insurance amount</header><text display-inline="yes-display-inline">Section 215 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415</external-xref>) is amended—</text><paragraph id="H4256371A0EB143D3A32018C945BEF476"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(B)(ii)(I)—</text><subparagraph id="H2A4D506ACD474A93B800160E00C72AAF"><enum>(A)</enum><text>in subclause (I)—</text><clause id="HF320D5F94F79491BA882108EA7344853"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>the national</quote> and inserting <quote>(aa) the national</quote>; and</text></clause><clause id="H859B735952D64068B057E2DBD5A45838"><enum>(ii)</enum><text>by striking <quote>, by</quote> at the end and inserting <quote>; or</quote>; and</text></clause></subparagraph><subparagraph id="H55A22996FC19418AB6FAD33DFDC8EEC5" display-inline="no-display-inline"><enum>(B)</enum><text>by adding at the end of subclause (I) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDC40FC9C91894A05B79B821D47F279F7"><item id="H03611DA5CE954928952D2EDC6C529951" indent="up2"><enum>(bb)</enum><text display-inline="yes-display-inline">if higher (and if such second calendar year is after 2019), the highest national average wage index (as so defined) for any calendar year before such second calendar year, by</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5E7BB8ABE2D548159523AB19C02A9A25"><enum>(2)</enum><text>in subsection (b)(3)(A)(ii)—</text><subparagraph id="HB1ACB551683B4745B5D70446C81035A2"><enum>(A)</enum><text>in subclause (I)—</text><clause id="H68EF5DD880E84A1E84102C874FEA896A"><enum>(i)</enum><text>by striking <quote>the national</quote> and inserting <quote>(aa) the national</quote>; and</text></clause><clause id="H078CA1BC0C29419DBEC8E70BEF0FF6F3"><enum>(ii)</enum><text>by striking <quote>, by</quote> at the end and inserting <quote>; or</quote>; and</text></clause></subparagraph><subparagraph id="H0190D7BCA0FD41C781838BD720EB74ED"><enum>(B)</enum><text>by adding at the end of subclause (I) the following:</text><quoted-block style="OLC" id="H433F73F4CF7A4856B5726F1518A47436" display-inline="no-display-inline"><item id="H576CB7FB4F2F405E970EE5FF7C449D1D" indent="up2"><enum>(bb)</enum><text display-inline="yes-display-inline">if higher (and if such second calendar year is after 2019), the highest national average wage index (as so defined) for any calendar year before such second calendar year, by</text></item><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H08DD2206A3914171BEFD35F284F566EF"><enum>(b)</enum><header>Modification related to reduction of benefits based on disability</header><text display-inline="yes-display-inline">Section 224(f)(2)(B)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/424">42 U.S.C. 424(f)(2)(B)(i)</external-xref>) is amended by inserting <quote>(or if higher (and if such calendar year is after 2019), the highest national average wage index (as so defined) for any calendar year before such calendar year)</quote> after <quote>made</quote>.</text></subsection></section><section id="HAD055878BD794E3FB3C05772EC82BB0E"><enum>4.</enum><header>Across-the-board benefit increase</header><subsection id="H685B578759144E65B3F92A28182FC90D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 215(a)(1)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(a)(1)(A)(i)</external-xref>) is amended by striking <quote>90 percent</quote> and inserting <quote>93 percent</quote>.</text></subsection><subsection id="H395F1E71DDFF4D56997FDB97F84E2316"><enum>(b)</enum><header>Effective date</header><paragraph id="HE96EDFC1FF1E451B88BDF4A4399E071B"><enum>(1)</enum><header>In general</header><text>The amendment made by subsection (a) shall apply with respect to monthly insurance benefits payable for months in calendar year 2020.</text></paragraph><paragraph id="HE292D0658007435CBFA3F346D49A1F3C"><enum>(2)</enum><header>Recomputation of primary insurance amounts</header><text display-inline="yes-display-inline">Notwithstanding section 215(f) of the Social Security Act, the Commissioner of Social Security shall recompute primary insurance amounts to the extent necessary—</text><subparagraph id="H74C48084B2144282965E1A99587C523C"><enum>(A)</enum><text>to carry out the amendments made by this section; and</text></subparagraph><subparagraph id="HBBF28E59489B425ABCD0763C318D8528"><enum>(B)</enum><text>to account for the nonapplication of such amendments after calendar year 2020.</text></subparagraph></paragraph></subsection><subsection id="HE0761914F88B458E89FF4A40FE0A24E7"><enum>(c)</enum><header>Rule of construction</header><text>For purposes of applying subparagraphs (A) and (B) of section 215(i)(1) of the Social Security Act in any calendar year, nothing in this Act shall be considered a general benefit increase under title II of such Act.</text></subsection></section><section display-inline="no-display-inline" id="H27968AF80C594C4BB0AE29D943D0EC42" section-type="subsequent-section"><enum>5.</enum><header>Increase in minimum benefit for lifetime low earners based on years in the workforce</header><subsection id="H573BDA65A8084605B1BCDE9D7FB45795"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 215(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(a)(1)</external-xref>) is amended—</text><paragraph id="H1BEFE0CCB2774A4C9126F549D4A22BA9"><enum>(1)</enum><text>by redesignating subparagraph (D) as subparagraph (E); and</text></paragraph><paragraph id="HA677476FCC224734B8B684052BBECA38"><enum>(2)</enum><text>by inserting after subparagraph (C) the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H6F31E0CB9F5744B19CFD0973FC845E48" style="traditional"><subparagraph id="H1BE55AF697854FBC84802805A10DD5E3" indent="up2"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HD8D0AD1B3A874FC7980EEBFF9D6F6027"><enum>(i)</enum><text display-inline="yes-display-inline">Effective with respect to monthly insurance benefits payable for months in calendar year 2020, no primary insurance amount computed under subparagraph (A) may be less than the greater of—</text><subclause id="HE6BE578498EC4F69A7D23CF21750AF87" indent="up1"><enum>(I)</enum><text>the minimum monthly amount computed under subparagraph (C); or</text></subclause><subclause id="H7CA12DD0A561414A93364722A80C043E" indent="up1"><enum>(II)</enum><text>in the case of an individual who has more than 10 years of work (as defined in clause (iv)(I)), the alternative minimum amount determined under clause (ii).