which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To correct shortfalls in the Great American Outdoors Act by providing fairness and parity to Eastern States, strengthening commitments to urban recreation, establishing logic in funding priorities, and ensuring appropriate consequences for shifts in funding sources, and for other purposes.</official-title></form><legis-body id="HFE1EBAAB00AC4BC88C6DB689245C9257" style="OLC"><section id="H3FFAE4626DEA4EAB87ED369B85C31A13" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving the Not-So-Great American Outdoors Act</short-title></quote>.</text></section><section id="H85D96446128040F3A4FD6B4932D8714C"><enum>2.</enum><header>Ensuring fairness and parity for eastern States</header><text display-inline="no-display-inline"> Section 200306(a) of title 54, United States Code, is amended by adding the at the end the following:</text><quoted-block id="H4CD6A956C1EC4AC78EA014FDB84DD9B3"><paragraph id="HD7EB91A16B7E47378A32738844DB2518"><enum>(5)</enum><text display-inline="yes-display-inline">Except for amounts specifically authorized by an Act of Congress, not less than 50 percent of the land acreage or interests in land acreage acquired pursuant to this section shall be east of the 100th meridian.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HAA9D6A624D9345E6A494A79AD59F4DD2"><enum>3.</enum><header>Strengthening commitments to urban recreation</header><subsection id="HCB4D964FA9EC49A08BDE9D0092A86A6F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H56EEE5071E1C42F4A35B0C4334E1696C"><enum>(1)</enum><header>Eligible entity</header><subparagraph id="H4F0C65674B264EB8BEA9C98417FFC3C3"><enum>(A)</enum><header>In general</header><text>The term <term>eligible entity</term> means—</text><clause id="H283C986DC33F4378BF33B11606595A39"><enum>(i)</enum><text>a State;</text></clause><clause id="H1C4B920FFD7548AFA6DD1C376448914E"><enum>(ii)</enum><text>a political subdivision of a State, including—</text><subclause id="HE059CA0D37C942BAAF63591D4D624EB9"><enum>(I)</enum><text>a city; and</text></subclause><subclause id="HE71ED66F4258429CB6720D626AE92F6F"><enum>(II)</enum><text>a county;</text></subclause></clause><clause id="HC1F4AEF72F484924A121434186952CBC"><enum>(iii)</enum><text>a special purpose district, including park districts; and</text></clause><clause id="H77E7B4A1A00F49D3A6F26D4E44267F6F"><enum>(iv)</enum><text>an Indian Tribe.</text></clause></subparagraph><subparagraph id="H5D9F048A54704942B5F0BF81451D644B"><enum>(B)</enum><header>Political subdivisions and Indian tribes</header><text>A political subdivision of a State or an Indian Tribe shall be considered an eligible entity only if the political subdivision or Indian Tribe represents or otherwise serves a qualifying urban area.</text></subparagraph></paragraph><paragraph id="H4D80AD7571CC4FBE92EE27186856AFBB"><enum>(2)</enum><header>Outdoor recreation legacy partnership grant program</header><text>The term <term>Outdoor Recreation Legacy Partnership Grant Program</term> means the program established under subsection (b).</text></paragraph><paragraph id="HDE17652207C94A6FB88812C3C1123FB0"><enum>(3)</enum><header>Qualifying urban area</header><text>The term <term>qualifying urban area</term> means an area identified by the Census Bureau as an <term>urban area</term> in the most recent census.</text></paragraph><paragraph id="H936FBEBAFE36499996397385AC098B0E"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="HAE7B4A3C47F747FA93BEEF25E2366F16"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish an outdoor recreation legacy partnership grant program under which the Secretary may award grants to eligible entities for projects—</text><paragraph id="HE424897C09FF4ECFBBB3364DAAC79480"><enum>(1)</enum><text>to acquire land and water for parks and other outdoor recreation purposes;</text></paragraph><paragraph id="HA87585EF72A6468A96CF5E903D30DBFC"><enum>(2)</enum><text>to develop new or renovate existing outdoor recreation facilities; and</text></paragraph><paragraph id="H9D5AFCA1C3714E5BBBE1ED945065CC74"><enum>(3)</enum><text>to develop projects that provide opportunities for outdoor education and public lands volunteerism.</text></paragraph></subsection><subsection id="H12AF003FA48B4B8D89558E50266234EB"><enum>(c)</enum><header>Matching requirement</header><paragraph id="H94A4CEEEAEEA49B69C3FE474FC71EDE6"><enum>(1)</enum><header>In general</header><text>As a condition of receiving a grant under subsection (b), an eligible entity shall provide matching funds in the form of cash or an in-kind contribution in an amount equal to not less than 100 percent of the amounts made available under the grant.