R. 8362</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200923">September 23, 2020</action-date><action-desc><sponsor name-id="P000618">Ms. Porter</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HHA00">House Administration</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require senior officials to report payments received from the Federal Government and to improve the filing and disclosure of financial disclosures by Members of Congress, congressional staff, and very senior employees.</official-title></form><legis-body id="H585C7B4295B7442D9ACB3295287A8069" style="OLC"><section id="H72562B5DB2854F7A8A0B9F7725878033" section-type="section-one"><enum>1.</enum><header>Improved reporting of payments and financial disclosures</header><subsection id="H3B4B41F0F3DD475F807892ED34ACC719"><enum>(a)</enum><header>Reporting of applications for and payments received from the Federal Government</header><paragraph id="H75C5F12E3F65400EB4C5018E3C731F70"><enum>(1)</enum><header>In general</header><text>Section 101 of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB1DA3D90EACD4A6084C2D9669F593CDE"><subsection commented="no" display-inline="no-display-inline" id="HE9E3C83C2DA440DE9ADC0F1785873F87"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA2563DDD8A194054B055D83FF93CDF24"><enum>(1)</enum><text display-inline="yes-display-inline">In this subsection— </text><subparagraph commented="no" display-inline="no-display-inline" id="HBEB501075FD84BF9B77B73AB1E3F9C89" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>covered payment</term>— </text><clause commented="no" display-inline="no-display-inline" id="H5E11D491164F49959B39F0C8D6C4AB83"><enum>(i)</enum><text display-inline="yes-display-inline">means a payment of money or anything else of value made or promised to be by the Federal Government, including a loan agreement, contract, or grant (including relating to agricultural activity); </text></clause><clause commented="no" display-inline="no-display-inline" id="H4977E2BD2A3A4B21B8BAF43A02429DD6"><enum>(ii)</enum><text display-inline="yes-display-inline">includes any other type of payment of money or anything else of value as the Secretary of the Treasury, in consultation with the Director of the Office of Government Ethics, may by regulation establish; and</text></clause><clause display-inline="no-display-inline" commented="no" id="H199FB6A257104F2EB29C9BFEC71F5DA5"><enum>(iii)</enum><text>does not include— </text><subclause display-inline="no-display-inline" commented="no" id="HFB497FADA0E24CE99093521FB7B171CC"><enum>(I)</enum><text>any salary or compensation for service performed as, or reimbursement of personal outlay by, an officer or employee of the Federal Government; or</text></subclause><subclause display-inline="no-display-inline" commented="no" id="H827D0D02A79D4EC6A5C6CEC137AFE5A8"><enum>(II)</enum><text>any tax refund (including a refundable tax credit); and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="HD5A50C8C77DC486792121BC19DBDC081"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>covered person</term> means a person described in paragraphs (1) through (10) of section 103(l). </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4BC6B239A13D472A8222EB7BF53B8829" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than 30 days after receiving notification of any application for or receipt of a covered payment by a covered person, the spouse of the covered person, or a dependent child of the covered person (including any business owned and controlled by the covered person, the spouse of the covered person, or a dependent child of the covered person), but in no case later than 45 days after the covered payment is made or promised to be made, the covered person shall file a report of the covered payment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HCD7D9194D060447088F5A6C9E6A99A88"><enum>(2)</enum><header>Contents</header><text>Section 102 of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB3114CD35CB945928722A15633CADA1E"><subsection commented="no" display-inline="no-display-inline" id="H479A241A6D664CE49DFA70AEB1BA5309"><enum>(j)</enum><text display-inline="yes-display-inline">A report filed pursuant to section 101(j) shall— </text><paragraph id="HB7A213AD3AC94DD5ADF8AB0B1932E218"><enum>(1)</enum><text>identify the type of payment or thing of value applied for or received; </text></paragraph><paragraph id="HE1E19FC68AAD475EA376B74F495724DD"><enum>(2)</enum><text>include the name of the recipient and the relation to the person required to file the report; </text></paragraph><paragraph id="HB25E14D32D2F4D2E8DCB0C1501042DC4"><enum>(3)</enum><text>provide the date of the application for and the date of receipt of the payment or thing of value; and</text></paragraph><paragraph id="H88274D03D0D74B328460B8EAB5C132A8"><enum>(4)</enum><text>indicate the amount of the payment or thing of value.