</text></subclause></clause><clause id="HA88B188CED314567A9ED0669F32CC6A9" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H49812DABC8C04DD5BB0FEA3F5B72F39D"><enum>(I)</enum><text display-inline="yes-display-inline">The alternative minimum amount determined under this clause is the applicable percentage of <fraction>1/12</fraction> of the poverty guideline for 2019.</text></subclause><subclause id="HD0765AAAB92242FBB5A3A16F20FB428A" indent="up1"><enum>(II)</enum><text>For purposes of subclause (I), the applicable percentage is the percentage specified in connection with the number of years respect to an individual, a year to which 4 quarters of coverage have been credited based on such individual’s wages and self-employment income; and</text></subclause><subclause id="H4B5A70943363497C86A9EAF045CA8C64"><enum>(II)</enum><text>the term <quote>poverty guideline for 2019</quote> means the annual poverty guideline for 2019 (as updated annually in the Federal Register by the Department of Health and Human Services under the authority of section 673(2) of the Omnibus Budget Reconciliation Act of 1981) as applicable to a single individual.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H990408E5BBA04828BCBDB2637423FF63"><enum>(b)</enum><header>Recomputation of primary insurance amounts</header><text display-inline="yes-display-inline">Notwithstanding section 215(f) of the Social Security Act, the Commissioner of Social Security shall recompute primary insurance amounts to the extent necessary—</text><paragraph id="H23E6DBAD068B4AC59C109BAEA3E4A8A8"><enum>(1)</enum><text>to carry out the amendments made by this section; and</text></paragraph><paragraph id="H1D671CF9A98A4AA7AFF09D3725B22E81"><enum>(2)</enum><text>to account for the nonapplication of such amendments after calendar year 2020.</text></paragraph></subsection><subsection id="H5CBADEF7BCAC4A1BB5BF34084E099C98"><enum>(c)</enum><header>Conforming amendment</header><text>Section 209(k)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/409">42 U.S.C. 409(k)(1)</external-xref>) is amended by inserting <quote>215(a)(1)(E), </quote> after <quote>215(a)(1)(D),</quote>.</text></subsection></section><section id="HE4A6508B4D0548F9867BFEC7347925B0"><enum>6.</enum><header>Increase in threshold amounts and rate for inclusion of Social Security benefits in income</header><subsection id="HDD98718AE86C4B3E9DA5918ACF4ED7AF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/86">section 86</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H536A398761CE4EBBB47F5FF959064E94" style="OLC"><subsection id="H08AC876423624DBE8F94F9ACBC701AF3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Gross income for the taxable year of any taxpayer described in subsection (b) (notwithstanding section 207 of the Social Security Act) includes Social Security benefits in an amount equal to the lesser of—</text><paragraph id="HC2B838885B9947908E67CE6564EF41EA"><enum>(1)</enum><text>85 percent of the Social Security benefits received during the taxable year, or</text></paragraph><paragraph id="HC7C0CEF9FF3347E885306ED3AE3572F1"><enum>(2)</enum><text>one-half of the excess described in subsection (b)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCF4B078D62BD4292A8AF3B52AC6BB11B"><enum>(b)</enum><header>Base amount</header><text>Subsection (c) of section 86 of such Code is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H7ADBBC9E4E52447E8AB068E6A11AA84C" style="OLC"><subsection id="HE29DB0241F5C40808F9F193498D61937"><enum>(c)</enum><header>Base amount</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>base amount</quote> means—</text><paragraph id="H8FC2C6543AD14B9AA94EF6640F9105D5"><enum>(1)</enum><text display-inline="yes-display-inline">except as otherwise provided in this paragraph, $35,000,</text></paragraph><paragraph id="HC83893B96BF0456AA194249CC612B99A"><enum>(2)</enum><text>$50,000 in the case of a joint return, and</text></paragraph><paragraph id="H8EBEDD0A53C4432E88FFC3DB2274CFBB"><enum>(3)</enum><text>zero in the case of a taxpayer who—</text><subparagraph id="H5E259BD9F11F4C5FBDD5E0C5F9F2D8CE"><enum>(A)</enum><text>is married as of the close of the taxable year (within the meaning of section 7703) but does not file a joint return for such year, and</text></subparagraph><subparagraph id="H604CC20C6F604D0F92FB69AAFCD0757C"><enum>(B)</enum><text>does not live apart from his spouse at all times during the taxable year.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0303127D8B2E4E399D7BB66781D99EB5"><enum>(c)</enum><header>Transfers to trust funds</header><paragraph id="HBC12902E86464E3D82A9BD4FF7D0EF11"><enum>(1)</enum><header>Hospital Insurance Trust Fund held harmless</header><text display-inline="yes-display-inline">Of the total revenue from taxation of social security benefits, there are appropriated to the Federal Hospital Insurance Trust Fund such amounts as would be transferred to such fund under section 121(e) of the Social Security Amendments of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> note) and section 86 of such Code as such sections were in effect on the day before the date of the enactment of this Act, at such times and in such manner as would be provided therein.