which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit funds made available under the airport improvement program from being provided to entities that have violated the intellectual property rights of United States entities and therefore pose a threat to national security, and for other purposes.</official-title></form><legis-body id="H01E615C62B4F45E2B597BF44535220B7" style="OLC"><section id="H8BB17847D6454062BAB257D67098A7C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airport Infrastructure Resources Security Act of 2020</short-title></quote> or the <quote><short-title>AIR Security Act</short-title></quote>.</text></section><section id="H4A281779A85841ABACBD59093AE3FE04" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on provision of grant funds to entities that have violated intellectual property rights of United States entities</header><subsection id="H84CBC21D60534853BC1EDABEB01D4CAD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of chapter 471 of the title 49, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HD12F16CEA5FD44C29B721A748B7086FF" style="USC"><section id="H76492BCD06EC44F7965DFFFE19FCBC90"><enum>47145.</enum><header>Prohibition on provision of grant funds to entities that have violated intellectual property rights of United States entities</header><subsection id="H71951106F2724CE9831184EB7C19C061"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date that is 30 days after the date of the enactment of this section, amounts provided as project grants under this subchapter may not be used to enter into a contract described in subsection (b) with any entity on the list required by subsection (c).</text></subsection><subsection id="H8709799FEA5248C4954BFA64E30190D7"><enum>(b)</enum><header>Contract described</header><text>A contract described in this subsection is a contract or other agreement for the procurement of infrastructure or equipment for a passenger boarding bridge at an airport.</text></subsection><subsection id="HBE2117A21A564FE7B44235079DD54BF6"><enum>(c)</enum><header>List required</header><paragraph id="H5E9F866249E84AB9A031280AE85FA2AB"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this section, and thereafter as required by paragraphs (2) and (3), the Administrator of the Federal Aviation Administration shall, in consultation with the United States Trade Representative and the Attorney General, make available to the public a list of entities that—</text><subparagraph id="HB57A31E15F46404CB319DD85FC2E1FE1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HF5C15A66692341C79215C8DC6BB9B6CA"><enum>(i)</enum><text>are owned or controlled by, or receive subsidies from, the government of a country—</text><subclause id="HF862E7F642534616878F59B354499F81" indent="up1"><enum>(I)</enum><text>identified by the Trade Representative under subsection (a)(1) of section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) in the most recent report required by that section; and</text></subclause><subclause id="HF6214CA758B34CAAA28DAC5A9889D729" indent="up1"><enum>(II)</enum><text>subject to monitoring by the Trade Representative under section 306 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2416">19 U.S.C. 2416</external-xref>); and</text></subclause></clause><clause id="HF5ABD9CE24A34954B721533B94027CAB" indent="up1"><enum>(ii)</enum><text>have been determined by a Federal court to have misappropriated intellectual property or trade secrets from an entity organized under the laws of the United States or any jurisdiction within the United States; or</text></clause></subparagraph><subparagraph id="H4FA08F31C52A415A8B32463E1B4EDEE1"><enum>(B)</enum><text>own or control, are owned or controlled by, are under common ownership or control with, or are successors to, an entity described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H58DA76CC0100469EAE98C4023148C1F9"><enum>(2)</enum><header>Updates to list</header><text>The Administrator shall update the list required by paragraph (1)—</text><subparagraph id="HFA4049BF229847A8A32E0B2A50B4FCF9"><enum>(A)</enum><text>not less frequently than every 90 days during the 180-day period following the initial publication of the list under paragraph (1); and</text></subparagraph><subparagraph id="H4CF658DED346499B8DE81C5F3A5736E6"><enum>(B)</enum><text>not less frequently than annually during the 5-year period following the 180-day period described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HA9BE13A97FA44BD8BB03F850871878C4"><enum>(3)</enum><header>Continuation of requirement to update list</header><subparagraph id="H925683E2D1D34732A866FBF0FB91A19E"><enum>(A)</enum><header>In general</header><text>Not later than the end of the 5-year period described in paragraph (2)(B), the Administrator shall make a determination with respect to whether continuing to update the list required by paragraph (1) is necessary to carry out this section.</text></subparagraph><subparagraph id="HE25428A7DDA54CB39BA7404AF9F592C8"><enum>(B)</enum><header>Effect of determination that updates are necessary</header><text>If the Administrator determines under subparagraph (A) that continuing to update the list required by paragraph (1) is necessary, the Administrator shall continue to update the list not less frequently than annually.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE00B0D7D52F476BA111FA54E2D17E58"><enum>(C)</enum><header display-inline="yes-display-inline">Effect of determination that updates are not necessary</header><text display-inline="yes-display-inline">If the Administrator determines under subparagraph (A) that continuing to update the list required by paragraph (1) is not necessary, the Administrator shall, not later than 90 days after making the determination, submit to Congress a report on the determination and the reasons for the determination.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA2120388142640EA951EAD4D4CA8A799"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for chapter 471 of such title is amended by inserting after the item relating to section 47144 the following:</text><quoted-block display-inline="no-display-inline" id="H732C50DCF94C4CBD8A456C2B39988B7A" style="OLC"><toc><toc-entry bold="off" level="section">47145. Prohibition on provision of grant funds to entities that have violated intellectual property rights of United States entities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
