which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to modify the apportionment formula for the congestion mitigation and air quality improvement program, and for other purposes.</official-title></form><legis-body id="H09276375221542CF9BF4B473702B2846" style="OLC"><section id="HEEC4E854BE25459DAAF7111CA2F09C79" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congestion Mitigation and Air Quality Improvement Modernization Act</short-title></quote>.</text></section><section id="H2D847D18F9C342D3873D71B63A380665" section-type="subsequent-section"><enum>2.</enum><header>Apportionment</header><text display-inline="no-display-inline">Section 104(b)(4) of title 23, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="H753ACC2CF5BB4426821D8B939DBF4AA6" display-inline="no-display-inline"><paragraph id="H72BA6C59555B48C4AC6BB00A5F317836"><enum>(4)</enum><header>Congestion mitigation and air quality improvement program</header><subparagraph id="H2A5917AF9C1E4FD89D0843FC99A5675F"><enum>(A)</enum><header>Calculation</header><text>For the congestion mitigation and air quality improvement program, an amount determined by multiplying the amount of the base apportionment remaining for the State under subsection (c) after making the set aside in accordance with paragraph (5) by the proportion that—</text><clause id="H611B6168BD94402080C153223F1E5751"><enum>(i)</enum><text display-inline="yes-display-inline">the total of all weighted county populations with monitored pollutant concentrations above national ambient air quality standards in the State; bears to</text></clause><clause id="H31500B10CC97424C9FCB5873D0BD87F9"><enum>(ii)</enum><text display-inline="yes-display-inline">the total of all weighted county populations with monitored pollutant concentrations above national ambient air quality standards in all States.</text></clause></subparagraph><subparagraph id="H3DB09B52D0694B65A3024250417D8514"><enum>(B)</enum><header>Calculation of weighted populations with monitored pollution concentrations above national ambient air quality standards</header><text display-inline="yes-display-inline">Subject to subparagraphs (C), (D), and (E), for the purpose of subparagraph (A), the weighted population in counties with pollution concentrations above national ambient air quality standards shall be calculated by multiplying the population of each county by a factor determined from the ratio of design values to national ambient air quality standards.</text></subparagraph><subparagraph id="H26BA3E7814114AC194426041B073D189"><enum>(C)</enum><header>Design values of ozone</header><clause id="H6C73316937F34095A29275917F014D93"><enum>(i)</enum><header>In general</header><text>In making the calculation under subparagraph (B), for counties with design values of ozone greater than the national ambient air quality standard, the population of a monitored county is multiplied by a factor of—</text><subclause id="H005922C08D2B42659FCB74F3B95B0C2F"><enum>(I)</enum><text display-inline="yes-display-inline">the average of 2013–2015 and 2016–2018 design values, provided by the Environmental Protection Agency Administrator; bears to</text></subclause><subclause id="HC2AD4F2A590A46BFAF1305903C04C9E1"><enum>(II)</enum><text display-inline="yes-display-inline">the primary national ambient air quality standard for ozone established by the Administrator under 109(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(b)</external-xref>). </text></subclause></clause><clause id="H02CB6F183E994AA7873C49A3B8F14F2F"><enum>(ii)</enum><header>Special rule</header><text display-inline="yes-display-inline">If the average of design values from 2013–2015 and 2016–2018 is not greater than the primary national ambient air quality standard for ozone, a weighting factor of zero is applied.</text></clause><clause id="H308AD3B00C7842F5B12A38379CF6941E"><enum>(iii)</enum><header>Maximum factor</header><text display-inline="yes-display-inline">Notwithstanding clauses (i) and (ii), the maximum factor to be applied for ozone shall not exceed 1.4.</text></clause></subparagraph><subparagraph id="H60DD3B0291764CFF8F56FEC44104EE04"><enum>(D)</enum><header>Design values of fine particulate matter</header><clause id="HEB038A72AD58474981A2D12DCEECEE35"><enum>(i)</enum><header>In general</header><text>For counties with design values of fine particulate matter greater than the national ambient air quality standards, the population of a monitored county is multiplied by the greater factor of—</text><subclause id="HD064133F485F436CB456CAB40C355166"><enum>(I)</enum><text display-inline="yes-display-inline">the average of the 2013–2015 and 2016–2018 design values for annual concentrations of fine particulate matter, provided by the Environmental Protection Agency Administrator; bears to</text></subclause><subclause id="HF392A6C4D61C4A308E6D378233C1BA41"><enum>(II)</enum><text display-inline="yes-display-inline">the primary national ambient air quality standard for fine particulate matter for annual concentrations established by the Administrator under 109(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(b)</external-xref>); or</text></subclause><subclause id="H93C9E42D8A3748AC8965ACDD59405A6A"><enum>(III)</enum><text display-inline="yes-display-inline">the average of the 2013–2015 and 2016–2018 design values for 24-hour averaging time of fine particulate matter, provided by the Environmental Protection Agency Administrator; bears to</text></subclause><subclause id="H8B9E71B59070466592493FDF246FE8FA"><enum>(IV)</enum><text display-inline="yes-display-inline">the primary national ambient air quality standard for fine particulate matter for 24-hour averaging time established by the Administrator under 109(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(b)</external-xref>).