<section id="H64FB6BE1C0594231AB0ED1C0A92B7338" section-type="section-one"><enum>1.</enum><header>Community Advantage Loan Program</header><text display-inline="no-display-inline">Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H958432AB6D9E488C9B8AA63E98B029CD" style="OLC"> <paragraph id="HA51E5E0CFAE54D8BBD8579EB6DBA43C8"><enum>(37)</enum><header>Community Advantage Loan Program</header> <subparagraph id="HB46720B99E7541F4882DEAC40D16826A"><enum>(A)</enum><header>Purposes</header><text>The purposes of the Community Advantage Loan Program are—</text> 
<clause id="HACE43FC9E166407F8A00C4B71F52EA3A"><enum>(i)</enum><text>to create a mission-oriented loan guarantee program that builds on the demonstrated success of the Community Advantage Pilot Program of the Administration, as established in 2011, to reach more underserved small business concerns;</text></clause> <clause id="HDD113D6BC0A84275ADD114E2A85D7A35"><enum>(ii)</enum><text>to increase lending to small business concerns in underserved and rural markets, including veterans and members of the military community, small business concerns owned and controlled by socially and economically disadvantaged individuals, women, and startups;</text></clause> 
<clause id="HF2C82385D6994FF0836BBC13E29544EF"><enum>(iii)</enum><text>to ensure that the program under this subsection (in this paragraph referred to as the <term>7(a) loan program</term>) is more inclusive and more broadly meets congressional intent to reach borrowers who are unable to get credit elsewhere on reasonable terms and conditions;</text></clause> <clause id="H8A9065DA8DF64FD2B705479B4303D32F"><enum>(iv)</enum><text>to help underserved small business concerns become bankable by utilizing the small-dollar financing and business support experience of mission-oriented lenders;</text></clause> 
<clause id="HBA073FDF226C4F8391C33853E0CD28B9"><enum>(v)</enum><text>to allow certain mission-oriented lenders, primarily nonprofit financial intermediaries focused on economic development in underserved markets, to access guarantees for loans under this subsection (in this paragraph referred to as <term>7(a) loans</term>) of not more than $250,000 and provide management and technical assistance to small business concerns as needed;</text></clause> <clause id="H0D0E1A14377C4C5BA23F49D25606DF2D"><enum>(vi)</enum><text>to provide certainty for the lending partners that make loans under this subsection and to attract new lenders; and</text></clause> 
<clause id="H7BC73C3B4ABD4F4B8E613E6096414F8D"><enum>(vii)</enum><text>to encourage collaboration between mission-oriented and conventional lenders under this subsection in order to support underserved small business concerns.</text></clause></subparagraph> <subparagraph id="H140EE3821A7A4E55B20C667AE6D5611F"><enum>(B)</enum><header>Definitions</header><text>In this paragraph—</text> 
<clause id="H5CFF43CF6019432DBCF2A9051CDA6507"><enum>(i)</enum><text>the term <term>covered institution</term> means—</text> <subclause id="HD7AFDAEF65AA42A59FC4C9CDFC8C7E2A"><enum>(I)</enum><text>a development company, as defined in section 103 of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/662">15 U.S.C. 662</external-xref>), participating in the 504 Loan Guaranty program established under title V of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695</external-xref> et seq.);</text></subclause> 
<subclause id="H5B64F93E61844CA480438554F240DC87"><enum>(II)</enum><text>a nonprofit intermediary, as defined in subsection (m)(12), participating in the microloan program under subsection (m);</text></subclause> <subclause id="HECCA5727F3484A35854BA9D5DF88C159"><enum>(III)</enum><text>a non-Federally regulated entity certified as a community development financial institution by the Community Development Financial Institutions Fund established under section 104(a) of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4703">12 U.S.C. 4703(a)</external-xref>); and</text></subclause> 
