which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To assess and improve the competitiveness of American civilian nuclear commerce, to expedite Department of Energy review of certain nuclear technology exports, and for other purposes.</official-title></form><legis-body id="H94E13EC8DA8049B697DECFF698CF0C94" style="OLC"><section id="HBAFB5E80FB1042FFA9666C28810C7DDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening American Nuclear Competitiveness Act</short-title></quote>. </text></section><section id="H890E1A87637742E5BA4560868BDDD8E0"><enum>2.</enum><header>Competitiveness of nuclear commerce</header><subsection id="HC2C16E4A88A24218A8C9D410399C0766"><enum>(a)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Energy shall develop and submit to Congress a report on United States civil nuclear commerce.</text></subsection><subsection id="HD5C4D5DAFB92440082928C42675BFDEB"><enum>(b)</enum><header>Consultation</header><text>In developing the report required under subsection (a), the Secretary of Energy shall consult with—</text><paragraph id="HD4630AA50A8E42E59F18492269C758AC"><enum>(1)</enum><text>the Secretary of State;</text></paragraph><paragraph id="H3F21B17A48BE4BF39BC7DA77BC591038"><enum>(2)</enum><text>the Secretary of Commerce;</text></paragraph><paragraph id="H1D8DB32024DC43E0BB5F4366E34A26FD"><enum>(3)</enum><text>the Administrator of the Environmental Protection Agency; and</text></paragraph><paragraph id="H96D58C4CE15042EA8D1B960E9640528C"><enum>(4)</enum><text>the Nuclear Regulatory Commission.</text></paragraph></subsection><subsection id="HBE26D9A5E8CD4F108CD3D7275D8354B1"><enum>(c)</enum><header>Contents</header><text>The report required under subsection (a) shall include—</text><paragraph id="H5A22736FEEA04049BDBE0EFD4E1A5530"><enum>(1)</enum><text>an assessment of—</text><subparagraph id="HE64DFE34C923466FB8054B0D481F9ECC"><enum>(A)</enum><text>current legal, regulatory, policy, and commercial practices of the United States with respect to the civilian nuclear industry of the United States; and</text></subparagraph><subparagraph id="HF3F8A7A048E04EE78F4E8C8A18A4559B"><enum>(B)</enum><text>the impacts of such practices on such civilian nuclear industry in the United States and in foreign commerce;</text></subparagraph></paragraph><paragraph id="H02A2AEE26DF64AADB41BF865AD5CC262"><enum>(2)</enum><text>a comparison of the practices of the United States described in paragraph (1) to practices of foreign countries with respect to the civilian nuclear industry of such countries;</text></paragraph><paragraph id="H0E0298E70128469D994B7506055ED2A4"><enum>(3)</enum><text>recommendations to improve the competitiveness of United States civil nuclear commerce; and</text></paragraph><paragraph id="H5E5EEAF24BA341B08DAFAC52332958F6"><enum>(4)</enum><text>options on how to apply section 170 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref>) (commonly known as the <quote>Price-Anderson Act</quote>) with respect to advanced nuclear technologies.</text></paragraph></subsection></section><section id="H02A7498B882F4E0FB3846E361E2C6773"><enum>3.</enum><header>Expediting nuclear technology exports</header><subsection id="H11005BF8CCFD4E26BB16AD977DBEC976"><enum>(a)</enum><header>Expedited procedures</header><text>Section 57 of the Atomic Energy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2077">42 U.S.C. 2077(d)</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="HF62CAD90B3864B428D20FF808C97D53D" style="OLC"><subsection id="H824A0B6456514716A4D7B29385D655F6"><enum>(f)</enum><header>Expedited procedures</header><paragraph id="H0F255D24626E44EB8EE637B8E0AEAD54"><enum>(1)</enum><header>Establishment</header><text>In carrying out subsection b.(2), the Secretary of Energy shall establish procedures for expedited consideration of requests for authorizations regarding the transfer of a technology that involves a low-proliferation-risk reactor activity described in paragraph (2) to a foreign country described in paragraph (3).</text></paragraph><paragraph id="H83B361D749194F38997C8D0F52E55C64"><enum>(2)</enum><header>Activities</header><text>A low-proliferation-risk reactor activity described in this paragraph is an activity that meets each of following criteria:</text><subparagraph id="H45FB410E46C9460E86C3C3C61139B78D"><enum>(A)</enum><text>The activity is listed in section 810.2(b) of title 10, Code of Federal Regulations, as in effect on March 25, 2015.</text></subparagraph><subparagraph id="H899E8B9F77254D839D2F0834B4E7ECA5"><enum>(B)</enum><text>The activity is not an activity requiring a specific authorization pursuant to section 810.7(c) of such title, as in effect on such date.</text></subparagraph><subparagraph id="H38AE02FF71D0452B90B03CF7A590D569"><enum>(C)</enum><text>The Secretary determines that the transfer (or retransfer) of a technology that involves the activity will not result in a significant increase of the risk of proliferation beyond such risk that exists at the time that the authorization is requested.