which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to expand access in frontier States to mental health services furnished through telehealth, and for other purposes.</official-title></form><legis-body id="H5919E1022D4446A795BF2E6D90054C08" style="OLC"><section id="HD5C6E4F60D0549CF886F4086B538D8EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating Reforms that Offer Necessary Telehealth In Every Rural (FRONTIER) Community Act</short-title></quote>.</text></section><section id="H3F12582A1DF64DB39DACCB9BB50E5B43"><enum>2.</enum><header>Expanding access to mental health services furnished in frontier States through telehealth</header><subsection id="H56944EA1A57541E58F5E8E25C259F517"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="H00A8725575484DEDB2449431CA49D1AE"><enum>(1)</enum><text>in paragraph (2)(B)(i), in the matter preceding subclause (I), by striking <quote>paragraph (6)(C)</quote> and inserting <quote>paragraphs (6)(C) and (9)</quote>;</text></paragraph><paragraph id="H6AE21D7FAF004035887C11B83871BBF4"><enum>(2)</enum><text>in paragraph (4)(C)(i), by striking <quote>and (7)</quote> and inserting <quote>(7), and (9)</quote>; and</text></paragraph><paragraph id="HE8B64984C83D43DAA7DF28CBA17FCD75"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAD6C1B2E276C4A64BE44487C57C29764"><paragraph id="HDA48E26C22D14B53A16D4B509F48746C"><enum>(9)</enum><header>Treatment of mental health services furnished in frontier States</header><subparagraph id="HBA3B37D775B74F22BD5349AE1B30D055"><enum>(A)</enum><header>In general</header><text>The originating site requirements under paragraph (4)(C) shall not apply with respect to telehealth services furnished on or after January 1, 2021, that are furnished in a frontier State (as defined in section 1886(d)(3)(E)(iii)(II)) and are mental health services (as determined by the Secretary), except that a facility fee under paragraph (2)(B)(i) may only be paid to an originating site that is a site described in any of subclauses (I) through (IX) of paragraph (4)(C)(ii).</text></subparagraph><subparagraph id="HEAFED81908494846B76CB17CCF1CCE66"><enum>(B)</enum><header>Definition of originating site</header><text>With respect to telehealth services described in subparagraph (A), the term <term>originating site</term> means any fixed or mobile location at which the individual is located at the time the service is furnished.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5235040AD9CF47F28E7BC9739E35B0B2"><enum>(b)</enum><header>Grants for the deployment of broadband structure</header><paragraph id="H89436EDA8A414DA7A22C82BA4C48D6E1"><enum>(1)</enum><header>In general</header><text>The Chairman of the Federal Communications Commission and the Administrator of the Rural Utilities Service of the United States Department of Agriculture, in consultation with the Administrator of the Health Resources and Services Administration and the Director of the Indian Health Service, shall award grants for the deployment of broadband infrastructure in frontier States, as defined in section 1886(d)(3)(E)(iii)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(3)(E)(iii)(II)</external-xref>), to support the furnishing of mental health services through telehealth pursuant to section 1834(m)(9) of such Act, as added by subsection (a).</text></paragraph><paragraph id="H1A56447663C34614B2CFCBAA0913281C"><enum>(2)</enum><header>Authorization</header><text>There are authorized to be appropriated such sums as are necessary for purposes of carrying out this subsection.</text></paragraph></subsection></section><section id="HBE380DA3A3DE47BD98149ED09E662FED"><enum>3.</enum><header>Indian Health Service facilities</header><subsection id="HC349991BEBC5420B8F519780B93B72C5"><enum>(a)</enum><header>In general</header><text>Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>), as amended by section 2(a), is amended—</text><paragraph id="H7F0DE35D3A494AFC93C94084CDD896E5"><enum>(1)</enum><text>in clause (i), in the matter preceding subclause (I), by inserting <quote>, and subject to clause (iii)</quote> after <quote>and (9)</quote>; and</text></paragraph><paragraph id="H78191DEF4B804A44BEF3EC5D67645765"><enum>(2)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB7973660231B48D18D99C4573A977BEA"><clause id="HD88BD1BA83A54BD0968DEA489F32E02F"><enum>(iii)</enum><header>Indian Health Service facilities</header><text>The originating site requirements described in clauses (i) and (ii) shall not apply with respect to a facility of the Indian Health Service, whether operated by such Service, or by an Indian tribe (as that term is defined in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>)) or a tribal organization (as that term is defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H63355D5085024619922A133924EC9A90"><enum>(b)</enum><header>No originating site facility fee for new sites</header><text>Section 1834(m)(2)(B)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(2)(B)(i)</external-xref>) is amended, in the matter preceding subclause (I), by inserting <quote>(other than an originating site that is only described in clause (iii) of paragraph (4)(C), and does not meet the requirement for an originating site under clause (i) of such paragraph)</quote> after <quote>the originating site</quote>.</text></subsection><subsection id="H78FEE1087D1443DB9C95FB8F7C7A0292" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2021. </text></subsection></section></legis-body></bill>