<subclause id="HFDF4E58A748748A7BD6AF62176B6BD6B"><enum>(IV)</enum><text>an eligible intermediary, as defined in subsection (l)(1), as in effect on the day before the date of enactment of this paragraph, that participated in the Intermediary Lending Pilot Program established under subsection (l)(2);</text></subclause></clause> <clause id="H3009A95607B54C9AB8F41C6B07DBC9ED"><enum>(ii)</enum><text>the term <term>existing business</term> means a small business concern that has been in existence for not less than 2 years on the date on which a loan is made to the small business concern under the program;</text></clause> 
<clause id="HCBFF337A8F4F4383A102602DACF2DD20"><enum>(iii)</enum><text>the term <term>new business</term> means a small business concern that has been existence for not more than 2 years on the date on which a loan is made to the small business concern under the program;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H662AE9993553462B91FBAFFF88E7FFFA"><enum>(iv)</enum><text display-inline="yes-display-inline">the term <term>program</term> means the Community Advantage Loan Program established under subparagraph (C);</text></clause> 
<clause id="HF2BFC2C1B5474237967EAE527BC2DFDB"><enum>(v)</enum><text>the term <term>Reservist</term> means a member of a reserve component of the Armed Forces named in section 10101 of title 10, United States Code;</text></clause> <clause commented="no" id="HDBF8087217FC477BA5A4D7DCB511A821"><enum>(vi)</enum><text>the term <term>rural area</term> means any county that the Bureau of the Census has defined as mostly rural or completely rural in the most recent decennial census;</text></clause> 
<clause id="HDB76B58A83C34EB7BBAC4757CA6CF6F3"><enum>(vii)</enum><text>the term <term>service-connected</term> has the meaning given the term in section 101(16) of title 38, United States Code;</text></clause> <clause id="H41D971E2708A40919ABDFFCE983D0B10"><enum>(viii)</enum><text>the term <term>small business concern in an underserved market</term> means a small business concern—</text> 
<subclause commented="no" id="H6ABD2DCC496B4B299277B1B81802DBC6"><enum>(I)</enum><text>that is located in—</text> <item commented="no" id="H76977BE25B4B446E9195AC8A9E1C2359"><enum>(aa)</enum><text>a low- to moderate-income community;</text></item> 
<item id="H423F0FEE17F540819449E34CEF922A84"><enum>(bb)</enum><text>a HUBZone;</text></item> <item id="HA627C5427DB0420DAFA15B3CBA59CEB6"><enum>(cc)</enum><text>a community that has been designated as an empowerment zone or an enterprise community under <external-xref legal-doc="usc" parsable-cite="usc/26/1391">section 1391</external-xref> of the Internal Revenue Code of 1986;</text></item> 
<item id="H12E2AFE77D7F4BE1AEB36D2A88CA1C35"><enum>(dd)</enum><text>a community that has been designated as a promise zone by the Secretary of Housing and Urban Development;</text></item> <item id="HB040ADABAD7245AE8CFB6854749006DD"><enum>(ee)</enum><text>a community that has been designated as a qualified opportunity zone under <external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">section 1400Z–1</external-xref> of the Internal Revenue Code of 1986;</text></item> 
<item id="H5BA95D9D03D248BABE52BC04CA943BE5"><enum>(ff)</enum><text>a rural area; or</text></item> <item id="H90889099D9C444869B3E5D6E247E2F11"><enum>(gg)</enum><text display-inline="yes-display-inline">any area for which a disaster declaration or determination described in subparagraphs (A), (B), (C), or (E) of subsection (b)(2) has been made that has not terminated or expired more than 2 years before the date (or later, as determined by the Administrator) on which a loan is made to such concern under the program;</text></item></subclause> 
<subclause commented="no" id="H99761F49C2EE432FBEC8219DA4C98D29"><enum>(II)</enum><text>for which more than 50 percent of the employees reside in a low- or moderate-income community;</text></subclause> <subclause id="HEEEEA7D9E99F4B0A876AD9DF0FF5BAFE"><enum>(III)</enum><text>that is a startup or new business;</text></subclause> 
<subclause id="HAAC56165D75B4250B8B43956D2B95BA7"><enum>(IV)</enum><text>owned and controlled by socially and economically disadvantaged individuals, including Black Americans, Hispanic Americans, Native Americans, Asian Pacific Americans, and other minorities;</text></subclause> <subclause id="HD9D567D4B8E14DEAA0F18B98DE292CA9"><enum>(V)</enum><text>owned and controlled by women;</text></subclause> 
