which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, to establish a program to provide public transportation agencies with grants to be used during a disaster declaration.</official-title></form><legis-body id="H9AD4E559FAC0482B937D491ABEEEF988" style="OLC"><section id="H592FA0D70ABE4D6FBA1E8071363AD0E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transit Reliability, Acknowledgment, Investment and Need Act of 2020</short-title></quote> or the <quote><short-title>TRAIN Act of 2020</short-title></quote>. </text></section><section id="H66A4F2FD1D284B899358947F7C5C8A04"><enum>2.</enum><header>Grant program for emergency operations funding public transportation during major disasters</header><subsection id="HDA730B0698C24C0DBD8B21A954029B68"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H021571CF40544104B6339F335146D7ED" style="USC"><section id="H93E27410D2874375946234BDC56B4DCA"><enum>5341.</enum><header>Emergency and continuity of operations during disaster declarations</header><subsection id="H561F3B6E26F549D9A6C33AD1B2293B6E"><enum>(a)</enum><header>Establishment of grant program</header><text>The Secretary of Transportation shall establish a program to provide public transportation agencies with grants to be used during a State disaster declaration. </text></subsection><subsection id="HFDFFF8138ECC4350A3CEC2FF8E950CC0"><enum>(b)</enum><header>Criteria for eligible agencies</header><text>A public transportation agency is eligible to participate in the program if the agency—</text><paragraph id="H14FE35005C304A8BA962DB49E1267179"><enum>(1)</enum><text>at the time of application, receives funds (or eligible for such funds) under the surface transportation block grant program under section 133 of title 23;</text></paragraph><paragraph id="HBDA52C37567C401EB669CA362DCC377E"><enum>(2)</enum><text>for each of the 3 years before the date of application, has received funding (or eligible for such funds) for a public transportation project under this chapter; and</text></paragraph><paragraph id="H467BCE9E9D834C4FBB6968297FE15029"><enum>(3)</enum><text>submits an application as described in subsection (c).</text></paragraph></subsection><subsection id="H8570588082C04B92BF24CAB6683173C4"><enum>(c)</enum><header>Application</header><text>In accordance with such requirements as the Secretary may by rule establish, each application for a grant under this section shall—</text><paragraph id="HAD3BF2FC86BC4D46919D6F1BB87CD059"><enum>(1)</enum><text>include a strategy and detailed implementation plan that reflects consultation with community groups and appropriate stakeholders, and shall specify how the transit agency will continue operations during a disaster declaration;</text></paragraph><paragraph id="H337F6FA9BC9942C7ACDA21F81C84420C"><enum>(2)</enum><text display-inline="yes-display-inline">assess the public transportation agency’s ability to operate during a disaster declaration;</text></paragraph><paragraph id="H7FC5DE753C9B4B02842327F738CB6A08"><enum>(3)</enum><text>identify how the grant will ensure continuity of public transportation services and meet applicable safety and health standards requirements under subsection (i) during such disaster declaration;</text></paragraph><paragraph id="H1371E780D55B42ED94FBE7C9B1744ACF"><enum>(4)</enum><text>demonstrate the agency’s plan to provide no-cost transportation for general transportation service, premium transportation service, and paratransit services during the time period under which such disaster declaration;</text></paragraph><paragraph id="HBD84D5F2FE3E4583A543BF835483A778"><enum>(5)</enum><text>include the total of revenue losses as of the date of application caused by the disaster declaration and a projection of such future losses anticipated during the course of such disaster declaration and shall include an analysis and description of such revenue losses following the 6-month period following the expected termination of such disaster declaration; </text></paragraph><paragraph id="HBF4EF92EE22C4507AD0184209AAB8DD2"><enum>(6)</enum><text>describe the mechanisms to be employed by the public transportation agency to protect employees from exposure to the conditions generating the disaster declaration;</text></paragraph><paragraph id="H42B89FEBD19D44949B8E92EDE29ACD92"><enum>(7)</enum><text>provide a list of protocol and supplies that will be used to clean and disinfect surfaces impacted by the events generating the disaster declaration;</text></paragraph><paragraph id="H2464F1FA7B9A4B279216E3CC62CE760F"><enum>(8)</enum><text>include