</text></paragraph><paragraph id="H7D6A46DE897D48AEAD698CFFCD7EF4FA"><enum>(2)</enum><header>Sources</header><text>The matching amounts referred to in paragraph (1) may include amounts made available from State, local, nongovernmental, or private sources.</text></paragraph><paragraph id="H4C1C85C0C37042BE8114417A9C83C384"><enum>(3)</enum><header>Waiver</header><text>The Secretary may waive all or part of the matching requirement under paragraph (1) if the Secretary determines that—</text><subparagraph id="HB0C94A9C11D848C6B096749011E901E5"><enum>(A)</enum><text>no reasonable means are available through which an applicant can meet the matching requirement; and</text></subparagraph><subparagraph id="H8A6FFD8C629242A9928276F99C0C69A1"><enum>(B)</enum><text>the probable benefit of such project outweighs the public interest in such matching requirement.</text></subparagraph></paragraph></subsection><subsection id="HAA2252C7FC43463A89B920A8C26CD7A7"><enum>(d)</enum><header>Eligible uses</header><paragraph id="HE1758C63714F49019B0452062E210C27"><enum>(1)</enum><header>In general</header><text>A grant recipient may use a grant awarded under this section—</text><subparagraph id="HF301434C05A449CD81B43B2DAA2F8E4A"><enum>(A)</enum><text>to acquire land or water that provides outdoor recreation opportunities to the public; and</text></subparagraph><subparagraph id="HE9913DCBD0B343B6A4558097D5775BD3"><enum>(B)</enum><text>to develop or renovate outdoor recreational facilities that provide outdoor recreation opportunities to the public, with priority given to projects that—</text><clause id="H8973699424144F318F922CF8F72BBB41"><enum>(i)</enum><text>create or significantly enhance access to park and recreational opportunities in an urban or suburban area that lacks access to such activities;</text></clause><clause id="HC549B97C4C0D47C3B108CB8B58F5CFB6"><enum>(ii)</enum><text>engage and empower underserved communities and youth;</text></clause><clause id="H56B03B196C024ABE92BDF1442C640F97"><enum>(iii)</enum><text>provide opportunities for youth employment or job training;</text></clause><clause id="HCEE563E01EC648828AE9CEF31A9285B6"><enum>(iv)</enum><text>establish or expand public-private partnerships, with a focus on leveraging resources; and</text></clause><clause id="HEDD294D5C60F467CBBE512FE210AAA4C"><enum>(v)</enum><text>take advantage of coordination among various levels of government.</text></clause></subparagraph></paragraph><paragraph id="H28C5E256C1AB4457B9CCF5EEDC149D1E"><enum>(2)</enum><header>Limitations on use</header><text>A grant recipient may not use grant funds for—</text><subparagraph id="HC93BCBB9FEA74001852D613585B893FF"><enum>(A)</enum><text>grant administration costs;</text></subparagraph><subparagraph id="H60954F61265C4408A8455536849B71D1"><enum>(B)</enum><text>incidental costs related to land acquisition, including appraisal and titling;</text></subparagraph><subparagraph id="H1E626B91209A4D60B91D0292F9E4063F"><enum>(C)</enum><text>operation and maintenance activities;</text></subparagraph><subparagraph id="H6401287E1DC241FAB2CD32447F6357A8"><enum>(D)</enum><text>facilities that support semiprofessional or professional athletics;</text></subparagraph><subparagraph id="HB8DC11E4BCDF4F6A8723896C3E05DDE7"><enum>(E)</enum><text>indoor facilities such as recreation centers or facilities that support primarily non-outdoor purposes; or</text></subparagraph><subparagraph id="HF446F7047DB3461E8CA13371AF5C6726"><enum>(F)</enum><text>acquisition of land or interests in land that restrict access to specific persons.</text></subparagraph></paragraph></subsection><subsection id="H1BA8E769B59E4C86A9D45C78C992AA49"><enum>(e)</enum><header>National park service requirements</header><text>In carrying out the Outdoor Recreation Legacy Partnership Grant Program, the Secretary shall—</text><paragraph id="HDF574BDF7D1644629AD2CD23D103E710"><enum>(1)</enum><text>conduct an initial screening and technical review of applications received; and</text></paragraph><paragraph id="HD17888848E3E4594BF5B5762075959F6"><enum>(2)</enum><text>evaluate and score all qualifying applications.