Deep Sea Coral Research and Technology Program.<enum>I</enum><header>Amendments to Coral Reef Conservation Act of 2000</header><section id="HF0255CA6D9F747FD967026D45A87CF30"><enum>101.</enum><header>Revisions to purposes of Coral Reef Conservation Act of 2000</header><text display-inline="no-display-inline">Section 202 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref>) is amended—</text><paragraph id="H20FEF9BFC1E04F2BA26613CC8E0BA0FF"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HEE9863687FBC48EA80AD939F71582BB0"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H6B392E3E0194463BB4E113592BE5053A"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H69F512881FE048E0A086489D50338A11" style="OLC"><paragraph id="HD715F07E4BFA4C3AAF9190712C9BCDC5" indent="down1"><enum>(7)</enum><text>to ensure healthy and resilient coral reefs for the benefit of island and coastal communities and the United States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H22B2EFD7188C45228E584FC50227860A"><enum>102.</enum><header>Revisions to national coral reef action strategy</header><subsection id="HB3596A1286614F9387482F03D49354ED"><enum>(a)</enum><header>In general</header><text>Section 203 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6402">16 U.S.C. 6402</external-xref>) is amended—</text><paragraph id="H708A7273A6274745B0BCF143DEF6867D"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H6E8697D0D3BD4D74939FF34FC55AC473"><enum>(A)</enum><text>by inserting <quote>Natural</quote> before <quote>Resources</quote>;</text></subparagraph><subparagraph id="H849B0A40AA8543C28692256A7A83E5F9"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, in consultation with the Secretary of the Interior,</quote> before <quote>shall periodically review and revise</quote>;</text></subparagraph><subparagraph id="HE0A98B1AF5E9433C90611FCD67009F66"><enum>(C)</enum><text>by striking <quote>this national strategy</quote> and inserting <quote>the national coral reef action strategy or any review or revision to such strategy</quote>;</text></subparagraph><subparagraph id="HDCAAD75880074E778234FE024BF6CA0F"><enum>(D)</enum><text>by striking <quote>may consult</quote> and inserting <quote>shall consult</quote>; and</text></subparagraph><subparagraph id="H57047CB97F194D6EB60987557CDC25E0"><enum>(E)</enum><text>by striking <quote>Executive Order 13089 (June 11, 1998)</quote> and inserting <quote>section 209</quote>; and</text></subparagraph></paragraph><paragraph id="HB4CC565907FC443AA6ADBA04002163D2"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H035BCD2D088346E3A60E5F4CFF33817D"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>goals and objectives as well as an implementation plan</quote> and inserting <quote>goals, objectives, and an implementation plan</quote>;</text></subparagraph><subparagraph id="HA485DCFCA9804000BA8FA70A2D65FC26"><enum>(B)</enum><text>in paragraph (7), by striking <quote>including regional fishery management councils; and</quote> at the end;</text></subparagraph><subparagraph id="H8D9BB40C78574073AD48566A71CDF046"><enum>(C)</enum><text>by amending paragraph (8) to read as follows:</text><quoted-block id="HE9EEFE6B4DD34E92AE20E105EA2D81A7" style="OLC"><paragraph id="H214FFBAE442B4FEB9A93AC906DCA99E1"><enum>(8)</enum><text>conservation, including how the use of marine protected areas to serve as replenishment zones will be developed consistent with local practices and traditions and in cooperation with, and with respect for the scientific, technical, and management expertise and responsibilities of, State fish and wildlife management agencies;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA34B2B3C6C294480ADD1590E1E18A154"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H2B0C384C42BD458CBAC558B1559C9340" style="OLC"><paragraph id="HE97517B7B7394CF091C545519F4D8CD9"><enum>(9)</enum><text>the condition of coral reefs located within maritime areas and zones subject to the jurisdiction or control of the United States;</text></paragraph><paragraph id="H6447A6FE13C341E6BEFA5DE81DB2AEA7"><enum>(10)</enum><text>emerging threats to coral health, including changes in ocean temperature and chemistry and threats identified under section 204(d)(3);</text></paragraph><paragraph id="H855361B0F102488394BEC4D3F3DF2C79"><enum>(11)</enum><text>adaptive management approaches with clearly identifiable, measurable, and science-based goals; and</text></paragraph><paragraph id="H45648B2022F1425BAD3D22CAF0C0A2D0"><enum>(12)</enum><text>restoration efforts, including improving coral reef resiliency.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HC8A0B6633A6C48EC8DD9B977DDECC219"><enum>(b)</enum><header>Deadline</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall review and revise the national coral reef action strategy developed under such section.</text></subsection></section><section id="H7E5AFC0A550149119AA47D1A3EAAD722"><enum>103.</enum><header>Revisions to Coral Reef Conservation Grant Program</header><text display-inline="no-display-inline">Section 204 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6403">16 U.S.C. 6403</external-xref>) is amended—</text><paragraph id="HF03593745739450B845F81EC242ED1A4"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text level="section" style="OLC">Grant</header-in-text></quote> before <quote><header-in-text level="section" style="OLC">Program</header-in-text></quote>;</text></paragraph><paragraph id="HAE6A729A7E1345FA94C61449AE66FC7D"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="H783BDF8F774440A093957377E57E11ED"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Geographic and biological diversity</header-in-text><header-in-text level="subsection" style="OLC"></header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Distribution of grants</header-in-text></quote>;</text></subparagraph><subparagraph id="HB029EB6B543241299FF722B25ABCDAAE"><enum>(B)</enum><text>in the language preceding paragraph (1), by striking <quote>subsection (b)</quote> and inserting <quote>subsection (a)</quote>; and</text></subparagraph><subparagraph id="H5776F86BFD8746438E30ECD2E7260336"><enum>(C)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block id="HCB4FCE5EF0CA429DB5905C611DA85E20" style="OLC"><paragraph id="HB7627E696D6D4B76AB328C6EC9D352ED" commented="no"><enum>(3)</enum><text>Remaining funds shall be awarded for projects that address—</text><subparagraph id="H6EEFE2743CD441F6B21285604B1BF5C1" commented="no"><enum>(A)</enum><text>bleaching;</text></subparagraph><subparagraph id="H466DD6361B674A1BAEEBC2FA4E3C7307" commented="no"><enum>(B)</enum><text>mortality events;</text></subparagraph><subparagraph id="H2D0562921FE84689960445711D1778CA" commented="no"><enum>(C)</enum><text>disease outbreaks;</text></subparagraph><subparagraph id="HD4E1823DE0B3449180D1015F0187059B" commented="no"><enum>(D)</enum><text>harmful algal blooms;</text></subparagraph><subparagraph id="H73F0302717004E15B51EE1B0632E90B7" commented="no"><enum>(E)</enum><text>invasive or nuisance species outbreaks;</text></subparagraph><subparagraph id="HEA28FAC02BA0411B8A47DF66C4800762" commented="no"><enum>(F)</enum><text>land-based sources of pollution;</text></subparagraph><subparagraph id="HBBD484D0019F4F9AB601CF75DDB46E0F" commented="no"><enum>(G)</enum><text>overfishing;</text></subparagraph><subparagraph id="H1B901E262E4B4A34939394DAA5ACCF5C" commented="no"><enum>(H)</enum><text>ocean acidification;</text></subparagraph><subparagraph id="HFDA2F5B194A0460ABF098E1E774072FE" commented="no"><enum>(I)</enum><text>coral reef restoration efforts;</text></subparagraph><subparagraph id="H5ADB3F34D7EA4551A3B04696517CDDA9" commented="no"><enum>(J)</enum><text>regional or international priorities or threats;</text></subparagraph><subparagraph id="H8CD9014570584AA3801A6069C69F13CB" commented="no"><enum>(K)</enum><text>physical impacts; </text></subparagraph><subparagraph id="HD5690395EFF3441D9A860A77C04C8EE8" commented="no"><enum>(L)</enum><text>thermal events; and</text></subparagraph><subparagraph id="HFD4D982E30F9462AAE900971A7897246" commented="no"><enum>(M)</enum><text display-inline="yes-display-inline">such other priorities or emerging threats as the Secretary, in consultation with the United States Coral Reef Task Force, may identify.</text></subparagraph></paragraph><paragraph id="H5DC285E98CD24BF3B6FEB2082C2F6A0D" commented="no"><enum>(4)</enum><text>To the extent practicable, the Secretary shall prioritize grants to a natural resource management authority of a State that is represented on the United States Coral Reef Task Force.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H268322DE323B4842818A2D13EAB59964"><enum>(3)</enum><text>in subsection (f), by adding at the end the following:</text><quoted-block id="HBE26B07D6E4A4269B6143FD22CAFC9AC" style="OLC"><paragraph id="H1E508248BE664C5E99D1A989466D660C"><enum>(3)</enum><header>Applicants seeking emergency consideration</header><subparagraph id="H9E27D25659704D6C93FBB4E87C013CBD"><enum>(A)</enum><header>Request</header><text>An applicant for assistance under this section may request emergency consideration of such applicant’s proposal under this subsection.</text></subparagraph><subparagraph id="H3F1E09E6AAC24ACABB538200117DD70D"><enum>(B)</enum><header>Consideration</header><text display-inline="yes-display-inline">The Secretary shall, not later than 15 days after the date of receipt of a request under subparagraph (A), conduct a preliminary review of the proposed project. The Secretary may issue not more than 50 percent of the total amount of assistance for which the Secretary estimates the project will qualify. </text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H732ACA38E32549CEA6F4C0E4843962FF"><enum>(4)</enum><text>in subsection (g)—</text><subparagraph id="HB832C195C9F3437B8D9A19FC78FFB8B9"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and resilient coral reef ecosystems</quote> after <quote>coral reefs</quote>;</text></subparagraph><subparagraph id="HE1F782BA85C74334B0882F626BEBE196"><enum>(B)</enum><text>by amending paragraph (4) to read as follows:</text><quoted-block id="HF2F6403235A54A40B0AA0A9BF0B45F1F" style="OLC"><paragraph id="HEF76886289E7485CB00BE315FB9C0780"><enum>(4)</enum><text>developing sound scientific information on the condition of coral reef ecosystems, threats to such ecosystems or the biodiversity of such ecosystems, the impacts of such threats, and potential interventions to address such threats;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H01B8E125868A43C3BEB0A1524A0B3032"><enum>(C)</enum><text>in paragraph (5), by striking <quote>to implement</quote> and inserting <quote>the implementation of</quote>;</text></subparagraph><subparagraph id="H92C050BF92B148F9B31F5E0912A6BA41"><enum>(D)</enum><text>in paragraph (6), by inserting <quote>, including how coral reefs function to protect island and coastal communities</quote> after <quote>conservation</quote>;</text></subparagraph><subparagraph id="H5E60368775B24D3C9920F267BD4E2F83"><enum>(E)</enum><text>by amending paragraph (7) to read as follows:</text><quoted-block id="H1A15A99CE8854CF6A975CA338E24AB4D" style="OLC"><paragraph id="HEAF7EA3C0FF646DAB655891F37955A4C"><enum>(7)</enum><text>mapping the location, distribution, and biodiversity, including taxonomic classification and related research, of coral reefs and coral reef ecosystems;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H33C009C94B404EF383388EEF6A3CCEDB"><enum>(F)</enum><text>in paragraph (8), by inserting <quote>and coral reef ecosystems</quote> after <quote>reefs</quote>;</text></subparagraph><subparagraph id="HF7C0CB01F6E84F5898F85681181243A0"><enum>(G)</enum><text>in paragraph (9), by striking <quote>or</quote>;</text></subparagraph><subparagraph id="HE7C95E222EEF4424BB2B497B90B4C83E"><enum>(H)</enum><text>by amending paragraph (10) to read as follows:</text><quoted-block id="HD2C18300C14E413E8294B9CB27805287" style="OLC"><paragraph id="HE7C56A8FA2BB45BBB7E69DA9B4982251"><enum>(10)</enum><text>preventing or minimizing the likelihood of vessel impacts on coral reefs, particularly those areas and any at-risk reefs identified under section 207(d), including by promoting ecologically sound navigation and anchorages