which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the rapid coverage of preventive services and vaccines for COVID-19.</official-title></form><legis-body id="H9033931B702D44CFA9E33A40DA718688" style="OLC"><section id="H3B07F3B358844DB1ACAAFDF1465E71A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rapid Coverage of COVID-19 Vaccine Act of 2020</short-title></quote>.</text></section><section id="H52874B23955148F4A91877F2A7B181B2" section-type="subsequent-section"><enum>2.</enum><header>Rapid coverage of preventive services and vaccines for COVID-19</header><subsection id="H8CF45F8547EE4C45A89B54B071BE4CB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a qualifying COVID-19 preventive service, notwithstanding section 2713(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-13">42 U.S.C. 300gg–13(b)</external-xref>) (including the regulations under section 2590.715–2713 of title 29, Code of Federal Regulations, section 54.9815–2713 of title 26, Code of Federal Regulations, and section 147.130 of title 45, Code of Federal Regulations), the Secretary of Health and Human Services, Secretary of Labor, and Secretary of the Treasury shall apply to group health plans and health insurance issuers offering group or individual health insurance coverage the requirement under section 2713(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-13">42 U.S.C. 300gg–13(a)</external-xref>), with respect to such services, as if such section 2713(a)—</text><paragraph id="H8F1B487A786B460B8D7D638839C95041"><enum>(1)</enum><text>required the coverage of such service under such plans and such coverage be effective not later than the specified date (as defined in subsection (b)(2)) with respect to such service; and</text></paragraph><paragraph id="H21ADFD6A45EA4EC78DDB5B6086B75D0B"><enum>(2)</enum><text>applied to grandfathered health plans (as defined in section 1251(e) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18011">42 U.S.C. 18011(e)</external-xref>)).</text></paragraph></subsection><subsection id="H6101DB14E02449EDA3E20C27D76BB813"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text><paragraph id="H84C1ED8DE1524C1CAD1F5C9CB453E878"><enum>(1)</enum><header>Qualifying COVID-19 preventive service</header><text display-inline="yes-display-inline">The term <quote>qualifying COVID-19 preventive service</quote> means an item, service, or immunization that is intended to prevent or mitigate COVID-19 and that is—</text><subparagraph id="H25B3EC2B3700439C8DEBF295D5712D3A"><enum>(A)</enum><text>an evidence-based item or service that has in effect a rating of <quote>A</quote> or <quote>B</quote> in the current recommendations of the United States Preventive Services Task Force; or</text></subparagraph><subparagraph id="HAD16E76CBBAC4DA68D6D9C9B78E156BB"><enum>(B)</enum><text>an immunization that has in effect a recommendation from the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention with respect to the individual involved.</text></subparagraph></paragraph><paragraph id="HE3355DCF8A97464BA206A8B216B0F75B"><enum>(2)</enum><header>Specified date</header><text display-inline="yes-display-inline">The term <quote>specified date</quote> means— </text><subparagraph id="HAF51323254E247E695D26918E34F382E"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to a qualifying COVID-19 preventive service described in paragraph (1)(A), the date that is 15 business days after the date on which a rating, as described in such paragraph, is made with respect to such service; and</text></subparagraph><subparagraph id="HCEF8ECE0B83B4AB481C5BC1406F32209"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a qualifying COVID-19 preventive service described in paragraph (1)(B), the date that is 15 business days after the date on which a recommendation, as described in such paragraph, is made relating to the service.</text></subparagraph></paragraph><paragraph id="H0E5C62F93482418DBFCE36D5EBC6B8DB"><enum>(3)</enum><header>Additional terms</header><text display-inline="yes-display-inline">The terms <quote>group health plan</quote>; <quote>health insurance issuer</quote>; <quote>group health insurance coverage</quote>, and <quote>individual health insurance coverage</quote> have the meanings given such terms in section 2791 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91</external-xref>), section 733 of the Employee Retirement Income Security Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191b">29 U.S.C. 1191b</external-xref>), and <external-xref legal-doc="usc" parsable-cite="usc/26/9832">section 9832</external-xref> of the Internal Revenue Code of 1986, as applicable.</text></paragraph></subsection><subsection id="HB8601A5775A842FB93E566C582DA8947"><enum>(c)</enum><header>Implementation</header><text>The Secretary of Health and Human Services, Secretary of Labor, and Secretary of the Treasury may implement the provisions of this section through program instruction, subregulatory guidance, or otherwise.</text></subsection></section></legis-body></bill>
