committed to the Committee of the Whole House on the State of the Union and ordered to be printed<pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To support the Consumer Product Safety Commission’s capability to protect consumers from unsafe consumer products, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="HD1033766A0514FAABCD57EFE121B3BBA" style="OLC"><section id="H40DA41B6E0674674B40A0A1D2247E88A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Product Safety Inspection Enhancement Act</short-title></quote>.</text></section><section id="HD820F8858A4A49A1930B3606D885F016"><enum>2.</enum><header>Enhanced risk assessment methodology</header><text display-inline="no-display-inline">Section 17 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2066">15 U.S.C. 2066</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HD28832CEEFD948AB9823D95A3DEDCA95" display-inline="no-display-inline"><subsection id="H957E5CA250594BCF9D08EBF29DC4A448"><enum>(i)</enum><header>Enhanced risk assessment methodology</header><paragraph id="H471259AFEB3D4DE08B7B7E66403837BB"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of the <short-title>Consumer Product Safety Inspection Enhancement Act</short-title>, the Commission shall enhance targeting, surveillance, and screening of consumer products entering the United States at ports of entry, including ports of entry for de minimis shipments, by—</text><subparagraph id="H967AE2980F894FB285D7EB8B089EF501"><enum>(B)</enum><text>working in consultation with Customs and Border Protection to—</text><clause id="HAA6E2F4FE7F649D889CB87F25377E6D7"><enum>(i)</enum><text>access and leverage all available data, including manifest data, to enhance targeting of violative consumer products, including de minimis shipments containing violative consumer products;</text></clause><clause id="H36E6E26F3FB94015B9CA99317710781E"><enum>(ii)</enum><text>access and leverage intellectual property rights seizure data to target products that may have both intellectual property rights infringements and consumer product safety violations; </text></clause><clause id="HD7BFA09DD9BF4408B213B818E7E3C11C"><enum>(iii)</enum><text display-inline="yes-display-inline">prioritize shipments coming from the People’s Republic of China; and</text></clause><clause id="HCA78D405C5204972834DFE3C23AA72F4"><enum>(iv)</enum><text>use the Participating Government Agencies Message Set, or any successor program, and additional consumer product specific data elements, including certificates of compliance and any other data that the Commission needs, to help risk assess and target violative consumer products; and</text></clause></subparagraph><subparagraph id="HF9CDD398DD0345CE8376CDBF0253177C"><enum>(C)</enum><text>building and improving information technology systems to support electronic access to and connection with the data and targeting systems associated with express consignment carrier facilities, international mail facilities, electronic commerce platforms, and other applicable system participants.</text></subparagraph></paragraph><paragraph id="H8BB33A85122842859E13C99D30F57C57"><enum>(2)</enum><header>Electronic filing of certificates of compliance</header><text display-inline="yes-display-inline">Beginning not later than 2 years after the date of enactment of the Port Surveillance Modernization Act, certificates of compliance shall be filed electronically for consumer products intended for entry into the United States to enhance risk assessment and target de minimis shipments containing violative consumer products. </text></paragraph><paragraph id="H3858CDDB33CE49D4B45231010A1F89E9"><enum>(3)</enum><header>Definitions</header><text>As used in this susbection—</text><subparagraph id="HB10C8E8C093A4E33869938D3C676A09C"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>de minimis shipments</term> means articles containing consumer products entering the United States under the de minimis value exemption in <external-xref legal-doc="usc" parsable-cite="usc/19/1321">19 U.S.C. 1321(a)(2)(C)</external-xref>;</text></subparagraph><subparagraph id="HD3953DFDD4A74C37982B70988338FE92"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>express consignment carrier facility</term> means a separate or shared specialized facility approved by the port director solely for the examination and release of express consignment shipments;</text></subparagraph><subparagraph id="H759168C3798B4BDE8EDBB8C83A9A2116"><enum>(C)</enum><text>the term <term>ports of entry for de minimis shipments</term> means environments where de minimis shipments are processed, including express consignment carrier facilities, international mail facilities, and air cargo facilities;</text></subparagraph><subparagraph id="H7BE1C71D46E7428EAE31D91545F82477" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">the term <term>violative consumer products</term> means consumer products in violation of an applicable consumer product safety rule under this Act or any similar rule, regulation, standard, or ban under any other Act enforced by the Commission.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HE6C078C24507485690955C5BE12E2B27"><enum>3.