near coral reefs;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H2B15CC99F0A24C08B0671DEDF925AF4F"><enum>(I)</enum><text>by adding at the end the following:</text><quoted-block id="H61CDB0396A0E44F18AFCB2E911DD48F6" style="OLC"><paragraph id="H54463287C90443199486F00C2DAC12DF"><enum>(11)</enum><text>responding to, or taking action to mitigate the effects of, coral bleaching, disease, harmful algal blooms, ocean acidification, or other changes in ocean temperature and chemistry;</text></paragraph><paragraph id="H1532663D800641FEBFDBE4AA3E709113"><enum>(12)</enum><text>developing and implementing innovative ecological interventions to build or maintain coral reef resistance and resilience to stressors;</text></paragraph><paragraph id="HEC7B56687C3A4C7D8B11864F0F3112FB"><enum>(13)</enum><text>developing and implementing innovative invasive or nuisance species capture, collection, removal, or trapping methods for use around coral reefs;</text></paragraph><paragraph id="H6C15624BECB249008E1D5F01664DB763"><enum>(14)</enum><text>developing and implementing cost-effective methods to restore degraded native coral reef ecosystems with an emphasis on techniques to advance coral recovery, growth, or resiliency;</text></paragraph><paragraph id="H56968A4B97A5413A89C140AF0A923565"><enum>(15)</enum><text>research on coral diseases, including the prevention and treatment of such diseases;</text></paragraph><paragraph id="H20C04CE47E4D45E0918FFAE0C2033929"><enum>(16)</enum><text>understanding and cataloging coral genetic diversity, including research into traits that promote resilience and applying such research to coral reef restoration efforts;</text></paragraph><paragraph id="HF910D3FA2DD84F40BFD948720C5D1A50"><enum>(17)</enum><text>developing in situ native coral propagation sites for use in coral reef restoration projects;</text></paragraph><paragraph id="H2250F02843F14D72956F9261B510425A"><enum>(18)</enum><text>developing networks of ex situ coral propagation nurseries for conservation, including holding coral in aquarium systems and genetic banking, captive breeding of rare species, and captive breeding of resilient coral populations for use in coral reef restoration projects;</text></paragraph><paragraph id="HFA712E07D8C84CA38D063776F6855C65"><enum>(19)</enum><text>developing networks of improved, real-time water quality monitoring along coral reefs, especially reefs impacted by land-based sources of pollution including coastal runoff, sediment erosion and turbidity, and harmful algal blooms;</text></paragraph><paragraph id="H7D1070F670DE447985EE751AA057A155"><enum>(20)</enum><text display-inline="yes-display-inline">implementing research and restoration projects that help ensure the population viability of coral species listed pursuant to the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) in United States waters as detailed in the population-based recovery criteria included in species-specific recovery plans developed under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); or</text></paragraph><paragraph id="H66A65AC8AB2448DBB33B524ECB97FEFF"><enum>(21)</enum><text>supporting community-based planning and management initiatives for the protection of coral reef ecosystems identified by the States, scientific experts, or the United States Coral Reef Task Force as a high priority that—</text><subparagraph id="HBF0F8FA9D0184EB198515A8C9ED0CDD8"><enum>(A)</enum><text>support attainment of criteria described in paragraphs (1) through (20);</text></subparagraph><subparagraph id="HFD22C4E8E04A4C839C2674C05A826ECF"><enum>(B)</enum><text>use, where applicable, watershed-based or ecosystem-based approaches;</text></subparagraph><subparagraph id="H69513E22F2C44FEFA02868CB1B74A6D4"><enum>(C)</enum><text>provide for coordination with Federal and State experts and managers;</text></subparagraph><subparagraph id="H2FD25C6B1D3C49A3BAD992AA441CF72F"><enum>(D)</enum><text>build upon local approaches or models, including traditional resource management concepts; and</text></subparagraph><subparagraph id="H3EE495AABCD1416DBEAAD97856452971"><enum>(E)</enum><text>complement local action strategies or regional plans for coral reef conservation efforts, as applicable.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H927F61F44DD74511A6FB56AC963A4999"><enum>(5)</enum><text>in subsection (j), by striking <quote>this Act</quote> and inserting <quote><short-title>Coral Reef Conservation Reauthorization Act of 2020</short-title></quote>.</text></paragraph></section><section id="H0F534427968343CF82ACB0BD6D03D8AA"><enum>104.</enum><header>Coral reef public-private partnership</header><text display-inline="no-display-inline">Section 205 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6404">16 U.S.C. 6404</external-xref>) is amended—</text><paragraph id="H14B9DAC7D48348868DF7257E903FD4DD"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="OLC">Coral Reef Conservation Fund</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Coral Reef Public-Private Partnership</header-in-text></quote>;</text></paragraph><paragraph id="HA5C5A54604F341768E9F25052C65930D"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="H1178B568957E4B8AACCC223E25A0E3A6"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Fund</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Public-Private partnership</header-in-text></quote>;</text></subparagraph><subparagraph id="H17EADB43B7FA47AF90FE566652FE8EF7"><enum>(B)</enum><text>by striking <quote>, hereafter referred to as the Fund,</quote>; and</text></subparagraph><subparagraph id="H60D387599A9F4786979643E2ACE5DD0C"><enum>(C)</enum><text>by striking <quote>organization solely</quote> and all that follows and inserting </text><quoted-block id="HC14FF4E99FC94DC9BA38035924D44D67" style="OLC" display-inline="yes-display-inline"><text>organization—</text><subparagraph id="H97D1C75FA1494394943EC7B79CB48C00"><enum>(A)</enum><text>to support public-private partnerships that further the purposes of this title and are consistent with the national coral reef action strategy under section 203;</text></subparagraph><subparagraph id="HDE41F9266B0B49EC98E3539BFFC0DCE1"><enum>(B)</enum><text>to address emergency response actions undertaken or authorized under section 206; and</text></subparagraph><subparagraph id="H061B73E4C5484C5AB79EF19C5C03D564"><enum>(C)</enum><text>to support activities that prevent damage to coral reefs, including any at-risk reefs identified under section 207(d).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3CF61B9B1E964C14B3DE34F59A6618AF"><enum>(3)</enum><text>in subsection (b);</text><subparagraph id="HFDD4E698CBBD4BEF8587241CCBCA19D9"><enum>(A)</enum><text>by striking <quote>Fund</quote> and inserting <quote>separate interest bearing account</quote>; and</text></subparagraph><subparagraph id="H33529B455256403AB8F4E90AA1C33216"><enum>(B)</enum><text>by adding at the end the following: <quote>The organization is encouraged to solicit donations, funding, and in-kind services from the private sector, including nongovernmental organizations, for emergency response actions under section 206 and for activities to prevent damage to coral reefs, including any at-risk reefs identified under section 207(d).</quote>.</text></subparagraph></paragraph></section><section id="HD8E2C2D5D8EB4C1797C87561A110BC56"><enum>105.</enum><header>Revisions to emergency assistance</header><text display-inline="no-display-inline">Section 206 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6405">16 U.S.C. 6405</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HEDC73D839CA04686B294AEEB069DEC1B" display-inline="no-display-inline"><section id="H6D2D7B82260F43FCA916D92BD0C7A9BB"><enum>206.</enum><header>Coral event of national significance</header><subsection id="H19DF99F21151426E9EBA5C1856AF0607"><enum>(a)</enum><header>Relief</header><paragraph id="HE28582D3A4E549478E090AA890DF25A3"><enum>(1)</enum><header>In general</header><text>Upon a determination under subsection (b) that there is an event of national significance, the appropriate Federal official is authorized to provide support, including emergency grants and contracts, equipment, and technical assistance, to any State, or local government agency with jurisdiction over a coral reef, or any entity contracted to act on behalf of a State or local government agency, for the purposes of—</text><subparagraph id="H8E19D0CA77B24C3FBF24F20AE848403C"><enum>(A)</enum><text>assessing and mitigating the detrimental environmental, economic, subsistence use, and public health effects of the event;</text></subparagraph><subparagraph id="HFB315398B80A4B559EB2B4BB7C2078A1"><enum>(B)</enum><text display-inline="yes-display-inline">respond rapidly to assess, stabilize, repair, recover, or restore a coral reef that is damaged, or that has lost the ability to function as an independent ecosystem;</text></subparagraph><subparagraph id="HB2F89DB18B384ECE9484088EE60EB32A"><enum>(C)</enum><text>remove or stabilize a vessel grounded on or in the vicinity of a coral reef; and</text></subparagraph><subparagraph id="HC0A0450193C14E00B345292B0E160213"><enum>(D)</enum><text>otherwise provide for rapid response to, assessment of, or monitoring of an event of national significance pertaining to a coral reef or coral reef ecosystem.</text></subparagraph></paragraph><paragraph id="H20A4715DEC084701B88E15D117974541"><enum>(2)</enum><header>Matching requirement</header><subparagraph id="H75B2B65AFBBB454D96FD1077931B73A9"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (C), the Federal share of the costs of an activity conducted under this section shall not exceed 75 percent of the costs for such activity.</text></subparagraph><subparagraph id="H3D79EB0B53AE4C39B7EBC59EBC6049DC"><enum>(B)</enum><header>In-kind contributions</header><text>In making a calculation of the non-Federal share of the costs of an activity under subparagraph (A), the Secretary shall include in such calculation the fair market value of property and services used for the activity.</text></subparagraph><subparagraph id="HCB30858688C74E63BFBBCFA0FF903BB5"><enum>(C)</enum><header>Waiver of requirements</header><text>The Secretary may waive the application of subparagraph (A) if the Secretary finds that such waiver is necessary to support a project that the Secretary has identified as high priority.</text></subparagraph></paragraph><paragraph id="HC5157B06AF864D959B4F1E63DBB037DB"><enum>(3)</enum><header>Written agreements</header><text>The Secretary may enter into written agreements with any State in which a coral reef is located regarding the manner in which the activities authorized under this section shall be conducted within the affected State’s waters. </text></paragraph><paragraph id="H1A1BB1C3F8484B82A0057ED3284984E3"><enum>(4)</enum><header>Cooperative enforcement agreements</header><text display-inline="yes-display-inline">All cooperative enforcement agreements in place between the Secretary and a State affected by this title shall be updated to include enforcement of this title where appropriate. </text></paragraph><paragraph id="HA0CCDAC8857F408AB7F39E7639CB1EAE"><enum>(5)</enum><header>Damage and cost assessment</header><text>In carrying out this section, the Secretary shall assess damages to coral reefs and applicable response and restoration costs in consultation with State officials regarding response and damage assessment actions undertaken for coral reefs within State waters. The Secretary shall make such assessments, including any related data and information, readily available to the public on a public website upon completion of such assessments.</text></paragraph><paragraph id="H984466EAF80D4962B06B37C90550EAA9"><enum>(6)</enum><header>Determinations</header><subparagraph id="H5CAF24CE16EA4B6F979FA7D7DFCFB79A"><enum>(A)</enum><header>In general</header><text>At the discretion of the Secretary, or at the request of the Governor of an affected State, an appropriate Federal official shall determine whether a coral event is an event of national significance.