</text></paragraph><paragraph id="H2F0B7E217279425ABD8EA1FF9FDA7A11"><enum>(2)</enum><header>Transfers to payor funds</header><text display-inline="yes-display-inline">Of the balance of the total revenue from taxation of social security benefits remaining after appropriations under paragraph (1) have been made, there are appropriated to each payor fund amounts equivalent to the portion of such balance equal to a fraction—</text><subparagraph id="H12180CCA13104D5889670A1122BA3633"><enum>(A)</enum><text display-inline="yes-display-inline">the numerator of which is the amount equivalent to the net revenues received in the Treasury attributable to the application of sections 86 and 871(a)(3) of such Code to payments from such payor fund made in taxable years beginning during calendar year 2019; and</text></subparagraph><subparagraph id="H195246F4AEB046D29E17AF15D96C22BB"><enum>(B)</enum><text display-inline="yes-display-inline">the denominator of which is the total revenue from taxation of social security benefits.</text></subparagraph></paragraph><paragraph id="HA09B10B642FF4927A369A9768832D5B5"><enum>(3)</enum><header>Transfers</header><text display-inline="yes-display-inline">The amounts appropriated by paragraph (2) to any payor fund shall be transferred from time to time (but not less frequently than quarterly) from the general fund of the Treasury on the basis of estimates made by the Secretary of the Treasury of the amounts referred to in such paragraph. Any such quarterly payment shall be made on the first day of such quarter and shall take into account social security benefits estimated to be received during such quarter. Proper adjustments shall be made in the amounts subsequently transferred to the extent prior estimates were in excess of or less than the amounts required to be transferred.</text></paragraph><paragraph id="H48C124A0C0654240BDD834FFCD6D0855"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection—</text><subparagraph id="HDC282CB1BBA845569C749033935963AF"><enum>(A)</enum><header>Total revenue from taxation of social security benefits</header><text display-inline="yes-display-inline">The term <quote>total revenue from taxation of social security benefits</quote> means the amount equivalent to the net revenues received in the Treasury attributable to the application of sections 86 and 871(a)(3) of the Internal Revenue Code of 1986 to payments from any payor fund made in taxable years beginning during calendar year 2019.</text></subparagraph><subparagraph id="HCC48B75C627B4013A5495A6F4E79C431"><enum>(B)</enum><header>Payor fund</header><text>The term <quote>payor fund</quote> means any trust fund or account from which payments of social security benefits are made.</text></subparagraph><subparagraph id="HAF20EB4522B542198A2F8C209A8B0AD7"><enum>(C)</enum><header>Social security benefits</header><text>The term <quote>social security benefits</quote> has the meaning given such term by <external-xref legal-doc="usc" parsable-cite="usc/26/86">section 86(d)(1)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph id="HD7AA6191D4EC48BD8591EB8A5DEF5E34"><enum>(5)</enum><header>Conforming rule</header><text display-inline="yes-display-inline">Section 121(e) of the Social Security Amendments of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> note) shall not apply with respect to net revenues received in the Treasury attributable to the application of sections 86 and 871(a)(3) of the Internal Revenue Code of 1986 to payments from any payor fund made in taxable years beginning during calendar year 2019.</text></paragraph></subsection><subsection id="HF86C6C73CC2E4E09937E5132AEFC251F"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning in calendar year 2019.</text></subsection></section><section id="H2CEF52BF45AE49B494CD97096C944C69"><enum>7.</enum><header>Extension of child’s benefit for full-time post-secondary school students under age 23</header><subsection id="H7BCC77BCA08B4D67AF4706F517FE83C0"><enum>(a)</enum><header>In general</header><text>Section 202(d)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(1)(B)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H74555961A5B94566A082DBED56E581CC" style="OLC"><subparagraph id="H6953CD14A79B4A74B3F76089A83F4732"><enum>(B)</enum><text display-inline="yes-display-inline">at the time such application was filed was unmarried and—</text><clause id="HB7EC9795C1694881B1B283006EA1EC5E"><enum>(i)</enum><text>had not attained the age of 18,</text></clause><clause id="H2D8E6F42D7D4462BA78C01B0983E38B4"><enum>(ii)</enum><text>was a full-time elementary or secondary school student and had not attained the age of 22,</text></clause><clause id="HC3429A87C8FF49AAA1A3060B4171C06B"><enum>(iii)</enum><text display-inline="yes-display-inline">was a full-time post-secondary school student and had not attained the age of 23, or</text></clause><clause id="H9E1AB06AE7CF438FB23B97EFAAE9F6FC"><enum>(iv)</enum><text>is under a disability (as defined in section 223(d)) which began before he attained the age of 22, and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9EEA29010B5F49968BBA9597164ACFA4"><enum>(b)</enum><header>Definition of full-Time post-Secondary school student</header><paragraph id="HECE67E97D720459C9F4DCCBC5363A955"><enum>(1)</enum><header>In general</header><text>Section 202(d)(7) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(7)</external-xref>) is amended—</text><subparagraph id="HDEC10382A3AE424F8365237F95532051"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H3223420125564504B079C6CFBA26C051"><enum>(i)</enum><text>by inserting <quote>and a <quote>full-time post-secondary school student</quote> is an individual who is in full-time attendance as a student at a post-secondary educational institution</quote> before <quote>, as determined by the Commissioner</quote>;</text></clause><clause id="H67D001D38B104F7C9A43355E8345B27E"><enum>(ii)</enum><text>by inserting <quote>or a <quote>full-time post-secondary school student</quote></quote> before <quote>if he is paid by his