which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to provide for mandatory cable carriage of low power television stations sharing facilities of certain full power commercial VHF stations, and for other purposes.</official-title></form><legis-body id="HEFCFA23FC81B4B9ABAC0F4C03D53550A" style="OLC"><section id="H52749FEE39224B0C9D4B6C8F4CE2173B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating Local News Deserts Act of 2020</short-title></quote>.</text></section><section id="HC98D63A13E99495D94E0227F9AAA4ECE"><enum>2.</enum><header>Carriage of low power television stations sharing facilities of certain full power commercial VHF stations</header><subsection id="HF915540E5FB64BBE86CAF0629A6C4491"><enum>(a)</enum><header>Carriage rights</header><text>Section 614(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/534">47 U.S.C. 534(c)</external-xref>) is amended—</text><paragraph id="H9E2B59247AB44EE6AD0934F2A456800C"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph><paragraph id="H6DCEFC9F737F41478F7B012B2FB24B71"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block id="H5EB0F2CE8E88483FBB03776653C56BA7" style="OLC"><paragraph id="H22CA5960A3BD4380ABD006F3D2EF4872"><enum>(2)</enum><header>Additional requirements for stations sharing facilities of certain full power commercial VHF stations</header><subparagraph id="HE0157522F02E482E8A5B661B0AEB5885"><enum>(A)</enum><header>In general</header><text>A cable operator of a cable system shall carry on such system, in addition to any qualified low power station such operator is required to carry under paragraph (1), any television broadcast station—</text><clause id="H5B1E5AC3AD11464DB76DF765296108AA"><enum>(i)</enum><text>that is a qualified low power station under subparagraph (B) of subsection (h)(2); and</text></clause><clause id="H4741C34EB2144AC3A5DF07BD6E38F87D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the full power commercial very high frequency television broadcast station described in subsection (h)(2)(B)(ii)(II) with which such qualified low power station shares facilities is in the same television market as such cable system. </text></clause></subparagraph><subparagraph id="HBD05697B784A4EEDBAD59C1D7933DCD7"><enum>(B)</enum><header>Requirements</header><text>In the case of a qualified low power station that is carried under subparagraph (A), such qualified low power station shall have the same carriage rights as the full power commercial very high frequency television broadcast station described in subparagraph (A)(ii) in the television market described in such subparagraph.</text></subparagraph><subparagraph id="H8FF58EF034114E7788FB0867D4057A83"><enum>(C)</enum><header>Timing</header><text>The requirements of subparagraph (A) shall apply, with respect to a television broadcast station, beginning on the date that is 90 days after the Commission makes a determination under subparagraph (B) of subsection (h)(2) that such station is a qualified low power station under such subparagraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2191FCF2002E40E7B30FCFB9F576942F"><enum>(b)</enum><header>Qualified low power station defined</header><text>Section 614(h)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/534">47 U.S.C. 534(h)(2)</external-xref>) is amended—</text><paragraph id="H2F9B8ED8D2A740B482CDC91CBBDA6CA0"><enum>(1)</enum><text>by redesignating subparagraphs (A) through (F) as clauses (i) through (vi), respectively;</text></paragraph><paragraph id="H294D29DB92264038BB8D72D45E38C702"><enum>(2)</enum><text>by striking <quote>The term</quote> and inserting the following:</text><quoted-block id="HD82F69F999834144B822D084F8244995" style="OLC"><subparagraph id="H6C71B98D264C45D3BBBC06C87919D734"><enum>(A)</enum><header>In general</header><text>The term</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H769C0A11AD9847C5BA888271105FF230"><enum>(3)</enum><text>by striking <quote>Nothing in this paragraph</quote> and inserting the following:</text><quoted-block id="HC462C41FDB66451CB11B40ACB95F7778" style="OLC"><subparagraph id="HB75B63E45739460898CEA4BE1F559C01"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in this paragraph</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H4E533C6829084CDD826C01AF08AFEEA3"><enum>(4)</enum><text>by inserting after subparagraph (A) (as so designated) the following:</text><quoted-block id="HE300365E53C749EAB49DE898FD1F5002" style="OLC"><subparagraph id="HF126727A41084083827BA24FCA4E30BA"><enum>(B)</enum><header>Stations sharing facilities of certain full power commercial VHF stations</header><clause id="H503CBFCB1B624918BCABA8CC92E91448"><enum>(i)</enum><header>In general</header><text>The term <quote>qualified low power station</quote> also includes any television broadcast station for which there is in effect a determination by the Commission that such station is a qualified low power station under this subparagraph.