</text></subparagraph><subparagraph id="H62DA4C112FB943069757922D3E8BFBEE"><enum>(B)</enum><header>Considerations</header><text>In making a determination under paragraph (1), the appropriate Federal official shall consider the severity of the event or disease outbreak or bleaching, its potential to spread, the economic impact, and the geographic scope, including the potential to affect several municipalities, to affect more than one State, or to cross an international boundary.</text></subparagraph></paragraph></subsection><subsection id="H0C0EF8E7696E40688EA9FD0017B5CC51"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HF5EEDAB0AE7B4EDC8136527F75A36898"><enum>(1)</enum><header>Event of national significance</header><text>The term <term>event of national significance</term> means—</text><subparagraph id="H73E3C12899784C0B8D2770866E65C803"><enum>(A)</enum><text>a coral disease outbreak or coral bleaching event that has had or will likely have a significant detrimental environmental, economic, subsistence use, or public health impact on an affected State;</text></subparagraph><subparagraph id="HD84656B1483C4CFE8695E8ED0542E1E7"><enum>(B)</enum><text>a vessel collision that severely negatively impacts a coral reef ecosystem;</text></subparagraph><subparagraph id="HB6CE72394F184F54A00AEE190C7C2A4A"><enum>(C)</enum><text>an unforeseen or disaster-related circumstance that negatively impacts a coral reef ecosystem, including as a result of human activities;</text></subparagraph><subparagraph id="HB1E19A61B4FD468892C16301F82A6B0E"><enum>(D)</enum><text>a harmful algal bloom or invasive or nuisance species outbreak that negatively impacts a coral reef ecosystem; or</text></subparagraph><subparagraph id="HCABCD176C5B74B2B88F823812442F5D5"><enum>(E)</enum><text>the presence of an unexploded ordnance or similar underwater munitions that harms a coral reef ecosystem. </text></subparagraph></paragraph><paragraph id="H79458AAB01EB48B886CCE024C69AB44B"><enum>(2)</enum><header>Coral disease outbreak or coral bleaching event</header><text>The term <term>coral disease outbreak or coral bleaching event</term> means the occurrence of a coral disease outbreak or coral bleaching as a result of a natural, anthropogenic, or undetermined cause.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC536A29FF7A4455F931EBAC53B8E5F54"><enum>106.</enum><header>Revisions to national program</header><text display-inline="no-display-inline">Section 207 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6406">16 U.S.C. 6406</external-xref>) is amended—</text><paragraph id="H6C4012E26EB14D228868170581E86D52"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H4AF5EA3EF5C340D1A3166C5E2279AB3F"><enum>(A)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block id="HACB409049198486884CA81E71BB42F70" style="OLC"><paragraph id="H6CAD198FA0C04173A340F459333D2F94"><enum>(2)</enum><text>enhancing public awareness, education, understanding, and appreciation of coral reefs and coral reef ecosystems, including the benefits healthy and resilient coral reefs provide to island and coastal communities and to the United States;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H8BD630A612714A489766DD91009FF11F"><enum>(B)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block id="HD4EFE3CB60BB4FC8A7129A2FE44CB9F6" style="OLC"><paragraph id="H832615B14766474F9A3225AECA500A52"><enum>(3)</enum><text>removing or otherwise addressing, and providing assistance to States in removing or otherwise addressing, derelict fishing gear, marine debris, and abandoned vessels from coral reef ecosystems to conserve living marine resources;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HDAD18B3377174592850A43D6D7D626D2"><enum>(C)</enum><text>by amending paragraph (4) to read as follows:</text><quoted-block id="H0890E4A5A89B4515B63A931463F106C3" style="OLC"><paragraph id="H912325C7D6804842B04F474430A039B3"><enum>(4)</enum><text>cooperative conservation, research, restoration, and management of coral reefs and coral reef ecosystems with local, regional, or international programs and partners, including research institutions located in a State;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HD7C63D50AB334463A52B325C93288305"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H3176E915574B4B979B96E02FD796DC15" style="OLC"><paragraph id="H456A06027D1F4282ABB02DD0FD12CA3F"><enum>(5)</enum><text>improving and promoting the resilience of corals, coral reefs, and coral reef ecosystems;</text></paragraph><paragraph id="H10F8CA697C1A4524936AA583545211CC"><enum>(6)</enum><text>activities designed to prevent or minimize the likelihood of vessel impacts or other physical damage to coral reefs, including any at-risk reefs identified under section 207(d); and</text></paragraph><paragraph id="H39A1DB689B1246DB94867582D0494E76"><enum>(7)</enum><text>centrally archiving, managing, and distributing data sets and coral reef ecosystem assessments and making such information readily available on public websites, including, at the discretion of the Administrator, on the public websites of local, regional, or international programs and partners.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAC2F46379E0F4B63BA8191AC0767E783"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HD206C542F4D74F278C0F1A3B2DB9CEAF" style="OLC"><subsection id="H63E80CE7D79F42A3ADA448A1138FBA0C"><enum>(c)</enum><header>Vessel grounding inventory</header><text>The Secretary, in coordination with other Federal agencies, shall establish and maintain an inventory of all vessel grounding incidents involving coral reefs, including a description of—</text><paragraph id="HEFBDEB8951814175954290D2951733C2"><enum>(1)</enum><text>the impacts to such coral reefs and related natural resources;</text></paragraph><paragraph id="H84A240DE867D4AEF9CEC8F75C3D067B1"><enum>(2)</enum><text>vessel and ownership information;</text></paragraph><paragraph id="H920BE33C438A4DA49130361DC94B045B"><enum>(3)</enum><text>an estimate of the costs for—</text><subparagraph id="H70BB89463A70443B8CA0079C585E56A1"><enum>(A)</enum><text>removal of the vessel; or</text></subparagraph><subparagraph id="H7B7B68B7A95A40FC9617C9B861D6BC1C"><enum>(B)</enum><text>restoration of the impacted reef;</text></subparagraph></paragraph><paragraph id="H79D4F2D0D64C42FC8E9DE9B181255972"><enum>(4)</enum><text>to the extent practicable, the actual costs, including costs estimated under section 206(e), that were incurred by each party that participated in any—</text><subparagraph id="H35F988BA73B54FBCAACC6006E153C363"><enum>(A)</enum><text>removal of the vessel; or</text></subparagraph><subparagraph id="HB85605EE9F444376A8C419D8065A4B28"><enum>(B)</enum><text>restoration of the impacted reef;</text></subparagraph></paragraph><paragraph id="HE9F580DF43C34B878C7BE2CA25089222"><enum>(5)</enum><text>the response action taken by the vessel owner, the Secretary, the Commandant of the Coast Guard, or other Federal or State agencies;</text></paragraph><paragraph id="HB7484DAABF7D4AAFB0B738CF338D56C5"><enum>(6)</enum><text>the status of the response action, including the dates of vessel removal and coral reef restoration, and any actions taken to prevent future grounding incidents; and</text></paragraph><paragraph id="H00BCAF5570B547C2817BFB5C0356E30C"><enum>(7)</enum><text>any other pertinent information the Secretary determines appropriate.</text></paragraph></subsection><subsection id="HFEB4128FF43E43388B1502264A2BB1AE"><enum>(d)</enum><header>At-Risk reefs</header><paragraph id="H85C5978A55AB4E30A15C26DA5EA8F9F3"><enum>(1)</enum><header>Inventory</header><text display-inline="yes-display-inline">The Secretary shall establish and maintain a nationwide inventory of at-risk reefs, including proposed remediation to address threats or damage to at-risk reefs identified under this subsection.</text></paragraph><paragraph id="H04D56957435D47C3BCC5F186FE79CFDB"><enum>(2)</enum><header>Identification</header><text display-inline="yes-display-inline">The Secretary shall use data and information collected or compiled under this title or any other available information source to identify at-risk reefs to be included in the inventory under paragraph (1).</text></paragraph><paragraph id="H840AE72E0D434CE891631FB2E80B4E33"><enum>(3)</enum><header>Remediation</header><text display-inline="yes-display-inline">The Secretary shall identify appropriate measures, including measures taken by other agencies, to remediate at-risk reefs, including—</text><subparagraph id="HA9D6A867140D4B31AAF5259E83738D4D"><enum>(A)</enum><text>recommendations to prevent, reduce the likelihood, or otherwise address negative impacts and incidents;</text></subparagraph><subparagraph id="HF564D328E989467B8338C885A8DB93E8"><enum>(B)</enum><text>cooperative actions with other Federal, State, and local agencies and nongovernmental partners; and</text></subparagraph><subparagraph id="H26A67883CD78416CABA3DCCA7DD5364D"><enum>(C)</enum><text>a strategy and timetable to implement such measures and recommendations.</text></subparagraph></paragraph><paragraph id="H7F5BDAE16F3F49168B8E3CD2A4C28D9D"><enum>(4)</enum><header>Measures taken</header><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall track any measures taken to remediate at-risk reefs identified under paragraph (2), including any measures identified and taken under paragraph (3).</text></paragraph><paragraph id="HFB6859CF0B9249E6867C1F8551A51592"><enum>(5)</enum><header>Publication</header><text>The Secretary shall make any inventory established and maintained under this subsection, a description of the remediation measures identified under paragraph (3), and a description of any actions tracked under paragraph (4), readily available to the public on a government website.</text></paragraph></subsection><subsection id="HD4CAF30D90DF47C2B150D908BD8C16CC"><enum>(e)</enum><header>Data stewardship and accessibility</header><paragraph id="H9768EEE4FA11440DAC4B1DAA6135AEE4"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with similar efforts at other Departments and agencies, shall provide for the long-term stewardship and public accessibility of all environmental data and information collected under this title.</text></paragraph><paragraph id="H10FC236B2928447F8782122B1A4D05E5"><enum>(2)</enum><header>Activities</header><text>The Secretary shall—</text><subparagraph id="H869EC764F7A8466BB1922BEBB31BDB32"><enum>(A)</enum><text>archive environmental data, research, and similar information collected under this title with the use of Federal funds;</text></subparagraph><subparagraph id="H33E5D6F3A2974E9C9F35D6EA52B081DD"><enum>(B)</enum><text>to the greatest extent practicable, make such environmental data and information readily available to the public on a government website;</text></subparagraph><subparagraph id="HF2B4088AA4BC416A9B76A420290B9120"><enum>(C)</enum><text>develop standards, protocols, and procedures for sharing Federal data with non-Federal partner agencies and the private sector or academia; and</text></subparagraph><subparagraph id="HD3C32A445D6840CA8EEEAC5BE1EEEBEB"><enum>(D)</enum><text>develop metadata standards for coral reef ecosystems in accordance with Federal Geographic Data Committee guidelines.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H38034EF342B74F749A983DACB26F56A8"><enum>107.</enum><header>Revisions to effectiveness reports</header><text display-inline="no-display-inline">Section 208 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6407">16 U.S.C. 6407</external-xref>) is amended to read as follows:</text><quoted-block id="H94048EBB7D78434CB7CE4F055A05886F" style="OLC"><section id="H8A966C29F30B4AFF936F44CFA2F03CE8"><enum>208.