which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that a request for the deployment or modification of a communications facility entirely within a brownfields site is categorically excluded from the requirement to prepare certain environmental or historical preservation reviews.</official-title></form><legis-body id="H839B1A7E034746FDA2BB6132D647709B" style="OLC"><section id="H6DBB637F30034A74A8B539FD7F8B2B22" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Broadband Deployment Act</short-title></quote>.</text></section><section id="HD3646943909E4FEBB9C948EAF4FA7F2A"><enum>2.</enum><header>Application of NEPA and NHPA to brownfields</header><subsection id="H57503329D2EB47C295283656C64F9D77"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HAC44BFB7A0664F9DB6D7E57AD163559E"><enum>(1)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><subparagraph id="HF8E43FAE0F504E9CB432734334B5E20C"><enum>(A)</enum><text>any wireless or wireline infrastructure for the transmission of writing, signs, signals, data, images, pictures, or sounds of all kinds;</text></subparagraph><subparagraph id="H2B17BDD94CAC47A0A3CC07F9DACE69D7"><enum>(B)</enum><text>any transmitting device, tower, or support structure, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, associated with the provision of communications service; and</text></subparagraph><subparagraph id="HCCEF8CD1F39D431F9D9AE14C171D33C9"><enum>(C)</enum><text>any antenna or apparatus that—</text><clause id="HFD568E9BE5924E459667490DE5029140"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text></clause><clause id="H191DC62E89CA4D549A9E93395032EC23"><enum>(ii)</enum><text>is designed to be operated, or is operating, from a fixed location; and</text></clause><clause id="H10A01EAFA7724B22980D8CDA064E74BC"><enum>(iii)</enum><text>is added to a tower, building, or other structure.</text></clause></subparagraph></paragraph><paragraph id="HE5AFCCEA59D94E78B338E04629CD3CFF"><enum>(2)</enum><header>Communications service</header><text>The term <term>communications service</term> means a service for the transmission of writing, signs, signals, data, images, pictures, or sounds of all kinds.</text></paragraph><paragraph id="H7641E3ACE0AA480C981248C2B06FFFEB"><enum>(3)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project for the deployment or modification of a communications facility that is to be carried out entirely within a brownfield site (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)).</text></paragraph></subsection><subsection id="H8D0BAE7214F841EDBC7585F8A5A3311E"><enum>(b)</enum><header>NEPA categorical exclusion</header><paragraph id="H7441EEC75C054A76BB6942F03020C515"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A covered project subject to the approval of the Commission shall be categorically excluded from the requirement to prepare an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></paragraph><paragraph id="H35000F1A854844949092018FF8B428AF"><enum>(2)</enum><header>Relation to extraordinary circumstances procedures</header><text display-inline="yes-display-inline">The use of the categorical exclusion under paragraph (1) shall not be considered to include extraordinary circumstances under section 220.6 of title 36, Code of Federal Regulations, or section 1508.4 of title 40, Code of Federal Regulations (or any successor to such regulations).</text></paragraph></subsection><subsection id="H2A0C518CBFC74636B1BA1299777DB232"><enum>(c)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project for which the Commission is required to issue a permit or that is otherwise subject to the jurisdiction of the Commission shall not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection></section></legis-body></bill>