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H26A01295B1774415AD3E1D2F917A200E"><enum>(3)</enum><header>Effective date</header><text>The amendments made by paragraphs (1) and (2) shall apply to payments made or promised to be made on or after the date that is 90 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H5E4823B4D08540A6A578953A55385B13"><enum>(b)</enum><header>Updating the public filing and disclosure of financial disclosure forms</header><paragraph id="HB48101EB225042D6995E4D4EB6438211"><enum>(1)</enum><header>Members of Congress and congressional staff</header><text>Section 8(b)(1)(B) of the STOCK Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/105">5 U.S.C. App. 105</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7A52F498B7534F93A5DE3A21699701BE"><subparagraph id="H296AF085C6664F3397AC4BAAD7EB7BF0"><enum>(B)</enum><text>public access— </text><clause id="H5B3B4A597265442DB440D3B10E26935B"><enum>(i)</enum><text>through databases that are maintained on the official websites of the House of Representatives and the Senate; </text></clause><clause id="HDFF9F4B2C93C48BC974D78C688B6C716"><enum>(ii)</enum><text>to— </text><subclause id="H5A89EEDF70B34839847EDA1550D5F074"><enum>(I)</enum><text>each financial disclosure report filed by a Member of Congress or a candidate for Congress; </text></subclause><subclause id="H612AE84B40034FE3B59D612FE9A12D33"><enum>(II)</enum><text>each report filed by a Members of Congress or a candidate for Congress of a transaction disclosure required by <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /103">section 103(l)</external-xref> of the Ethics in Government Act of 1978 (5 U.S.C. App); and</text></subclause><subclause id="H9B16B3D57532416FB591CDA53059B279"><enum>(III)</enum><text>notice of any extension, amendment, or blind trust, with respect to a report described in subclause (I) or (II), pursuant to title I of the Ethics in Government Act of 1978 (5 U.S.C. App.); and</text></subclause></clause><clause id="HA93A938D0BF549A8A2F778E50F44E917"><enum>(iii)</enum><text>in a manner that—</text><subclause id="HB2ACB4378E4F4DE08C6F6C6DD3851757"><enum>(I)</enum><text>allows the public to search, sort, and download data contained in the reports described in subclause (I) or (II) of clause (ii) by criteria required to be reported, including by filer name, asset, transaction type, ticker symbol, notification date, amount of transaction, and date of transaction;</text></subclause><subclause id="HE4C4C3BE87F24D1C8A1E2E3A88D2C14A"><enum>(II)</enum><text>allows access through an application programming interface; and</text></subclause><subclause id="HB764E82EC1FF495895E556A3F36D0AB0"><enum>(III)</enum><text>is fully compliant with section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>) and the most recent Web Content Accessibility Guidelines, or successor guidelines.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H149E108CB24D4F26B773CDC92471FF27"><enum>(2)</enum><header>Very senior executive branch employees</header><text>Section 11(b)(1)(B) of the STOCK Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/105">5 U.S.C. App. 105</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8FDA464A7E0048CDABC11E22092F0A2E"><subparagraph id="H7D381047CD9F4915AB273029E01DA433"><enum>(B)</enum><text>public access— </text><clause id="H50B7860CDD44495EAB0F263E3E0F734F"><enum>(i)</enum><text>through a database that is maintained on the official website of the Office of Government Ethics; </text></clause><clause id="H7AFCBDB9D36F4CD6B09E8218395BCA51"><enum>(ii)</enum><text>to— </text><subclause id="H40C1684B9F63400096EB02F552859182"><enum>(I)</enum><text>each financial disclosure report filed by the President, the Vice President, or any officer occupying a position listed in section 5312 or section 5313 of title 5, United States Code, having been nominated by the President and confirmed by the Senate to that position; </text></subclause><subclause id="H3918AF442F0B4AF3B1BF397F39764383"><enum>(II)</enum><text>each report filed by an individual described in subclause (I) of a transaction disclosure required by <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /103">section 103(l)</external-xref> of the Ethics in Government Act of 1978 (5 U.S.C. App); and</text></subclause><subclause id="H5128F2CAF1D74DB2A6A9B0E4F4903536"><enum>(III)</enum><text>notice of any extension, amendment, or blind trust, with respect to a report described in subclause (I) or (II), pursuant to title I of the Ethics in Government Act of 1978 (5 U.S.C. App.); and </text></subclause></clause><clause id="HAFD11C7F385C448BA05FC5CD2F737109"><enum>(iii)</enum><text>in a manner that—</text><subclause id="H0446FFE287794F7C8EDD7F61FFDBE05F"><enum>(I)</enum><text>allows the public to search, sort, and download data contained in the reports described in subclause (I) or (II) of clause (ii) by criteria required to be reported, including by filer name, asset, transaction type, ticker symbol, notification date, amount of transaction, and date of transaction;</text></subclause><subclause id="H7FB457309CC84C1595F9A6A672F8E513"><enum>(II)</enum><text>allows access through an application programming interface; and</text></subclause><subclause id="H9FC88BABF8704E3386C844517BD2F485"><enum>(III)</enum><text>is fully compliant with section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>) and the most recent Web Content Accessibility Guidelines, or successor guidelines.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBAA7F222A8F34C3BAFCE7A76500AB982"><enum>(3)</enum><header>Applicability</header><text>The amendments made by this subsection shall—</text><subparagraph id="H8CC55D6780D04F9FA6568A589D47EE68"><enum>(A)</enum><text>take effect on the date of enactment of this Act; and</text></subparagraph><subparagraph id="H2F7BD46C4D3B44D68C24267398F3FAE6"><enum>(B)</enum><text>apply on and after the date that is 18 months after the date of enactment of this Act. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