<subclause id="HE9A76E0C71394B7FB846DE578B990F61"><enum>(VI)</enum><text>owned and controlled by veterans;</text></subclause> <subclause id="H8EC65331C69546CA8CF4093F39C3D3E2"><enum>(VII)</enum><text>owned and controlled by service-disabled veterans;</text></subclause> 
<subclause id="HA3B0C281A0BE40E78A22083B589CE2BB"><enum>(VIII)</enum><text>not less than 51 percent owned and controlled by one or more—</text> <item id="HAAD418CE698F4A4D9D25495DB5E587DD"><enum>(aa)</enum><text>members of the Armed Forces participating in the Transition Assistance Program of the Department of Defense;</text></item> 
<item id="H2C428F693AEA49ADBE84B42E85EC8438"><enum>(bb)</enum><text>Reservists;</text></item> <item id="HB7B2BB259E814663873B89AF9A12C479"><enum>(cc)</enum><text>spouses of veterans, members of the Armed Forces, or Reservists; or</text></item> 
<item id="HDD414956599642449A93539FB0779969"><enum>(dd)</enum><text>surviving spouses of veterans who died on active duty or as a result of a service-connected disability; or</text></item></subclause> <subclause id="H46E09F71CC43442A92F9546BD8235838"><enum>(IX)</enum><text>that is eligible to receive a veterans advantage loan;</text></subclause></clause> 
<clause id="HA342AE0AC667445FA34E541F21ECC377"><enum>(ix)</enum><text>the term <term>small business concern owned and controlled by socially and economically disadvantaged individuals</term> has the meaning given the term in section 8(d)(3)(C);</text></clause> <clause id="HEF76888356E948D3AD19927A21F86B42"><enum>(x)</enum><text>the term <term>startup</term> means a business that has not yet opened; and</text></clause> 
<clause id="H842442AAFE164429A9600EF54916BF9B"><enum>(xi)</enum><text>the term <term>veterans advantage loan</term> means a loan made to a small business concern under this subsection that is eligible for a waiver of the guarantee fee under paragraph (18) or the yearly fee under paragraph (23) because the small business concern is a concern described in subclause (VI), (VII), or (VIII) of clause (viii).</text></clause></subparagraph> <subparagraph id="H7DC0C7A356CE47188A74D443DC9FCA6E"><enum>(C)</enum><header>Establishment</header><text>There is established a Community Advantage Loan Program under which the Administration may guarantee loans made by covered institutions under this subsection, including loans made to small business concerns in underserved markets.</text></subparagraph> 
<subparagraph id="H93DAB23C0F9546BE9902CCFB6DCF4D93"><enum>(D)</enum><header>Program levels</header><text>In each of fiscal years 2021 through 2025, not more than 10 percent of the number of loans guaranteed under this subsection may be guaranteed under the program.</text></subparagraph> <subparagraph id="H53AE3DCA3EFB4B4DB21E6EB23FC4B9EA"><enum>(E)</enum><header>New lenders</header> <clause id="HBE6DF43531544D30B729465034044B08"><enum>(i)</enum><header>Fiscal years 2021 and 2022</header><text>In each of fiscal years 2021 and 2022—</text> 
<subclause id="HF550086C67EC4C66A05FE58FA46A09AC"><enum>(I)</enum><text>not more than 150 covered institutions shall participate in the program; and</text></subclause> <subclause id="HECD592C8B8CB4A45AFDF9CC6A52901C4"><enum>(II)</enum><text>the Administrator shall allow for new applicants and give priority to applications submitted by any covered institution that is located in an area with insufficient lending under the program.</text></subclause></clause> 
<clause id="H846EB80C942242B493523BC7E85F6676"><enum>(ii)</enum><header>Fiscal years 2023, 2024, and 2025</header> 
<subclause id="H9AEECBF188FD4B0FA682CA02CDD10F9B"><enum>(I)</enum><header>In general</header><text>In each of fiscal years 2023, 2024, and 2025—</text> <item id="H0A2E30954FE04E3C96CB8CB4948EE872"><enum>(aa)</enum><text>except as provided in subclause (II), not more than 175 covered institutions shall participate in the program; and</text></item> 
<item commented="no" display-inline="no-display-inline" id="HBD40F87DB0E944369E9C03C843E70AB0"><enum>(bb)</enum><text display-inline="yes-display-inline">the Administrator shall allow for new applicants and give priority to applications submitted by any covered institution that is located in an area with insufficient lending under the program.</text></item></subclause> <subclause commented="no" display-inline="no-display-inline" id="H364A48E7BB164051994C1EF0F46A7E48"><enum>(II)</enum><header>Exception for fiscal year 2025</header><text>In fiscal year 2025, not more than 200 covered institutions may participate in the program if—</text> 