</text></paragraph></subsection><subsection id="H992D67E90860473B82B6FE3D56BC073B"><enum>(f)</enum><header>Reporting</header><text display-inline="yes-display-inline">Each grant recipient that receives a grant under this section shall annually submit to the Secretary performance and financial reports that—</text><paragraph id="H90AB931842EB441C838ADE8279A6C4F0"><enum>(1)</enum><text>summarize project activities conducted during the report period; and</text></paragraph><paragraph id="HD56E07672B1B446E992449068C71E76A"><enum>(2)</enum><text>provide the status of the project, including of description of how the project has improved access to parkland, open space, or recreational facilities from the community perspective.</text></paragraph></subsection><subsection id="H169BD335D18C493D97B97F418CC87CB1"><enum>(g)</enum><header>Funding</header><text>Section 200306(a) of title 54, United States Code, is amended by adding at the end the following:</text><quoted-block id="H4ACC1A6F2431486E9285252460BFC5D6" style="OLC"><paragraph id="HCA8595B1C3BD40C2B84D9719FE1460DA"><enum>(7)</enum><text>Five percent of the amounts shall be allocated to provide grants under the Outdoor Recreation Legacy Partnership Grant Program established under section 3 of the <short-title>Improving the Not-So-Great American Outdoors Act</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2997204AE81B4067AF673D506237ECF5"><enum>4.</enum><header>Establishing logic in funding priorities</header><text display-inline="no-display-inline">Section 200402(b) of title 54, United States Code, is amended by—</text><paragraph id="H679095A4D8D1442A8C9FB50ADE69BB8A"><enum>(1)</enum><text>redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph id="H2F743CA6436442BFB52B6A3B16E36621"><enum>(2)</enum><text>adding the following after paragraph (2)—</text><quoted-block id="HFA1D056EE7F44B4CB85A50ED113E27F4" style="OLC"><paragraph id="H03BCEECAF21144729FF8E14323126AC8"><enum>(3)</enum><header>Insufficient funds</header><text>In any of fiscal years 2021 through 2025 in which the total amount deposited into the Fund is less than $1,900,000,000, sufficient funds (if available) under section 200306 5 of title 54, United States Code, shall also be available for the uses of the Fund in accordance with this chapter in such amounts as are necessary to ensure that a total of $1,900,000,000 is available for those uses for that fiscal year. If sufficient funds are not available under section 200306 of title 54, United States Code, to ensure the $1,900,000,000 total, then the maximum amount allocated to that section shall be made available for the uses of the Fund.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE5BC9C61571D4C55802F0BF60C904F34"><enum>5.</enum><header>Transparency in project funding allocation</header><text display-inline="no-display-inline">Section 200303(c)(2)(B) of title 54, United States Code, is amended by inserting <quote>only in accordance with the detailed submission to Congress under paragraph (1)</quote> after <quote>allocated by the President</quote> both places it appears.</text></section><section id="HA4E0F9B51DB244B8BE731D2E9135286D"><enum>6.</enum><header>Appropriate consequences regarding funding sources</header><text display-inline="no-display-inline">In the first fiscal year in which receipts under section 200302(c)(2) of title 54, United States Code, are unavailable for deposit in the Land and Water Conservation Fund established under that section, the Land and Water Conservation Fund shall be repealed, any existing unobligated balances shall revert to the general Treasury, and any future revenues and collections that would have been deposited in that Fund shall instead be deposited in the general Treasury.</text></section><section id="H2E289335C9284EA19D31F93CF724EDDD"><enum>7.</enum><header>Ensuring availability of funds for maintenance backlog</header><text display-inline="no-display-inline">Section 200302(c) of title 54, United States Code, is amended by striking <quote>not less than</quote>.</text></section><section id="HFC8F836C343F4F639D230934034A62A6"><enum>8.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">Section 200306(a)(2)(B) of title 54, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="H9BAA1C58E57F47EF9F1405BC5B4CCF28" display-inline="no-display-inline"><clause id="H1B515061D4D443D7B6432DA1DF8A3926"><enum>(iii)</enum><header>Limitation</header><text display-inline="yes-display-inline">Except for areas specifically authorized by Act of Congress, not more than 15 percent of the acreage added to the National Forest System pursuant to this section shall be west of the 100th meridian.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