</text></subparagraph></paragraph><paragraph id="H2618CD07B8EB456D845591B069D344C1"><enum>(3)</enum><header>Foreign countries</header><text>A foreign country described in this paragraph is a foreign country—</text><subparagraph id="H928609397C7E4E0684253E6F04A5059A"><enum>(A)</enum><text>that is not a nuclear-weapon state, as defined by Article IX(3) of the Treaty on the Non-Proliferation of Nuclear Weapons, signed at Washington, London, and Moscow on July 1, 1968, other than the United Kingdom or France; and</text></subparagraph><subparagraph id="HEC0E827022094BDA8C772DB1BA5E84C7"><enum>(B)</enum><text>with respect to which the Secretary determines under subsection b.(2) that a transfer to the country of a technology that involves a low-proliferation-risk reactor activity described in paragraph (2) of this subsection will not be inimical to the interest of the United States.</text></subparagraph></paragraph><paragraph id="H95CF1CF457204149ABDE91AEFDCD34BF"><enum>(4)</enum><header>Concurrence and consultation</header><text>The Secretary of Energy shall establish the procedures under paragraph (1) with the concurrence of the Department of State and after consultation with the Nuclear Regulatory Commission, the Department of Commerce, and the Department of Defense.</text></paragraph><paragraph id="HCC38FFAF936C4E66AFB24F1A31091F74"><enum>(5)</enum><header>Timing and availability</header><text>The procedures established under paragraph (1) shall—</text><subparagraph id="HD05A4E3BACB04B05B6ADE466A0B7B842"><enum>(A)</enum><text>ensure that each request is approved or denied by not later than 45 days after the later of—</text><clause id="HDB764B4F95834BE3BB00B7311CCA109F"><enum>(i)</enum><text>the date on which the foreign country transmits any required assurances to the Department of State; or</text></clause><clause id="H9B6C07533CFB4FC594E7F6F534EF0B89"><enum>(ii)</enum><text>the date on which the interagency review under subsection b. is completed; and</text></clause></subparagraph><subparagraph id="HB8AD8F55A974473F90B38DD9E0A0C5F7"><enum>(B)</enum><text>be publicly available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H61BBFD097DB04EAD8CB71541843F5764"><enum>(b)</enum><header>Assurances</header><text>Section 57 b.(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2077">42 U.S.C. 2077(b)(2)</external-xref>) is amended by inserting after <quote>mechanisms.</quote> the following new sentence: <quote>To the extent practicable, the Secretary of Energy shall continue to process such requests during such interagency review in a manner that enables the Secretary to make such determination as soon as practicable after the receipt of assurances by a foreign country to the Department of State, if any such assurances are required.</quote>.</text></subsection></section><section id="H3CF6AB9B874740E88AA18EAA91FF8F05"><enum>4.</enum><header>Commercial license restrictions assessment</header><text display-inline="no-display-inline"> Not later than 18 months after the date of enactment of this Act, the Comptroller General shall transmit to Congress a report containing the results of a study on the feasibility and implications of modifying or repealing restrictions under sections 103 d. and 104 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>; 2134(d)) on issuing licenses for certain nuclear facilities to an alien or an entity owned, controlled, or dominated by an alien, a foreign corporation, or a foreign government.</text></section><section id="H8823D8F690D54A14BAC5A377D5CAB7EC"><enum>5.</enum><header>Risk pooling program assessment</header><subsection id="H57AE28521F774A45BCE93A49BF2F145D"><enum>(a)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall carry out a review of, and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on, the Secretary of Energy’s actions with respect to the program described in section 934(e) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17373">42 U.S.C. 17373(e)</external-xref>).</text></subsection><subsection id="HC94A076648194746AA5D6846A0ACB123"><enum>(b)</enum><header>Contents</header><text>The report described in subsection (a) shall include—</text><paragraph id="H3E709FEA700B40D9AB6F5C26603004D0"><enum>(1)</enum><text>an assessment of the Secretary of Energy’s actions to determine the risk-informed assessment formula under section 934(e)(2)(C) of the Energy Independence and Security Act of 2007;</text></paragraph><paragraph id="H990790D137A14ECBB4ED0C577F0BA5E5"><enum>(2)</enum><text>a review of the Secretary of Energy’s methodology to collect information to determine and implement the formula; and</text></paragraph><paragraph id="HB7533C9E6AA24A7892FA7627AFE4E0BB"><enum>(3)</enum><text>an evaluation of the program described in section 934(e) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17373">42 U.S.C. 17373(e)</external-xref>), including the Secretary of Energy’s actions with respect to such program.</text></paragraph></subsection></section></legis-body></bill>
