committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide an exclusion from gross income for certain workers, and for other purposes.</official-title></form><legis-body id="HD2C8AB7B4BFE4640AEE2B61F8233B421" style="OLC"><section id="H558D7711FE6C4BB8AC99872740900FF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assistance and Gratitude for Coronavirus Heroes in Agribusiness who are Invaluable to the Nation Act</short-title></quote> or the <quote><short-title>AG CHAIN Act</short-title></quote>.</text></section><section id="H21444D83521842AAA210D4DFF007E2AF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text><paragraph id="HF34A3D5184FA419893BF5BBB310943E6"><enum>(1)</enum><header>Qualified employee</header><text display-inline="yes-display-inline">The term <quote>qualified employee</quote> means any individual who is—</text><subparagraph id="H57FE005897B0422E8FF974CCB763D6DC"><enum>(A)</enum><text>an essential food and agriculture employee, and</text></subparagraph><subparagraph id="H8C00DD8DFE85413C9A6E617E277D83ED"><enum>(B)</enum><text>working on his or her employer’s premises or on duty delivering to customers or performing tasks on the premises of a customer, traveling to and from such locations, or otherwise at a prescribed work place that is not his or her home or a remote worksite.</text></subparagraph></paragraph><paragraph id="H6D7A2D025CED40DD993E3367B57BFF86"><enum>(2)</enum><header>Essential food and agriculture employee</header><text display-inline="yes-display-inline">The term <quote>essential food and agriculture employee</quote> means—</text><subparagraph id="H6CF9E6814BB64DCA84E70CF8F619ABD3"><enum>(A)</enum><text display-inline="yes-display-inline">an employee who provides services at a business that—</text><clause id="H028F95E77078496C9B0210C975995A55"><enum>(i)</enum><text display-inline="yes-display-inline">is assigned a North American Industry Classification System code beginning with 4451, 4471, 4247, 7225, 72233, 722330, 72331, or 722310, and </text></clause><clause id="H5382AA321CED4E9CB09E9CFB398AA8BB"><enum>(ii)</enum><text>is located in a county that has at least one confirmed case of COVID–19, or </text></clause></subparagraph><subparagraph id="H08904B5F7534450C9D9ADA4A79EBB7D4"><enum>(B)</enum><text display-inline="yes-display-inline">an employee identified as a member of the food and agriculture workforce in the guidance issued by the Cybersecurity and Infrastructure Security Agency on April 17, 2020, entitled “Guidance on the Essential Critical Infrastructure Workforce: Ensuring Community and National Resilience in COVID-19 Response Version 3.0” (or any successor guidance).</text></subparagraph></paragraph></section><section id="H9241817D48E14CA8AE5FE5B803DA5A17"><enum>3.</enum><header>Exclusion from gross income for certain workers</header><subsection id="HA449D432B95F4D759056C7BBEA38A332"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of the Internal Revenue Code of 1986, gross income shall not include specified income of any qualified employee. </text></subsection><subsection id="HD60917E6C2D044F4A5D27E2F3878B4B5"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The aggregate amount not included in the gross income of any individual by reason of subsection (a) shall not exceed $25,000.</text></subsection><subsection id="HF1B82C644E094065BF7297A07A522994" display-inline="no-display-inline"><enum>(c)</enum><header>Applicable period</header><text display-inline="yes-display-inline">The term <quote>applicable period</quote> means the period beginning on February 15, 2020, and ending on June 15, 2020.</text></subsection><subsection id="H19268075D93D4BACBAF0064D753639BC"><enum>(d)</enum><header>Specified income</header><text>For purposes of this section, the term <quote>specified income</quote> means—</text><paragraph id="H874D084B3B3E4F97A243775CA0A94A01"><enum>(1)</enum><text display-inline="yes-display-inline">if the services described in section 1(2) are provided as an employee, the wages (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/3121">section 3121(a)</external-xref> of the Internal Revenue Code of 1986 determined without regard to paragraph (1) thereof) received by the qualified employee for the applicable period, and</text></paragraph><paragraph id="HEA2A7FE17C234BF79E9DB1CD08F67074"><enum>(2)</enum><text display-inline="yes-display-inline"> in any other case, the income of the qualified employee which is properly allocable to the services described in section 1(2) which are provided by such qualified employee during the applicable period.</text></paragraph></subsection><subsection id="H38FEB2F0907A499DAFB05B23EBF9C1C2"><enum>(e)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary of the Treasury (or the Secretary’s delegate) may extend the applicable period for a period not to exceed 3 additional calendar months if the Secretary (or the Secretary’s delegate) determines that the emergency related to COVID-19 is likely to be ongoing during such period. If such period is so extended, the dollar amount in subsection (b) shall be increased by $6,250 for each month of such extension (and a like rate of increase with respect to any extension which is not a whole number of months).