</text></subclause></clause><clause id="H7BED093E9DF94EC280C23A9062C21484"><enum>(ii)</enum><header>Special rule</header><text display-inline="yes-display-inline">If the average of design values from 2013–2015 and 2016–2018 are not greater than the primary national ambient air quality standards for particulate matter, a weighting factor of zero is applied.</text></clause><clause id="H718CFA5B85624BFB8711D62E5A06B373"><enum>(iii)</enum><header>Maximum factor</header><text display-inline="yes-display-inline">Notwithstanding clause (i), the maximum factor to be applied for fine particulate matter shall not exceed 1.4.</text></clause></subparagraph><subparagraph id="HE8D8BA579D264A7B81EFA8C89DAC0798"><enum>(E)</enum><header>Design values of both ozone and particulate matter</header><text display-inline="yes-display-inline">Notwithstanding subparagraphs (B) through (D), for counties with design values greater than the national ambient air quality standards for both ozone and particulate matter, a new factor, determined by multiplying the factors determined in subparagraphs (C) and (D), is applied to county populations in place of the individual factors determined in subparagraphs (C) and (D).</text></subparagraph><subparagraph id="H166B18F147EE46C9A502AFDAE70E30D5"><enum>(F)</enum><header>Minimum apportionment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this paragraph, the minimum apportionment for a State under this paragraph shall be one half of 1 percent of the funds apportioned under this paragraph.</text></subparagraph><subparagraph id="H2DFD060BABE44290BDFFF23C37A2B370"><enum>(G)</enum><header>Maximum apportionment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this paragraph, the maximum apportionment for a State under this paragraph shall be 25 percent of the funds apportioned under this paragraph. </text></subparagraph><subparagraph id="HA2FCA097B0EE45C8A3B825CDA7391056"><enum>(H)</enum><header>Determinations of population</header><text display-inline="yes-display-inline">In determining county population for purposes of this paragraph, the Secretary shall use the latest available annual estimates prepared by the Secretary of Commerce. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB8A6C618DAF9499EA5E9209A3D0F5CD9"><enum>3.</enum><header>Congestion mitigation and air quality improvement program</header><text display-inline="no-display-inline">Section 149 of title 23, United States Code, is amended—</text><paragraph id="H76CDF4E111974D3087E5C54AEA69A0A6"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HDBF1FD41ADBF400285449FE5BC14506E"><enum>(A)</enum><text>by striking <quote>, carbon monoxide,</quote>;</text></subparagraph><subparagraph id="H9AC70D59D7A345F29DD4CCF825088632"><enum>(B)</enum><text>by striking <quote>186(a),</quote>;</text></subparagraph><subparagraph id="H7DB3DD76D67D45DFAAE9D85B3CD97894"><enum>(C)</enum><text>by striking <quote>7512(a),</quote>;</text></subparagraph><subparagraph id="HAC92C3E020234F56899BF746A0E085AF"><enum>(D)</enum><text>in paragraph (8)(B) by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HBF0607C7F0CC409AA091BCB6B7FC292B"><enum>(E)</enum><text>in paragraph (9) by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H512AC2F0D4D249049929A17B9A03F982"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HA7D9E53D9A6842868FBF6E36B36BECE4" display-inline="no-display-inline"><paragraph id="H09C8F86249E04E368F73B998C4AAA5E7"><enum>(10)</enum><text display-inline="yes-display-inline">other projects, if determined by the Secretary, to be more cost-effective than projects described in paragraphs (1) through (9). </text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8A56160754E943FA9FA1A4917072BB59"><enum>(2)</enum><text>in subsection (c) by striking <quote>carbon monoxide, or both, and for</quote>; and</text></paragraph><paragraph id="HDB5C0244A9B0407C8D89343DA85D8B61"><enum>(3)</enum><text>by amending subsection (d) to read as follows: </text><quoted-block style="USC" id="H22C910BD842448C78C74BD69F5914D54" display-inline="no-display-inline"><subsection id="H1DE671E59F16464BB077D5350AFC3C0A"><enum>(d)</enum><header>States flexibility</header><text display-inline="yes-display-inline">If a State does not have, and never has had, a nonattainment area designated under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.), the State may use funds apportioned to the State under section 104(b)(4) for any project in the State that—</text><paragraph id="H3B19AF9529E54B5CB26E929A8E252271"><enum>(1)</enum><text display-inline="yes-display-inline">would otherwise be eligible under subsection (b) as if the project were carried out in a nonattainment or maintenance area; or</text></paragraph><paragraph id="HB46860E296BA4F07B401C0169D907F27"><enum>(2)</enum><text display-inline="yes-display-inline">is eligible under the surface transportation block grant program under section 133.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
