R. 6723</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200505">May 5, 2020</action-date><action-desc><sponsor name-id="P000258">Mr. Peterson</sponsor> (for himself, <cosponsor name-id="Y000033">Mr. Young</cosponsor>, <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>, <cosponsor name-id="C001124">Mr. Cox of California</cosponsor>, <cosponsor name-id="R000395">Mr. Rogers of Kentucky</cosponsor>, <cosponsor name-id="L000491">Mr. Lucas</cosponsor>, <cosponsor name-id="C001119">Ms. Craig</cosponsor>, <cosponsor name-id="C001055">Mr. Case</cosponsor>, <cosponsor name-id="G000581">Mr. Gonzalez of Texas</cosponsor>, and <cosponsor name-id="C001110">Mr. Correa</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to clarify the eligibility of broadband internet access services for Federal universal service support, and for other purposes.</official-title></form><legis-body id="H442B52BCB6DC4EC8A15DBC29C2A4D472" style="OLC"><section id="H7A957FB6BCB84E7A9751E022DA90F215" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Universal Broadband Act of 2020</short-title></quote>.</text></section><section id="H24196E89EE1443EE957EC6053E678581"><enum>2.</enum><header>Universal service support for broadband internet access services</header><subsection id="H6C7C28FFE83A41F88968485EEABAAF93"><enum>(a)</enum><header>Clarification of eligibility for support</header><paragraph id="HDC231E507F7942AF94B5B7D770B1B921"><enum>(1)</enum><header>In general</header><text>Section 254(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H2A5FDF727DE84947A2FB7467640BD61D" display-inline="no-display-inline"><paragraph id="HB3E2A27BD84D4545A8467FF4FF24079B"><enum>(4)</enum><header>Broadband internet access services</header><text display-inline="yes-display-inline">In addition to the services included in the definition of universal service under paragraph (1), the Commission shall designate broadband internet access services as services that are supported by Federal universal service support mechanisms. In designating services under this paragraph, the Commission shall ensure that the services designated are sufficient for the purposes for which consumers use broadband internet access services, as such purposes evolve over time.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4B926559CA9C4C2C8CBBD8F0362647A2"><enum>(2)</enum><header>Obligations of eligible telecommunications carriers</header><text display-inline="yes-display-inline">Section 214(e)(1)(A) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/214">47 U.S.C. 214(e)(1)(A)</external-xref>) is amended by inserting <quote>all of</quote> after <quote>offer</quote>. </text></paragraph></subsection><subsection id="HF09CC79620B34226BF55EF814D1985EC"><enum>(b)</enum><header>Contributions to universal service</header><paragraph id="H0452A6852EF34911A13AEC8F1DF29CCF"><enum>(1)</enum><header>Providers of broadband internet access services required to contribute</header><text display-inline="yes-display-inline">Section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) is amended—</text><subparagraph id="HAD0F366D5B274703AE564484BBB5ED51"><enum>(A)</enum><text>in subsection (b)(4), by inserting <quote>and all providers of broadband internet access services</quote> after <quote>telecommunications services</quote>; and </text></subparagraph><subparagraph id="H141C0299160E47479183F0576F4F8F43"><enum>(B)</enum><text>in subsection (d)—</text><clause id="H9F9233EC2FEA4F068303A3647DB319F5"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Telecommunications carrier</header-in-text></quote>;</text></clause><clause id="HDF461878B8144A5B86E8791A2B7E7A69"><enum>(ii)</enum><text>in the first sentence, by inserting <quote>and every provider of broadband internet access services</quote> after <quote>telecommunications services</quote>; and</text></clause><clause id="HB4C49E1B2D844CBE9FD7AADC6E03CB3B"><enum>(iii)</enum><text>in the second sentence—</text><subclause id="HE21FF3BFD3574737A0234E00201E7034"><enum>(I)</enum><text>by inserting <quote>, or provider or class of providers,</quote> after <quote>carriers</quote>; and</text></subclause><subclause id="H2BD7E77570784D5A9E24DE423B036C4C"><enum>(II)</enum><text>by inserting <quote>or provider’s</quote> after <quote>carrier’s</quote> each place it appears.</text></subclause></clause></subparagraph></paragraph><paragraph id="H2F334ABDA8064BC9A9C61133E12B625A"><enum>(2)</enum><header>Additional matters relating to universal service contributions</header><text>Section 254(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(d)</external-xref>) is amended—</text><subparagraph id="H29C5EA77BF854C5AAA68A47A67AB8104"><enum>(A)</enum><text>by striking <quote>Every telecommunications carrier</quote> and inserting the following: </text><quoted-block style="OLC" id="HF5B97B00DBFE41E4979836AD4A593CCC" display-inline="no-display-inline"><paragraph id="H9022C2E59D9A482090FF248FD688232F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Every telecommunications carrier</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7421047A24F744E0A87D3E3AF243531B"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H3F814E31A89F424A9EAD622294F18248" display-inline="no-display-inline"><paragraph id="H953EEB59907247268B6367D1A30CE7E0"><enum>(2)</enum><header>Exclusion from contribution base of services provided to Lifeline consumers</header><text display-inline="yes-display-inline">In determining the amount that a telecommunications carrier or provider of a broadband internet access service is required to contribute under this subsection, the Commission shall exclude from the determination any services provided by such carrier or provider to consumers who receive services through the Lifeline program of the Commission.</text></paragraph><paragraph id="H067CF934BE2443E4B86F860E95CAE912"><enum>(3)</enum><header>Consideration of anticipated funding needs</header><subparagraph id="HEEED0E3E3065408F909F27BE47E3B3D3"><enum>(A)</enum><header>In general</header><text>In determining the amount of contributions required under this subsection, the Commission shall consider forecasts of anticipated demand for services that are supported by each of the Federal universal service support mechanisms over periods that are sufficiently long to allow for adequate planning, thereby ensuring sufficient and predictable funding for each such mechanism.