R. 7422</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200630">June 30, 2020</action-date><action-desc><sponsor name-id="G000571">Ms. Gabbard</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Federal financial regulators to issue guidance to encourage depository institutions to establish programs to educate customers at risk of unwittingly becoming money mules.</official-title></form><legis-body id="HAEF074A269AC4589A3CC952A3ED3479D" style="OLC"><section id="H2753C374DBD341B284AF9CCDB6DB268F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Money Mule Awareness Act</short-title></quote>.</text></section><section id="H60F4800222824CBD9CC5658AF9B22C7B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H31453261214D46A5BC81F6C7A4B3FE76"><enum>(1)</enum><text display-inline="yes-display-inline">Criminals frequently recruit unwitting participants to move and hide illicit funds through the U.S. financial system.</text></paragraph><paragraph id="H2B3FEC2A7A864FBEB4AD492DC3CC70E9"><enum>(2)</enum><text>The Federal Trade Commission has issued materials to help educate consumers about money mule schemes.</text></paragraph><paragraph id="HBC03720D1F374A08B3B99DFA4F1448AD"><enum>(3)</enum><text>In April 2020, the Federal Bureau of Investigation issued a warning and guidance to the public of money mule schemes exploiting the COVID–19 pandemic.</text></paragraph><paragraph id="H6AC7893C29564BFCB00EB2A2BF18A8D7"><enum>(4)</enum><text>Depository financial institutions can be unwitting participants in fraudulent transactions by money mules and should be encouraged to educate at-risk customers of money mule schemes.</text></paragraph></section><section id="H94DF56028729452580F29383A2C258D5"><enum>3.</enum><header>Guidance on money mule education programs</header><subsection id="H2D6ED7DFC46C402D97D8562306115864"><enum>(a)</enum><header>Guidance</header><text display-inline="yes-display-inline">The Federal financial regulators shall, jointly, issue guidance to encourage depository institutions to establish programs to educate customers at risk of unwittingly becoming money mules.</text></subsection><subsection id="H7F0C6C87A1D644BBB91CB872FD8E02A4"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In issuing the guidance required under subsection (a), the Federal financial regulators shall consult with the Attorney General, the Director of the Federal Bureau of Investigation, the Director of the United States Secret Service, and the Federal Trade Commission.</text></subsection><subsection id="H561B4B7F653E4893910BF7C1FE28A2B1"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4DB91BD080AD493991EC9416477FB275"><enum>(1)</enum><header>Depository institution</header><text>The term <quote>depository institution</quote>—</text><subparagraph id="HB6CDBED527F64088AC5B577AD06E34C6"><enum>(A)</enum><text>has the meaning given that term under section 3 of the Federal Deposit Insurance Act; and</text></subparagraph><subparagraph id="H714F3681658D410AAD58A349960565D7"><enum>(B)</enum><text>means a State credit union and a Federal credit union, as such terms are defined under section 101 of the Federal Credit Union Act.</text></subparagraph></paragraph><paragraph id="H535B8B227E234256940422556A360009"><enum>(2)</enum><header>Federal financial regulators</header><text>The term <quote>Federal financial regulators</quote> means the Board of Governors of the Federal Reserve System, the Comptroller of the Currency, the Director of the Financial Crimes Enforcement Network, the Federal Deposit Insurance Corporation, and the National Credit Union Administration Board.</text></paragraph><paragraph id="H5D3A7B7F670447FF98F1E3F2DEFAC919"><enum>(3)</enum><header>Money mule</header><text display-inline="yes-display-inline">The term <quote>money mule</quote> means a person who transfers illegally acquired money on behalf of or at the direction of another. </text></paragraph></subsection></section></legis-body></bill>
