which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide Federal funding for targeted purchases to buy food from producers who rely on local agricultural food markets affected by COVID–19, and for other purposes.</official-title></form><legis-body id="H98170CB90252411BB886170CC47AA927" style="OLC"><section id="H423A6F457C6A4D15A907500773458391" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farmers Feeding Families Coronavirus Response Act</short-title></quote>. </text></section><section id="H00F3DAAFE8F44330AEFD329F9CB4658D"><enum>2.</enum><header>Targeted purchases</header><subsection id="H4574C18F37184A4FB9D1F17AD1411BD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall use not less than $300,000,000 of the funds available under section 32 of the Act of August 24, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref>), to purchase qualified agricultural products to provide to food assistance programs, including the emergency food assistance program under the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501</external-xref> et seq.), of which the Secretary shall utilize—</text><paragraph id="H12733A7EAA7047FB95D2BF3C7C734FB3"><enum>(1)</enum><text>not less than $150,000,000 to purchase specialty crops;</text></paragraph><paragraph id="HB5F610BAB16C461EB882911E59A96C97"><enum>(2)</enum><text>not less than $75,000,000 to purchase dairy; and</text></paragraph><paragraph id="HF2DF719C0F3243DBB1B71AA1C47B3023"><enum>(3)</enum><text>not less than $75,000,000 to purchase meat and poultry products.</text></paragraph></subsection><subsection id="H449A812A7A5A459BBD2F65E6D050D669"><enum>(b)</enum><header>Qualified agricultural product defined</header><text>In this section, the term <term>qualified agricultural product</term> means a specialty crop, dairy, meat, or poultry product—</text><paragraph id="HD85C6F0DF3F7421286D3DBEE1F40D875"><enum>(1)</enum><text>that was packaged, marketed, intended to be harvested, or harvested for sale—</text><subparagraph id="H005578D905B54A9289D60547830E788A"><enum>(A)</enum><text>to commercial or food service industries; or</text></subparagraph><subparagraph id="HC621D7E6F6FD4AA1800114ADF6A0375A"><enum>(B)</enum><text display-inline="yes-display-inline">through direct-to-consumer, direct-to-institution, direct-to-retail, or direct-to-restaurant-or-store marketing channels, including local and regional food enterprises like food hubs, agricultural cooperatives and producer associations; and</text></subparagraph></paragraph><paragraph id="H5BD492A6AB994114A731FA7C8DF637CB"><enum>(2)</enum><text>for which decreased demand exists for such a product due to the COVID–19 outbreak.</text></paragraph></subsection><subsection id="HF6090AC125F44762BBCF00D28B66C77C"><enum>(c)</enum><header>Direct market products</header><text>Of the amounts in subsection (a), to the maximum extent practicable, the Secretary of Agriculture shall use not less than 10 percent to purchase qualified agricultural products that would otherwise have been sold through direct-to-consumer, direct-to-institution, direct-to-retail, or direct-to-restaurant marketing channels.</text></subsection><subsection id="HA2E01EDDDE6E4C9BBA51664D3B60161C"><enum>(d)</enum><header>State purchasing funds</header><paragraph id="H7974BD8B9A0146CCA10C96EB8F8E82AA"><enum>(1)</enum><header>In general</header><text>In addition to the amounts used under subsection (a), the Secretary of Agriculture shall use not less than $200,000,000 of the funds available under section 32 of the Act of August 24, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref>), to be apportioned among the States for the purpose of procuring additional food products to support food assistance programs within each State.</text></paragraph><paragraph id="H0BB25A530ACC4E4CB5C5CDED1B8C2EB4"><enum>(2)</enum><header>Amount available</header><text>The Secretary shall allocate the amounts made available under paragraph (1) to each State in the amount proportionate to the share such State received under the formula under section 251.3(h) of title 7, Code of Federal Regulations, for such fiscal year 2020.</text></paragraph><paragraph id="HDA207FF4F6874096A5D1577D3672B741"><enum>(3)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds available under this subsection shall be transferred to the State agency designated as responsible for distributing commodities pursuant to a State plan under the emergency food assistance program under the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501</external-xref> et seq.). The distributed funds may only be used to—</text><subparagraph id="HD64597B9153644458232BB765673EDEB"><enum>(A)</enum><text display-inline="yes-display-inline">purchase qualified agricultural products to be donated to food assistance programs within the State or transferred directly to one or more eligible recipient agencies (as defined in section 201A of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501</external-xref>)) for such procurement;</text></subparagraph><subparagraph id="H14F545C35D504FCEAD07DC28CBA5054F"><enum>(B)</enum><text>purchase, lease, or otherwise acquire vehicles, including refrigerated vehicles, or other equipment to carry out activities related to procurement and distribution of qualified agricultural products;</text></subparagraph><subparagraph id="HBCF279BCD9B04CD6915EF8D028000762"><enum>(C)</enum><text>reimburse travel costs related to procurement of qualified agricultural products at the per mile rate established by the Commissioner of the Internal Revenue Service; and</text></subparagraph><subparagraph id="H70F69391F2F64EA6ACC3A7F6726BE65F"><enum>(D)</enum><text>reimburse costs related to preparing, storing, and transporting qualified agricultural products, including transportation to or between recipient agencies, as well as delivery to end-consumers.</text></subparagraph></paragraph><paragraph id="HD939FCFA9B1B4B09BF849F27B8F1EA5F" commented="no"><enum>(4)</enum><header>Direct market support in-state</header><text>Each State shall, to the maximum extent practicable, use not less than 10 percent of the amounts allocated to such State under paragraph (2) to purchase crops and products that would otherwise have been sold through direct-to-consumer, direct-to-institution, direct-to-retail, or direct-to-restaurant marketing channels.</text></paragraph></subsection></section></legis-body></bill>