employer</quote>;</text></clause><clause id="H481ED92920A0449092522897A4FA1468"><enum>(iii)</enum><text>by inserting <quote>or a post-secondary educational institution, as applicable,</quote> before <quote>at the request</quote>;</text></clause><clause id="HB99E04BD67334A7B9E07FEC03E0450D5"><enum>(iv)</enum><text>by inserting <quote>or a <quote>full-time post-secondary school student</quote></quote> before <quote>for the purpose of this section</quote>; and</text></clause><clause id="HC40ECB1F4F624FCA8D4C3D349D9D3592"><enum>(v)</enum><text>by inserting <quote>or a full-time post-secondary school student</quote> before <quote>shall be deemed</quote>; and</text></clause></subparagraph><subparagraph id="HF24711762937474DBCA2DC897B767101"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="H3ACA3EB254404012845AE4387B0AE3E7"><enum>(i)</enum><text>by inserting <quote>or a full-time post-secondary school student</quote> after <quote>student</quote>;</text></clause><clause id="H76CAF9E0E0AA4BF8AC56C48E8560FE1E"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>or a post-secondary educational institution, as applicable</quote> before <quote>at which he has been</quote>; and</text></clause><clause id="H76F54902B4334E36B884A9E71D78F5F0"><enum>(iii)</enum><text>by striking <quote>an elementary or secondary school</quote> in each of the second and third places in which such term appears and inserting <quote>such a school</quote>.</text></clause></subparagraph></paragraph><paragraph id="HB84BE9BCF903477893758D934F353035"><enum>(2)</enum><header>Transition from elementary or secondary school</header><text>Section 202(d)(7)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(7)(B)</external-xref>) is amended by adding at the end the following sentence: <quote>An individual who has been in full-time attendance at an elementary or secondary school shall, during a succeeding period of nonattendance at such school, be deemed to be a full-time secondary-school student if (i) such period is 4 calendar months or less, and (ii) the individual shows to the satisfaction of the Commissioner that he intends to be in full-time attendance at a post-secondary educational institution immediately following such period.</quote></text></paragraph></subsection><subsection id="H2605A674FA7047C0BFAC5C3FE404493D"><enum>(c)</enum><header>Definition of post-Secondary educational institution</header><text display-inline="yes-display-inline">Section 202(d)(7)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(7)(C)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H766CDC247BB54EE58113B8C9D521B416" style="OLC"><clause id="H063F9862805542E1AE35207B8BD46654"><enum>(iii)</enum><text display-inline="yes-display-inline">A <quote>post-secondary educational institution</quote> is an institution described in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7A5F575B63AD448F954F296FD226E2E9"><enum>(d)</enum><header>Conforming amendments</header><paragraph id="HB274931265AD4DF4A9C340D31466E493"><enum>(1)</enum><text display-inline="yes-display-inline">Section 202(d)(1)(E) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(1)(E)</external-xref>) is amended by inserting <quote>or a full-time post-secondary school student</quote> after <quote>student</quote>.</text></paragraph><paragraph id="HD2CC55E3E65D47B593C17FF855740456"><enum>(2)</enum><text display-inline="yes-display-inline">Section 202(d)(1)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(1)(F)</external-xref>) is amended by striking <quote>the earlier of—</quote> and all that follows through <quote>the age of 19,</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="HFDAF5B64FDDB4F438602B11F01BDF8FC" style="OLC"><text>the earlier of—</text><clause id="H687C0B3E0F254F8AB550CD2B8F3423AA"><enum>(i)</enum><text display-inline="yes-display-inline">the first month during no part of which the child is a full-time elementary or secondary school student or a full-time post-secondary school student,</text></clause><clause id="H2BABDD4B1E0146DC863D34CB92C5B900"><enum>(ii)</enum><text display-inline="yes-display-inline">the month in which the child attains the age of 22, but only if the child is not a full-time post-secondary school student during any part of such month, or</text></clause><clause id="H32B879A7227644F792040BF9AD5F4EFD"><enum>(iii)</enum><text>the month in which the child attains the age of 23,</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC33E9F1017884202BCC93F2B1DD00708"><enum>(3)</enum><text display-inline="yes-display-inline">Section 202(d)(1)(G) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(1)(G)</external-xref>) is amended by striking <quote>(if later)</quote> and all that follows through the <quote>the age of 19,</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" display-inline="yes-display-inline">Section 202(d)(6)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(6)(A)</external-xref>) is amended to read as id="H1FAC2402E6DE468F8AB28FA300E06C5B"><enum>(5)</enum><text display-inline="yes-display-inline">Section 202(d)(6)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 23.