</enum><header>Effectiveness reports</header><text display-inline="no-display-inline">Not less than once every 5 years, the Secretary, in cooperation with the United States Coral Reef Task Force, shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report, with respect to the 5 fiscal years preceding the year in which the report is submitted, that—</text><paragraph id="HE4E7135E4F60453889A31A8232FAB3DD"><enum>(1)</enum><text>describes the funds obligated by each Federal agency to implement the national coral reef action strategy;</text></paragraph><paragraph id="H31CFD5C167EE41E1A754AD6528611FFE"><enum>(2)</enum><text>summarizes all actions taken by Federal and non-Federal entities under the national coral reef action strategy;</text></paragraph><paragraph id="H44EEBB76A0044849B0951E0A87E99A12"><enum>(3)</enum><text>provides a State-by-State summary of Federal and non-Federal contributions toward the costs of each project for which a grant was awarded under the coral reef conservation grant program under section 204;</text></paragraph><paragraph id="H1D43B355F71B4FEE9801B6C69A9F91CC"><enum>(4)</enum><text>provides an accounting of Federal funds transferred to a nonprofit organization and non-Federal matching funds provided by such nonprofit organization under the coral reef public-private partnership under section 205;</text></paragraph><paragraph id="HEF4328F6C6B44587B06489AC0CB5CA71"><enum>(5)</enum><text>summarizes emergency response actions undertaken or authorized under section 206;</text></paragraph><paragraph id="HE8D135B888174D99B233D3D812CFDC85"><enum>(6)</enum><text>summarizes the information contained in any vessel grounding inventory under section 207(c) and any additional authorization or funding needed for response and removal of vessels listed in such inventory;</text></paragraph><paragraph id="HE0FA6F7DE860412CB4D94EB33886A8AB"><enum>(7)</enum><text>provides a summary of any at-risk reefs identified under section 207(d) and any remediation actions recommended, underway, or taken under such section;</text></paragraph><paragraph id="H0DB2FF9EEF934C368F24E1DFBC82F619"><enum>(8)</enum><text>assesses the conditions of coral reefs in the United States, accomplishments under this title, and the effectiveness of management actions to address threats to coral reefs and coral reef ecosystems; and</text></paragraph><paragraph id="HCD41A9D19C0E47E79EE237A60E50D12F"><enum>(9)</enum><text>any other pertinent information the Secretary determines appropriate.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HED0D310B033542B4941150654E0ECCBF"><enum>108.</enum><header>Revisions to authorization of appropriations</header><text display-inline="no-display-inline">Section 209 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6408">16 U.S.C. 6408</external-xref>) is amended—</text><paragraph id="HB6DC6D6AE0CD4F51AEB31E50C431173D"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block id="HEB51F967C5CC40E4853C97B685032381" style="OLC"><subsection id="HB36C5A3C549E40F0ACEAAA349C6276E5"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary of Commerce to carry out this title the following amounts, which shall remain available until expended:</text><paragraph id="HCB1D562A7AA3413392AB437A8227B632"><enum>(1)</enum><text>$38,000,000 for fiscal year 2021.</text></paragraph><paragraph id="H3BBD6653952C446590BB840FBE47D448"><enum>(2)</enum><text>$40,000,000 for fiscal year 2022.</text></paragraph><paragraph id="HB2776F5669424728866A23510F154158"><enum>(3)</enum><text>$42,000,000 for fiscal year 2023.</text></paragraph><paragraph id="H4612BAC1A8D64B7CB8863929EDF182E3"><enum>(4)</enum><text>$44,000,000 for fiscal year 2024.</text></paragraph><paragraph id="H7A31EAEDB428453EA2B048BF96BD9106"><enum>(5)</enum><text>$45,000,000 for fiscal year 2025.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H916EEA3EFBEA4ECDB1CF6C1E4C83CA30"><enum>(2)</enum><text>in subsection (b), by striking <quote>$1,000,000</quote> and inserting <quote>$2,000,000</quote>;</text></paragraph><paragraph id="H42609C562CB945749AF07CC6965E34F9"><enum>(3)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block id="H1C698484E7CE426185183645E39B2210" style="OLC"><subsection id="H08D8691FD891489092E6AD86D4072566"><enum>(c)</enum><header>Coral reef conservation grant program</header><text>From the amounts appropriated under subsection (a) for a fiscal year, there shall be made available to the Secretary of Commerce not less than $14,000,000 for the coral reef conservation grant program under section 204.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H91E64B9FF3B74F97B014BDCD48CA0846"><enum>(4)</enum><text>by amending subsection (d) to read as follows:</text><quoted-block id="H0A26AEC2DDCE4B868C270E75C44799D4" style="OLC"><subsection id="H72F4A88BEFE44661BC77431DE5850A2F"><enum>(d)</enum><header>National program</header><text>From the amounts appropriated under subsection (a) for a fiscal year, there shall be made available to the Secretary of Commerce not less than $16,000,000 for activities conducted under section 207.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H96C892BCB8D24DFBAC8A7873FD555AA0"><enum>109.</enum><header>Revisions to definitions</header><text display-inline="no-display-inline">Section 210 of the of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6409">16 U.S.C. 6409</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H3C06286640264558A842FDA9AB97F6FA" display-inline="no-display-inline"><section id="H1D049F7FE91A4EDDB14ED6C68A65FA50"><enum>210</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HCE580984CC9A42E78B5B6F577BABCC33"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the National Oceanic and Atmospheric Administration, unless otherwise specified.</text></paragraph><paragraph id="HDB6BD41A4F2543BD95E7C4918AA31E74"><enum>(2)</enum><header>At-risk reef</header><text>The term <term>at-risk reef</term> means a coral reef that has a high exposure to vessel impacts, marine debris, harmful algal blooms, overfishing, land-based or marine-based pollution, coastal development, and changes in ocean temperature and chemistry.</text></paragraph><paragraph id="HCAC83ACBF113458DB094770DA5AC8570"><enum>(3)</enum><header>Bona fide research</header><text>The term <term>bona fide research</term> means scientific research on corals or coral reefs, the results of which are likely—</text><subparagraph id="H4C1AAA9A326049628B31675D5707ADE1"><enum>(A)</enum><text>to be eligible for publication in a peer-reviewed scientific journal;</text></subparagraph><subparagraph id="H0DDF6A9DD4EB4BE895CF03530CC5578C"><enum>(B)</enum><text>to contribute to the basic knowledge of coral biology or coral reef ecology;</text></subparagraph><subparagraph id="H92FB60209A664BABA27EC886907D8CAB"><enum>(C)</enum><text>to improve management of coral reefs and coral reef ecosystems; or</text></subparagraph><subparagraph id="HEF29485CF06A4479BD1A4A9F44A8F16F"><enum>(D)</enum><text>to identify, evaluate, or resolve conservation issues or decisions.</text></subparagraph></paragraph><paragraph id="H8C599EE0CE2E41BBA83D46E3F9664A92"><enum>(4)</enum><header>Conservation</header><text>The term <term>conservation</term> means the use of any methods and procedures necessary to preserve, restore, or sustain corals, coral reefs, and associated marine species as resilient, diverse, viable, and self-perpetuating coral reef ecosystems, including—</text><subparagraph id="HDED4C22A28104A95BB84ABBD2915C1BB"><enum>(A)</enum><text>all activities associated with resource management, such as assessment, research, protection, restoration, sustainable use, and management of habitat;</text></subparagraph><subparagraph id="HA8783E48541C406CB3FA7CF4EC1D64DE"><enum>(B)</enum><text>mapping, observation, or monitoring of coral reef ecosystems;</text></subparagraph><subparagraph id="H8B9099818DCF4E9EB8514DC839494B58"><enum>(C)</enum><text>scientific expertise and technical assistance in the development and implementation of management strategies for marine protected areas and marine resources consistent with the National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431</external-xref> et seq.) and the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801</external-xref> et seq.), and with respect for the scientific, technical, and management expertise and responsibilities of State fish and wildlife management agencies;</text></subparagraph><subparagraph id="HE3F61B04ABD44E6CA72B575183C98DD7"><enum>(D)</enum><text>law enforcement;</text></subparagraph><subparagraph id="HD3E13C149A7648D7A8C2F6ACD5123590"><enum>(E)</enum><text>conflict resolution initiatives;</text></subparagraph><subparagraph id="HDC885DADEEEC461D8B5CC587F9144D16"><enum>(F)</enum><text>community outreach and education; and</text></subparagraph><subparagraph id="HB90264A13A08474AA8A2810EB5E6361D"><enum>(G)</enum><text>activities that promote safe and ecologically sound navigation.</text></subparagraph></paragraph><paragraph id="H965579BF5E3443078124F62A9045551C"><enum>(5)</enum><header>Coral</header><text>The term <term>coral</term> means species of the phylum Cnidaria, including—</text><subparagraph id="H28106871A47E422093817035BF2AA643"><enum>(A)</enum><text display-inline="yes-display-inline">all species of the orders Antipatharia (black corals), Scleractinia (stony corals), Gorgonacea (horny corals), Stolonifera (organpipe corals and others), Alcyanacea (soft corals), and Coenothecalia (blue coral), of the class Anthozoa; and</text></subparagraph><subparagraph id="HCB937FCCCC6845A9B1FADD11857704FD"><enum>(B)</enum><text>all species of the families Milleporidae (fire corals) and Stylasteridae (stylasterid hydrocorals), of the class Hydrozoa.</text></subparagraph></paragraph><paragraph id="H5C4E13A8717F410E81805E6FE2FA8B15"><enum>(6)</enum><header>Coral reef</header><text>The term <term>coral reef</term> means limestone structures in the form of a reef or shoal, comprised in whole or in part by living coral, skeletal remains of coral, and other associated sessile invertebrates and marine plants.</text></paragraph><paragraph id="H01F179752B0C43A7B44E6DCDBB9AE8C4"><enum>(7)</enum><header>Coral reef component</header><text>The term <term>coral reef component</term> means any part of a coral reef, including individual living coral, skeletal remains of coral, and other associated sessile invertebrates or marine plants.</text></paragraph><paragraph id="H93081AC955B44D53BF8364400FAA28E4"><enum>(8)</enum><header>Coral reef ecosystem</header><text>The term <term>coral reef ecosystem</term> means the system of coral and other geographically and ecologically associated marine species, habitats, and environment and the processes that control its dynamics.</text></paragraph><paragraph id="HECDD748691004E00BEA74F993ECC414A"><enum>(9)</enum><header>Coral products</header><text display-inline="yes-display-inline">The term <term>coral products</term> means any living or dead specimens, parts, or derivatives, or any product containing specimens, parts, or derivatives, of any species referred to in paragraph (5).</text></paragraph><paragraph id="H7D2B498C61E94F569B0AEDAF8D146FC6"><enum>(10)</enum><header>Damages</header><text>The term <term>damages</term> includes—</text><subparagraph id="H54404EE2D1914B2CAD2B7EF8E5A86560"><enum>(A)</enum><text>compensation for—</text><clause id="H07470B8617664D30B7D638A6B0B30DE6"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H4B55460647B44989ABB676F42A70331A"><enum>(I)</enum><text>the cost of replacement, restoration, remediation, or acquisition of the equivalent of a coral or coral reef resource; and</text></subclause><subclause id="H0DB25547975E498CA3EA38E358F6D8F7" indent="up1"><enum>(II)</enum><text>the value of the lost use or services of a coral or coral reef resource pending the replacement, restoration, remediation, or acquisition of the equivalent coral or coral reef resource; or</text></subclause></clause><clause id="HC890BD14452D42F190ED5616DACC4153"><enum>(ii)</enum><text>the value of a coral or coral reef resource if the coral or coral reef resource cannot be replaced, restored, or remediated or if the equivalent of such resource cannot be acquired; and</text></clause></subparagraph><subparagraph id="H0BB09A6E4A6E48EC8864E7BA5735B0D6"><enum>(B)</enum><text>the reasonable cost of monitoring appropriate to the injured, replaced, restored, or remediated coral or coral reef resource.</text></subparagraph></paragraph><paragraph id="H6C9E479E896D406BBC1EEA8BFD5F850E"><enum>(11)</enum><header>National coral reef action strategy</header><text>The term <term>national coral reef action strategy</term> means the strategy developed under section 203.</text></paragraph><paragraph id="H18967E59D3FC40CFB1D085E555AAA731"><enum>(12)</enum><header>Resilience</header><text>The term <term>resilience</term> means the capacity for corals, coral reefs, or coral reef ecosystems to resist and recover from natural and human disturbance and maintain structure and function to allow the continued provision of ecosystem goods and services, as determined by clearly identifiable, measurable, and science-based standards.