subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Mineral Leasing Act and the Outer Continental Shelf Lands Act to limit the authority of the Secretary of the Interior to reduce certain royalties, to amend the CARES Act to limit the provision of assistance to certain businesses, to impose a moratorium on certain oil and natural gas lease sales, the issuance of coal leases, and modifications to certain regulations, to extend certain public comment periods, and for other purposes.</official-title></form><legis-body id="H3B39F214416A4D0A8C7C1C87592F4F31" style="OLC"><section id="H730A9451B87542639D0A936715D339FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resources for Workforce Investments, Not Drilling Act</short-title></quote> or the <quote><short-title>ReWIND Act</short-title></quote>.</text></section><section id="H21D0648DFAED447EA4806307D867B32A"><enum>2.</enum><header>Limitation on certain forms of assistance under the CARES Act</header><subsection id="HECECFFFD178640B8AC55A71C94A9B503"><enum>(a)</enum><header>Exclusion of certain businesses from financial assistance</header><paragraph id="H3740AD6286A8443B885884067FAC62EB"><enum>(1)</enum><header>Definition of eligible business</header><text>Section 4002(4)(B) of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 281) is amended by inserting <quote>(other than a United States business for which not less than 15 percent of the revenue is derived from the extraction, transport, storage, export, or refining of oil, natural gas, and coal)</quote> after <quote>United States business</quote>.</text></paragraph><paragraph id="HF009C7C3CF244DACA82BBAB8A9A01F7D"><enum>(2)</enum><header>Loans and loan guarantees for businesses critical to maintaining national security</header><text>Section 4003(b)(3) of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 281) is amended by inserting <quote>(other than a United States business for which not less than 15 percent of the revenue is derived from the extraction, transport, storage, export, or refining of oil, natural gas, and coal)</quote> after <quote>national security</quote>.</text></paragraph></subsection><subsection id="H29A3F168C8ED4BBCAFB784488F2384A1"><enum>(b)</enum><header>Limitation on acquisition of federal leases by loan recipients</header><text>Section 4003(c)(1) of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 281) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEADDAD373A0B4E8FB0073F0117D99814"><subparagraph id="H0DC26891645F4581A67B0DCCAC1D68F0"><enum>(C)</enum><header>Limitation on acquisition of federal leases by loan recipients</header><text>An eligible business that receives a loan or loan guarantee under this section may not bid on, purchase, or acquire any Federal lease or acquire a Federal lease from a third party until the date on which the Secretary certifies that any loans received or guaranteed under this section have been repaid.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB533F58B093A417FA8D24249E9F58A8E"><enum>(c)</enum><header>Limitation on loans and loan guarantees to certain financial institutions</header><text>Section 4003 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 281) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE816CDFD986E4C52A7B5901CA6C0BD41"><subsection id="H78D4F546E41A451BA398A4D30DC298B0"><enum>(i)</enum><header>Limitation on loans and loan guarantees to certain financial institutions</header><text>The Secretary shall not make a loan or loan guarantee to, or other investment in, a financial institution under this section for the purpose of assisting any business for which not less than 15 percent of the revenue is derived from the extraction, transport, storage, export, or refining of oil, natural gas, and coal.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBE21748401184E5D9B4CAFF0A5D3888B"><enum>3.</enum><header>Limitations on banks operating fossil fuel companies</header><subsection id="H70E761B862DB42238D8FABA7225B356B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H7E279B6502844A899C3C79AB45FE48B5"><enum>(1)</enum><header>CARES Act</header><text>The term <term>CARES Act</term> means the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></paragraph><paragraph id="HE6C59873674B4ABC96B8C3CF2FDF1C8B"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text><subparagraph id="H507E6172377C41FCA84671290EBF231B"><enum>(A)</enum><text>a solvent insured depository institution or solvent depository institution holding company (including any affiliate thereof) that issues debt that is guaranteed under the program authorized by subsection (h) of section 1105 of the Dodd-Frank Wall Street Reform and Consumer Protection Act, as added by section 4008 of the CARES Act;</text></subparagraph><subparagraph id="H4E98B8E06E5840B1A574986199645643"><enum>(B)</enum><text>any entity issuing loans or extensions of credit described in section 5200(c)(7) of the Revised Statutes, as amended by section 4011 of the CARES Act;</text></subparagraph><subparagraph id="HE076D99CFDF547E6A2EF0F8519061CA4"><enum>(C)</enum><text>any bank sponsoring a money market mutual fund that benefits from a guarantee as a result of the application of section 4015(a) of the CARES Act;</text></subparagraph><subparagraph id="HCC8F2435F6964E42BBA47853165BA35C"><enum>(D)</enum><text>a qualifying community bank that is subject to interim rule issued under section 4012(b)(1) of the CARES Act; and</text></subparagraph><subparagraph id="H1FCCF0E716464889AB4F02BC531D73E9"><enum>(E)</enum><text>an insured depository institution, bank holding company, or any affiliate thereof that does not comply with the current expected credit losses methodology for estimating allowances for credit losses described in section 4014(b) of the CARES Act.