<item commented="no" display-inline="no-display-inline" id="H169CBD2E561548AB856EF3166CEFDDBA"><enum>(aa)</enum><text>after reviewing the report under subparagraph (M)(iii), the Administrator determines that not more than 200 covered institutions may participate in the program;</text></item> <item commented="no" display-inline="no-display-inline" id="HC89AF9E2A2364464A670BADDCC83D0E6"><enum>(bb)</enum><text>the Administrator notifies Congress in writing of the determination of the Administrator under item (aa); and</text></item> 
<item commented="no" display-inline="no-display-inline" id="H7752E5E9F9FE4986B12C4C2D8AEAA2F8"><enum>(cc)</enum><text>not later than July 30, 2024, the Administrator notifies the public of the determination of the Administrator under item (aa).</text></item></subclause></clause></subparagraph> <subparagraph id="H60AAC52F3EC443B28DAC30400DF778F7"><enum>(F)</enum><header>Grandfathering of existing lenders</header><text>Any covered institution that participated in the Community Advantage Pilot Program of the Administration and is in good standing on the day before the date of enactment of this paragraph—</text> 
<clause id="H4495285F90944A57B0550F38A34256BD"><enum>(i)</enum><text>shall retain designation in the program; and</text></clause> <clause id="H69F72502C083494AA5C5265184D28174"><enum>(ii)</enum><text>shall not be required to submit an application to participate in the program.</text></clause></subparagraph> 
<subparagraph id="H7822A694C4234915BF7D676DEBB30E91"><enum>(G)</enum><header>Requirement to make loans to underserved markets</header><text>Not less than 75 percent of loans made by a covered institution under the program shall consist of loans made to small business concerns in underserved markets.</text></subparagraph> <subparagraph id="H750C025CF1264B1C8261EC8EC4C05D67"><enum>(H)</enum><header>Maximum loan amount</header> <clause id="H22C06854CE6348AD9B202B043ABCAE1D"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the maximum loan amount for a loan guaranteed under the program is $250,000.</text></clause> 
<clause id="H8B9F840AB92841018716F016C3B00EAC"><enum>(ii)</enum><header>Exception</header> 
<subclause id="H16C3BD3064D34822BF8D4E897EA1615F"><enum>(I)</enum><header>In general</header><text>The Administration may, in the discretion of the Administration, approve a guarantee of a loan under the program that is more than $250,000 and not more than $350,000.</text></subclause> <subclause id="H16E3C74E6E2F4DBA9EDF58A02AEC2624"><enum>(II)</enum><header>Notification</header><text>Not later than 2 days after approving the guarantee of a loan under subclause (I), the Administration shall provide notification of the approval to the covered institution making the loan.</text></subclause></clause></subparagraph> 
<subparagraph id="HED1AFE71A40148CEB328EE0468CD27C4"><enum>(I)</enum><header>Interest rates</header> 
<clause id="H434865A2B5204643BFBEA6E50DDE8F1F"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the maximum allowable interest rate prescribed by the Administration on any financing made on a deferred basis pursuant to the program shall not exceed the maximum allowable interest rate in effect on September 1, 2018.</text></clause> <clause id="H46F4C30E50F0435ABDA0BF693308EF24"><enum>(ii)</enum><header>Modification</header><text>The Administration shall not modify the maximum allowable interest rate described in clause (i) unless the Administration provides the public with an opportunity to comment for a period of not less than 180 days before implementing the modified interest rate.</text></clause></subparagraph> 
<subparagraph id="H058940321385454BA2FF6ACFCA767AA1"><enum>(J)</enum><header>Training and technical assistance</header><text>The Administration—</text> <clause id="H70D75E52C9014B65839E39A0FA0F36B5"><enum>(i)</enum><text>shall in person and online, provide upfront and ongoing training and technical assistance for covered institutions making loans under the program in order to support prudent lending standards and improve the interface between the covered institutions and the Administration;</text></clause> 