</text></paragraph><paragraph id="HE5253BDFFE4544D5A0782DEB9A5452AD"><enum>(13)</enum><header>Response costs</header><text>The term <term>response costs</term> means the costs of actions that would be necessary to—</text><subparagraph id="HA759E805117F4DBE9C8DB1AF31A621CC"><enum>(A)</enum><text>minimize destruction, loss, or taking of, or injury to a coral reef or component thereof;</text></subparagraph><subparagraph id="H82FE85E125204A4788CE1A9DB7C4500E"><enum>(B)</enum><text>prevent or minimize the imminent risks of such destruction, loss, or taking of, or injury to;</text></subparagraph><subparagraph id="H20CB134E56D540B38ACC4456DB2AF99C"><enum>(C)</enum><text>assess the reasonable costs of damage as determined under section 206(e); and</text></subparagraph><subparagraph id="HFF9DD17DD9A14AA89BE5F596A62C66B5"><enum>(D)</enum><text>respond to or otherwise address an emergency pertaining a coral reef or coral reef ecosystem.</text></subparagraph></paragraph><paragraph id="HE3D8C83B2C1F49E38402DBB01D63746C"><enum>(14)</enum><header>Restoration</header><text display-inline="yes-display-inline">The term <term>restoration</term> means the use of methods and procedures necessary to enhance, rescue, hold in aquarium systems, rehabilitate, recreate, or create a functioning coral reef or coral reef ecosystem, in whole or in part, within suitable waters of the historical range of such ecosystems, to benefit native populations of coral reef organisms.</text></paragraph><paragraph id="H2191FD5258B74C748853F523541A4000"><enum>(15)</enum><header>United states coral reef task force</header><text>The term <term>United States Coral Reef Task Force</term> means the task force established under section 209.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H743EA0BDEABA4A9680D32007C5907475"><enum>110.</enum><header>Establishment of United States Coral Reef Task Force</header><subsection id="H7D14176774AC40BEB4D544EDBC230990"><enum>(a)</enum><header>In general</header><text>The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> et seq.) is amended—</text><paragraph id="H6D46D78ACA6C4F6BB23BCFC015CC573F"><enum>(1)</enum><text>by redesignating sections 209 and 210, as amended by this Act, as sections 215 and 216, respectively; and</text></paragraph><paragraph id="H9B818FFCA55143C9AB537E25E20718FA"><enum>(2)</enum><text>by inserting after section 208 the following:</text><quoted-block id="HD0DCEC0776704F00A83B7DA2B451B09F" style="OLC"><section id="H7118AD91E7084B3796A437144C51C0C5"><enum>209.</enum><header>United States Coral Reef Task Force</header><subsection id="HADE0656EE3FF4A27B0C0ED295EFD150F"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the United States Coral Reef Task Force.</text></subsection><subsection id="H1462989CCC244235A36FBCB0EA8A5A15"><enum>(b)</enum><header>Duties</header><text>The duties of the United States Coral Reef Task Force shall be to coordinate and strengthen Federal, State, international, and local actions to conserve and restore coral reef ecosystems by—</text><paragraph id="H4751862C9DBC477CB5B399861052B608"><enum>(1)</enum><text>supporting, in cooperation with non-Federal partners as appropriate, activities regarding the mapping, monitoring, research, conservation, mitigation, and restoration of coral reefs and coral reef ecosystems;</text></paragraph><paragraph id="H506F6948A80B41788E940B9E741BFD3B"><enum>(2)</enum><text>implementing the policy and Federal agency responsibilities set forth in Executive Order 13089 (63 Fed. Reg. 32701; relating to coral reef protection) (as in effect on June 11, 1998), the national coral reef action strategy, and activities authorized by this title;</text></paragraph><paragraph id="HFA7B1DD8ABA14DF98F7EC1AA5199271A"><enum>(3)</enum><text>analyzing the United States role in international trade and protection of coral species;</text></paragraph><paragraph id="HD77D702C93FA4A39AF342B7481F5CD58"><enum>(4)</enum><text>enhancing public awareness, education, understanding, and appreciation of coral reefs and coral reef ecosystems, including the benefits healthy and resilient coral reefs provide to island and coastal communities and the United States;</text></paragraph><paragraph id="HE48CDB84DA694532BDCC781A1F71C9B7"><enum>(5)</enum><text>supporting coral reef ecosystem research, including on the ecological and economic benefits of coral reefs, both extramurally and across government agencies; and</text></paragraph><paragraph id="HB6B6AC1F9C5341F792F63A59BF3DBDEF"><enum>(6)</enum><text>encouraging implementation of strategies and actions for the conservation and sustainable use of coral reef resources worldwide.</text></paragraph></subsection><subsection id="HE4CEB074A96F42E39B63E6A7B6D63DBF"><enum>(c)</enum><header>Leadership</header><text>The Secretary of Commerce, represented ex officio by the Administrator of the National Oceanic and Atmospheric Administration, and the Secretary of the Interior shall lead the United States Coral Reef Task Force as co-chairs.</text></subsection><subsection id="HF396321C3E9D4B54B5DD013C6D65082C"><enum>(d)</enum><header>Voting membership</header><text display-inline="yes-display-inline">The voting members of the United States Coral Reef Task Force shall be comprised of—</text><paragraph id="H1463D8C9B0C04753A456B8F43BAD54AD"><enum>(1)</enum><text>the co-chairs designated under subsection (c);</text></paragraph><paragraph id="H0CF797A16BC542DFBA5468000DD6C099"><enum>(2)</enum><text>the Federal agency members specified by Executive Order 13089 (63 Fed. Reg. 32701; relating to coral reef protection) (as in effect on June 11, 1998);</text></paragraph><paragraph id="HFE00379D02694204A8E544B2861C1204"><enum>(3)</enum><text>the Secretary of the Army, represented ex officio by the Assistant Secretary of the Army for Civil Works of the Corps of Engineers;</text></paragraph><paragraph id="H391077D93F024B4D9AD79E5E3C507531"><enum>(4)</enum><text>the Secretary of Homeland Security represented by the United States Coast Guard and the Federal Emergency Management Agency; and</text></paragraph><paragraph id="H4EF27B751AF34FCCAE7EE3CB5298FF40"><enum>(5)</enum><text>the Governor, if such Governor elects to participate in the United States Coral Reef Task Force, of—</text><subparagraph id="H360FBE60C5D9445F94ABF5E0B0C20052"><enum>(A)</enum><text>the State of Florida;</text></subparagraph><subparagraph id="HB1304137F1BE4906BA9C8F16B81DED7B"><enum>(B)</enum><text>the State of Hawaii;</text></subparagraph><subparagraph id="HCFD157660FBA417B83ADD2D95C88EAB3"><enum>(C)</enum><text>American Samoa;</text></subparagraph><subparagraph id="H0F91AF7B54074EFE9123534D14241187"><enum>(D)</enum><text>Guam;</text></subparagraph><subparagraph id="H9D5BD8B718D14416B21508EC785266F7"><enum>(E)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph id="H77E5C116B9DD4024A34C03D434E77203"><enum>(F)</enum><text>Puerto Rico; and</text></subparagraph><subparagraph id="H8F4F08288A6545B3A2286680BDF938E2"><enum>(G)</enum><text>the Virgin Islands of the United States.</text></subparagraph></paragraph></subsection><subsection id="H183552450448492891EF3E8D5BBA07C2"><enum>(e)</enum><header>Non-Voting membership</header><text display-inline="yes-display-inline">The non-voting members of the United States Coral Reef Task Force shall be comprised of the President or a representative of the President, if such President elects to participate, of each of the Freely Associated States of—</text><paragraph id="H3B8444FDCC904DABA71D17B2AB075C17"><enum>(1)</enum><text>the Federated States of Micronesia;</text></paragraph><paragraph id="H3A48B9824D5E4FB09A656E25C43B3CEA"><enum>(2)</enum><text>the Republic of the Marshall Islands; and</text></paragraph><paragraph id="H78110AA1FD084109BB4C1497B38EEDDB"><enum>(3)</enum><text>the Republic of Palau.</text></paragraph></subsection><subsection id="HEE22A52E027548EB91D492B8390BD8D3"><enum>(f)</enum><header>Responsibilities of federal agency members</header><text>The Federal members of the United States Coral Reef Task Force shall—</text><paragraph id="H264DE033B8BC4D79ADF22E61FAD796A5"><enum>(1)</enum><text>identify actions by their agencies that may affect coral reef ecosystems;</text></paragraph><paragraph id="HBA219EBBC2CD4B4A87A75A0B0E165FA1"><enum>(2)</enum><text>use the authorities and programs of their agencies to carry out the duties of the United States Coral Reef Task Force as defined by subsection (b); and</text></paragraph><paragraph id="HE017CD375D2F41308A875AB216E240CC"><enum>(3)</enum><text>implement the national coral reef action strategy and any other coordinated efforts approved by the United States Coral Reef Task Force.</text></paragraph></subsection><subsection id="H7B194239560744B3BF8A119266E5FB19"><enum>(g)</enum><header>Working groups</header><text>The co-chairs of the United States Coral Reef Task Force may establish working groups as necessary to advance the purposes of this title, including—</text><paragraph id="H3C990B0E5958435D8F253257E0A5583B"><enum>(1)</enum><text>at the request of members of the United States Coral Reef Task Force; and</text></paragraph><paragraph id="HB8B7AC7413A14EEA809830BD5A061E0E"><enum>(2)</enum><text>working groups for which vested stakeholders, including nongovernmental organizations and research institutions, such as marine laboratories and coral reef institutes, are participants.</text></paragraph></subsection><subsection id="HF67CC4B6285645CE93041A645A724F35"><enum>(h)</enum><header>Nonapplication of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the United States Coral Reef Task Force or working groups established by the United States Coral Reef Task Force.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H13B71446793F4875AC515F96F83E6A16"><enum>(b)</enum><header>Conforming amendment</header><text>The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> et seq.) is amended by inserting <quote>United States</quote> before <quote>Coral Reef Task Force</quote> each place it appears where <quote>United States</quote> does not precede <quote>Coral Reef Task Force</quote>.</text></subsection></section><section id="HD73853977645488BAAD5788EF08268FE"><enum>111.</enum><header>Agreements</header><subsection id="HFDC0DB8F57844375BCD1AFB7BBF0A365"><enum>(a)</enum><header>In general</header><text>The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> et seq.) is further amended by inserting after section 209, as added by this Act, the following:</text><quoted-block id="H2DA695CE54664C889AD84D227D07C740" style="OLC"><section id="H7327669B1AA54266BCF9185708B7C787"><enum>210.</enum><header>Agreements</header><subsection id="H7B39EFD1B400403B8F751F359B0CD247"><enum>(a)</enum><header>In general</header><text>The Secretary may execute and perform such contracts, leases, grants, cooperative agreements, or other transactions as may be necessary to carry out the purposes of this title.</text></subsection><subsection id="H3B1DDC2A76524DF5AFBAF093906FD850"><enum>(b)</enum><header>Funding</header><text>Under an agreement entered into under subsection (a), the Secretary may fulfill the terms of the agreement by reimbursing or providing appropriated funds to, and may receive funds or reimbursements from—</text><paragraph id="H127A89EA342543B5B21340F1D46ADD5C"><enum>(1)</enum><text>Federal agencies, instrumentalities and laboratories;</text></paragraph><paragraph id="H2663005BCD764194AC77B40114AC7384"><enum>(2)</enum><text>State and local governments;</text></paragraph><paragraph id="H4AD7B6663D984915A855D39D7D08C353"><enum>(3)</enum><text>Federally recognized Indian Tribes and Indian Tribal organizations;</text></paragraph><paragraph id="H05DA22DC711845E4BB48E2584AD22EB4"><enum>(4)</enum><text>international organizations;</text></paragraph><paragraph id="H47C631D9349E44F585B1F2D3ADF77189"><enum>(5)</enum><text>foreign governments;</text></paragraph><paragraph id="H2429BFC51DEC46D3A09C911164CAC5D2"><enum>(6)</enum><text>research institutions, including marine laboratories and coral reef institutes;</text></paragraph><paragraph id="HE6A42026B10946839F364C577F920A89"><enum>(7)</enum><text>nongovernmental organizations;</text></paragraph><paragraph id="H4052645F535A4871819121C44585C4C9"><enum>(8)</enum><text>nonprofit organizations;</text></paragraph><paragraph id="HBE2DA14CD08F460BA4E38B2D8E3412F8"><enum>(9)</enum><text>commercial organizations; and</text></paragraph><paragraph id="HFE9E808138B044FDB39F153A10A1A18C"><enum>(10)</enum><text>other public and private persons or entities, as necessary for purposes identified in section 202 and actions taken under section 206.