Horn of Oklahoma</cosponsor>, and <cosponsor name-id="T000484">Ms. Torres Small of New Mexico</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide emergency paid leave benefits to certain individuals affected by COVID-19, and for other purposes.</official-title></form><legis-body id="HF0D667AF9D904846BBD5518A5850908A" style="OLC"><section id="H0DA74CB215A3485A9BB910A870A88937" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Paid Leave Act of 2020</short-title></quote>.</text></section><section id="H61BA9DBA63854E21A48BFFD9000F03EE"><enum>2.</enum><header>Emergency paid leave benefits</header><text display-inline="no-display-inline">The Social Security Act is amended by inserting after title V the following:</text><quoted-block style="OLC" id="H940C7A70FDF645BCBDB97F812254DE10" display-inline="no-display-inline"><title id="HA54ED5DE23844E7589863C3CD8C8918A"><enum>VI</enum><header>Emergency Paid Leave Benefits</header><section id="HB66AC0AD1FDC4EEEBD83ED4FB28E73A1"><enum>601.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions apply:</text><paragraph id="HDBAF729EAC954C158733E35F9CA91094"><enum>(1)</enum><header>Emergency leave day</header><subparagraph id="H8FBD53065D4B4BCF87B51A959F16EBB8"><enum>(A)</enum><header>In general</header><text>The term <term>emergency leave day</term> means, with respect to an individual, a calendar day in which the individual is not able to engage in employment due to any of the following reasons:</text><clause id="H234DC4F024354AAA9E417DD22D795C51"><enum>(i)</enum><text>The individual has a current diagnosis of COVID-19.</text></clause><clause id="H247D719576D546FFA29F9E0B60AF03CD"><enum>(ii)</enum><text>The individual is under quarantine (including self-imposed quarantine), at the instruction of a health care provider, employer, or a local, State, or Federal official, in order to prevent the spread of COVID-19.</text></clause><clause id="H58F6555C2BF24BB98887CD5D6C06CE5C"><enum>(iii)</enum><text display-inline="yes-display-inline">The individual is engaged in caregiving for an individual who has a current diagnosis of COVID-19 or is under quarantine as described in clause (ii).</text></clause><clause id="H5EFC9A22DDAB436B9EA3E471D9686683"><enum>(iv)</enum><text display-inline="yes-display-inline">The individual is engaged in caregiving, because of the COVID-19-related closing of a school or other care facility or care program, for a child or other individual unable to provide self-care.</text></clause></subparagraph><subparagraph id="H53AF2FFF5A754AA99AC51F0A0BF67A76" commented="no"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">No calendar day may be treated as an emergency leave day with respect to an individual if the individual—</text><clause id="H34FAC7CBEC85469BAD19F898455E8F28"><enum>(i)</enum><text>received any form of compensation from an employer (other than State or private paid leave), including wages or any form of accrued paid leave, for such day; or</text></clause><clause id="HF73E69DDF34A41FDA8CE0F3AC93CCF86"><enum>(ii)</enum><text>was eligible for unemployment compensation for the week in which such day occurs.</text></clause></subparagraph></paragraph><paragraph id="HA782986004064A8291388D6658F799E5"><enum>(2)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of Social Security.</text></paragraph><paragraph id="HC29A942068D4482C8F3E8AA0D927F2BC"><enum>(3)</enum><header>Eligible individual</header><text display-inline="yes-display-inline">The term <term>eligible individual</term> means an individual who had wages or self-employment income during the 30-day period ending on the first emergency leave day with respect to such individual.</text></paragraph><paragraph id="HD7F837733CB44D4C94EDE96BF41D99DA"><enum>(4)</enum><header>Self-employment income</header><text>The term <term>self-employment income</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/1402">section 1402(b)</external-xref> of the Internal Revenue Code of 1986 for purposes of the taxes imposed by section 1401(b) of such Code.</text></paragraph><paragraph id="HB506F606F7DA48F894ABDBACA2F4E3A9"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means any State of the United States or the District of Columbia or any territory or possession of the United States.