R. 6186</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200310">March 10, 2020</action-date><action-desc><sponsor name-id="W000814">Mr. Weber of Texas</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To facilitate screening and criminal history background checks for individuals seeking access to qualified chemical and refining infrastructure entities, and for other purposes.</official-title></form><legis-body id="H90BEB516BEFD4889A05974DACABD3FFF" style="OLC"><section id="H0B0C859FAF6A4E9FA923996A74DFBEF1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expedient Workforce Screening Act of 2020</short-title></quote>.</text></section><section id="H5263EC0BA0E64133866D5884519C1D90"><enum>2.</enum><header>Purpose; findings</header><subsection id="HA171CF8F55734A2DBB54D83F249D8842"><enum>(a)</enum><header>Purpose</header><text>The purpose of this Act is to facilitate screening for individuals seeking access to qualified chemical and refining infrastructure entities in a manner that promotes public safety while protecting the interests of both individuals and qualified entities.</text></subsection><subsection id="HD5038635F6AA414DAE48BB822582C0B9"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="HBC02CF3189E24EF2B0C6050CE509407B"><enum>(1)</enum><text>Federal Criminal History Record Information (CHRI) is an essential and widely accepted resource for background screening.</text></paragraph><paragraph id="HA95F1F8467A8426697BC8C85A1781453"><enum>(2)</enum><text>The Federal Bureau of Investigation’s (FBI) existing CHRI system, the Interstate Identification Index (III), including the National Fingerprint File (NFF), is a partnership between the States and the FBI. It is the primary means for accessing and communicating CHRI for criminal justice and certain critical noncriminal justice purposes.</text></paragraph><paragraph id="H7DB3E51DB56C4513B44D252A4B6ED2E5"><enum>(3)</enum><text>The existing CHRI system is built on information maintained by the States. CHRI available from the States represents 95 percent of the CHRI available for background check decisions.</text></paragraph><paragraph id="HCCECBC54761A4D058752932E4D4CC1DD"><enum>(4)</enum><text>Today, access to a national criminal history background check through the FBI is dependent on a patchwork of legal authorizations, resulting in ongoing requests for new Federal or State authorizing legislation by private sector entities that do not currently have a means of access.</text></paragraph><paragraph id="H2FDDB786CAD740699942AF1C95648EAD"><enum>(5)</enum><text>An enhanced system for facilitating chemical and refining infrastructure access to CHRI for venue access should rely upon a user-fee-funded mechanism through which qualified chemical and refining infrastructure entities nationwide can obtain fingerprint-based positive identification and national criminal history background checks from the FBI.</text></paragraph><paragraph id="H93FC318501994ED686222CF69522163C"><enum>(6)</enum><text>Qualified chemical and refining infrastructure entities should be free to use either a national criminal history background check through the FBI or a court-sourced history record information through a check using name and other identifiers, fingerprints, or a combination of both.</text></paragraph><paragraph id="H3EF8FE3D63BF4E3B87C85653054BA6A3"><enum>(7)</enum><text>Any national system for qualified chemical and refining infrastructure noncriminal justice background checks must adhere to high standards for privacy and security, including mechanisms for those seeking access to challenge accuracy and completeness of the information reported about them.</text></paragraph><paragraph id="HDC5BF2DC9FBC4BA88FC9ACBD8E61BA7C"><enum>(8)</enum><text display-inline="yes-display-inline">The national criminal history background check system should leverage the most recent technological advances to obtain high speed responses, as well as enhance accuracy and completeness.</text></paragraph><paragraph id="H1A19BE06B09D4EA39CE6DEAE881464D8"><enum>(9)</enum><text display-inline="yes-display-inline">The national criminal history background check system does not alter the Department of Homeland Security’s responsibilities under the Chemical Facility Anti-Terrorism Act and the performance standards for high risk chemical facilities. </text></paragraph></subsection></section><section id="HF76DF01CF095428A802132EB4F96C3EE"><enum>3.</enum><header>National Criminal History Background Check Program</header><subsection id="H2A4C8099A9B04CDA89E6308839948596"><enum>(a)</enum><header>Establishment of the program</header><text>The Attorney General, acting through the Director of the FBI, shall establish and implement a program to be known as the <quote>National Criminal History Chemical and Refining Background Check Program</quote> (referred to in this Act as the <quote>Program</quote>) to permit qualified entities to request national criminal history background checks for the purpose of obtaining identification authentication and criminal history background check information of individuals seeking access to a qualified entity.</text></subsection><subsection id="HEB5D3B7B93B04536B53231735EDE83A4"><enum>(b)</enum><header>Request system</header><text display-inline="yes-display-inline">The Program shall include a system through which a qualified entity may request a national criminal history background check directly through the FBI, which system shall be fingerprint-supported and maintain appropriate privacy protections.