</text></paragraph></subsection><subsection id="H9CE3492C1EA24497BFCAAA94BEB1C516"><enum>(c)</enum><header>Cooperative institute</header><paragraph id="H41DF824AD5BD4B6F92EA4BF95C42A04B"><enum>(1)</enum><header>Establishment</header><text>Subject to paragraph (2), the Secretary shall establish a cooperative institute or cooperative institutes for the purpose of advancing and sustaining essential capability in coral reef research.</text></paragraph><paragraph id="H36454B4036B54EE48F4578AE6AF52ED4"><enum>(2)</enum><header>Membership</header><text>To be eligible to designed as a cooperative institute under paragraph (1), an institution shall include a coral research center, designated by the administrator, that—</text><subparagraph id="H6DB8C811EB10456B86C8C4E9540AF6A6"><enum>(A)</enum><text display-inline="yes-display-inline">is operated by an institution of higher education (as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>);</text></subparagraph><subparagraph id="H7ADCA3B30DB248EA9C7E2E4E31F13E23"><enum>(B)</enum><text>has established management-driven national or regional coral reef research or restoration programs;</text></subparagraph><subparagraph id="H1A8CAD70E1DD46AAB380D2773487FEE3"><enum>(C)</enum><text>is located in a State;</text></subparagraph><subparagraph id="HF1DD12F3788640AD8DD0F65030E8787A"><enum>(D)</enum><text>has demonstrated the ability to coordinate closely with appropriate Federal and State agencies, as well as other academic and nonprofit organizations; and</text></subparagraph><subparagraph id="H758A3B0D622E4377A76B6374804AC301"><enum>(E)</enum><text>maintains significant local community engagement and outreach programs related to coral reef ecosystems.</text></subparagraph></paragraph><paragraph id="H9E4228A164FB448FB6599D8103C26DB0"><enum>(3)</enum><header>Functions</header><text>The cooperative institute or institutes established under this section shall—</text><subparagraph id="H8756BFD1A5C14946A61F229C61E7978C"><enum>(A)</enum><text>conduct bona fide research, observation, and monitoring of coral reef ecosystems aimed at building capacity for more effective resource management and coral reef restoration; and</text></subparagraph><subparagraph id="HE3823DEB55584DAFA98745E731A87E56"><enum>(B)</enum><text>through agreements with centers referred to in paragraph (1)—</text><clause id="H3BA37A77D66A446EAAFE1B4D4C8422E9"><enum>(i)</enum><text>collaborate directly with governmental resource management agencies, nonprofit organizations, academic research institutions, and other research organizations;</text></clause><clause id="H78D69587DB184786A3902CD2519C3761"><enum>(ii)</enum><text>build capacity within resource management agencies to establish research priorities, plan interdisciplinary research projects, and make effective use of research results; and</text></clause><clause id="HEB2AB09C688B463799B7FB15EE8AE408"><enum>(iii)</enum><text>conduct public education and awareness programs for policymakers, resource managers, and the general public on coral reef ecosystems, best practices for coral reef and ecosystem management, conservation, and restoration, their value, and threats to their sustainability.</text></clause></subparagraph></paragraph></subsection><subsection id="H061DEB899AB44BF0B2001F0ED0EBF337"><enum>(d)</enum><header>Multiyear cooperative agreements</header><text>The Secretary may enter into, extend, or renegotiate multiyear cooperative agreements with the heads of other Federal, State, and local government agencies and other vested stakeholders, including nongovernmental organizations and research institutions, such as marine laboratories and coral reef institutes, to further the purposes of this title consistent with the national coral reef action strategy developed under section 203.</text></subsection><subsection id="H0DD921D8FF0241BFAC2501626C2089D5"><enum>(e)</enum><header>Other use of agencies’ resources</header><text>For purposes related to the conservation, preservation, protection, restoration, or replacement of coral reefs or coral reef ecosystems and the enforcement of this title, the Secretary is authorized to use, with their consent and with or without reimbursement, the land, services, equipment, personnel, and facilities of any Department, agency, or instrumentality of the United States, or of any State, local government, or Indian tribal government, or of any political subdivision thereof, or of any foreign government or international organization.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HB3F53A30AE5B448FB288B3217C8F6A05"><enum>112.</enum><header>Permits</header><text display-inline="no-display-inline">The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> et seq.) is further amended by inserting after section 210, as added by this Act, the following:</text><quoted-block id="H700BFDD547464124A389BF3FE1E97BA5" style="OLC"><section id="H0A580A5AEE2D4503B4CA2CCB196111EE"><enum>211.</enum><header>Permits</header><subsection id="HA4C184ADE8964E3998EB954C4B82CDCA"><enum>(a)</enum><header>In general</header><text>The Secretary may, in accordance with this section and regulations promulgated under this title, issue a permit authorizing the conduct of bona fide research or other activities compatible with one or more of the purposes in section 202 of this title.</text></subsection><subsection id="H48E9F6B965D94D11AFD7C2DD773967D4"><enum>(b)</enum><header>Terms and conditions</header><text>The Secretary may place any terms and conditions on a permit issued under this section that the Secretary deems reasonable.</text></subsection><subsection id="H263D48C38A6145168302858178926C8D"><enum>(c)</enum><header>Fees</header><paragraph id="HA2FC526CEC494E949F580E815EBA9EDA"><enum>(1)</enum><header>Assessment and collection</header><text>Subject to regulations promulgated under this title, the Secretary may assess and collect fees as specified in this subsection.</text></paragraph><paragraph id="H63AFF5DA1DCE4ADEB508E1A3E6200113"><enum>(2)</enum><header>Amount</header><text>Any fee assessed shall be equal to the sum of—</text><subparagraph id="H317DBBF5141844BC96F0AE96F3DF3C4B"><enum>(A)</enum><text>all costs incurred, or expected to be incurred, by the Secretary in processing the permit application, including indirect costs; and</text></subparagraph><subparagraph id="HF2F4008FF8EE4CE59AA04AA81ECE2BB0"><enum>(B)</enum><text>if the permit is approved, all costs incurred, or expected to be incurred, by the Secretary as a direct result of the conduct of the activity for which the permit is issued.</text></subparagraph></paragraph><paragraph id="H329B55BA1D284376B6BA2E414F8FF27A"><enum>(3)</enum><header>Use of fees</header><text>Amounts collected by the Secretary in the form of fees under this section may be used by the Secretary for issuing and administering permits under this section.</text></paragraph><paragraph id="HEB8CE517D1DB4C03A72B634732A16F71"><enum>(4)</enum><header>Waiver or reduction of fees</header><text>For any fee assessed under paragraph (2) of this subsection, the Secretary may—</text><subparagraph id="H2532084EC15F4DECAFB3FE389D47B0E3"><enum>(A)</enum><text>accept in-kind contributions in lieu of a fee; or</text></subparagraph><subparagraph id="H8E23D5F5D9264BA2B01B664920B86979"><enum>(B)</enum><text>waive or reduce the fee.</text></subparagraph></paragraph></subsection><subsection id="HE7646D165E754FCB980F32C931BC5A26"><enum>(d)</enum><header>Fishing</header><text>Nothing in this section shall be considered to require a person to obtain a permit under this section for the conduct of any fishing activities not prohibited by this title or regulations promulgated thereunder.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF4B25DA6395746CAA01351C58975F8C6"><enum>113.</enum><header>Regulations</header><text display-inline="no-display-inline">The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> et seq.) is further amended by inserting after section 211, as added by this Act, the following:</text><quoted-block id="H38758276F452412781A76EB67E35FB14" style="OLC"><section id="HA5348A218CDC4BCF94528E99E4E72094"><enum>212.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary may issue such regulations as are necessary and appropriate to carry out the purposes of this title. This title and any regulations promulgated thereunder shall be applied in accordance with international law. No restrictions shall apply to or be enforced against a person who is not a citizen, national, or resident alien of the United States (including foreign-flag vessels) unless in accordance with international law.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H376B0C2F53EC4117860A996686E84BAE"><enum>114.</enum><header>Use of recovered amounts</header><text display-inline="no-display-inline">The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> et seq.) is further amended by inserting after section 212, as added by this Act, the following:</text><quoted-block id="HA29764A8BA8C4B41BA357E255A672DC7" style="OLC"><section id="HAFDAAF70C6594A1BB3DBB0505BC2E91D"><enum>213.</enum><header>Use of recovered amounts</header><text display-inline="no-display-inline">Any amounts available to the Secretary of Commerce that are attributable to fines, penalties, or forfeitures of property (including proceeds from the sale of such forfeited property) imposed for violations of any marine resource law enforced by such Secretary, or regulations implementing such law, for damages to corals, coral reefs, or coral reef ecosystems shall be used by such Secretary—</text><paragraph id="H05900BF637D6436390944C7B14E9FA77"><enum>(1)</enum><text>for the benefit of the coral reef ecosystem impacted by the applicable violation, to the extent practicable;</text></paragraph><paragraph id="HC031E481CEE2483290F21AD252829DA2"><enum>(2)</enum><text>to carry out emergency response activities authorized under section 206, including to reimburse any Federal, State or local government agency for response costs incurred; or</text></paragraph><paragraph id="H9CD217BD37904C0598576B90F1B6465A"><enum>(3)</enum><text>to carry out the purposes of this title, including grants of financial assistance for coral reef conservation projects.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6FD73C6DCABE418BA0B61C283156A069"><enum>115.</enum><header>Prize competitions to promote innovation in coral reef research and conservation</header><text display-inline="no-display-inline">The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> et seq.) is further amended by inserting after section 213, as added by this Act, the following:</text><quoted-block id="H1B3B18486650475EB1073ED71F4B1C3F" style="OLC"><section id="H9B6BA22840EA43F59297BCE9C5C8B6E8"><enum>214.</enum><header>Coral Reef Prize Competitions</header><subsection id="HEE2169811B834874B19643A66D43FFC3"><enum>(a)</enum><header>In general</header><text>The head of any Federal agency with a representative serving on the U.S. Coral Reef Task Force established under Executive Order 13089 issued on June 11, 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref> note), may, either individually or in cooperation with one or more agencies, carry out a program to award prizes competitively under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>).</text></subsection><subsection id="HEAB41083C1A34530B90AAFDB2B2E11EC"><enum>(b)</enum><header>Purposes</header><text>Any program carried out under this section shall be for the purpose of stimulating innovation to advance the ability of the United States to understand, research, or monitor coral reef ecosystems, or to develop management or adaptation options to preserve, sustain, and restore coral reef ecosystems.