</text></paragraph><paragraph id="H558AE703CCAE4570A652610BB9B5DBD9"><enum>(6)</enum><header>State or private paid leave</header><text>The term <term>State or private paid leave</term> means a benefit which provides full or partial wage replacement to employees on the basis of specifically defined qualifying events described in section 102 of the Family and Medical Leave Act of 1993 or defined by a written employer policy or State law and which ends either when the qualifying event is no longer applicable or a set period of benefits is exhausted.</text></paragraph><paragraph id="H8A098B78718A4FB7B512FBB9AC5E43B9"><enum>(7)</enum><header>Unemployment compensation</header><text>The term <term>unemployment compensation</term> means—</text><subparagraph id="HC3B7E412DD3743228B6F134401E3C10C" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline"><term>regular compensation</term>, <term>extended compensation</term>, and <term>additional compensation</term> (as such terms are defined by section 205 of the Federal-State Extended Unemployment Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note)); and</text></subparagraph><subparagraph id="H0245762B70514C8FA5712493DF9A4628" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">assistance under section 410 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5177">42 U.S.C. 5177</external-xref>).</text></subparagraph></paragraph><paragraph id="HBC938ED6D6D94C79BCE033EF4D5BBED5" commented="no"><enum>(8)</enum><header>Wages</header><text display-inline="yes-display-inline">The term <term>wages</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/3121">section 3121(a)</external-xref> of the Internal Revenue Code of 1986 for purposes of the taxes imposed by sections 3101(b) and 3111(b) of such Code.</text></paragraph></section><section id="H524CF06327F14C23B143112165A8CFC7"><enum>602.</enum><header>Emergency paid leave benefits</header><subsection id="H5651D1A6CF55458CAFF6DA4EA04EE416"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner shall pay an emergency paid leave benefit, to be paid electronically or, if necessary, by mail, to each eligible individual for each 30-day period beginning and ending in the benefit period (not to exceed 3) for which the eligible individual has filed an application containing such certifications as required under subsection (e).</text></subsection><subsection id="H20188E026C3848008A21EBEDFC2BEDA1" commented="no"><enum>(b)</enum><header>Benefit amount</header><paragraph id="HC8E47396816E4C2ABE373F4E6F83E186" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the amount of the emergency paid leave benefit to which an individual is entitled under subsection (a) for a 30-day period shall be an amount (not to exceed $4,000) equal to <fraction>2/3</fraction> of the individual’s average monthly earnings.</text></paragraph><paragraph id="H91FC71FB483C478BA224188911800934"><enum>(2)</enum><header>Reduction based on receipt of State or private paid leave</header><text display-inline="yes-display-inline">The amount of an emergency paid leave benefit to which an individual is entitled under subsection (a) for a 30-day period shall be reduced by $1 for each dollar of State or private paid leave received by the individual for such period.</text></paragraph><paragraph id="H2BF4A887DD244819B7297AEAD1518454"><enum>(3)</enum><header>Average monthly earnings</header><text display-inline="yes-display-inline">For purposes of this subsection, an individual’s average monthly earnings shall be equal to the quotient obtained by dividing—</text><subparagraph id="HB726B5E7D2AC4B259521BD5E48584538"><enum>(A)</enum><text display-inline="yes-display-inline">the total of the wages and self-employment income received by the individual during the most recent calendar year preceding an application for an emergency paid leave benefit under this section for which data is available to the Commissioner; by</text></subparagraph><subparagraph id="HCA28443A3F0D43DAB3BEF41250C917AE"><enum>(B)</enum><text>12.</text></subparagraph></paragraph></subsection><subsection id="HF9DB10FDCA444B4BA46A9AAE80FB5541"><enum>(c)</enum><header>Benefit period</header><text display-inline="yes-display-inline">For purposes of this section, the benefit period begins on January 19, 2020, and ends on the date that is 1 year after the date of enactment of this title.</text></subsection><subsection id="HFC9E0F07FCDF4F5DB826444FCA6A0E61"><enum>(d)</enum><header>Retroactive benefits</header><text>An application for benefits for any month beginning and ending in the benefit period may be filed at any time prior to the date that is 180 days after the end of such benefit period.