</enum><header>Additional CPSC surveillance personnel at key ports of entry for de minimis shipments</header><text display-inline="no-display-inline">The Commission shall hire, train, and assign not fewer than 16 full-time equivalent personnel during each fiscal year and to be stationed at or supporting efforts at ports of entry, including ports of entry for de minimis shipments, for the purpose of identifying, assessing, and addressing shipments of violative consumer products. Such hiring shall continue during each fiscal year until the total number of full-time equivalent personnel equals and sustains the staffing requirements identified in the report to Congress required under section 4. </text></section><section id="HAABDA323623D44F5A411721845491C20"><enum>4.</enum><header>Report to Congress</header><subsection id="H859A12AEBAEC41DDA6F84073DA83D12F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Commission shall transmit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available, a study and report assessing the risk to consumers associated with the targeting and screening of de minimis e-commerce shipments. </text></subsection><subsection id="H7983BA248FDE4A7AA997591478CE983D"><enum>(b)</enum><header>Report Requirements</header><text>In the study and report, the Commission shall—</text><paragraph id="H091D2487541C4B888011030A4EC48ACF"><enum>(1)</enum><text>examine a sampling of de minimis shipments at a sufficient and representative sample of all types of ports of entry where de minimis shipments are processed, including express consignment carrier facilities, international mail facilities, and air cargo facilities to assess the extent to which such shipments include violative consumer products;</text></paragraph><paragraph id="H63A5BE2AE50547CBA02C228A91FF1386"><enum>(2)</enum><text display-inline="yes-display-inline">examine a sampling of shipments coming from the People’s Republic of China to identify trends associated with the shipment of products containing both intellectual property rights infringements and consumer product safety violations;</text></paragraph><paragraph id="HF95A9E322B804EDEB5CE704C6FA18067"><enum>(3)</enum><text>detail plans and timelines to effectively address targeting and screening of de minimis shipments to prevent the entry of violative consumer products entering into the commerce of the United States taking into consideration projected growth in e-commerce;</text></paragraph><paragraph id="H6B6D6ACB38124359836A62761E525B70"><enum>(4)</enum><text>establish metrics by which to evaluate the effectiveness of the Commission efforts to reduce the number of de minimis shipments containing violative consumer products from entering into the commerce of the United States; and</text></paragraph><paragraph id="HF8C7E20D8E494F1B8BFD51EE661BD721"><enum>(5)</enum><text display-inline="yes-display-inline">assess projected technology and resources, including staffing requirements necessary to implement such plans.</text></paragraph></subsection></section><section id="H01EB2668641942D097F199FC66755B27"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="H53CC69A2662B42A6BC2C067D84E38F65"><enum>(1)</enum><text>the term <term>Commission</term> means the Consumer Product Safety Commission;</text></paragraph><paragraph id="HF4FA255CA375432BB3397860986F1480"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>de minimis shipments</term> means articles containing consumer products entering the United States under the de minimis value exemption in <external-xref legal-doc="usc" parsable-cite="usc/19/1321">19 U.S.C. 1321(a)(2)(C)</external-xref>;</text></paragraph><paragraph id="H0493295A8604400CBB1D6E08B90AFB77"><enum>(3)</enum><text>the term <term>ports of entry for de minimis shipments</term> means environments where de minimis shipments are processed, including express consignment carrier facilities, international mail facilities, and air cargo facilities;</text></paragraph><paragraph id="H525CAEC8F663474FA16B33EDD2F00A89" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>violative consumer products</term> means consumer products in violation of an applicable consumer product safety rule under the Consumer Product Safety Act or any similar rule, regulation, standard, or ban under any other Act enforced by the Commission; </text></paragraph><paragraph id="H67962B204CBF4B20BB56FA8C24DC9851"><enum>(5)</enum><text>the term <term>electronic commerce platform</term> or <term>e-commerce platform</term> means any electronically accessed platform that includes publicly interactive features that allow for arranging the sale, purchase, payment, or shipping of goods, or that enables a person other than an operator of such platform to sell or offer to sell physical goods to consumers located in the United States; and</text></paragraph><paragraph id="H98A9250683FB49C2AD66798408B6D2B0"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>express consignment carrier facility</term> means a separate or shared specialized facility approved by the port director solely for the examination and release of express consignment shipments.</text></paragraph></section><section id="H5D09C42A3D26472CB0507A08A66003CC"><enum>6.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to limit, affect, or conflict with any other authority of the Commission or any other statutory requirements governing the Commission.</text></section></legis-body><endorsement display="yes"><action-date>September 24, 2020</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