a list of protective gear to be used by public transit employees that will reduce employee exposure to the conditions generating the disaster declaration;</text></paragraph><paragraph id="HF8CFB8C2E12649E282C69409C611B0EC"><enum>(9)</enum><text>identify related governmental and community initiatives which compliment or will be coordinated with the proposal;</text></paragraph><paragraph id="H4E637A2832514CFCBFCDCFCACEFC34AD"><enum>(10)</enum><text>certify that there has been appropriate coordination with all appropriate agencies; and</text></paragraph><paragraph id="H4A065650693A4022BF3FF909DE50CFDA"><enum>(11)</enum><text>additional information as required by the Secretary.</text></paragraph></subsection><subsection id="HC395CF5716EA4DE4A5F38FA773E64051"><enum>(d)</enum><header>Forms of assistance</header><text>Funds provided under this section may be expended for—</text><paragraph id="HAD79649536784F93A5958630BD5C8F9B"><enum>(1)</enum><text>providing continued services during the pandemic or disaster declaration, consistent with the requirements under subsection (i);</text></paragraph><paragraph id="H1DD39F8A2FD74969BF515C147348B998"><enum>(2)</enum><text>stabilization of fare prices for passengers during the period of such disaster declaration;</text></paragraph><paragraph id="H139A1F0CDE444A5A873F4B9B23FDF9B2"><enum>(3)</enum><text>no-cost public transportation services during such disaster declaration;</text></paragraph><paragraph id="HF470090927F742ECAC04EE60BF501CCB"><enum>(4)</enum><text>provision of new or supplemental public transportation service bus routes, or bus rapid systems; and</text></paragraph><paragraph id="H7FA09383079149D49386DE8F62B4A884"><enum>(5)</enum><text>procurement of personal protective gear and equipment needed to protect employees from hazards generated or originating from the disaster declaration.</text></paragraph></subsection><subsection id="HA63D473A2DA24D8180D48CB89850444D"><enum>(e)</enum><header>Special rule on expenditures and minimum requirement for eligibility of funds</header><text>A public transportation agency receiving grant funds under this section shall provide assistance to the general public under subsection (d)(3) and (d)(4) during the disaster declaration period and, subsequently, for a period of 6 months after the termination of such disaster declaration.</text></subsection><subsection id="HABED6ACDF8CE429B8C0CA4B3084E1CC6"><enum>(f)</enum><header>Grant requirements</header><paragraph id="HFB97CCAE56994DB6ADFDF939A67C5B0A"><enum>(1)</enum><header>Amount</header><text>A grant awarded under this section may not exceed $5,000,000,000.</text></paragraph><paragraph id="H63C2AA309D84491FA8E6B56804E5FEDE"><enum>(2)</enum><header>Renewals of certain grants</header><subparagraph id="H06A5D0DD8E1640959379E6CAC0B0E42D"><enum>(A)</enum><header>In general</header><text>A grant may be renewed during the disaster declaration period, provided the public transportation agency—</text><clause id="H127CAE1FA2D946D39130736AC9D1AB3E"><enum>(i)</enum><text>submits to the Secretary an application for renewal at such time, in such manner, and containing such information as the Secretary may require; and</text></clause><clause id="HB69EC7412C22481E8E42FBED88DE31C8"><enum>(ii)</enum><text>demonstrates in such application for renewal that—</text><subclause id="H393AEA7FB19D4F9A913D300DEB9AB7EE"><enum>(I)</enum><text>the initial grant was used in a manner required under the most recently approved application; and</text></subclause><subclause id="HACD8CDD7273B4466968EAE61926C2E43"><enum>(II)</enum><text>the public transportation agency has made progress in achieving the objectives of the initial application approved for the public transportation agency under this section.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H4761CE71E1A2492B93DD81C183EB33F2"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph id="H1696558600224CEC8528CBCC9C9A2E2A"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $50,000,000,000 for each of fiscal years 2020 and 2021.</text></paragraph><paragraph id="H9F39338D1FC84D4AA1622A4709BE0C52"><enum>(2)</enum><header>Availability</header><text>Funds authorized to be appropriated under this section shall remain available until expended.</text></paragraph></subsection><subsection id="H2F62FF5ECD7D4AFEAE44DCA11581D76D"><enum>(h)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit a project from receiving a grant under this section while simultaneously receiving funds for associated transit improvement or capital projects.