<clause id="H183553743053415C8EF9B7121EC58B21"><enum>(ii)</enum><text>shall ensure that the training and technical assistance described in clause (i) is provided for free or at a low-cost; and</text></clause> <clause id="H273661A92CEC4945AA8BB2F20BA4B78E"><enum>(iii)</enum><text>may enter into a contract to provide the training or technical assistance described in clause (i) with an organization with expertise in lending under this subsection, mission-oriented lending, and lending to underserved markets.</text></clause></subparagraph> 
<subparagraph id="HEA9BD44E2FDE46AFB039A3CFDF7B0242"><enum>(K)</enum><header>Delegated authority</header><text>A covered institution is not eligible to receive delegated authority from the Administration under the program until the covered institution makes not less than 7 loans under the program.</text></subparagraph> <subparagraph id="H3E8CE1986EDA478E92C889BEF780FD2F"><enum>(L)</enum><header>Regulations</header> <clause id="H456913786F3249ACBDE5B81EDA78D4BD"><enum>(i)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this paragraph and in accordance with the notice and comment procedures under section 553 of title 5, United States Code, the Administrator shall promulgate regulations to carry out the program, which shall—</text> 
<subclause id="H1EBA1E8CE31442F6A3631A4821E8D50E"><enum>(I)</enum><text>outline the requirements for participation by covered institutions in the program;</text></subclause> <subclause id="H67885480AA764178A522CDCA3722013A"><enum>(II)</enum><text>define performance metrics for covered institutions participating in the program for the first time, which are required to be met in order to continue participating in the program;</text></subclause> 
<subclause id="HE0312052BA17492D82DED46A9C4201E5"><enum>(III)</enum><text>determine the credit score of a small business concern under which the Administration is required to underwrite a loan provided to the small business concern under the program and the loan may not be made using the delegated authority of a covered institution;</text></subclause> <subclause id="HB56390D7DBAA42A59BEF872F8AD75A9D"><enum>(IV)</enum><text>require each covered institution that sells loans made under the program on the secondary market to establish a loan loss reserve fund, which—</text> 
<item id="H7748B2A3F48A444E8EED00F711E1845E"><enum>(aa)</enum><text>with respect to covered institutions in good standing, including the covered institutions described in subparagraph (F), shall be maintained at a level equal to 3 percent of the outstanding guaranteed portion of the loans; and</text></item> <item id="H6056A9B368B04380A7BD405C3B860981"><enum>(bb)</enum><text>with respect to any other covered institution, shall be maintained at a level equal to 5 percent of the outstanding guaranteed portion of the loans; and</text></item></subclause> 
<subclause id="HC72E26E9FBA84472AAF8396B61654188"><enum>(V)</enum><text>allow the Administrator to require additional amounts to be deposited into a loan loss reserve fund established by a covered institution under subclause (IV) based on the risk characteristics or performance of the covered institution and the loan portfolio of the covered institution.</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H4CFE3733A96348D28B35C2958E46AA9D"><enum>(ii)</enum><header>Pilot program</header> <subclause commented="no" display-inline="no-display-inline" id="HD2B5B6A199574FED8256DAF81ED078C8"><enum>(I)</enum><header>Reversion</header><text>Beginning on the date of enactment of this paragraph and ending on the day before the date on which the regulations promulgated by the Administrator under clause (i) take effect, the Administrator may only carry out the Community Advantage Pilot Program of the Administration based on applicable program guidelines, requirements, and other policy in effect on September 1, 2018, except that the definition of underserved market shall include—</text> 