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HAF9A9B2FB0E54676A7629ECB2E770DD8"><enum>(7)</enum><text>Section 202(d)(7)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(7)(D)</external-xref>) is amended—</text><subparagraph id="HD4C27F1F2DB3408281BAD8B1E764533E"><enum>(A)</enum><text>by striking <quote>A child who</quote> and inserting <quote>(i) A child who</quote>; </text></subparagraph><subparagraph id="HDC819131527847B8A72B95705E00E4EB"><enum>(B)</enum><text>by striking <quote>age 19</quote> and inserting <quote>age 22</quote>;</text></subparagraph><subparagraph id="HBEA6F2310A624911860A7892861B4FFD"><enum>(C)</enum><text>by striking <quote>clause (i) of paragraph (1)(B)</quote> and inserting <quote>clause (ii) of paragraph (1)(B)</quote>; and</text></subparagraph><subparagraph id="HEA02C31D7C4A49439E22D6CC62961E6C"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H0626400F3C0E465BACEA58C6CCAE8762" display-inline="no-display-inline"><clause id="HE2B721B9CBEA4535BFADC867C034F3FA" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">A child who attains age 23 at a time when he is a full-time post-secondary school student (as defined in subparagraph (A) of this paragraph and without application of subparagraph (B) of such paragraph) but has not (at such time) completed the requirements for, or received, a diploma or equivalent certificate from a post-secondary educational institution (as defined in subparagraph (C)(iii)) shall be deemed (for purposes of determining whether his entitlement to benefits under this subsection has terminated under paragraph (1)(F) and for purposes of determining his initial entitlement to such benefits under clause (iii) of paragraph (1)(B)) not to have attained such age until the first day of the first month following the end of the quarter or semester in which he is enrolled at such time (or, if the post-secondary educational institution (as so defined) in which he is enrolled is not operated on a quarter or semester system, until the first day of the first month following the completion of the course in which he is so enrolled or until the first day of the third month beginning after such time, whichever first occurs).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H6B117351957B44349A7FCA51AC7A1BE2"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to applications for child’s insurance benefits filed in calendar year 2020 and with respect to individuals entitled to such benefits during any month of such calendar year, except that such amendments shall not apply for purposes of determining continuing eligibility for child’s insurance benefits for any month after such calendar year.</text></subsection></section><section id="H2188B4750F6A48D698F62C24A9E3904B"><enum>8.</enum><header>Improving social security benefits for widows and widowers in two-income households</header><subsection id="HF5135B5492BD4CDEBAE0B7AEC489CD30"><enum>(a)</enum><header>In general</header><paragraph id="HAF5775842CB54B598D93C57BC08C6789"><enum>(1)</enum><header>Widows</header><text>Section 202(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(e)</external-xref>) is amended—</text><subparagraph id="HC395B021648E48DF95615C244E18AB50"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H4ED4D128D41247EAB64F6D521022BA2D"><enum>(i)</enum><text>in subparagraph (B), by inserting <quote>and</quote> at the end;</text></clause><clause id="H29FB3E3B80FF45049B66D0C5F6D597BB"><enum>(ii)</enum><text>in subparagraph (C)(iii), by striking <quote>and</quote> at the end;</text></clause><clause id="H775965EC5041406F98D1ADBE127A1AA4"><enum>(iii)</enum><text>by striking subparagraph (D);</text></clause><clause id="HC4F76C82B7E84C0D9897FA2177534235"><enum>(iv)</enum><text>by redesignating subparagraphs (E) and (F) as subparagraphs (D) and (E), respectively; and</text></clause><clause id="H0399A3790FD84199B2F21EB239007C0E"><enum>(v)</enum><text>in the flush matter following subparagraph (E)(ii), as so redesignated, by striking <quote>becomes entitled to an old-age insurance benefit</quote> and all that follows through <quote>such deceased individual,</quote>;</text></clause></subparagraph><subparagraph id="H63528EB9F1DF49E5B3B9809E3ED731E6"><enum>(B)</enum><text>by striking subparagraph (A) in paragraph (2) and inserting the following:</text><quoted-block id="H20C69784CE174677AE8F96D96F84981C" style="OLC"><paragraph id="H08B3863DE9164A2495C4685AE95AA226"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H01FEA64017084EF69E6F1F2D17DC9EC7"><enum>(A)</enum><text>Except as provided in subsection (k)(5), subsection (q), and subparagraph (D) of this paragraph, such widow’s insurance benefit for each month shall be equal to the greater of—</text><clause id="HD6FDED95674D4B79953A84E021042BBB"><enum>(i)</enum><text>the primary insurance amount (as determined for purposes of this subsection after application of subparagraphs (B) and (C)) of such deceased individual, or</text></clause><clause id="H134925E2C5D44AAFBDEEC00B3DCF4C0C"><enum>(ii)</enum><text>subject to paragraph (9), in the case of a fully insured widow or surviving divorced wife, 75 percent of the sum of any old-age or disability insurance benefit for which the widow or the surviving divorced wife is entitled for such month and the primary insurance amount (as determined for purposes of this subsection after application of subparagraphs (B) and (C)) of such deceased individual.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA6118972B0174087BF93FEDE6106798C"><enum>(C)</enum><text>in paragraph (5)—</text><clause id="HB65FA17AB98B4DFCA52203B386566CBB"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>paragraph (1)(F)</quote> and inserting <quote>paragraph (1)(E)</quote>; and</text></clause><clause id="H53C6A576DB7F42179EBD8AF7B327CDC7"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>paragraph (1)(F)(i)</quote> and inserting <quote>paragraph (1)(E)(i)</quote>; and</text></clause></subparagraph><subparagraph id="H23B31F4EB068438D98D1421F94F6BAA5"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="HA3B2751B56594C768BFA34208D18F771" style="OLC"><paragraph id="H55DD52920D11469BABA13083980BEC2C"><enum>(9)</enum><text>For purposes of paragraph (2)(A)(ii), the amount determined under such paragraph shall not exceed the primary insurance amount for such month of a hypothetical individual—</text><subparagraph referred to in paragraph (1) became entitled to old-age or disability insurance benefits, or died (before becoming entitled to such benefits), and</text></subparagraph><subparagraph id="H050A7644FA3D4ACE834B667144BE807A"><enum>(B)</enum><text>to whom wages and self-employment income were credited in each of such hypothetical