</text></subsection><subsection id="HACA152D446C343A89A34659BEE37C197"><enum>(e)</enum><header>Application</header><paragraph id="HFD10711196BB41A4B29BE719DE1DBA62"><enum>(1)</enum><header>In general</header><text>An application for an emergency paid leave benefit under this section for a 30-day period shall include—</text><subparagraph id="HC79DC506C7B24FCE9A64A79D99397CAB"><enum>(A)</enum><text>an attestation by the individual—</text><clause id="H0BDB135D476042B99B7573D7ACFAB641"><enum>(i)</enum><text>that he or she is an eligible individual;</text></clause><clause id="HE560F186EC8947649A8387F59FEC767D"><enum>(ii)</enum><text>that at least 14 emergency leave days with respect to the individual occurred, or are expected to occur, during such period; and</text></clause><clause id="H9A716AD92ECF49E9AFFC23D324B5A8E3" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">that the individual has informed his or her employer of the individual’s need to take emergency leave, if the individual has an employer.</text></clause></subparagraph></paragraph><paragraph id="H3853C3E5094A4515B3E36764AA5AABCF"><enum>(2)</enum><header>Availability</header><text>The Commissioner shall accept applications online, by telephone, and by mail.</text></paragraph><paragraph id="H2E9E420CB2804104BFD8F7F607DBEF1B"><enum>(3)</enum><header>Authentication of identity</header><text>The Commissioner is authorized to take such steps as are necessary to authenticate the identity of applicants.</text></paragraph><paragraph id="H99D3AA6669094F2C9667F3FCAD1A98B8"><enum>(4)</enum><header>Penalties for fraud</header><text>Any fraud or misrepresentation relating to an application for benefits under this title shall be treated as a violation of section 208.</text></paragraph></subsection><subsection id="H0D768FB43B8A4A46B671A3E0E28C9DC6" display-inline="no-display-inline"><enum>(f)</enum><header>Ineligibility based on fraud and criminal activity</header><paragraph id="H17DE339706B54A35A00397A02C6A458A" commented="no"><enum>(1)</enum><header>Ineligibility following certain convictions</header><text display-inline="yes-display-inline">An individual who has been convicted of a violation under section 208 or who has been found to have used false statements to secure benefits under this section shall be ineligible for benefits under this section.</text></paragraph><paragraph id="H54D5615685FB4E7EA64E242617B14693" commented="no"><enum>(2)</enum><header>Ineligibility of prisoners</header><text>An individual shall be ineligible for a benefit under this section for any 30-day period with respect to which the individual is an individual described in clause (i), (ii), or (iii) of section 202(x)(1)(A).</text></paragraph></subsection><subsection id="H3AB60C61158344958EF40ED8A249B8F5" commented="no"><enum>(g)</enum><header>Review of eligibility and benefit payment determinations</header><paragraph id="H5D545AE3644647A2B7C1090DFD9417DE" commented="no"><enum>(1)</enum><header>Burden of proof</header><text display-inline="yes-display-inline">An application for benefits under this section shall be presumed to be true and accurate, unless the Commissioner demonstrates by a preponderance of the evidence that information contained in the application is false.</text></paragraph><paragraph id="H0537B36664C94C369341129FBCBD07E3"><enum>(2)</enum><header>Review</header><subparagraph id="H25C96CAD9EA94F2CBD94437F90020AD6"><enum>(A)</enum><header>In general</header><text>An individual may request review of an adverse determination with respect to such application or of a benefit payment determination and shall have the same appeals rights as provided under title II.</text></subparagraph><subparagraph id="HE795892F26E64DBA8A5D5120969FDA1F"><enum>(B)</enum><header>Final determinations</header><text>All final determinations of the Commissioner under this subsection shall be reviewable according to the procedures set out in section 205.