<item commented="no" display-inline="no-display-inline" id="H3AC717CF25B24B26BD82B8CB9E1DF5E1"><enum>(aa)</enum><text>a community and an area described in items (ee) and (ff), respectively, of subparagraph (B)(viii)(I); and</text></item> <item commented="no" display-inline="no-display-inline" id="HE0224F6ED0CC4200ADA72C71A489629C"><enum>(bb)</enum><text>small business concerns described in clauses (IV) and (V) of subparagraph (B)(viii).</text></item></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H8205BAF08A174BEBB6CE5214D6CF7586"><enum>(II)</enum><header>Termination</header><text>Beginning on the date on which the regulations promulgated by the Administrator under clause (i) take effect, the Administrator may not carry out the Community Advantage Pilot Program of the Administration.</text></subclause></clause></subparagraph> <subparagraph id="H8B55C09FDFF041CC987E2B005251CE07"><enum>(M)</enum><header>Reporting</header> <clause id="HB4B416C3007E4674BAAFAA00537F6C9F"><enum>(i)</enum><header>Weekly reports</header> <subclause id="H040FD3178E9642BCB2A9EEA94626BC0C"><enum>(I)</enum><header>In general</header><text>The Administration shall report on the website of the Administration, as part of the weekly reports on lending approvals under this subsection—</text> 
<item id="H4383AEE09D724EEEA51D6FF703EF3C6A"><enum>(aa)</enum><text>on and after the date of enactment of this paragraph until the date on which the regulations promulgated under subparagraph (L)(i) take effect, the number and dollar amount of loans guaranteed under the Community Advantage Pilot Program of the Administration; and</text></item> <item id="HA5DA64321293422E9F598AD8DF33E490"><enum>(bb)</enum><text>on and after the date on which the Administration begins to approve loans under the program, the number and dollar amount of loans guaranteed under the program.</text></item></subclause> 
<subclause id="H01D3BE6C96884D8488CB9297FA974228"><enum>(II)</enum><header>Separate accounting</header><text>The number and dollar amount of loans reported in a weekly report under subclause (I) for loans guaranteed under the Community Advantage Pilot Program of the Administration and under the program shall include a breakdown by the categories of race, ethnicity, and gender of the owners of the small business concerns.</text></subclause></clause> <clause id="H7E638E61C36E439ABEF7C7BF8BED4A8F"><enum>(ii)</enum><header>Annual reports</header> <subclause id="HA19E411010AC461CAC370508D5668907"><enum>(I)</enum><header>In general</header><text>For each of the first 5 fiscal years in which the program is in effect, the Administration shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives, and make publicly available on the internet, information about loans provided under the program and under the Community Advantage Pilot Program of the Administration.</text></subclause> 
<subclause id="H5569665487DB43E685031AD0F5656073"><enum>(II)</enum><header>Contents</header><text>Each report submitted and made publicly available under subclause (I) shall include—</text> <item id="H26A8AD8E79164F3EA0C431CF757B5C1D"><enum>(aa)</enum><text>the number and dollar amounts of loans provided to small business concerns under the program and under the Community Advantage Pilot Program of the Administration, including a breakdown by—</text> 
<subitem id="H30CBF03004D04C6398F3DF70DDF38044"><enum>(AA)</enum><text>the gender of the owners of the small business concern;</text></subitem> <subitem id="HCCFF275D05ED42D692645C1E94CD1BC5"><enum>(BB)</enum><text>the race and ethnicity of the owners of the small business concern, disaggregated in a manner that captures all the racial groups specified in the American Community Survey conducted by the Bureau of the Census;</text></subitem> 
<subitem id="HB494A39A6F8A4825AA6524BF5E6F7E27"><enum>(CC)</enum><text>whether the small business concern is located in an urban or rural area; and</text></subitem> <subitem id="H49FE00C5AD654AAA9309DB83151A4D31"><enum>(DD)</enum><text>whether the small business concern is a startup, an existing business, or a new business, as provided in the weekly reports on lending approvals under this subsection;</text></subitem></item> 
<item id="H720209A48ECD47E0AE0BCEFCE47910AD"><enum>(bb)</enum><text>the proportion of loans described in item (aa) compared to—</text> <subitem id="H7CF1A3574FDF404AB4E66E0E1C2E9A39"><enum>(AA)</enum><text>other 7(a) loans of any amount;</text></subitem> 
<subitem id="HA16A4A7E2E464A68829567DA167C79B0"><enum>(BB)</enum><text>other 7(a) loans of similar amounts;</text></subitem> <subitem id="H2F39F088B8F14A85A28EC10A002FC75A"><enum>(CC)</enum><text>express loans provided under paragraph (31) of similar amounts; and</text></subitem> 