individual’s elapsed years (within the meaning of section 215(b)(2)(B)(iii)) in an amount equal to the national average wage index (as described in section 209(k)(1)) for each such year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7A19BCB2AD9A4FD6A78FA4B9254DDC0D"><enum>(2)</enum><header>Widowers</header><text>Section 202(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(f)</external-xref>) is amended—</text><subparagraph id="H8AE5373C7D31400D99C95619D0CA5AA9"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H7C223BB9FD5746DAA77D22A5FFE23A68"><enum>(i)</enum><text>in subparagraph (B), by inserting <quote>and</quote> at the end;</text></clause><clause id="HE93C321E348145FFB428F1D747662277"><enum>(ii)</enum><text>in subparagraph (C)(iii), by striking <quote>and</quote> at the end;</text></clause><clause id="HC11EA6B1D0B643F2A5A87AD44C8BDDFB"><enum>(iii)</enum><text>by striking subparagraph (D);</text></clause><clause id="HE4FE45CDE132405685EE59042351CDF3"><enum>(iv)</enum><text>by redesignating subparagraphs (E) and (F) as subparagraphs (D) and (E), respectively; and</text></clause><clause id="H3307CF1297424EE496EFAB984AD62546"><enum>(v)</enum><text>in the flush matter following subparagraph (E)(ii), as so redesignated, by striking <quote>or becomes entitled to an old-age insurance benefit</quote> and all that follows through <quote>such deceased individual,</quote>;</text></clause></subparagraph><subparagraph id="HC5939FFED80D492EA75A6B96939520C8"><enum>(B)</enum><text>by striking subparagraph (A) in paragraph (2) and inserting the following:</text><quoted-block id="H57F94E58DE9248E292BD6C4374D08675" style="OLC"><paragraph id="HA0DC31C0A0644437BC38E0C723A2B6DC"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA13227A143404BA5B9BDCE18CCE82933"><enum>(A)</enum><text>Except as provided in subsection (k)(5), subsection (q), and subparagraph (D) of this paragraph, such widower’s insurance benefit for each month shall be equal to the greater of—</text><clause id="H28F5810C1633490096DD275992EE39AE"><enum>(i)</enum><text>the primary insurance amount (as determined for purposes of this subsection after application of subparagraphs (B) and (C)) of such deceased individual, or</text></clause><clause id="HE11DAD0263C543D3B45390A501F2DB22"><enum>(ii)</enum><text>subject to paragraph (9), in the case of a fully insured widower or surviving divorced husband, 75 percent of the sum of any old-age or disability insurance benefit for which the widower or the surviving divorced husband is entitled for such month and the primary insurance amount (as determined for purposes of this subsection after application of subparagraphs (B) and (C)) of such deceased individual.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H81FB1190B1BC4400A55F86D75BA7760D"><enum>(C)</enum><text>in paragraph (5)—</text><clause id="H22A0FB52ABBF44408D944F9475E7A6D9"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>paragraph (1)(F)</quote> and inserting <quote>paragraph (1)(E)</quote>; and</text></clause><clause id="H944F1834E3E343E28794AC9500D8CF4B"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>paragraph (1)(F)(i)</quote> and inserting <quote>paragraph (1)(E)(i)</quote>; and</text></clause></subparagraph><subparagraph id="H75990A4663514B539B3C2CB2F8B45BD5"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H4BDA3F20D9824E2FB82AD4D1FCB70CDB" style="OLC"><paragraph id="H9AB77C8EC5BA4215B369D6596E130173"><enum>(9)</enum><text>For purposes of paragraph (2)(A)(ii), the amount determined under such paragraph shall not exceed the primary insurance amount for such month of a hypothetical individual—</text><subparagraph id="H1974CEECA1D5438EABD18061DD9452A4"><enum>(A)</enum><text>who became entitled to old-age insurance benefits upon attaining early retirement age during the month in which the deceased individual referred to in paragraph (1) became entitled to old-age or disability insurance benefits, or died (before becoming entitled to such benefits), and</text></subparagraph><subparagraph id="HA8D758D9820A4199A7BB40EEB11A3DCE"><enum>(B)</enum><text>to whom wages and self-employment income were credited in each of such hypothetical individual’s elapsed years (within the meaning of section 215(b)(2)(B)(iii)) in an amount equal to the national average wage index (as described in section 209(k)(1)) for each such year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HFFF0E15F54E84A85A95E9536532C7F5A"><enum>(b)</enum><header>Conforming amendment</header><text>Section 209(k)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/409">42 U.S.C. 409(k)(1)</external-xref>), as amended by section 103(c), is further amended by inserting <quote>202(e)(9), 202(f)(9),</quote> after <quote>sections</quote>. </text></subsection><subsection id="HC61C0E1141734A9D9C8920BFBBE9F8D8"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply only with respect to widow’s and widower’s insurance benefits payable for months in calendar year 2020.</text></subsection></section><section id="H9EB0E74583E14295BE038EE07491D9EF" commented="no"><enum>9.</enum><header>Increasing access to benefits for children who live with grandparents or other relatives</header><subsection id="HA4F7207CFE8C44C4A1095F8D138AF6FD"><enum>(a)</enum><header>In general</header><text>Title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> et seq.) is amended—</text><paragraph id="H858D6778615F4E4A8DE1151CB0EECA52"><enum>(1)</enum><text>in section 202(d)—</text><subparagraph id="H5D334D38328040A595EDA0CDF40B8542"><enum>(A)</enum><text>in paragraph (1)(C), by inserting <quote>except as provided in paragraph (9),</quote> before <quote>was dependent</quote>; and</text></subparagraph><subparagraph id="HCFBDF9E6B73E4D6EA9DDDA44AC54464E"><enum>(B)</enum><text>by amending paragraph (9) to read as follows:</text><quoted-block act-name="" id="HBE8E381A903847F189C20BAD7BF7FCB3" other-style="archaic" style="other"><paragraph id="HA44024C3C8D54905AE13B5753CBE1C41" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H521A2B1605A84D99A9B9F35898C8D281"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a child who is the child of an individual under clause (3) of the first sentence of section 216(e) and is not a child of such individual under clause (1) or (2) of such first sentence, the criteria specified in subparagraph (B) shall apply instead of the criteria specified in subparagraph (C) of paragraph (1).