</text></subparagraph></paragraph><paragraph id="HEC7C60959FC3489EA9C9DDB2DB22A4B3"><enum>(3)</enum><header>Program integrity</header><text display-inline="yes-display-inline">The Commissioner shall have the authority to conduct random sample audits of benefits provided under this title to ensure compliance with the eligibility requirements for such benefits. </text></paragraph></subsection><subsection id="HE62AA9EF239D4B5094196D6852D066AC" commented="no"><enum>(h)</enum><header>Protection of existing benefit rights</header><paragraph id="H3F92D7AECCEA47519FD1F5E6D775E50B" commented="no"><enum>(1)</enum><header>In general</header><text>This title does not preempt or supercede any provision of State or local law that authorizes a State or local municipality to provide paid leave benefits similar to the benefits provided under this title.</text></paragraph><paragraph id="HEA0A0DC131F24A6789C3DC293D3F7BA4" commented="no"><enum>(2)</enum><header>Greater benefits allowed</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to diminish the obligation of an employer to comply with any contract, collective bargaining agreement, or any employment benefit program or plan that provides greater paid leave or other leave rights to employees than the rights established under this title.</text></paragraph></subsection><subsection id="H089D912AF6C648D493E3D9753DBB4751"><enum>(i)</enum><header>Reimbursement grants to States</header><text display-inline="yes-display-inline">Not later than July 1, 2021, the Secretary of the Treasury, in consultation with the Commissioner of Social Security, shall make a grant to each State in an amount equal to the total amount, for all 30-day periods beginning and ending in the benefit period, by which benefits under this title were reduced under subsection (b)(2) as a result of State and private paid leave paid by such State or under the law of such State.</text></subsection><subsection id="HEB8714419CB64AABB31252F4383B5DB7" commented="no"><enum>(j)</enum><header>Applicability of certain title II provisions</header><text>The provisions of sections 204, 205, 206, and 208 shall apply to benefit payments made under this section in the same way that such provisions apply to benefit payments made under title II.</text></subsection><subsection id="HC2529E7922204E3393919BC2703235AC"><enum>(k)</enum><header>No effect on eligibility for SSI</header><text>Any benefit paid to an individual under this title shall not be regarded as income or resources for any month, for purposes of determining the eligibility of the recipient (or the recipient's spouse or family) for benefits or assistance, or the amount or extent of benefits or assistance, under the Supplemental Security Income program.</text></subsection></section><section id="H1B6BE89681204BC894F11E8BAC63C2F4"><enum>603.</enum><header>Funding and expedited implementation authority</header><subsection id="H570C8F14507B40BFB38ACDF9667EC5F4"><enum>(a)</enum><header>Funding</header><text display-inline="yes-display-inline">There are appropriated such sums as necessary to the Commissioner of Social Security to administer and pay benefits under the program established under this title, and to the Secretary of the Treasury for reimbursement grants under section 602(i).</text></subsection><subsection id="HFE682FB0499B470E9ACCDE9E92373696"><enum>(b)</enum><header>Expedited implementation authority</header><text display-inline="yes-display-inline">In order to expedite the implementation of the emergency paid leave program under this title, the Commissioner is authorized to waive existing Federal requirements regarding paperwork reduction, system of records notices, contracting and acquisitions, and hiring.</text></subsection><subsection id="HA903A819630D4359A32FFF595194DB1D"><enum>(c)</enum><header>Protection of existing employee rights</header><text display-inline="yes-display-inline">This title does not preempt or supersede existing collective bargaining agreements.</text></subsection></section><section id="H992BB03922564691B35FBEC724DB9ACF"><enum>604.</enum><header>Protection of Social Security trust funds</header><text display-inline="no-display-inline">No funds from the Federal Old-Age and Survivors Insurance Trust Fund or the Federal Disability Insurance Trust Fund, or appropriated to the Social Security Administration for the administration of titles II or XVI, may be used for any purpose under this title.</text></section><section id="HACEE1D7988894E0D8B5998A020B7E27F"><enum>605.</enum><header>Taxation of emergency leave benefits</header><text display-inline="no-display-inline">No amount received by an individual under this title shall be included in gross income for purposes of the Internal Revenue Code of 1986.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