<subitem id="H096B702708A14293941DC71C39C7230B"><enum>(DD)</enum><text>other 7(a) loans of similar amounts provided to small business concerns in underserved markets;</text></subitem></item> <item id="H93C8EADE36854D8DA26A03C9B33E7E17"><enum>(cc)</enum><text>a comparison of the number and dollar amounts of loans provided to small business concerns under the program, under the Community Advantage Pilot Program of the Administration, and under each category of loans described in item (bb), broken down by—</text> 
<subitem id="HD556819A36084A4883D30BBF13D95725"><enum>(AA)</enum><text>loans of not more than $50,000;</text></subitem> <subitem id="H68FDB1389DB848D9B87D157BCE9B6A8B"><enum>(BB)</enum><text>loans of more than $50,000 and not more than $150,000;</text></subitem> 
<subitem id="HAE1298B07AF64902986257C39D070E85"><enum>(CC)</enum><text>loans of more than $150,000 and not more than $250,000; and</text></subitem> <subitem id="H868683382CB74FD2A24E40A40694746E"><enum>(DD)</enum><text>loans of more than $250,000 and not more than $350,000;</text></subitem></item> 
<item id="HFA3B68CA55EA471890366B1ED8D23D77"><enum>(dd)</enum><text>the number and dollar amounts of loans provided to small business concerns under the program and under the Community Advantage Pilot Program of the Administration by State, and the jobs created or retained within each State;</text></item> <item id="H2570ACEC15834DF69F0F9820E7CEA997"><enum>(ee)</enum><text>with respect to loans provided to small business concerns under the program and under the Community Advantage Pilot Program of the Administration—</text> 
<subitem id="HB91C1D4FE906483AB019F8103274BC43"><enum>(AA)</enum><text>the performance of the loans provided by each type of covered institution;</text></subitem> <subitem id="HF4C1C424785445AF9756C632B3D90A4C"><enum>(BB)</enum><text>the performance of the loans broken down by loan size;</text></subitem> 
<subitem id="H50E99C4D949D44D3BE02B2E12B613993"><enum>(CC)</enum><text display-inline="yes-display-inline">the performance of the loans broken down by whether the credit score of the borrower is above, below, or equal to 140;</text></subitem> <subitem id="H39208D76920F4D81A09F7019AE013A80"><enum>(DD)</enum><text>the predictive purchase rate of the loans;</text></subitem> 
<subitem id="H2C44BCACA4F840E78B52866F889058C0"><enum>(EE)</enum><text>the early default rate of the loans;</text></subitem> <subitem id="HB2ED7D303F944FE48B73EB57D3930F56"><enum>(FF)</enum><text>the 12-month default rate of the loans;</text></subitem> 
<subitem id="HBDA755801F2C4E0C9903E2F96091B695"><enum>(GG)</enum><text>the cumulative default rate for the loans for the 5-year period preceding the report;</text></subitem> <subitem id="H64AE5638D81A4D46982C0BC674736F05"><enum>(HH)</enum><text>the charge-off rates of the loans;</text></subitem> 
<subitem id="HC60FE9DA3EE9457EA5E5D1AC598D71FF"><enum>(II)</enum><text>the charge-off rates as a percent of the unpaid principal balance as in table 9 of the annual budget submitted by the Administration; and</text></subitem> <subitem id="H881ECCA58E09402498A291F8B49CDDEA"><enum>(JJ)</enum><text>the purchase rates as a percent of the unpaid principal balance as in table 8 of the annual budget submitted by the Administration;</text></subitem></item> 
<item id="H8D3F0844C5BD4256AD2D1ABD88B09C06"><enum>(ff)</enum><text>a list of covered institutions participating in the program and the Community Advantage Pilot Program of the Administration, including—</text> <subitem id="HEAD0EDC3D12240E3A1492CDA6E884976"><enum>(AA)</enum><text>the name, location, and contact information, such as the website and telephone number, of each covered institution; and</text></subitem> 
<subitem id="HBDC4CE3AC140472EA20DC55FECEF06ED"><enum>(BB)</enum><text>a breakdown by the number and dollar amount of the loans approved for small business concerns; and</text></subitem></item> <item id="HAD97AF0DC44447AFB28E44970BF708E4"><enum>(gg)</enum><text>the benchmarks established by the working group under subparagraph (N)(i).</text></item></subclause> 