</text></subsection><subsection id="H4F864298BDC6418C819BFD4980E55489"><enum>(c)</enum><header>Role of qualified educational entities</header><text display-inline="yes-display-inline">The Program shall include a process through which a qualified educational entity may assist in—</text><paragraph id="HA40D6D1DAA454AF4BD6639BF92352E45" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">identification authentication of individuals seeking access to a qualified entity and may obtain access to the personally identifiable information of such individuals; and</text></paragraph><paragraph id="HEFD8FFE87BCF4ABC86D54B767FD8C644"><enum>(2)</enum><text display-inline="yes-display-inline">setting criminal history record information standards for access to qualified entities.</text></paragraph></subsection><subsection id="H59AA5C4646414676BA4E504E59C62A28"><enum>(d)</enum><header>Response time</header><text display-inline="yes-display-inline">To the extent practicable, the FBI shall respond to a request received under the national criminal history background check program under this section not later than two business days after receipt of such request.</text></subsection><subsection id="H923CAD6976B949D0937C8DA773459CFF"><enum>(e)</enum><header>Fees</header><text display-inline="yes-display-inline">The Attorney General may charge a fee for conducting a national criminal history background check under this section, except that the amount of such fee may not exceed the actual cost of the background check. For purposes of calculating the actual cost of the background check, the Attorney General shall include the cost of building, maintaining, and enhancing an appropriate Federal and State infrastructure for the national criminal history background check system, technology costs, staffing costs, and administrative costs based on the sum of both State-by-State and Federal costs, and shall review the amount of the fee no less frequently than every two years.</text></subsection></section><section id="HB23398CC927A44DCAFE99B0A3FD3D9D9"><enum>4.</enum><header>Rules of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to—</text><paragraph id="H699298BEA6FE43ABB032FD7A8F4950FC"><enum>(1)</enum><text display-inline="yes-display-inline">impose a requirement on a qualified entity, a consumer reporting agency, or a State, to participate in the Program; and</text></paragraph><paragraph id="H4B8820F0CB1249B18CE33E023385131D"><enum>(2)</enum><text display-inline="yes-display-inline">limit the authority under any other Federal or State law for a qualified entity, a consumer reporting agency, or an authorized agency to request or provide criminal history background checks that are independent from the Program.</text></paragraph></section><section id="H1B0241BD1AB94EE6A6FA35AE9A699376"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, the Attorney General shall submit to Congress a report on the Program, including any recommendations for improvements to the Program.</text></section><section id="H0ED5E94F9677422A8A707ED9E44C30CC"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text><paragraph id="HB7E9AAE9FE1E4277A5DB9250C426F52C"><enum>(1)</enum><header>Authorized agency</header><text>The term <term>authorized agency</term> means a division or office of a State designated by a State to collect, maintain, and disseminate criminal history record information under this Act.</text></paragraph><paragraph id="HA385B084E29D4FBDB4679B30337B6D7F"><enum>(2)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means an entity that—</text><subparagraph id="H0377064F3AB94B709193CED7350F9631" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">provides natural gas or petroleum chemical manufacturing or refining-related services, including connecting terminals and pipelines, whether or not regulated under the national critical infrastructure under the Chemical Facility Anti-Terrorism Standards Program under title XXI of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref> et seq.), or the Maritime Transportation Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/295">Public Law 107–295</external-xref>; 116 Stat. 2064); and</text></subparagraph><subparagraph id="HCD26027A0E7C4BF185C1FBC2B0C38C2B"><enum>(B)</enum><text display-inline="yes-display-inline">is approved by the FBI to request, directly or through a consumer reporting agency, to obtain a fingerprint-supported national criminal history background check for chemical or refining infrastructure access. </text></subparagraph></paragraph><paragraph id="H4A8FD0907519408A8968D63083E75A57"><enum>(3)</enum><header>Qualified educational entity</header><text>. The term <term>qualified educational entity</term> means school or industrial safety training facility that is—</text><subparagraph id="H473358D312FD481BA9DDC8D700E536D5"><enum>(A)</enum><text>described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986;</text></subparagraph><subparagraph id="HE064FFFED48A447698D66CCB026F4A4F"><enum>(B)</enum><text>American owned; and</text></subparagraph><subparagraph id="H328FFC3C86C042C3BE068EA8066F157F"><enum>(C)</enum><text>recognized by the Attorney General to provide assistance to qualified entities under section 3.</text></subparagraph></paragraph><paragraph id="H6DE649D3082F42D4872E23F40907735C"><enum>(4)</enum><header>Consumer reporting agency</header><text>The term <term>consumer reporting agency</term> has the meaning given that term under section 603(1) of the Fair Credit Reporting Act (15 U.S.C. 168la(J)).</text></paragraph><paragraph id="H52065E9656C14A28B62AF31653D64436"><enum>(5)</enum><header>Criminal history record information</header><text>The term <term>criminal history record information</term> means information collected by criminal justice agencies on individuals, consisting of identifiable descriptions and notations of arrests, detentions, indictments, infractions, or other informal criminal charges, and any disposition arising therefrom, including acquittal, sentencing, correctional supervision, and release. The term does not include identification information, such as fingerprints, if such information does not indicate the individual’s involvement with the criminal justice system.</text></paragraph></section></legis-body></bill>