</text></clause><clause id="HB3B74E463CA04392ADA06D19C75629A0"><enum>(ii)</enum><header>Requirements</header><text>The Commission shall determine that a television broadcast station is a qualified low power station under this subparagraph if—</text><subclause id="H0F3187AD7EC74A539DF3E89C20F9AEB1"><enum>(I)</enum><text display-inline="yes-display-inline">such station conforms to the rules established for low power television stations contained in part 74 of title 47, Code of Federal Regulations;</text></subclause><subclause id="H941B8F3281BE40338F18AA841DE6E6D9"><enum>(II)</enum><text display-inline="yes-display-inline">such low power station shares facilities with a licensee of a full power commercial very high frequency television broadcast channel allocated to a State under section 331(a);</text></subclause><subclause id="HC6F12168418B408EB13B3E446AB882E1"><enum>(III)</enum><text>such low power station maintains its main studios and offices in such State;</text></subclause><subclause id="H6C7E74814D7C4BDF9BE8AE147F07C008"><enum>(IV)</enum><text display-inline="yes-display-inline">such State has no exclusive, in-State broadcast television market within its boundaries, as determined by Nielsen Media Research or any successor entity; </text></subclause><subclause id="HD3BD235CEF564F0A831E060B1B863398"><enum>(V)</enum><text display-inline="yes-display-inline">there are no <quote>big 4</quote> full power commercial network affiliates (ABC, CBS, NBC, and FOX) that are licensed to, and principally operate within, such State; and</text></subclause><subclause id="H63829943E04348329BE4FC0587A06B8A"><enum>(VI)</enum><text display-inline="yes-display-inline">such low power station provides, for a minimum of 3 hours per day Monday through Friday and a minimum of 2 hours per day on Saturday and Sunday, locally produced news, public affairs, and informational programming focused on, or of general interest to, the many residents and communities throughout such State.</text></subclause></clause><clause id="H4CC5E964AC0D4451BA4CBADC853F85CB"><enum>(iii)</enum><header>Petition and determination</header><text>Not later than 30 days after a television broadcast station submits to the Commission a petition for a determination that such station is a qualified low power station under this subparagraph, the Commission shall—</text><subclause id="H730CFE15152844C39D007F7A248DC84A"><enum>(I)</enum><text>if the Commission finds that the requirements of clause (ii) are met with respect to such station, grant such petition; or</text></subclause><subclause id="HC8F581F331CF4B3897ACA01AD863AE4F"><enum>(II)</enum><text display-inline="yes-display-inline">if the Commission finds that the requirements of clause (ii) are not met with respect to such station, deny such petition.</text></subclause></clause><clause id="H30BD30431ABF4736985501AB3CEDED42"><enum>(iv)</enum><header>Annual certification</header><subclause id="H4AE8ADB571DD4533B5E22C60358ABD64"><enum>(I)</enum><header>In general</header><text>Beginning on the date that is 1 year after the date on which a qualified low power station under this subparagraph is first carried on a cable system under subsection (c)(2), and annually thereafter, such station shall submit to the Commission a certification that—</text><item id="HF853CC2033474D84B321AC70B3173732"><enum>(aa)</enum><text display-inline="yes-display-inline">such station is providing locally produced news, public affairs, and informational programming as described in clause (ii)(VI); and</text></item><item id="HFD44A9C2B5BF475AB5A97EDE24ADA30F"><enum>(bb)</enum><text display-inline="yes-display-inline">such station commits to the Commission that such station will continue to provide such locally produced news, public affairs, and informational programming as described in such clause during the 1-year period beginning on the date of the certification.</text></item></subclause><subclause id="H22B85C918D3E4916A5F171838D538C9C" commented="no"><enum>(II)</enum><header>Failure to certify</header><text>If a qualified low power station under this subparagraph fails to submit a certification as required by subclause (I), the Commission may revoke the determination that such station is a qualified low power station under this subparagraph.</text></subclause><subclause id="H3094D41DA8BF48139E0B6542C25DF72F" commented="no"><enum>(III)</enum><header>Schedule and administration</header><text>Not later than 30 days after the date of the enactment of this subparagraph, the Commission shall by order establish the schedule and administration of the schedule for and other requirements relating to the administration of the certifications required by this clause.</text></subclause></clause><clause id="HB25007331DAD4300BE16C52522401499" commented="no"><enum>(v)</enum><header>Grounds for revocation of determination</header><text>The Commission may not revoke a determination that a television broadcast station is a qualified low power station under this subparagraph except—</text><subclause id="HD7E745FA63864CF8B362B2E0B2D6F657" commented="no"><enum>(I)</enum><text>as provided in clause (iv)(II); or</text></subclause><subclause id="H7300630C678149A7835838BA13B6145D" commented="no"><enum>(II)</enum><text>if the requirements of clause (ii) are no longer met with respect to such station.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