</text></subparagraph></paragraph><paragraph id="H02E77719CE024A71A2807C8C170393BF"><enum>(3)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period beginning on the date of enactment of this Act and ending on the date that is 2 years after—</text><subparagraph id="HFC779DFC5BAA401E9B378848A7B98190"><enum>(A)</enum><text>with respect to a covered entity described in subparagraph (A) of paragraph (2), the date on which the program described in that subparagraph terminates;</text></subparagraph><subparagraph id="HF01CD6D654AF4E7BA7E454A6FFCD2352"><enum>(B)</enum><text>with respect to a covered entity described in subparagraph (B) of paragraph (2), the date on which the period described in section 4011(b) of the CARES Act expires;</text></subparagraph><subparagraph id="H86C8F9645E6241B5973485AA9BBD90CB"><enum>(C)</enum><text>with respect to a covered entity described in subparagraph (C) of paragraph (2), the date on which the guarantee described in that subparagraph terminates;</text></subparagraph><subparagraph id="HE2E25F99952247CFA3C18870B25BC10F"><enum>(D)</enum><text>with respect to a covered entity described in subparagraph (D) of paragraph (2), the date on which the period described in section 4012(b)(2) of the CARES Act expires; and</text></subparagraph><subparagraph id="HCF4E9091081144C7AFCE5FE05C7CE8B3"><enum>(E)</enum><text>with respect to a covered entity described in subparagraph (E) of paragraph (2), the date on which the period described in section 4014(b) of the CARES Act expires.</text></subparagraph></paragraph></subsection><subsection id="HCD08FCB580BF4C9B86925CB798A087D1"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">From the date of enactment of this law no covered entity, or subsidiary or affiliate of a covered entity, may take a new equity stake or otherwise own or operate, or sponsor or retain an ownership interest in any fund that takes any new ownership stake in, any business for which 15 percent or more of the revenue is derived from the extraction, transport, storage, export, and refining of oil, natural gas, and coal during the covered period.</text></subsection></section><section id="HF926520C39104E3697DE3C4C7687A6DC"><enum>4.</enum><header>Moratorium on oil and natural gas lease sales, noncompetitive leases for oil or natural gas, the issuance of coal leases, and modifications to certain regulations</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, during the period beginning on the date of enactment of this Act and ending on the termination date of the national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the Coronavirus Disease 2019 (COVID–19), the Secretary of the Interior shall not—</text><paragraph id="H7021F9776FBB43AAB0E139B1CEEC25FE"><enum>(1)</enum><text display-inline="yes-display-inline">conduct any lease sales for oil or natural gas;</text></paragraph><paragraph id="HAAC53224FECD43DC9B82CC0010BDAD34"><enum>(2)</enum><text>issue any noncompetitive leases for oil or natural gas;</text></paragraph><paragraph id="HF72086EECB22449F9042CC5F11F96A27"><enum>(3)</enum><text>issue any coal leases; or</text></paragraph><paragraph id="H8FB1DAD6B62F47CF85121FDE2D8001A5"><enum>(4)</enum><text display-inline="yes-display-inline">modify any regulations relating to oil, natural, gas, or coal.</text></paragraph></section><section id="HD302641FC6814A608A1D5BAD3CBD6478" commented="no"><enum>5.</enum><header>Strategic Petroleum Reserve</header><subsection id="H7EDDC363941441B0BC9DC5501EE59375"><enum>(a)</enum><header>Maximum storage capacity</header><paragraph id="HD761D43C463240BCAB79EF6DB0CF4CCD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 154(a) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6234">42 U.S.C. 6234(a)</external-xref>) is amended by striking <quote>1 billion barrels</quote> and inserting <quote>713,500,000 barrels</quote>.</text></paragraph><paragraph id="HA8C251D6244C45D899F84E3A178CEDAA"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="HED8431F0666C486982C89F249CF33DD2"><enum>(A)</enum><text>Section 301(e) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/6240">42 U.S.C. 6240</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>) is amended by striking paragraph (1).</text></subparagraph><subparagraph id="H76081D8851D547F8B146FE3E8D723F7F"><enum>(B)</enum><text>Section 159 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6239">42 U.S.C. 6239</external-xref>) is amended by striking subsection (j).</text></subparagraph></paragraph></subsection><subsection id="HDE6A36572DCA460081C2052E744F74AC"><enum>(b)</enum><header>Development, operation, and maintenance of Reserve</header><text>Section 159 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6239">42 U.S.C. 6239</external-xref>) (as amended by subsection (a)(2)(B)) is amended—</text><paragraph id="H0BF23D18754D4538B2EA29F59941C8BD"><enum>(1)</enum><text>by redesignating subsections (f), (g), (k), and (l) as subsections (a), (b), (c), and (d), respectively; and</text></paragraph><paragraph id="H4B4748C5FB054EDFAB161BAF46E936A6"><enum>(2)</enum><text>by inserting after subsection (d) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H523EF7E8AFB7462FA0C2CA18E1CAE2FD"><subsection id="H3B51738828C2413AB70EE76A8FC22DAD"><enum>(e)</enum><header>Prohibition of storage of petroleum products not owned by the United States</header><text>The Secretary may not store in a storage or related facility of the Strategic Petroleum Reserve owned by or leased to the United States any petroleum products that are not owned by the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF2172EB7E17F47109688DB7E07E8B5A0"><enum>(c)</enum><header>Repeal of royalty-in-Kind provision</header><text>Title I of The Department of the Interior, Environment, and Related Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/54">Public Law 109–54</external-xref>; 119 Stat. 512), is amended in the matter under the heading <quote><header-in-text style="OLC" level="appropriations-small">Royalty and offshore minerals management</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">Minerals Management Service</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-major">Department of the Interior</header-in-text></quote> by striking the fifth proviso (<external-xref legal-doc="usc" parsable-cite="usc/30/1758">30 U.S.C. 1758</external-xref>).