</text></subparagraph><subparagraph id="H4A62F13A59014FCA8687B20E858A450E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The criteria of this subparagraph are that—</text><clause id="HDA052BB666E045888BF8842220634D21"><enum>(i)</enum><text>the child has been living with such individual in the United States for a period of not less than 12 months;</text></clause><clause id="HE15C2EEE2D064692BE5358A34C4624AF"><enum>(ii)</enum><text>the child has been receiving not less than ½ of the child's support from such individual for a period of not less than 12 months; and</text></clause><clause id="H4CE989AADD2142FF8790198D1506B6CE"><enum>(iii)</enum><text>the period during which the child was living with such individual began before the child attained age 18.</text></clause></subparagraph><subparagraph id="H329E634C827544C59E760723CA73C587" indent="up1"><enum>(C)</enum><text>In the case of a child who is less than 12 months old, such child shall be deemed to meet the requirements of subparagraph (B) if, on the date the child attains 1 year of age, such child has lived with such individual in the United States and received at least ½ of the child's support from such individual for substantially all of the period which began on the date of such child's birth.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD2B6272E9CC94E8697CF9F5F8614DBDF"><enum>(2)</enum><text>in section 216(e), in the first sentence—</text><subparagraph id="HBB68EBBAC4C540B381D85DFDD0B16C44"><enum>(A)</enum><text>by striking <quote>grandchild or step­grand­child of an individual or his spouse</quote> and inserting <quote>grandchild, stepgrandchild, or other first-degree, second-degree, third-degree, fourth-degree, or fifth-degree relative of an individual or the individual's spouse</quote>;</text></subparagraph><subparagraph id="HFC550866D5B24D2292797B0C4E666265"><enum>(B)</enum><text>by striking <quote>was no natural or adoptive parent</quote> and inserting <quote>is no living natural or adoptive parent</quote>;</text></subparagraph><subparagraph id="H6EE78F66B38D4624B76C9EEF0B19A40E"><enum>(C)</enum><text>by striking <quote>was under a disability</quote> and inserting <quote>is under a disability</quote>;</text></subparagraph><subparagraph id="HDDD97AC3F42C4B19ADABDAB1F4D52929"><enum>(D)</enum><text>by striking <quote>living at the time</quote> and all that follows through <quote>, or (B)</quote> and inserting <quote>, (B)</quote>; and</text></subparagraph><subparagraph id="H38E9CABF317D4B68B549B21C68445557"><enum>(E)</enum><text>by inserting <quote>, or (C) a court of competent jurisdiction has issued an order granting custody of such person to the individual or the individual’s spouse</quote> before the first period.</text></subparagraph></paragraph></subsection><subsection id="H586EA8937F7A44268988BB94A140B453"><enum>(b)</enum><header>Conforming amendments</header><text>Section 202(d)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(1)</external-xref>) is amended—</text><paragraph id="HFEC4524D88F14874A8ACE9E6EE298FCA"><enum>(1)</enum><text>by striking <quote>subparagraphs (A), (B), and (C)</quote> and inserting <quote>subparagraphs (A) and (B) and subparagraph (C) or paragraph (9) (as applicable)</quote>; and</text></paragraph><paragraph id="H4D8378B6EFDE4A5983A12191D0786B1F"><enum>(2)</enum><text>by striking <quote>subparagraphs (B) and (C)</quote> and inserting <quote>subparagraph (B) and subparagraph (C) or paragraph (9) (as applicable)</quote>.</text></paragraph></subsection><subsection id="HF293E8C4A792494DB34B693F39FCEDCE"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to applications for child’s insurance benefits filed in calendar year 2020, except that such amendments shall not apply for purposes of determining continuing eligibility for child’s insurance benefits for any month after such calendar year.</text></subsection></section><section id="H3A367BFFBA7C49AFB69234312963CB74"><enum>10.</enum><header>Update in eligibility for the Supplemental Security Income program</header><subsection id="H99E18F1853FC4BE4A0839527748F30B1"><enum>(a)</enum><header>Update in general income exclusion</header><text display-inline="yes-display-inline">Section 1612(b)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382a">42 U.S.C. 1382a(b)(2)(A)</external-xref>) shall be applied for calendar year 2020 by substituting <quote>$1,476</quote> for <quote>$240</quote>.</text></subsection><subsection id="H1BF99F391F294B4C983B171893F4694D"><enum>(b)</enum><header>Update in earned income exclusion</header><text display-inline="yes-display-inline">Section 1612(b)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382a">42 U.S.C. 1382a(b)(4)</external-xref>) shall be applied for calendar year 2020 by substituting <quote>4,788</quote> for <quote>$780</quote> each place it appears.</text></subsection><subsection id="H5A4BD14BCAB946A5A71A731817690110"><enum>(c)</enum><header>Update in resource limit for individuals and couples</header><text>Section 1611(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382">42 U.S.C. 1382(a)(3)</external-xref>) is amended—</text><paragraph id="HB2ABD74959734060BC2D0A5EA1FC47BC"><enum>(1)</enum><text>in subparagraph (A), by adding at the end the following: <quote>Notwithstanding the preceding sentence, such dollar amount shall be deemed to be $20,000 for calendar year 2020 only.