</text></subsection></section><section id="H240915EF2FBD406B917A228CA3C6D0D2"><enum>4.</enum><header>Temporary suspension of payroll taxes up to a cap</header><subsection id="HB2230CEF7D884BC5AC1E9177FB59B94F"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, with respect to so much of the total wages (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/3121">section 3121(a)</external-xref> of the Internal Revenue Code of 1986) of the qualified employees of an employer as does not exceed $75,000—</text><paragraph id="HF3719981F32C4155A0EC7F61C0559D41"><enum>(1)</enum><text>with respect to any taxable year which begins in the payroll tax suspension period, the rate of tax under <external-xref legal-doc="usc" parsable-cite="usc/26/1401">section 1401(a)</external-xref> of the Internal Revenue Code of 1986 shall be 0 percent,</text></paragraph><paragraph id="HD766B2968EA14E5C83E0E64E1DE18B8C"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to remuneration received for pay periods ending during the payroll tax suspension period, the rate of tax under 3101(a) of such Code shall be 0 percent (including for purposes of determining the applicable percentage under sections 3201(a) and 3211(a)(1) of such Code), and </text></paragraph><paragraph id="HF00CBAFC3C7643538D16BF3F05286E72"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to remuneration paid for pay periods ending during the payroll tax suspension period, the rate of tax under section 3111(a) of such Code shall be 0 percent (including for purposes of determining the applicable percentage under section 3221(a) of such Code). </text></paragraph></subsection><subsection id="H9E4376F663BC41839CF3E48AEC46DC9D" display-inline="no-display-inline"><enum>(b)</enum><header>Payroll tax suspension period</header><text display-inline="yes-display-inline">The term <quote>payroll tax suspension period</quote> means the period beginning on February 15, 2020, and ending on June 15, 2020.</text></subsection><subsection id="H29150F98083F439CB27D300404AB3461"><enum>(c)</enum><header>Employer Notification</header><text>The Secretary of the Treasury (or the Secretary’s delegate) shall notify employers of the payroll tax suspension period in any manner the Secretary (or the Secretary’s delegate) deems appropriate. </text></subsection><subsection id="HD0883032D40B4F5F830CFB64664A6BE6" display-inline="no-display-inline"><enum>(d)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary of the Treasury (or the Secretary’s delegate) may extend the payroll tax suspension period for a period not to exceed 3 additional calendar months if the Secretary (or the Secretary’s delegate) determines that the emergency related to COVID-19 is likely to be ongoing during such period. If such period is so extended, the dollar amount in subsection (a) shall be increased by $18,750 for each month of such extension (and a like rate of increase with respect to any extension which is not a whole number of months).</text></subsection><subsection id="H3CCE018949124F78916E656FB080E52E"><enum>(e)</enum><header>Transfer of funds</header><paragraph id="HB91B1FA901A64682BF9E8B2055BA749D"><enum>(1)</enum><header>Transfers to federal old-age and survivors insurance trust fund</header><text>There are hereby appropriated to the Federal Old-Age and Survivors Trust Fund and the Federal Disability Insurance Trust Fund established under section 201 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref>) amounts equal to the reduction in revenues to the Treasury by reason of the application of subsection (a). Amounts appropriated by the preceding sentence shall be transferred from the general fund at such times and in such manner as to replicate to the extent possible the transfers which would have occurred to such Trust Fund had such amendments not been enacted. </text></paragraph><paragraph id="HADC09610068D465EA6DC6491A38FE703"><enum>(2)</enum><header>Transfers to social security equivalent benefit account</header><text>There are hereby appropriated to the Social Security Equivalent Benefit Account established under section 15A(a) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231n-1">45 U.S.C. 231n–1(a)</external-xref>) amounts equal to the reduction in revenues to the Treasury by reason of the application of subsection (a). Amounts appropriated by the preceding sentence shall be transferred from the general fund at such times and in such manner as to replicate to the extent possible the transfers which would have occurred to such Account had such amendments not been enacted. </text></paragraph><paragraph id="H5EAA5BA289AA46749E8FC5A5D5CEF47B"><enum>(3)</enum><header>Coordination with other Federal laws</header><text>For purposes of applying any provision of Federal law other than the provisions of the Internal Revenue Code of 1986, the rate of tax in effect under section 3101(a) of such Code shall be determined without regard to the reduction in such rate under this section.</text></paragraph></subsection></section><section id="HA36DC16D74454FC5AD2E43527A88005C"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall apply to taxable years beginning after December 31, 2019. </text></section></legis-body></bill>
