R. 6374</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200323">March 23, 2020</action-date><action-desc><sponsor name-id="V000081">Ms. Velázquez</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To suspend requirements that tenants of assisted housing make contributions toward rent during the public health emergency relating to coronavirus, and for other purposes.</official-title></form><legis-body id="H5D86211558254C1A8BAF93B8931A3867" style="OLC"><section id="H425374E168454727BE95ED0453316B81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Affordable Housing Security During the Coronavirus Emergency Act of 2020</short-title></quote>.</text></section><section id="H1F7A70EBF0494449BFC61EC6AE990045" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Suspension of requirements regarding tenant contribution toward rent</header><subsection id="HBB969D5567A7470C90C008C0A8DF5465"><enum>(a)</enum><header>Suspension</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the obligation of each tenant household of a dwelling unit in assisted housing to pay any contribution toward rent for occupancy in such dwelling unit shall be suspended with respect to such occupancy during the period beginning on the date of the enactment of this Act and ending 6 months after the date of the termination by the Federal Emergency Management Agency of the emergency declared on March 13, 2020, by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref> et seq.) relating to the Coronavirus Disease 2019 (COVID-19) pandemic.</text></subsection><subsection id="HD12A9421F8744CD7A773274CB4F83A43"><enum>(b)</enum><header>Federal reimbursement payments</header><text display-inline="yes-display-inline">To the extent that amounts are made available pursuant to subsection (e) for reimbursements under this subsection, the Secretary of Housing and Urban Development or the Secretary of Agriculture, as appropriate, shall—</text><paragraph id="HBA23E74B33714FCC8F13B435952BBC67"><enum>(1)</enum><text>provide owners of assisted housing and public housing agencies for any amounts in rent not received as a result of subsection (a), plus the amount of any increases in costs of administering and maintaining such housing to the extent only that such increases result from the public health emergency relating to Coronavirus Disease 2019 (COVID-19); and</text></paragraph><paragraph id="HB1638A0F745A41E499CD74056FF354BA"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of public housing agencies providing assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>), reimburse such agencies in an amount sufficient to cover any increase in housing assistance payments resulting from the suspension of tenant rent payments pursuant to subsection (a), plus the amount of any increases in the cost of administering such assistance to the extent only that such increases result from the public health emergency relating to Coronavirus Disease 2019 (COVID-19).</text></paragraph></subsection><subsection id="H2F12D890194C44A3A19B02F4A56FB2D2"><enum>(c)</enum><header>Prohibitions</header><paragraph id="H06BAAEF3820F46A3910A03D2329FF9B6"><enum>(1)</enum><header>On fines</header><text display-inline="yes-display-inline">No tenant or tenant household may be charged a fine or fee for nonpayment of rent in accordance with subsection (a) and such nonpayment of rent shall not be grounds for any termination of tenancy or eviction.</text></paragraph><paragraph id="H22A6839F1BF442018CF15C9F538C2922"><enum>(2)</enum><header>On debt</header><text display-inline="yes-display-inline">No tenant or tenant household may be treated as accruing any debt by reason of suspension of contribution of rent under subsection (a).</text></paragraph><paragraph id="H531B37945AD1416BAF20DE769B13B1EA"><enum>(3)</enum><header>On repayment</header><text>No tenant or tenant household may be held liable for repayment of any amount of rent contribution suspended under subsection (a).</text></paragraph><paragraph id="HE36B352A77114BF1A56006622880D7B6"><enum>(4)</enum><header>On credit scores</header><text display-inline="yes-display-inline">The nonpayment of rent by a tenant or tenant household shall not be reported to a consumer reporting agency nor shall such nonpayment adversely affect a tenant or member of a tenant household’s credit score.</text></paragraph></subsection><subsection id="HAF78CD2DE4CA48E39B66685BACC53A0E"><enum>(d)</enum><header>Assisted housing</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>assisted housing</quote> means housing or a dwelling unit assisted under—</text><paragraph id="HDDFF4EB630034FA5B3B22E6D60F6C152"><enum>(1)</enum><text>section 213, 220, 221(d)(3), 221(d)(4), 223(e), 231, or 236 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715l">12 U.S.C. 1715l(d)(3)</external-xref>, (d)(4), or 1715z–1);</text></paragraph><paragraph id="H7FA3F9A4B130486F86D9AFFD9DA297A0"><enum>(2)</enum><text>section 101 of the Housing and Urban Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701s">12 U.S.C. 1701s</external-xref>);</text></paragraph><paragraph id="H0F8DCBA2AEFE45C487998159524AF3E3"><enum>(3)</enum><text>section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>);</text></paragraph><paragraph id="H6C9011198E314B66A3962E403147B7E1"><enum>(4)</enum><text>section 811 of the Cranston-Gonzales National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>);</text></paragraph><paragraph id="H84C88CC00F354B30A91FE72AEDC37A01"><enum>(5)</enum><text>title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12701">42 U.S.C. 12701</external-xref> et seq.);</text></paragraph><paragraph id="HC98FDDEBED974A96AFC58D2B5FFAC6C3"><enum>(6)</enum><text>subtitle D of title VIII of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12901">42 U.S.C. 12901</external-xref> et seq.);</text></paragraph><paragraph id="HF6A798FD9F434569ADA195CBF89CB9C6"><enum>(7)</enum><text>title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.);</text></paragraph><paragraph id="HF306453C77A44E7B9F79B2AF667E3460"><enum>(8)</enum><text>section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>);</text></paragraph><paragraph id="H6D06DECA4A3045478EAD1D92B51BD9F3"><enum>(9)</enum><text>the public housing program under title I of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437</external-xref> et seq.); or</text></paragraph><paragraph id="H95400C9059F94CE594A7840651952B7A"><enum>(10)</enum><text display-inline="yes-display-inline">section 514, 515, 516, 521(a)(2), 538, or 542 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1484">42 U.S.C. 1484</external-xref>, 1485, 1486, 1490a(a)(2), 1490p–2, 1490r).</text></paragraph></subsection><subsection id="H35B09D69B3FA424890761DEF71B8B9C1"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to make payments under subsection (b) to all owners of assisted housing and public housing agencies.</text></subsection></section></legis-body></bill>
