which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a moratorium on collection efforts made by certain lenders against borrowers affected by coronavirus.</official-title></form><legis-body id="HDB650C51DA874ED1BF8186BF73B496DA" style="OLC"><section id="HA6A9EA4336934F84B24C240F67C30B72" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Payday and Predatory Loans Moratorium Act of 2020</short-title></quote>.</text></section><section id="HD2DA50D2CFC742AB8F11341CF2575A0B" section-type="subsequent-section"><enum>2.</enum><header>Moratorium on collection efforts for certain borrowers affected by coronavirus</header><subsection id="H59634090D5CE44DA8F1C25D7A2D8DD63"><enum>(a)</enum><header>Moratorium</header><text display-inline="yes-display-inline">During the one-year period beginning on the date on which a borrower notifies a covered lender of the borrower being affected by coronavirus, the covered lender may not carry out any collection efforts against the borrower with respect to a loan described in subsection (b).</text></subsection><subsection id="H7EF76A482A0541C09FA0A87325B0C9E2"><enum>(b)</enum><header>Loan described</header><text>A loan described in this subsection is any of the following loans:</text><paragraph id="H67DC4448AB7B4B8D94B41577F3507414"><enum>(1)</enum><text display-inline="yes-display-inline">A loan with nominal interest rates of 36 percent or more.</text></paragraph><paragraph id="H241EE72CD8CF4F16A91A8656CAA58AAD"><enum>(2)</enum><text display-inline="yes-display-inline">A loan by a covered lender described in subsection (c)(3)(B) that does not, or did not at the time of issuing the loan, determine whether the borrower can afford, while still meeting the basic living expenses and major financial obligations of the borrower—</text><subparagraph id="HE7269BE5927E4524863F5E1EA8EB3557"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to payday and auto title loans that are due in one lump sum within one month of the date of such issuance, the full payment of the total loan amount, plus fees and finance charges; or</text></subparagraph><subparagraph id="H07E8DF201834432299C63579F6CB8537"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to longer-term loans with a balloon payment, the payments for the month with the highest total payments on the loan.</text></subparagraph></paragraph></subsection><subsection id="HC1605C50F241467A85B148E69FB86A99"><enum>(c)</enum><header>Definitions</header><paragraph id="HFC5352FE13D3451D9C6259E951A6F9C8"><enum>(1)</enum><header>Affected by coronavirus</header><text display-inline="yes-display-inline">The term <term>affected by coronavirus</term> means, with respect to a borrower, any of the following circumstances:</text><subparagraph id="H1AB7F7EBB4E74787B7D33B9A9CC5AF68"><enum>(A)</enum><text display-inline="yes-display-inline">The household income of the borrower is reduced by reason of coronavirus disease 2019 (COVID–19).</text></subparagraph><subparagraph id="HE7D29DD4FEFE47E2A7B3515A1975606A"><enum>(B)</enum><text display-inline="yes-display-inline">The borrower becomes unemployed by reason of such disease.</text></subparagraph><subparagraph id="HF9E0F23B0E884B85B67F11F13F1BA55E"><enum>(C)</enum><text display-inline="yes-display-inline">The borrower, or a member of the household of the borrower, is hospitalized by reason of such disease.</text></subparagraph><subparagraph id="H61A3C40A0AE74E508E46D6F80D4A5DFB"><enum>(D)</enum><text display-inline="yes-display-inline">The borrower resides or is employed in an area covered by an emergency declared by the Federal Government or a State or local government as a result of such disease.</text></subparagraph></paragraph><paragraph id="H83DCCD83947D4D42B7BD7F2A01178715"><enum>(2)</enum><header>Collection efforts</header><text display-inline="yes-display-inline">The term <term>collection efforts</term> means any of the following actions, or attempted actions, made by a covered lender (or a collection agency acting on behalf of the covered lender) in order to collect amounts owed to the lender by a borrower:</text><subparagraph id="H3AA192AD7BDD4E2B996999BEDA22599B"><enum>(A)</enum><text display-inline="yes-display-inline">Contacting the borrower by telephone, including by text message.</text></subparagraph><subparagraph id="HAF1F101C06B44B779F7F0FA8443BE0D6"><enum>(B)</enum><text display-inline="yes-display-inline">Contacting the employer of the borrower.</text></subparagraph><subparagraph id="H4ADE873153564483BE24014F849BFB7B"><enum>(C)</enum><text display-inline="yes-display-inline">Cashing post-dated checks of the borrower or making a direct withdrawal from a bank account of the borrower.</text></subparagraph><subparagraph id="H1D668B582E904A71A14CEC8B1B6909E9"><enum>(D)</enum><text>Entering into an agreement with a collections agency to collect such amounts.</text></subparagraph><subparagraph id="H70483816A1C349A4BE36F2E0718D0D01"><enum>(E)</enum><text>Reporting to a credit reporting agency any missed payments related to such amounts.</text></subparagraph><subparagraph id="H5B8491F4423B48DAB0928B68DDF23C42"><enum>(F)</enum><text>Any other effort not described in subparagraphs (A) through (E) to enforce the collection of the amounts or the making of payments related to such amounts.</text></subparagraph></paragraph><paragraph id="H3E619D24279C49CC913390049AD6567B"><enum>(3)</enum><header>Covered lender</header><text>The term <term>covered lender</term> means any of the following:</text><subparagraph id="HE13BA3FEE6C14D1EBABF57E329BBC370"><enum>(A)</enum><text>A payday lender.</text></subparagraph><subparagraph id="H546908B14B8842F4A7BD8F136E72AC01"><enum>(B)</enum><text display-inline="yes-display-inline">A lender who is not a depository institution (as defined under section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)) or a Federal or State credit union (as such terms are defined under section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>)).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