</text></subsection><subsection id="H0B465C7D09C9417DB76D16ACFCD908AD"><enum>(c)</enum><header>Priority programs</header><text>Priority shall be given to establish programs under this section that address communities, environments, or industries that are in distress due to the decline or degradation of coral reef ecosystems, including—</text><paragraph id="H9DAFFBF3520F490AA2F298E9AD944F43"><enum>(1)</enum><text>scientific research and monitoring that furthers the understanding of causes behind coral reef decline and degradation and the generally slow recovery following disturbances, including ocean acidification and its impacts on coral reproduction;</text></paragraph><paragraph id="HFC1773564E86401EB97A0EBE059B3C70"><enum>(2)</enum><text>the development of monitoring or management options for communities or industries that are experiencing significant financial hardship;</text></paragraph><paragraph id="HFC241D09B8554D81B296BA4131D2A7EB"><enum>(3)</enum><text>the development of adaptation options to alleviate economic harm and job loss caused by damage to coral reef ecosystems;</text></paragraph><paragraph id="H93E82795F5804F558C759CE24CE14B59"><enum>(4)</enum><text>the development of measures to help vulnerable communities or industries, with an emphasis on rural communities and businesses; within—</text><paragraph id="HDADE6CDB8B234C0386D8A6573C3283F0"><enum>(1)</enum><text>any unit of the National Park System;</text></paragraph><paragraph id="HBBA0D539F1CC425FB51B6D65949E7176"><enum>(2)</enum><text>any unit of the National Wildlife Refuge System;</text></paragraph><paragraph id="HCAB30DA14F9F4C3499C816738E8F8B80"><enum>(3)</enum><text>any National Monument or Marine National Monument designated by an Act of Congress or under section 320301 of title 54, United States Code, under the administrative jurisdiction of the Secretary; or</text></paragraph><paragraph id="H6B2FB5D6EBA842BB9C9DFDD2FA6ABF66"><enum>(4)</enum><text>any other Federal land unit or any territorial waters under the administration of the Secretary.</text></paragraph></subsection><subsection id="HB556BB1E22074A629BF733185C49AB9C"><enum>(b)</enum><header>Assistance</header><text>The Secretary may provide technical assistance, scientific expertise, and financial assistance grants for the conservation of coral reefs in proximity to the Federal land and waters described in paragraph (a) to—</text><paragraph id="H25B5421DF584407AB17C9CA1CA6A1268"><enum>(1)</enum><text>entities eligible to receive a grant under section 204 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6403">16 U.S.C. 6403</external-xref>);</text></paragraph><paragraph id="HAA129E749FB24459807B13ED49C37BEC"><enum>(2)</enum><text>territories of the United States; and</text></paragraph><paragraph id="H56304AB253564CD08E93BABB47D736F8"><enum>(3)</enum><text>federally recognized Indian Tribes.</text></paragraph></subsection><subsection id="HDBA5AE16042A4133817120FF8141655F"><enum>(c)</enum><header>Requirement</header><text>The Secretary shall ensure that any action taken by the Secretary under this title is consistent with the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401</external-xref>), as amended by this Act, including the national coral reef action strategy developed under section 203 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6402">16 U.S.C. 6402</external-xref>). </text></subsection><subsection id="HC7C12C5F01A840BF891E938894A69AB0"><enum>(d)</enum><header>Office of Insular Affairs Coral Reef Initiative</header><text>The Secretary shall establish within the Office of Insular Affairs a Coral Reef Initiative Program to—</text><paragraph id="H370A55A4FE434C67A1E1D3BB55617D23"><enum>(1)</enum><text>provide grant funding to support local management, conservation, and protection of coral reef ecosystems in—</text><subparagraph id="HD4615FDB63A0430481C8A97301D99EF4"><enum>(A)</enum><text>insular areas; and</text></subparagraph><subparagraph id="H0AF69B13096B4A659488184DFEA08D37"><enum>(B)</enum><text>freely associated states;</text></subparagraph></paragraph><paragraph id="HC228B92AC2504FF6B468D58A1AAE044A"><enum>(2)</enum><text>complement the other conservation and assistance activities conducted under this title; and</text></paragraph><paragraph id="HC3E4D66B9C3541779F0E68B63443CD99"><enum>(3)</enum><text>provide other technical, scientific, and financial assistance and conduct conservation activities that advance the purposes of this title.</text></paragraph></subsection></section><section id="HCA37BFD1C2524E4693CB00CA5824F563"><enum>202.</enum><header>United States Geological Survey Coral Reef Ecosystem Studies Program</header><text display-inline="no-display-inline">The Secretary shall establish within the United States Geological Survey a program to be known at the Coral Reef Ecosystem Studies Program to—</text><paragraph id="H58E77D12D3904BA2B5C5C3798AB8F9CA"><enum>(1)</enum><text>research, monitor, and map coral reef ecosystems to understand coral reef processes and assess coral reef health, including the effects of changes in ocean temperature and chemistry, ocean acidification, land-based sources of pollution including coastal runoff, sediment erosion and turbidity, and harmful algal blooms;</text></paragraph><paragraph id="H77C715B514B84112976E530CEC335EAC"><enum>(2)</enum><text>develop science and tools to assess and help address the consequences of changing coral reef structure on tourism, recreation, community vulnerability and resilience to storms, erosion, and inundation, and to inform the management of coral reefs and coral reef ecosystems;</text></paragraph><paragraph id="H47F5B1E944264A289E1DC75084F15102"><enum>(3)</enum><text>complement the other conservation and assistance activities conducted under this title;</text></paragraph><paragraph id="HCDD77D98D53E44DF8558F92945832AAA"><enum>(4)</enum><text>provide technical assistance, subject to the availability of appropriations, for research on coral reefs and coral reef ecosystems to—</text><subparagraph id="H2DB2ED4FEEDD49359A30161D965A50A9"><enum>(A)</enum><text>entities eligible to receive a grant under section 204 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6403">16 U.S.C. 6403</external-xref>); and</text></subparagraph><subparagraph id="HA7F2B3C13FDE4EE5802926E1726E7E26"><enum>(B)</enum><text>territories of the United States;</text></subparagraph></paragraph><paragraph id="H73B8CD97640D4F7CA7B3F063687EEF97"><enum>(5)</enum><text display-inline="yes-display-inline">coordinate United States Geological Survey activities relating to coral reefs, including the National Wildlife Health Center; and</text></paragraph><paragraph id="H661FEEBE0F6142ACB1841543B9562717"><enum>(6)</enum><text>carry out other scientific and conservation activities that advance the purposes of this title, as considered appropriate by the Secretary.</text></paragraph></section><section id="H8AB6AF8185E34AFFA476B9CF60B4812D"><enum>203.</enum><header>Use of recovered amounts</header><text display-inline="no-display-inline">All amounts available to the Secretary of the Interior that are attributable to fines, penalties, and forfeitures of property (or proceeds from the sale of such forfeited property) imposed for violations of any law for which the Secretary of the Interior is an enforcement agency, including the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) and the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref> et seq.), and regulations implementing such law, for damages to corals, coral reefs, or coral reef ecosystems, shall be used by the Secretary of the Interior—</text><paragraph id="H186A2CA124E24C95BF3F2F6FF142D026"><enum>(1)</enum><text>for the benefit of the coral reef ecosystem impacted by the applicable violation, to the extent practicable;</text></paragraph><paragraph id="HB87B6626057B4FA8997D5DF9D78B2EBB"><enum>(2)</enum><text>to carry out emergency response activities authorized under section 206 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6405">16 U.S.C. 6405</external-xref>), including to reimburse any Federal, State or local government agency for response costs incurred; or</text></paragraph><paragraph id="HE7531EFDF3574D988613A84653C35055"><enum>(3)</enum><text>to carry out the purposes of this title, including grants of financial assistance for coral reef conservation projects.</text></paragraph></section><section id="HB6D3976A79BA4D4488066CB4FD8778D6"><enum>204.</enum><header>Authorization of appropriations</header><subsection id="H71AD6064D4204B8B89633499E3317725"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary of the Interior to carry out this title $12,000,000 for each of fiscal years 2021 through 2025, which may remain available until expended.</text></subsection><subsection id="H722FD6CB419242CC93568E073B3D5158"><enum>(b)</enum><header>Office of Insular Affairs coral reef initiative program</header><text>From the amounts appropriated under subsection (a) for a fiscal year, there shall be made available to the Secretary of the Interior, acting through the Assistant Secretary of the Interior for Insular Areas, not less than $3,000,000 for the grant program under section 201(d).</text></subsection><subsection id="H4B0F2579EA594C6AA8B18AAD55FC731D"><enum>(c)</enum><header>United States Geological Survey coral reef ecosystem studies program</header><text>From the amounts appropriated under subsection (a) for a fiscal year, there shall be made available to the Secretary of the Interior, acting through the Director of the United States Geological Survey, not less than $4,000,000 for the Coral Reef Ecosystem Studies Program under section 203.</text></subsection></section><section id="H9222676EA5D247FAA15A377D1CCF7E27"><enum>205.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H8204D6F24C84429BBE299196B87DB688"><enum>(1)</enum><header>Conservation</header><text>The term <term>conservation</term> has the meaning given such term in section 215 of the Coral Reef Conservation Act of 2000, as redesignated by this Act.</text></paragraph><paragraph id="H13B55E64DC5F4390B664399984285CCE"><enum>(2)</enum><header>Coral reef</header><text>The term <term>coral reef</term> has the meaning given such term in section 215 of the Coral Reef Conservation Act of 2000, as redesignated by this Act.</text></paragraph><paragraph id="H6D0ADB5FBF5240C78A0FA91DDE5F5D20"><enum>(3)</enum><header>Coral reef ecosystem</header><text>The term <term>coral reef ecosystem</term> has the meaning given such term in section 215 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6409">16 U.S.C. 6409</external-xref>), as redesignated by this Act.</text></paragraph><paragraph id="HD69EBF88992545AEA47301DEA4B4A3E9"><enum>(4)</enum><header>Freely associated state</header><text>The term <term>Freely Associated State</term> means each of the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau in an applicable Compact of Free Association with the United States.</text></paragraph><paragraph id="H8DA9DD4094B44451ABFDC7DC6CF52F55"><enum>(5)</enum><header>Insular area</header><text>The term <term>Insular Area</term> means each of American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, and the Virgin Islands of the United States.</text></paragraph><paragraph id="H7F98F03EAE914EB1ABD6EA3344B2BC57"><enum>(6)</enum><header>Resilience</header><text>The term Act.</text></paragraph></section><enum>III</enum><header>National Coral Reef Management Fellowship</header><section id="H47F3E1E7C68C47EAB69B016C2F7395D2"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>National Coral Reef Management Fellowship Act of 2020</short-title></quote>.</text></section><section id="HEB4A6870310F4D22ACDC6EF4923B6286"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H2A38A863724F4C57B1D7E526BD6AD0D3"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="H00B2EDF4183B4B6CA646E8F94B12FFDF"><enum>(2)</enum><header>Fellow</header><text>The term <term>fellow</term> means a National Coral Reef Management Fellow.</text></paragraph><paragraph id="H349B67621021410FB4B855A09FB678C6"><enum>(3)</enum><header>Fellowship</header><text>The term <term>fellowship</term> means the National Coral Reef Management Fellowship established in section 303.