</text></subsection><subsection id="H3062A7733E1C4B6180ED8AD327AEE5AD"><enum>(i)</enum><header>Required certification of safety and health protocol</header><text>A public transportation agency shall certify with the Secretary every 7 days that any use of funds under subsection (d) meet applicable health and safety standards and guidance by the Centers for Disease Control issued during the disaster declaration for passengers and employees of the public transportation agency that includes a description of the compliance mechanisms employed by such agency.</text></subsection><subsection id="H7109C0E42A10467A86FD5BDEC6D4058D"><enum>(j)</enum><header>Annual reports</header><text>A public transportation agency that receives funds under this section during a fiscal year shall submit to the Secretary a description and an evaluation report on a date specified by the Secretary regarding the progress such projects have made to make transportation access points accessible to persons with limited mobility.</text></subsection><subsection id="HB6312E593D2A4087B2492C5F7D05AC2B"><enum>(k)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5F533E6D6A5E4BF1BE513E18C6C022D4"><enum>(1)</enum><header>Disaster declaration</header><text>The term <quote>disaster declaration</quote> means—</text><subparagraph id="H3EEC85298FE6415D8EAD6A8CDA1E2BCF"><enum>(A)</enum><text>an emergency involving Federal primary responsibility determined to exist by the President under section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191(b)</external-xref>);</text></subparagraph><subparagraph id="HD1DE70217F43448B81F3D8237E03885A"><enum>(B)</enum><text>a national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.);</text></subparagraph><subparagraph id="H7B7BBF51387145D8B2E34E9537E2AA15"><enum>(C)</enum><text>an emergency declared by a Federal official with respect to coronavirus (as defined in section 506 of the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>)); or</text></subparagraph><subparagraph id="H5A67AD4E97FC4625B6D31F09D3FF9D5D"><enum>(D)</enum><text>a public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247">42 U.S.C. 247(d)</external-xref>) with respect to COVID–19 or any other coronavirus with pandemic potential.</text></subparagraph></paragraph><paragraph id="H1A43B5167ACD405EB539854BAE4BFEF1"><enum>(2)</enum><header>General transportation service</header><text>The term <quote>general transportation service</quote> means a transportation service that is subject to the same base fare established by the transportation agency for local or general service.</text></paragraph><paragraph id="H8F4698F0C48E4CE4B270D7952200C90A"><enum>(3)</enum><header>Premium transportation service</header><text>The term <quote>premium transportation service</quote> means a transportation service that is not a general transportation service.</text></paragraph><paragraph id="H23FC7DE61E31472284E02404179C0394"><enum>(4)</enum><header>Paratransit services</header><text>The term <quote>paratransit services</quote> means service to individuals with disabilities that is comparable to the level of service provided to individuals without disabilities who use routes operated by the public transportation agency.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF7AA016AD50740BCAAC351CEB5E58899"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of chapters for chapter 53 of subtitle III of title 49, United States Code, is amended by adding after the item relating to section 5340 the following new item:</text><quoted-block style="USC" id="HB769D22BC52D4D9188E1B7509F104510" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">5341. Emergency and continuity of operations during disaster declarations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HE400C92DB875490DB60DC4F44BC7415B"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary shall publish in the Federal Register interim final rules implementing this title, which shall allow eligible public transportation agencies to immediately apply for funds under section 5341 of title 49, United States Code (as added by section 2). Notwithstanding section 553 of title 5, United States Code, the regulation shall be effective, on an interim basis, immediately upon publication, but may be subject to change and revision after public notice and opportunity for a period of public comment. The Secretary shall finalize such rules not later than 90 days after the date of publication.</text></section></legis-body></bill>