</text></subsection></section><section id="H192065EB5D2A46D39F0E3AA83D34288E" commented="no"><enum>6.</enum><header>Limitation on availability of funds under the Defense Production Act of 1950</header><text display-inline="no-display-inline">A fossil fuel company shall not be eligible for financial assistance made available in connection with the national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the Coronavirus Disease 2019 (COVID–19) under title III of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4531">50 U.S.C. 4531</external-xref> et seq.), including through a loan guarantee, loan, direct investment, or price guarantee under that title.</text></section><section id="H270B8CB2446E4A20ABF0C937B8870EB7" commented="no"><enum>7.</enum><header>Repeal of royalty relief provisions</header><subsection id="H8EB88952D7E94933A6D61D1D9DE62CC8" commented="no"><enum>(a)</enum><header>Royalty relief under the Mineral Leasing Act</header><paragraph id="H335D38AEA0B642CE8B53BB2F2787AADC" commented="no"><enum>(1)</enum><header>Repeal</header><text>Section 39 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/209">30 U.S.C. 209</external-xref>) is repealed.</text></paragraph><paragraph id="H5BC6378735964C90B645290274E0244D" commented="no"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="H8114F90E3AC94C8CB9F0CA700BB82768" commented="no"><enum>(A)</enum><text>Section 8721(b) of title 10, United States Code, is amended by striking <quote>202–209</quote> and inserting <quote>202–208</quote>.</text></subparagraph><subparagraph id="H0F347414AFA44EAEA67C729C8083D67E" commented="no"><enum>(B)</enum><text>Section 8735(a) of title 10, United States Code, is amended by striking <quote>202–209</quote> and inserting <quote>202–208</quote>.</text></subparagraph><subparagraph id="H5016FFDC6AEB401B9FD7CA5044BCD6E5" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>Section 31(h) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/188">30 U.S.C. 188(h)</external-xref>) is amended by striking <quote>and the provisions of section 39 of this Act</quote>.</text></subparagraph></paragraph></subsection><subsection id="H92A4136B21A949328EB449E0793480ED" commented="no"><enum>(b)</enum><header>Royalty relief for deepwater production</header><text>Section 345 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15905">42 U.S.C. 15905</external-xref>) is repealed.</text></subsection></section><section id="H93DA5F6048B74998A5B8FDA5253E8218"><enum>8.</enum><header>Limitation on the authority of the Secretary to reduce or eliminate certain royalties and net profit shares under the outer Continental Shelf Lands Act</header><text display-inline="no-display-inline">Section 8(a) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(a)</external-xref>) is amended by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7E7CCF674BA6428F864FF34117F07DD2"><paragraph id="H67FADC362C1646288856AEAA8F2B6429"><enum>(3)</enum><header>Limitation on authority of Secretary to reduce or eliminate certain royalties or net profit shares</header><text>Notwithstanding any other provision of this Act, the Secretary may not reduce or eliminate any royalty or net profit share established under a lease.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF8D382BDDE734FF5B1D8E4553FBBD9AA"><enum>9.</enum><header>Extension of public comment periods and suspension of rulemaking</header><subsection id="H4BEC9F07BEF64E65A9712CE449FFB51A"><enum>(a)</enum><header>Extension of public comment periods</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the heads of Federal agencies shall keep open any public comment period that was open as of March 13, 2020, during the period beginning on the date of enactment of this Act and ending on a date, as designated by the head of the applicable Federal agency, that is not earlier than 30 days after the date on which the National Emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the Coronavirus Disease 2019 (COVID–19) is terminated.</text></subsection><subsection id="HE63720CC48354768912E3D7ADA7FD376"><enum>(b)</enum><header>Suspension of rulemaking</header><text display-inline="yes-display-inline">Not­with­stand­ing any other provision of law, unless the head of a Federal agency determines that a rulemaking is specifically required to respond to, or recover from, the Coronavirus Disease 2019 (COVID–19) pandemic, the head of a Federal agency shall not initiate any new administrative rulemaking during the period beginning on the date of enactment of this Act and ending on a date, as designated by the head of the applicable Federal agency, that is not earlier than the date 30 days after the date on which the National Emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the Coronavirus Disease 2019 (COVID–19) is terminated.</text></subsection></section></legis-body></bill>