</text></subparagraph><subparagraph id="HB568B59A99844B018C6388D543AF0749"><enum>(B)</enum><header>Prohibition on contribution limit</header><text display-inline="yes-display-inline">The Commission may not establish any limit on the total amount of contributions required under this subsection with respect to all Federal universal service support mechanisms, except for establishing the amount that providers are required to contribute with respect to a particular time period based on the projected demand for services that are supported by Federal universal service support mechanisms over such time period.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H1CAA7BD864F941B08A44DD8917BA6EB8"><enum>(c)</enum><header>Access in Tribal areas</header><text>Section 254(b)(3) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(b)(3)</external-xref>) is amended—</text><paragraph id="HC39E7ECC61D047C78CAB1124C915C19A"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Access in rural and high cost areas</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Access in all regions</header-in-text></quote>; and</text></paragraph><paragraph id="HC889F33778E2456C9E037590F16DFA8F"><enum>(2)</enum><text>by inserting <quote>Tribal,</quote> after <quote>insular,</quote>.</text></paragraph></subsection><subsection id="H5744AA9C14E741CBA92461D9018F6D0C"><enum>(d)</enum><header>Prohibition on expenditure limit</header><text display-inline="yes-display-inline">Section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HCE5F2914BC6F47B994DCE06CA6C75B86" display-inline="no-display-inline"><subsection id="HF9C4C0E1E1464DCEA36F977BD5ED6D07"><enum>(m)</enum><header>Prohibition on expenditure limit</header><text display-inline="yes-display-inline">The Commission may not establish any limit on the total amount of funds that may be expended through all Federal universal service support mechanisms. Nothing in the preceding sentence shall be construed to prohibit the Commission from ensuring that funds expended through the Federal universal service support mechanisms are expended for services eligible for support through such mechanisms.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1AFA4520EA1B4F599AEE356C60009C0A"><enum>(e)</enum><header>Consultation among FCC, NTIA, and USDA</header><text display-inline="yes-display-inline">The Federal Communications Commission, the Assistant Secretary of Commerce for Communications and Information, and the Secretary of Agriculture shall, in administering Federal financial assistance for the deployment of broadband services, consult with one another regarding the distribution of such assistance for the deployment of broadband services in rural areas.</text></subsection><subsection id="H299201F093344F88BC228D1E53FAC91E"><enum>(f)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">Section 254 of the Communications Act of 1934, as amended by subsection (d), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H9841010D9AA747ACA023B5243E699820" display-inline="no-display-inline"><subsection id="H12C18B10CEB642CCAEEC1018E88607DE"><enum>(n)</enum><header>Reporting requirements</header><text>Not later than 180 days after the end of each calendar year, the Commission shall submit to Congress a report that contains the following:</text><paragraph id="H85DAC8E24830461495D27D75EDCE13DE"><enum>(1)</enum><text display-inline="yes-display-inline">A statement of the total amount expended in such year to support broadband internet access services through the Federal universal service support mechanisms for high-cost areas.</text></paragraph><paragraph id="H34CF7B34D0AD482CB6A9D45B677678D5"><enum>(2)</enum><text>A statement of the amount, of the total amount stated under paragraph (1), expended in each of the following:</text><subparagraph id="HFEF3AE217C2B4993AC92B06BF715A20B"><enum>(A)</enum><text>Rural areas.</text></subparagraph><subparagraph id="H718AD891C3DD4206A8F3EE182A972568"><enum>(B)</enum><text display-inline="yes-display-inline">Insular areas.</text></subparagraph><subparagraph id="HC498308972544DC9AC1503FF2E52A914"><enum>(C)</enum><text display-inline="yes-display-inline">Tribal areas.</text></subparagraph><subparagraph id="H4393C30DD5EB45D69D99CA9C45813E97" commented="no"><enum>(D)</enum><text>Areas that, as of the beginning of such year, were unserved areas, as determined by the Commission.</text></subparagraph></paragraph><paragraph id="H7D45FC33204B4520876025E8D95F72A7"><enum>(3)</enum><text display-inline="yes-display-inline">A description of progress during such year in advancing the universal service principles described in subsection (b) and the requirements for meeting future growth in the demand for the services that are supported by Federal universal service support mechanisms, including challenges that may prevent the advancement of such principles.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD12B8D3FD3E446FE8FCC5051BBABD26E"><enum>(g)</enum><header>Broadband internet access service defined</header><text>Section 254 of the Communications Act of 1934, as amended by subsections (d) and (f), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H6B132D12F56A4562880E30E3A3FA0890" display-inline="no-display-inline"><subsection id="HA9254F1A0A414CAA8F3D47575D5D7B81"><enum>(o)</enum><header>Broadband internet access service defined</header><text display-inline="yes-display-inline">In this section, the term <quote>broadband internet access service</quote>—</text><paragraph id="HEC73D1DC57DA4CDD83F8176AB22F0AD8"><enum>(1)</enum><text>means a mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service, but excluding dial-up internet access service; and</text></paragraph><paragraph id="H26FE7F2AA8E94479867E5F2682D2C130"><enum>(2)</enum><text>includes any service that the Commission finds to be providing a functional equivalent of the service described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