<subclause id="H683960ACD5A04190B30530257EA395E4"><enum>(III)</enum><header>Timing</header><text>An annual report required under this clause shall—</text> <item id="H990DEAA72FB64DF2AD601326F1340D28"><enum>(aa)</enum><text>be submitted and made publicly available not later than October 15 of each year; and</text></item> 
<item id="H8D9782273591412F981D4EC4B1622E53"><enum>(bb)</enum><text>cover the lending activity for the fiscal year that ended on September 30 of that same year.</text></item></subclause></clause> <clause id="H8303BD34659F419EAF7182D74034172E"><enum>(iii)</enum><header>GAO report</header><text>Not later than 3 years after the date of enactment of this paragraph, the Comptroller General of the United States shall submit to the Administrator, the Committee on Small Business and Entrepreneurship of the Senate, and the Committee on Small Business of the House of Representatives a report—</text> 
<subclause id="H1096AA576341448FBC9F5B5BA421AFA1"><enum>(I)</enum><text>assessing—</text> <item id="HD24D058BCD8F40D49A948C381204DD24"><enum>(aa)</enum><text>the extent to which the program fulfills the requirements of this paragraph; and</text></item> 
<item id="H69F17691EC7C47EA98ECEA1E2B66144D"><enum>(bb)</enum><text>the performance of covered institutions participating in the program; and</text></item></subclause> <subclause id="H3770449D305841D6AEB587CE6E676513"><enum>(II)</enum><text>providing recommendations on the administration of the program and the findings under items (aa) and (bb) of subclause (I).</text></subclause></clause></subparagraph> 
<subparagraph id="HA7BD685CE81E4E3F8B3847018969EA26"><enum>(N)</enum><header>Working group</header> 
<clause id="H789A091C78B1461184674951636A1799"><enum>(i)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this paragraph, the Administrator shall establish a Community Advantage Working Group, which shall—</text> <subclause id="HE247B77AE6D940988738EA258E7E6283"><enum>(I)</enum><text>include—</text> 
<item id="HB5772EC74332433A90F45388E4F783B0"><enum>(aa)</enum><text>a geographically diverse representation of members from among covered institutions participating in the program; and</text></item> <item id="H05B9E5BA8A6947289A6B7E7BAC6B0371"><enum>(bb)</enum><text>representatives from the Office of Capital Access of the Administration, including the Office of Credit Risk Management, the Office of Financial Assistance, and the Office of Economic Opportunity;</text></item></subclause> 
<subclause id="H539AED84EAA242B48D3190606E7F985B"><enum>(II)</enum><text>develop recommendations on how the Administration can effectively manage, support, and promote the program and the mission of the program;</text></subclause> <subclause id="H7BD9DDDE9B0E49419432DDA941E8C46D"><enum>(III)</enum><text>establish metrics of success and benchmarks that reflect the mission and population served by covered institutions under the program, which the Administration shall use to evaluate the performance of those covered institutions; and</text></subclause> 
<subclause id="H6079C7EE528C4CBC834AF5C9C8621B2F"><enum>(IV)</enum><text>institute regular and sustainable systems of communication between the Administration and covered institutions participating in the program.</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H6D1A166F45E240EF967E45DD271AF900"><enum>(ii)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this paragraph, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report that includes—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HE198A1443ECD4660A4F469F1DBBF355C"><enum>(I)</enum><text>the recommendations of the Community Advantage Working Group established under clause (i); and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HBD718AAD0CE8439B8BB1607BE750A84B"><enum>(II)</enum><text>a recommended plan and timeline for implementation of those recommendations.</text></subclause></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD0E3CA134C264C1D98E6A5B8A767D856"><enum>(O)</enum><header>Termination</header><text>The authority to carry out the program under this paragraph shall terminate on September 30, 2025.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> <attestation><attestation-group><attestation-date date="20201203" chamber="House">Passed the House of Representatives December 3, 2020.</attestation-date><attestor display="no">Cheryl L.