</text></paragraph></section><section id="HD5B7FFE43E4147458E0745534EF5865A"><enum>303.</enum><header>Fellowship program</header><paragraph id="HB6E5700C2B404BAB9098846A4B06E3BB"><enum>(1)</enum><header>In general</header><text>There is established the National Coral Reef Management Fellowship Program.</text></paragraph><paragraph id="HBCF2B0C923264E19805629B13C89DA91"><enum>(2)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the Fellowship Program is to encourage future leaders of the United States—</text><subparagraph id="HF9B6E18AD6164385966E6642B5E4FBFA"><enum>(A)</enum><text>to develop additional coral reef management capacity in States and Territories with coral reefs;</text></subparagraph><subparagraph id="H727A11CCEA934403A862C7D65BBB8404"><enum>(B)</enum><text>provide State and Territorial coral reef management agencies with highly qualified candidates whose education and work experience meet the specific needs of each State and territory; and</text></subparagraph><subparagraph id="H0951987FCDAF457D8A99BB014ABF0008"><enum>(C)</enum><text>provide the individual fellows with professional experience in coastal and coral reef resources management.</text></subparagraph></paragraph><paragraph id="HD71BBBBDD8EA4EBEB0A3F15CAA623E04"><enum>(3)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary shall offer to provide a grant to the National Oceanic and Atmospheric Administration’s National Ocean Service to administer the Fellowship.</text></paragraph></section><section id="HB2EBE329FBDB49779F764634E02380AD"><enum>304.</enum><header>Fellowship awards</header><subsection id="H475CF04C1787454F807C9EF9207DD08B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make available National Coral Reef Management Fellowship in accordance with this subsection.</text></subsection><subsection id="H59D8C0B8AEC540418A1D8443AB0824AE"><enum>(b)</enum><header>Period of fellowship</header><text display-inline="yes-display-inline">National Coral Reef Management Fellowship awarded under this section shall be for not more than 24 months.</text></subsection><subsection id="H97234D04A4E1497EA47D415B41847E5C"><enum>(c)</enum><header>Qualifications</header><text display-inline="yes-display-inline">A successful program applicant shall be an individual who has demonstrated—</text><paragraph id="HD108B899155644A788E53572555BB4E9"><enum>(1)</enum><text>an intent to pursue a career in marine services and outstanding potential for such a career;</text></paragraph><paragraph id="H0AD0D0E5D28D48408FB2DE70F4DB46ED"><enum>(2)</enum><text>leadership potential or actual leadership experience;</text></paragraph><paragraph id="H9303C015DA9447FAB95D0A51CF77DD2A"><enum>(3)</enum><text>diverse life experience;</text></paragraph><paragraph id="HFE95F460C2BE49FDBD7F6AEE77AC81A0"><enum>(4)</enum><text>proficient writing and speaking skills; and</text></paragraph><paragraph id="H36930DEE09BF4F56B181FC419E50E4DB"><enum>(5)</enum><text>such other attributes as are considered to be appropriate by the Director.</text></paragraph></subsection><subsection id="H071CCB0B4CFD41EFA91B60FDFDFBAAC7"><enum>(d)</enum><header>Matching requirement</header><paragraph id="HA7899FE517984D779B8DECF04DABE7CA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the non-Federal share of the costs of a fellowship under this section shall be 25 percent of such costs.</text></paragraph><paragraph id="H160E9694254B4726A1A2EE699B36E794"><enum>(2)</enum><header>Waiver of requirements</header><text display-inline="yes-display-inline">The Secretary may waive the application of paragraph (1) if the Secretary finds that such waiver is necessary to support a project that the Secretary has identified as of high priority.</text></paragraph></subsection><subsection id="HC1C3D3EED66C46F6B77F5D5D4F003B27"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section, to remain available until expended.</text></subsection></section><enum>IV</enum><header>Assessing the Threats and Values of Coral Reef Ecosystems</header><section id="HB61A852B4E584B55AB19159D21A5C34B"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H554A6775DD374814B8CAA56EF4D7F9A5"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="HC6C7D43636364C109FC1C8E2AEA8696E"><enum>(2)</enum><header>National Academy</header><text>The term <term>National Academy</term> means the National Academies of Sciences, Engineering, and Medicine.</text></paragraph><paragraph id="H0B5B8139C8F64E099052EDC196FF59F6"><enum>(3)</enum><header>Appropriate Committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="H11268E2B53D34BBFB397AB836F95FF1A"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and </text></subparagraph><subparagraph id="HE5F76A7023414B0A97330F38AA4201D9"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H09A11264B8254A43B1711E41CF5B1E8D"><enum>(4)</enum><header>Coral reef ecosystem</header><text>The term <term>coral reef ecosystem</term> means the corals and the animals, plants, and other living organisms that are supported by coral reefs for food, shelter, reproduction, and rearing.</text></paragraph><paragraph id="H2E899829A607435EB243527C0CA577CB"><enum>(5)</enum><header>Ultraviolet filters</header><text>The term <term>ultraviolet filters</term> means chemical compounds commonly used in sunscreen formula.</text></paragraph></section><section id="HFDFAD0A0AB9E42C0B4C406D8CF47CBE2"><enum>402.</enum><header>Study examining the impact of ultraviolet filters on coral reef ecosystems</header><subsection id="H9C09134F896A44FE80F1779776F2B41C"><enum>(a)</enum><header>Agreement</header><text>The Secretary shall, not more than 90 days after the date of enactment of this Act, enter into an agreement with the National Academy of Sciences to conduct a study and submit to the appropriate committees of Congress a report examining the impact of ultraviolet filters on coral reef ecosystems, including—</text><paragraph id="HEFB9E837746B476289EA8523954D7AE9"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the impacts of common ultraviolet filters on coral reef ecosystems including regional, longitudinal, and long-term chronic impacts; </text></paragraph><paragraph id="H4D2275086BA54B38AF46FEA50C3A9F3A"><enum>(2)</enum><text>an assessment of the bioconcentration and bioaccumulation potential of ultraviolet filters in coral reef ecosystems; </text></paragraph><paragraph id="HF284221ED1A945D1AB42F66FBEBF9335"><enum>(3)</enum><text>an assessment of the interaction effects of ultraviolet filters between predicted temperature and ocean acidification conditions; </text></paragraph><paragraph id="H7EA5A67FF6FC4175A0EEB4530684B925"><enum>(4)</enum><text>considerations of the ecological, conservation, economic, and social factors involved in a ban of specific ultraviolet filters; and </text></paragraph><paragraph id="H38B71D694E3F4CD086DE45BE82713644"><enum>(5)</enum><text>recommendations for ultraviolet filters that are safe and ultraviolet filters that pose a threat to healthy coral reef ecosystems.</text></paragraph></subsection><subsection id="HBD699BF2196042ED8418B157A7B05365"><enum>(b)</enum><header>Submission to Congress</header><text>Not more than 3 years after the date of enactment of this Act, the Secretary shall submit the final report of the National Academy containing the results of the study carried out under subsection (a) to the appropriate committees.</text></subsection><subsection id="H4BA7F0069B1042AA8C42DDCEF6811A63"><enum>(c)</enum><header>Publication</header><text display-inline="yes-display-inline">Not more than 30 days after the completion of the report produced pursuant to subsection (a), the Secretary shall make such report available on a public website.</text></subsection></section><section id="H86EB232212264D179C065C9C536EDD3F"><enum>403.</enum><header>Study to determine the economic, societal, and ecological value of coral reef ecosystems in the United States and territories of the United States</header><subsection id="H642CD69046E340FF853683A8C6EE7DBE"><enum>(a)</enum><header>Agreement</header><text>The Secretary shall, not more than 90 days after the date of enactment of this Act, enter into an agreement with the National Academy of Sciences to conduct a study evaluating the economic, societal, and ecological value of coral reef ecosystems in the United States and Territories of the United States, including—</text><paragraph id="H7C9F84DD89474820840D98E09C269374"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the economic, societal, and ecological value of coral reef ecosystems at national, regional, and site-specific scales with respect to—</text><subparagraph id="HDE632F92B30B40EABEF77436D8B52299"><enum>(A)</enum><text>tourism;</text></subparagraph><subparagraph id="HD911713B64BA47B29212BC8987A75157"><enum>(B)</enum><text>fisheries; </text></subparagraph><subparagraph id="HE9B479D5C9D049A18BE9C4AE02056DC4"><enum>(C)</enum><text>coastal protection including against storm surge, flooding, and other natural threats;</text></subparagraph><subparagraph id="H976C6C9DCCD740E3AF918C1B220BC356"><enum>(D)</enum><text>biodiversity; and</text></subparagraph><subparagraph id="H981E483CB90847B3AB4D6810AE5AEB6E"><enum>(E)</enum><text>carbon sequestration; and </text></subparagraph></paragraph><paragraph id="HA501C76FDADE404AA64007897D905BF7"><enum>(2)</enum><text>an assessment of the economic costs of degradation and loss of coral reef with respect to the matter described in paragraph (1) over the next 50 years.</text></paragraph></subsection><subsection id="H12890D2E64E04684837732900E3C8AF3"><enum>(b)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Secretary shall submit the final report of the National Academy containing the results of the study carried out under subsection (a) to the appropriate committees.</text></subsection><subsection id="HA73252DF18724CA7B68519E3229C8984"><enum>(c)</enum><header>Publication</header><text display-inline="yes-display-inline">Not more than 30 days after the completion of the report produced pursuant to subsection (a), the Secretary shall make such report available on a public website.</text></subsection></section><enum>V</enum><header>Miscellaneous Provisions</header><section id="H03ACEAE782834302A78498CA7D66B580"><enum>501.</enum><header>Stock assessments under Magnuson-Stevens Fishery Conservation and Management Act</header><text display-inline="no-display-inline">Title IV of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1881">16 U.S.C. 1881</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H28963396B43B4104BDDDF606B640BB56" display-inline="no-display-inline"><section id="HDDAF89ECFCEF4CF697302AD66026E2A7"><enum>409.</enum><header>Stock assessments for fisheries associated with coral reefs</header><text display-inline="no-display-inline">In preparing stock assessments under this Act, the Secretary shall, to the extent practicable, place emphasis on such assessments for economically important fisheries associated with coral reefs.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HE85069CC416D426DAB7A8E34942E1A79"><enum>502.</enum><header>Deep Sea Coral Research and Technology Program</header><subsection id="HF5CBB3B3DD5E44CB8AAFDC36340E607C"><enum>(a)</enum><header>In general</header><text>Section 408(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1884">16 U.S.C. 1884(a)</external-xref>) is amended—</text><paragraph id="H623B9A3BCEAE48D1BAD9031E1F52BE57"><enum>(1)</enum><text>by striking <quote>federal</quote> and inserting <quote>Federal</quote>; </text></paragraph><paragraph id="HAA2F6DC3FCE14913BF04F73CA730E918"><enum>(2)</enum><text>by striking <quote>subject to the availability of appropriations,</quote>; and</text></paragraph><paragraph id="HC867E09A87784663A3AC9C1CB1278684"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H9FF42CFE7096415A9EB780E1CAF661B5" display-inline="no-display-inline"><subsection id="H53265FC8A8734C87B2D9CECC4067EE22"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this title $3,000,000 for each of fiscal years 2021 through 2025, which may remain available until expended.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD335CEF6AD46435198C2D7E512127891"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in the first section of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1881">16 U.S.C.
