>(except sections 44704(a)(6), 44704(e)(4), 44717, and 44719–44723)</quote>.</text></paragraph></section><section id="H39CB7B51A8FB4434A3EA0866A9D7A850"><enum>27.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HC87F7A77195442FDA1AF295DE364DFA4"><enum>(1)</enum><header>Administration; FAA</header><text>The terms <quote>Administration</quote> and <quote>FAA</quote> mean the Federal Aviation Administration.</text></paragraph><paragraph id="H71F9CA916364498EA1829AA5EDF1915F"><enum>(2)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the FAA.</text></paragraph><paragraph id="H9184B848B7FA45D186CCC0296C96C73A"><enum>(3)</enum><header>Organization designation authorization</header><text>The term <quote>organization designation authorization</quote> has the same meaning given such term in section 44736 of title 49, United States Code.</text></paragraph><paragraph id="H8DBC58DA5BF24BC798E5A06EE7407068"><enum>(4)</enum><header>Congressional committees of jurisdiction</header><text>The term <quote>congressional committees of jurisdiction</quote> means the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph><paragraph id="H0ABA8E310D374B9386806D7C25B9CE04" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Human factors</header><text display-inline="yes-display-inline">The term <term>human factors</term> means a multidisciplinary set of principles developed to holistically explain and predict pilot behavior in relation to the management of the operation of an aircraft, including the pilot’s management of aircraft systems and response to systems failures and non-normal conditions.</text></paragraph><paragraph id="H9EA72E0106C94B4D86A582CCE8E2662C" commented="no"><enum>(6)</enum><header>Transport airplane</header><text>The term <quote>transport airplane</quote> means a transport-category airplane designed for operation by an air carrier or foreign air carrier type-certificated with a passenger seating capacity of 30 or more or an all-cargo or combi derivative of such an airplane.</text></paragraph><paragraph id="HC7D5303499734763877F2C0F784FCA08"><enum>(7)</enum><header>Type certificate</header><text>The term <quote>type certificate</quote>—</text><subparagraph id="HD2F63AF803B84FB081F2CF85E60C843B"><enum>(A)</enum><text>means a type certificate issued pursuant to section 44704(a) of title 49, United States Code, or an amendment to such certificate; and</text></subparagraph><subparagraph id="H68D47817915242C2AE94D66DFBD6A2DB"><enum>(B)</enum><text>does not include a supplemental type certificate issued under section 44704(b) of such section.</text></subparagraph></paragraph></section></legis-body></bill>