</quote>; and</text></paragraph><paragraph id="HB66F7B8447344B99BE5921403FB4957F"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by adding at the end the following: <quote>Notwithstanding the preceding sentence, such dollar amount shall be deemed to be $10,000 for calendar year 2020 only.</quote>.</text></paragraph></subsection></section><section commented="no" id="HD78D526AD6BE43689B94D6AEF2829609"><enum>11.</enum><header>Support and maintenance furnished in kind not included as income</header><subsection id="H585661C47A904CD8AAF1379615A32FD7"><enum>(a)</enum><header>In general</header><text>Section 1612(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382a">42 U.S.C. 1382a(a)(2)</external-xref>) is amended—</text><paragraph commented="no" id="HC8B9B3C083E64B7F8FA55EB2F77EAA0A"><enum>(1)</enum><text>by inserting <quote>(other than support or maintenance furnished in kind)</quote> after <quote>all other income</quote>; and</text></paragraph><paragraph commented="no" id="H15866638DC214C3E9DE7F7FCB32D99B2"><enum>(2)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" id="HDA84122A688C46D4B6969CF2A62F262F"><enum>(A)</enum><text>by striking <quote>or kind</quote>;</text></subparagraph><subparagraph commented="no" id="H75076DA3F85646FEB45D4AA5C42D4ACE"><enum>(B)</enum><text>by striking clause (i) and redesignating clauses (ii) and (iii) as clauses (i) and (ii), respectively; and</text></subparagraph><subparagraph commented="no" id="HB6022FCD1A75472596997DCB0890B45F"><enum>(C)</enum><text display-inline="yes-display-inline">in clause (ii) (as so redesignated), by striking <quote>and the provisions of clause (i) shall not be applicable</quote>.</text></subparagraph></paragraph></subsection><subsection id="HDF2E67EE45F34877B38D4D96FAE85253"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H885B71CF781E43EEBCA758D10E4A98B8"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1611(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382">42 U.S.C. 1382(c)</external-xref>) is amended by striking paragraph (6) and redesignating paragraphs (7) through (10) as paragraphs (6) through (9), respectively.</text></paragraph><paragraph id="HA6113F19C4C5484CB2BCD961620282C8"><enum>(2)</enum><text display-inline="yes-display-inline">Section 1612(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382a">42 U.S.C. 1382a(a)(2)</external-xref>) is amended—</text><subparagraph id="H88AAF83320A44DA2A5E1743690837917"><enum>(A)</enum><text>in subparagraph (F), by inserting <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HF205521150D143F087F908BE36239CCB"><enum>(B)</enum><text>in subparagraph (G), by striking <quote>; and</quote> and inserting a period;</text></subparagraph><subparagraph id="H7DA11B1935094F27857E3A6C7C9FCFC9"><enum>(C)</enum><text>by moving subparagraph (G) 2 ems to the right; and</text></subparagraph><subparagraph id="HF092724C36F74E3A9EB57CE46EC39A67"><enum>(D)</enum><text>by striking subparagraph (H).</text></subparagraph></paragraph><paragraph id="H6F1DE67F0374479090657DEB71765CB0"><enum>(3)</enum><text display-inline="yes-display-inline">Section 1621(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382j">42 U.S.C. 1382j(c)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H27A800148B744C2092311EB01F2E384E" style="OLC"><subsection id="H4EA2A259637D49B2A6A914460CD5247A"><enum>(c)</enum><text>In determining the amount of income of an alien during the period of 5 years after such alien's entry into the United States, support or maintenance furnished in cash to the alien by such alien's sponsor (to the extent that it reflects income or resources which were taken into account in determining the amount of income and resources to be deemed to the alien under subsection (a) or (b) of this section) shall not be considered to be income of such alien under section 1612(a)(2)(A).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDD24A242C17845ABA9FCB64543872CA5"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply for purposes of determining eligibility to supplemental security income benefits for months during calendar year 2020.</text></subsection></section><section id="HCD3C8DAAA47F43FF98C7B06437F768A4"><enum>12.</enum><header>Holding SSI, Medicaid, and CHIP beneficiaries harmless</header><text display-inline="no-display-inline">For purposes of determining the income of an individual to establish eligibility for, and the amount of, benefits payable under title XVI of the Social Security Act, eligibility for medical assistance under the State plan under title XIX (or a waiver of such plan), or eligibility for child health assistance under the State child health plan under title XXI (or a waiver of the plan), the amount of any benefit to which the individual is entitled under title II of such Act shall be deemed not to exceed the amount of the benefit that would be determined for such individual under such title as in effect on the day before the date of the enactment of this Act.</text></section><section id="H0A4602B9BE2A49EFA96BFF75D94B8FA6"><enum>13.</enum><header>Expedited adjustment of underpayments</header><text display-inline="no-display-inline">In any case in which, as a result of a provision of this Act or an amendment made by this Act, the Commissioner determines that an underpayment of benefits has occurred, the Commissioner shall pay the balance of the amount due as soon as practicable after the date of enactment of this Act.</text></section><section id="H472A96DBCD0B4C9BB0E4711C169F3959"><enum>14.</enum><header>Appropriation of funds</header><text display-inline="no-display-inline">There are appropriated from the general fund of the Treasury to the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund such sums as necessary to pay for the increases in benefits paid from such Trust Funds attributable to sections 3 through 9 of this Act and the amendments made by such sections.</text></section></legis-body></bill>
